California's Deadly Embrace of Big Government
Golden State voters open the gates to an endless flood of tax increases.
After Tuesday night's election results came in, I started searching for two things: a stiff drink and a good out-of-state real-estate agent.
The national election sends troubling signs about the direction the country is headed, but nothing much will change from the past four years, so we know what to expect even if it isn't particularly good. But California voters have sent their state into some new and potentially dark territory, the results of which will soon be felt.
I quoted journalist H.L. Mencken before the election, but now is a good time to repeat his quip about democracy being the theory that the people know what they want and deserve to get it … "good and hard." Californians are definitely going to feel the pain, not just in the passage of Proposition 30 and its direct hike in taxes.
The big news: It looks like voters have handed two-thirds majorities to Democrats in the state Senate and Assembly. The Senate is a sure thing and final counting will likely yield supermajority control of the Assembly, thanks in part to Fullerton voters' apparent ousting of Chris Norby.
Currently, the only thing standing between California residents and endless sea of increases in sales taxes, income taxes, gasoline taxes, and business taxes has been the constitutional requirement that tax increases gain a two-thirds vote.
Republicans in California don't stand for much, but they have mostly stood together in their opposition to tax increases. Likewise, Democrats—including the handful of "moderates"—have been unified in their promotion of higher taxes as the answer to California's problems. Now the Democrats will have their way early and often.
"It's time to start anew and to live within our means but at the same time invest in the cornerstone of our future and of our economy, and that's education," Senate President Pro Tem Darrell Steinberg (D-Sacramento) told CBS News. "I certainly don't mean to suggest to my colleagues that the first thing we do is go out and raise more taxes," Steinberg added.
Maybe not the first thing, but certainly the second and third things if Steinberg governs the way has typically governed. Gov. Jerry Brown and other Democrats assured the public that there will be no tax frenzy. As a headline put it, they "vow restraint," but don't believe them. Look at the bills that passed the Legislature even when tax increases were not assured. Unions pulled out the stops to pass taxes and get the Democrats the unlimited power they desire. They have their demands and will soon be receiving even higher pay and benefit levels.
The only good news is that the Democrats will now completely own the state's budget and fiscal situation. They will no longer be able to blame Republicans for holding up solutions to the state's budgetary problems.
In recent years, good-government reformers have complained about gridlock in the state Capitol. Voters approved a proposition in 2010 to eliminate the supermajority vote requirement for passing budgets. Since then Republicans have been irrelevant to the budgeting process given that their votes aren't needed.
Whatever their flaws and inconsistencies, Republicans at least provided some counterbalance to Democratic priorities. Now they will be completely irrelevant to everything, especially the most important power, taxing authority.
At his victory party, Gov. Jerry Brown was described as "jubilant" by the Sacramento Bee, which reported the following: "Brown declared victory after his tax initiative seized a narrow lead Tuesday night, calling Proposition 30 a 'unifying force' that countered the 'Kool-Aid of the market ideologues.'"
That provides meaningful insight into his thinking—it's a world in which raising taxes and building government is a great and unifying thing, and where allowing individuals to pursue their dreams and grow businesses is ideological Kool-Aid. The governor, by the way, is more moderate than most of his fellow party members.
Voters also approved Prop. 39. "Democrats received a second tax boost Tuesday when Proposition 39 passed, raising $1 billion annually for clean energy programs and the state budget by increasing taxes on multistate companies based elsewhere," reported the Bee.
Consider that a harbinger of things to come. Many of the state's businesses backed 39, figuring that it's better to stick it to out-of-state companies than have the state government come after them. But as in all advanced welfare states, it's only a matter of time before the taxers and regulators start coming for them.
While I don't agree with a friend of mine who argued that state GOP officials ought to be placed head first in a vat of acid in response to their continued incompetence, I do agree that it's time for rethinking party strategies.
Republicans need to better articulate an alternative vision that is more consistent and libertarian, and that can reach beyond conservative bastions. Then again, it may be too late. Carl DeMaio, a true GOP reformer who knows how to package free-market issues for a broad audience, was beaten by an old-school union hack in the race to become San Diego's mayor.
The failure of Proposition 32, which would have limited union ability to extract dues from members to pay for the kind of bare-knuckled politics on display Tuesday, was beaten badly. That means that unions will continue to control the field.
After former Republican Assemblyman Chuck DeVore moved from Irvine to Austin, I chewed him out for abandoning California in its time of need. Turn-about is fair play, so he called me following the election to tease me about the new reality in California. He loves California but recommends Texas.
A lot more tax-paying Californians are going to start exploring housing options in Dallas and Houston, now that California voters have decided to give the Democrats the PIN number to their bank accounts.
I'm still not suggesting moving, but it's wise to keep that agent on speed dial as you watch the coming legislative session in Sacramento.

Here is a good example of what I am talking about. Don't argue with liberals about spending and education. They are too far gone for that. Just talk about how it is totally unfair that poor people should pay taxes so that administrators can get six figure salaries.
The next person I hear talking about the poor and the need to tax the rich I am going to tell "You know what is gross, there are people in South Boston who can't pay their heating bills and can't feed their kids while Harvard has a $28 billion endowment and pays even their lowest professors six figure salaries. Why should anyone have that much money when so many people are poor?" Then I am going to watch their heads explode.

I have really decided to become and Alinskyite populist when dealing with liberals. Let me give you an example of what I am talking about. A very nice, generally harmless but woefully uninformed liberal friend of mine were going back and forth on Facebook about the state of the economy. In the middle of this, one of his really nasty brain dead friends posts about six posts in a row complete with links ranting about how self regulation doesn't work, banks, need more regulator, banks, Bush, and so forth. You guys I am sure know the type and the bullshit they spew.
In the past I would have posted a long rant of my own pointing to Coase Hayak and explaining exactly why regulations don't and generally can't work. You all know they arguments. But that would have done no good. Liberals do not speak our language. He wouldn't have understood any of it. That type of thinking is too counter intuitive and subtle for you typical liberal to understand and they have too much of their personal worth invested in their position to listen anyway.
So what I did was said the following; "What good does it do to pass regulations if no one will ever go to jail for violating them? It was Obama who never prosecuted a single person responsible for the 08 banking crisis. Pass all of the regulations you want. But Obama will never enforce them against anyone important. Obama won nine out of the ten richest counties in America. He knows who his supporters are." Stunned silence ensued.
I am not going to pretend that I changed his mind. But I did shut him the hell up and that is no small feat with these people. We all know that Obama is a crony capitalist who is totally on board with his rich cronies looting the country and is the exact opposite of everything liberals claim to be. But liberals don't know or won't admit that. So when talking to them don't bother to argue in our language. Argue in their language, use their memes and smugness back against them.

How much is moderate California weather worth in comparison to a Texas? Texas has great schools, low taxes, and a low cost of living. Yes, it can be hot and it can be humid.
Is a Mediterranean climate worth it compared to what you get in another state?
A couple of things. First is inertia. If your whole family is there and you grew up there, it is hard to leave. Also, a lot of people have jobs and vested retirements they can't leave. Second is that it is more than the weather. Outside of the really fucked up fascist places like Berkley and San Fransisco, California really does have a wonderful relaxed, anything goes culture. And that is a very good thing. They working their hardest to destroy it. But a lot of it still exists.
Yeah, I'd say that what you said are the main reasons I'm planning on staying in California after I graduate. The government sucks, but my family's here, I grew up here, I enjoy the lifestyle, the weather's great, and I love me some California girls. Plus, I think I'll be fortunate enough to get a pretty good job after graduation

We're tied in for a couple of reasons still-- ill family members that we watch out for being chief among them. Also, this is my husband's primary market. But it is getting harder and harder to stay and watch this place fall apart. At least we live in a rural pocket of generally conservative bliss.

John your exactly right... I can't get my wife to even consider leaving California.... Her parents are here; so are mine. I'm gonna do what that lady back east, wherever, did and (attempt) to track all of the taxes we pay. Maybe that'd convince her. We're on such a tight budget this showing her how much goes to waste might convince her.
I told my wife that I am moving out of CA once the teenage kids are out of the house...and that she can join me if she likes.

It is like that in my state as well (Maine). B+C taxes D, and now D is gone. Leaving A+B+C wondering why all the jobs are in New Hampshire. Then someone actually gets the bright idea to lower taxes, but someone mentions roadz, skoolz and teh childrenz. Leaving us in an infinite loop. Rinse and repeat.

Tahoe is paradise. But it is like living in Aspen. There is no way to make a living and all of the real estate is owned by the incredibly rich. Living in Tahoe is not an option for anyone without a trust fund.
John's right; Reno's not much to look at. The surrounding suburbs are pleasant, but Reno itself was one of the more shabby American cities I've ever seen. I don't know whether it's the legalized gambling, and the gazillion pawn shops, check cashing places, and cheap liquor stores that seem to go with it like ticks, but it just looked really shabby and dirty. I hope you like sage and rocks, because that's all that seems to grow there. No idea about the schools.
Judging by my CA relatives, many of whom have moved to the Reno area, Nevada will be emulating CA's policies shortly. They already have some of the most Draconian school zone speed limits known to mankind. I'm surprised they don't make you get out and push your car through them.
Tahoe is gorgeous. And expensive. Never did make it up to Virginia City, but I imagine the pines are pretty too.

Nevada has some strict driving rules everywhere because there are so many drunk drivers.
The casinos give everybody drinks for "free" (so long as they're playing), and locals all take advantage of that, too.
So the drinking and driving is just atrocious. It's just a huge percentage of the people on the road at any given time are drunk.

It's happened in Virginia and North Carolina with carpetbaggers from the NE hell pit and it is already happening to Colorado, Oregon, Nevada, and Arizona with the rats fleeing the sinking ship of California.

This is getting really scary. When I moved here from a low tax state, the gains in income and career advancement more than made up for the larger tax bite. But now that career and income progress is just making me a big fat target for those bloodsuckers. Time to think about retiring early, and heading East again.
I have been here 10 years, and am planning to leave for a lower tax state. I love the weather and lifestyle, but the taxes and regulations have gotten completely out of control. Maybe if enough of us "evil 1%'ers" leave, the idiots in Sacramento will learn...or, maybe not, as their corrupt cronies in DC will probably just bail them out!!!

If Unemployment hit 17% and 4 cities declared bankruptcy in CA tomorrow, every beach, OC glitzy mall and trendy coffee shops will be packed on the weekends. The dem friendly ethnic neighborhoods will continue to be very ethnic or very poor, because they ain't gonna move to, um, Idaho or somewhere there aren't 2 million people speaking your language. The UCs (adored by Asians) and the gated communities that voted for tax hikes, why, they ain't going nowhere.
What may wake up CA is not what happened in Greece, but the IMF crisis that hit South Korea in the 90's, where the entire economy suffered when a handful of conglomerates fell on their butts. In other words, unless something TRAGIC happens to the CA's tech, entertainment, and tourist industry and the government REALLY runs out of money, the show will continue.

Apple has managed to game tax law such that it pays little in CA and the USA. If that were to change, Apple might well 'go away' to somewhere with decent tax laws.

It seems to me lots of minorities in CA are reverse libertarians.
The Latino workers I used to work with drove trucks with "La Nueva Vida" (which is some sort of Spanish language Christian station, I think) bumper stickers and hung crucifixes and pictures of the Virgin Mary on the rear view mirror. Very friendly people, VERY pro life, strong social conservatives. Bam, they vote dems and for Obama.
At any Korean churches the members are 100% opposed to the gay marriage and are just about STUNNED by the notion that drugs should be legalized. They do a fair amount of grumbling about taxes too. But in the end, you know who they'll vote for.
They'll pay the price if CA goes down in flames, not these Obama loving Laguna Beach white crowd. Speaking of CA beaches, most of them stink. Especially Huntington Beach, why do people love that place.
Let's get the deep pockets money bag, the fat lady herself, Ms. Winfrey, to pay for all of us.
What about the local measures? In San Mateo county, prop A passed -- so sales taxes will increase by 0.5%. In Half Moon Bay, voters approved a measure to increase sales taxes by 0.25%.
The CA state constitution prohibits cities from enacting an income tax. Wonder if that will change now.
I'm sure Steyer, who practically funded prop 39 Meg Whitman style, will be happy to pay the SF income tax.

This is not a good idea. You see, once the country becomes destabilized with big government policies, two things happen:
(1) People desire more big government to save them. I think this is one explanation of why in a recent poll black people said they think the country is moving in the right direction. Unemployment is high, and you'd expect the opposite, but being in a bad situation makes you crave big government more. So if the republicans just give up, rather than the country realize it's misguided flirtation with big government, it will seek more big government. This will be hard to recover from.
(2) The worst will rise to the top. This is from from Hayek's book (chapter 10). The destabilized condition of the economy -- things such as more poverty, rationing, etc -- will lead to a dictator who will promise to set things right. This is what happened in Germany after world war I. While dictators may bring stability, they kill a lot, and make the country worse, and destroy liberty.

What is the alternative?
NY and NJ illegally fixed the price of gasoline after a storm. Naturally, that kept gasoline in storage in many places that weren't NY and NJ; who's going to pay to move gas if you can't recover the costs?
So now, NY and NJ are rationing gas, since all that gas stayed where it was rather than moving to where the price was higher.
Given that sort of stupidity, what should Boehner do? Try to talk sense to folks who think that was assistance from the government?
Yeah so price fixing (more government) leads to shortages, which leads to rationing (more government). Who knows; maybe they'll blame corporate big wigs for being greedy and throw some of them in jail (more government).

Here's a depressing but documented comparison of California taxes and economic climate with the rest of the states. The news is breaking bad, and getting worse (at least twice a month, I update crucial data on this fact sheet):
Prior to Prop 30 passing, CA already had the 2nd worst state income tax rate in the nation. Currently our 9.3% tax bracket starts at $48,029 for people filing as individuals. Now our "millionaires' tax" rate is 13.3% ? including capital gains. Increased taxes now start at $250K. CA now has by far the nation's highest state income tax rate. We are 21% higher than the 2nd highest state (Hawaii), 34% higher than the 3rd highest state (Oregon), and a heck of a lot higher than all the rest ? including 7 states with zero state income tax. CA has the highest state sales tax rate in the nation. 7.25% (does not include local sales taxes). 7.5% starting next year.

CA corporate income tax rate (8.84%) is the highest west of the Mississippi (our economic competitors) except for Alaska.

Don't forget the $800 minimum tax on corporations and LLC's. Even small ones, like a home business that makes 3k a year, needs to pay this tax. The conservative minded Schwarzenegger was able to waive the tax for the first year of operation of S corps (and maybe C corps). True enough, but it ignores the 'value' of property inflated by CA zoning regulations. Control for that, and you've likely got a 'top five finish' again!

Ask Tiger Woods about this. At "only" 10.3%, when he started making good money, he left his CA home and moved to hot, humid, muggy redneck Florida. So did the Williams sisters -- the tennis greats. Imagine pro athletes facing not 10.3%, but 13.3%. Not going to go well.

BOTTOM LINE: Consider California's net domestic migration (migration between states). From 2000 through 2009, California lost a NET 1.5 million people. Net departures slowed in 2008 only because people couldn't sell their homes. But more people still leave each year -- in 2011 we lost 66,000 net people to domestic out-migration. Again, note that this is NET loss.

These are not welfare kings and queens departing. They are the young, the educated, the productive, the ambitious, the wealthy (such as Tiger Woods) ? and retirees seeking to make their pensions provide more bang for the buck.
Too often these departing seniors are retired state and local government employees fleeing the state that provides them with their opulent pensions ? in order to avoid the high taxes that these same employees pushed so hard through their unions. And once they move out of California, our state can no longer tax their California-paid pensions.
All the high tech billionaires and Hollywood types love paying taxes. So until these people start to leave nothing will change.
Many of the Hollywood types profess to love paying taxes. They maintain a primary residence outside California to avoid them though.
They claim to want to "pay their fair share" (notably not without government putting a gun to their collective heads), but they have tax attorneys, financial advisers, and accountants to worm their way through the deductions and exemptions. These people are incapable of understanding that the people on the margins of brackets don't have a tax cheat staff and immune to the idea that progressive taxation actually destroys social mobility.
A friend of mine is a progressive millionaire who lives in CA, he gets money back every year. His gross tax burden usually ends up being a few thousand dollars and he gets a Hell of a lot of that back. I'd be shocked if contributed more than a couple hundred bucks to the state and federal coffers.
I think the taxes target the small business owner with employees, and middle-class income people. Millionaires end up being spokespersons for the Democrat agenda. It's important they stay happy. The middle is the true enemy of the rich and poor, at least in class warfare.
I suspect that there is considerable Hollywood hypocrisy in play here. Most movie stars and moguls today do their work in OTHER states. Few "work" in CA anymore.
By quietly (and privately) making one of their other homes in a lower tax state (and ALL states have lower income taxes!) their tax residence, these liberals can stop paying most if not all the CA income tax, even while living in CA up to six months a year.
With this new 30% tax increase, expect this trend to grow.
There is no way to research this, as their tax records are private.
Obviously this rejection of the GOP means that Californians are libertarians.
