Palm Beach County Sheriff May Get $1 Million for First in the Nation "Violence Prevention Unit"
Florida governor can use line-item veto against it


The effort by states to outdo each other with civil liberties violating legislation in the wake of shootings like those in Newtown and Aurora last year continues in Florida, where the state is close to sending $1 million to Palm Beach County Sheriff Ric Bradshaw for a "violence prevention unit" that will respond to tips about (presumably) potentially dangerous people. Here's how Bradshaw describes it, via the Palm Beach Post:
"Every single incident, whether it's Newtown, that movie theater, or the guy who spouts off at work and then goes home and kills his wife and two kids — in every single case, there were people who said they knew ahead of time that there was a problem," Bradshaw said. "If the neighbor of the mom in Newtown had called somebody, this might have saved 25 kids' lives."
This is not actually a true statement. Murders, mass and otherwise, are also described as "the last person you'd expect to do it" (see: Ted Bundy) and not even in the specific cases Bradshaw mentioned was there a prominent account of someone knowing "ahead of time" something could happen. Anyone reading this can tick off a few names in their heads of people who "spout off at work." They are highly unlikely to ever, ever commit a (violent) crime. The U.S. violent crime rate, in fact, has been going down for the last five years and is at historical lows.
But it seems its constitutional rights and civil liberties be damned for the sheriff. Via the Palm BeachPost again:
"We want people to call us if the guy down the street says he hates the government, hates the mayor and he's gonna shoot him," Bradshaw said. "What does it hurt to have somebody knock on a door and ask, 'Hey, is everything OK?' "
Because everyone who "hates the government" is going to threaten to shoot the mayor in Bradshaw's world of simplistic examples. It's a brazen attitude that doesn't bode well for the program. Bradshaw says his department knows "how to sift through frivolous complaints" in regards to obvious worries about the prime opportunity this hotline provides for abuse by score-settling neighbors.
The Florida governor, Rick Scott, can still use the line-item veto to stop this state spending, and ought to. Bradshaw's response to the Seth Adams shooting ought to be enough to disqualify from any state support for yet more police powers. In that case, a deputy shot an unarmed man while conducting an "undercover investigation" not targeting Adams or his family's business. He was cleared in a report the family has said is full of holes. Bradshaw defended the shooting before any facts were even known, leaning on the fact that Adams was dead and so there was only one side of the story. There's even a forum about all the alleged corruption in the Palm Beach County Sheriff's office that the Florida governor's office would do well to check out to help him decide against sending any money to this civil liberties abomination of a proposed program.

Actually, he was cleared in three different investigations. And the physical evidence that came out COMPLETELY supported what the deputy said, to include Seth Adams' DNA found on the deputies throat where he said Adams grabbed/choked him, and Seth Adams DNA on his forearm which he said he used to break the hold.
And of course Adams toxicology shows he was about 2 1/2 times the limit iirc, which means the deputy was confronted with a violent, drunk assaultive guy who made a claim to be a property owner, the deputy tried to defuse the situation and when he issued orders to Adam not return to his vehicle (where he feared Adams was retreating for a gun) Adams refused said orders.
It's a tragic shooting, but the family can wank all they want. The EVIDENCE points to the shooting being justified.
Then, there's the issue of the phone calls etc (establishing that Adams knew he was dealing with a LEO, that he didn't call 911 for help, etc.)
The evidence supporting the shooting is strong.

The Seth Adams is the PERFECT example (conspiracyers and those looking to slam cops LOVE a vacuum) of the kind of case that from the beginning allowed you to easily insert all sorts of stuff into the narrative to make it look bad.
Once the adults took over , the evidence was gathered, etc. much of the vacuum was filled in, and nearly every little bit of evidence to fill in all those holes SUPPORTED the deputy's story and his reasonable belief that he was in fear for his life.
I totally empathize with Adams. It's a tragedy. But when you do what Adams did, he practically BEGGED to get shot. Alcohol is a messed up drug when it comes to affecting judgment, restraint, etc.
He had SO many opportunities to simply do the REASONABLE thing, but he didn't. He was assaultive, giving the officer every reason to believe that he was in danger from further violence, and when given a clear order not to go back and enter or reach into his car did so anyway. Just colossal "please shoot me" behavior

Seth Adams was almost certainly justifiably shot, which is a tragedy, but one completely of his own doing.
He had every right to call 911 (he had a cell phone on him) and complain about the "trespassing" cop. He did not have the right to shoot or assault him based on his being parked in a business parking lot after hours.

People on alcohol do dumb things. I just got finished watching the Reese Witherspoon video (props to her... she paid her $100 fine after pleading no contest) and she apologized to the LEO as she should. The video showed him to be polite and reasonable.
I have zero doubt that if we had a video of Seth Adams, it would show a similar story, just more violent. A drunk man drives up in an unmarked pickup truck (see: Apparent authority), attacks a police officer after the police officer identifies himself, disobeys an order not to return to his car and gets shot.

A REASONABLE person first of all wouldn't have been driving DUI. But beyond that, he would have identified himself as the property owner (deputy said he didn't).
He would have ASKED the deputy to leave. Deputy would have been within his rights to check online or phone resources to VERIFY if this man was in fact the property owner. Because there is no exigency.
Adams would be free to also call 911 and ask for another officer to respond or a supervisor (of a supervisor), video/audiotape the incident (that would have been awesome). He was not ok in grabbing the officer's neck and escalating. And he got justifiably shot.

But to answer your question, if a plain-clothes cop went into a house and then was told to leave by somebody in the house, then yes, the cop should leave. And when the guy in the house starts walking towards his bedroom, the cop should not unload his gun into him because he's "been trained that most people keep their guns in their bedrooms."

Totally different situation. The bar is a place of public accommodation and your presence there is only allowed because there is an understanding that the general public are allowed to just walk in (unlike other kinds of private property). So there's a lot of stuff that you're allowed to/supposed to assume, like that someone representing himself to be the manager/bouncer really is such. That's why you're allowed to assume that the guy behind the counter at a camera shop really is the owner or an authorized employee, and you're not committing theft when you pay him and he lets you take a camera.
This situation is totally different.
The cop was not justified in shooting Adams. Period. I don't care what his buddies concluded in their investigation. There's no way the officer feared for his life, it was not self defense, it was an execution for failing to respect his authoritah. There was no death penalty. It wasn't punitive, it was the officer protecting himself based on his reasonable perception of risk of death or serious bodily injury. Read the FDLE report. The deputy was violently assaulted by the intoxicated male who THEN refused repeated orders not to return to his car.
There have been several shootings of officers involving a similar fact pattern (what the deputy was referring to) and several ofc. shootings with a similar fact pattern. THe fact is this, whatever else is the case, after the deputy was violently attacked (DNA don't lie) and he gave the order to the man not to get back into his car, that's where the rubber hits the road.
Seth Adams at that point sealed his fate. He decided he didn't have to obey that lawful order, and especially after violently assaulting the deputy. He had a cell phone. He could call 911. He could have ASKED the deputy to leave (deputy said he did NOT).
What you had was a intoxicated hothead who was violent and made a serious of very poor choices and had only himself to blame for the tragic consequences of his poor choices.

If you refuse to believe the cop, then you don't have any evidence to base a belief on, so the logical conclusion is to admit you don't know whether he was in the right or not.
Far too often, the people around here just assume the cop was in the wrong in the absence of compelling evidence that he was right (and sometimes even in the presence thereof).

On average, cops do a fantastic job day in day out of de-escalating drunk violent people and resolving situations with no force whatsoever in most cases, and very low levels in many more. But some people just don't offer the cops a choice. Like Seth Adams.

The deputy's report in no way indicates that the deputy ever tried to leave. You SHOULD fear death and serious injury if you're trespassing and refuse to leave.

I actually witnessed something similar to this last year when I was in Manhattan. We were walking from Times Square back to the NJ ferry, and the girls wanted to stop at a McDonalds to use the restroom.
While we were in there, and I was waiting for the girls, there was some scene going on between one of the employees, who was maybe 30, and a customer, who was probably 60. Next think I knew young cocky guy said, let's take it outside. Moments later, I hear a 'crack' and looked out the window to see McDonalds hero hit the pavement. Not sure who was right or wrong, because I don't know what was going on, but the kid got hit ass kicked.

The funny thing is that the common people often posses those traits in greater abundance than the elites, the elites have just convinced themselves that this isn't true.
