Why is the government doing so little to end sexual assault in prisons?
In 1984 the photographer Tom Cahill smashed a plate-glass door in a fit of fury at the San Francisco Chronicle. He had just unsuccessfully attempted to get the paper's reporters to write about rape in America's jails and prisons. Cahill was a desperate man at the time, tormented by flashbacks and nightmares, his personal and professional life in ruins.
Cahill's story began in 1968, when he was arrested in Texas during a peaceful antiwar protest. An Air Force vet who opposed the Vietnam War, he did not prove popular among jail staff in the heavily military town of San Antonio. Before placing him in an overcrowded communal cell, he says, the guards spread word that he was a child molester. Cahill remembers with a shudder how one of the staff members shouted "fresh meat" before leaving. After 24 hours of beatings and gang rape, his life was shattered.
More than four decades later, sexual violence behind bars is still widespread in the United States. But thanks to Cahill and other courageous survivors, the ongoing crisis is no longer shrouded in silence.
The U.S. Department of Justice recently released its first-ever estimate of the number of inmates who are sexually abused in America each year. According to the department's data, which are based on nationwide surveys of prison and jail inmates as well as young people in juvenile detention centers, at least 216,600 inmates were victimized in 2008 alone. Contrary to popular belief, most of the perpetrators were not other prisoners but staff members—corrections officials whose job it is to keep inmates safe. On average, each victim was abused between three and five times over the course of the year. The vast majority were too fearful of reprisals to seek help or file a formal complaint.
Sexual violence is not an inevitable part of prison life. On the contrary, it is highly preventable. Corrections officials who are committed to running safe facilities train their staff thoroughly. They make sure that inmates who are especially vulnerable to abuse—such as small, mentally ill, and gay or transgender detainees—are not housed with likely perpetrators. And they hold those who commit sexual assaults accountable, even if they are colleagues.
But many corrections administrators are reluctant to make sexual abuse prevention a top priority, preferring to maintain the status quo rather than acknowledge the role their own employees play. Others are actually fighting reform efforts, claiming, in spite of the evidence, that sexual violence is rare.
This resistance is reflected in the slow implementation of the Prison Rape Elimination Act, which Congress unanimously passed in 2003. The law mandated binding national standards to help end sexual abuse in detention. But almost eight years later, the Justice Department has yet to promulgate final standards.
Attorney General Eric Holder has not shown leadership on this issue. In 2009 Holder essentially rejected standards recommended by a bipartisan commission that spent years studying the problem of prisoner rape, claiming that the recommendations—which included limits on cross-gender supervision and the loosening of deadlines for survivors to file formal grievances—would have been too expensive.
It's easy to feel numbed by the Justice Department's estimate that almost 600 prisoners are sexually victimized each day. But behind that number are real people like Jan Lastocy. While serving time for attempted embezzlement in a Michigan prison in 1998, Lastocy was raped. Not once, not twice, but several times a week for seven months. The rapist was an officer who supervised her at a prison warehouse. Lastocy was so afraid of him that she did not even dare to tell her husband of 30 years, John, what was going on. Later John said, "Jan did a stupid thing, and she went to prison for it. But no one should have to pay the price that she did."
Jan and John Lastocy's lives were devastated by prisoner rape. Holder should listen to and learn from them rather than bowing to corrections officials trying to maintain the status quo.

Regardless, sexual assault in prison is absolutely unconscionable in our justice system--and every effort should be made to stamp out sexual assault in our prisons.

Actually, you're right. Crappy groggy reading ability at that time. Missed the point you were making.
Up front, 2.8% of inmates surveyed reported being sexually assaulted by staff, not 100%. So whatever's going on, it's not just uniform inmate hostility to staff.
The self-report data included almost as many rapes by inmates as by staff. So at worst, if we assume all reports of sexual assault by staff were made up, we have 2.1% of prison inmates being sexually assaulted in a year.
Now, there's no way that every inmate was lying about being sexually assaulted by staff. We don't know the rate of lying, which might be small or large, but won't be 0% or 100%. How would we get a handle on this rate?
The obvious thing to do next is to anonymously survey staff, asking both whether they've done it and whether they've observed anyone else doing it. (I'm not sure how likely anyone is to admit in a survey to something that will lose them their job and land them in prison, though people apparently do answer those surveys sometimes.) It would also make sense to look for patterns--some prisons should have much higher rates than others of sexual assault by staff, because of permissive management or an accumulation of rapists on the staff.
We don't even know if 2.8% is high enough--some inmates may have been making it up, but others may have been afraid to say anything, for fear of word somehow getting back to the guy who's going to be raping them again next week.

I took part in the IT side of the PREA surveys FLDOC was doing 4-5 years ago. If anything, the statistic is worse than reported. After seeing people get regularly fired for inappropriate prison relations, (not just officers on the line) no percentage they come up with is beyond belief for me.

It's not at all unreasonable to question the results of a survey especially one conducted amoungst a population as unreliable as prison inmates. It's like surveys of elementary school children, they lack the impulse control to answer a survey seriously. I suppose you also believe the media when they claim that survey results have proven that 75% of 8th graders are sexually active.

I have a sneaky suspicion someones math is off. You can't divide the total number of victims, 216,600, by the number days, 365, arrive at 593.42 and conclude almost 600 inmates are sexually victimized each day.
Why would the assailants be more likely to choose one day than another?

When I did juvenile persecutions for Mohave County, I intentionally tried to avoid sending kids to Black Canyon. You see, there was a problem with the staff fucking the kids and I kind of felt bad about sending a kid to go get raped.

My reaction. There has to be a communications mistake. No way they are dropping .net support as the backbone of future development. They have to much invested in it to slag off something that has been central to their own success in the development community. Even so, it would be technically impossible to prevent apps from being developed in C and C++ that work in the Windows 8 environment. Maybe the PR department overstated? WTF?
(I base that on Apple's losing track record of attempting to limit development to their own tool set and not succeeding because a programmer using C has access to the same hardware driver calls that they do.)

I worked in Arizona juvenile detention for 2 years. The only adult abusers were the FEMALE staff who couldn't keep their stinking paws off the boys' privates.

The problem is the writer does not distinguishing between consensual sexual relations and the "nightstick-in-the-ass" variety. If an inmate has been locked up for 20 years and a female guard offers to spread her legs for them, I find it difficult to feel sorry for the inmate. And that is the problem I have with this article. It uses the same logic that has been used to create laws that see no difference between an 18 year old sleeping with his 17 year old girlfriend with a 45 year old molesting a 3 year old.

Prison rape is likely far more common than this article suggests. Prison rape is extra judicial punishment, but even more it is the sort of display of incredible power by which the state asserts itself against us all. Any interaction with a cop could potentially lead to gang rape if you don't play your cards right, and you know this. Therefore you are more apt to respect the cop's authoritah. Rape, whether of prisoners or sex workers is one of the many tools all governments (even those in nice social democratic countries) use to make sure we know who's boss.
I absolutely agree with this comment. By raping they break down the prisoner's confidence and makes them feel inferior and therefore submissive to authority.
It's worse than that. In many States, failure to pay child support will get you put into the pokey. Unfortunately...if you lose your job, you have to petition to Court for relief. You ex-wife's lawyer will file repeated requests for a continuance...so the child support you can't pay piles up while she delays your day in court. Meanwhile, any professional licenses or State-issued credentials are revoked while you're a "deadbeat dad," which does not exactly enhance your ability to get another job.
Heck...as far as that goes, the VAWA makes it he-said/she-said/he-goes-to-jail.
I've been mostly happily married for 15 years, but I'd never get married again, and I plan to urge my sons never to get married. To do otherwise is the same kind of child abuse as not warning your kids to avoid drugs/cigarettes. You're one vengeful ex-wife and one event of bad luck away from getting raped. Literally.

Personally, I've always said the best way to get through prison would be absolute solitary...no contact with other prisoners from the moment one gets there to the moment one is released. Keeps them from teaching each other how to commit crimes better, too.
The punishment for murder should be watching an episode of 'According to Jim', or a Keith Olbermann report. Beats the electric chair, since you won't have to pay anything for them to lunge a knife into their own throats after the experience.

Feminists understood early in the days of making ANY sexual assualt unacceptable that men had stories to tell too. We also understood we couldn't tell them for you. It was not easy watching our sons, brothers, sometimes fathers...travel through terribly difficult lives, not yet ready to tell their stories out loud.
Then in late '80's a book came out called Broken Boys, Broken Men.....by a man about men! It became a best seller in the therapeutic crowd instantly. I know I gave at least a dozen copies away to men I knew were hurting. But still they didn't speak out....not really.
I think the big breakout event was Tyler Perry's courageous self-disclosure. So proud of him!!
And now I think men will begin....as the survivors of the residential schools, as those who've been in prisons are starting to do.....to tell their story and then do something about it so it won't happen to their grandsons.

i am a jail doctor and have been for 20 years--i also find that many inmates certainly at least the 2 percent that the report is based on, lie, lie, lie and claim all kinds of things to get sympathy from family and friends and such. that's why in some sectors you have so many mommas who think their sons are being abused and are in jail because of racism and unfair law enforcement and all kinds of other things.
when a man spends enough time in jail the only people left to feel sorry for him are elitist journalists and advocates working a political agenda and their momma, who never gives up thinking their baby was wrongly incarcerated and is regularly being abused.

They probably think this counts as a deterrent or something, if you go to jail you will get raped, so don't commit crimes. In this situation, the government would essentially be using inmates to intimidate people from committing crimes. Philosophically, crimes shouldn't be committed out of morality, not out of fear. I know that it's idealistic, but should a person believe that they shouldn't murder because it's immoral or because they could get the death penalty? I think that the same applies here to a lesser extent.
People go to jail for all sorts of reasons. I spoke with a fellow who was involved in the civil rights protests back in the 60s; he was tossed into prison for "trespassing" or some other nonsense charge. While there, he heard boys loudly protesting being raped.
It is stupid to characterize all prisoners as liars. If you find yourself tempted to dehumanize people in this manner, you should take a long hard look in the mirror, and see if you can try becoming a man, if it's not too late.
I was gang raped repeatedly in the mens jail at age 19. Jails are understaffed and under funded. Inmates called trustees run alot of the jail. Cameras are only on a few checkpoints. When you have 1 guard who oversees 6 tiers, and the guard is a black with gang ties, he basically lets the blacks do as they wish. That would include staying away from a tier for along period of time, while the big black inmates take the new smaller white boy to the back of the tier, and while pinned down, rape his ass for hours on end. Thats what happened to me, and once there, it is cold calculated and there is no way out, and no one to save you. All the screams in the world get ignored.

Saw Nat Geo's special on solitary confinement, coupled with what we now know about ADHD, it is almost like we've been swindled into paying for a penal system that does the exact opposite of what we want it to do. The system takes non-violent people and makes them violent. It purposely goes after the weakest and most wretched among us, and bullies them into behaving in ways that end up costing them additional years, almost as if they were targets for extension before they walked in. We have got to change this system...camps instead of prisons or something, and less people being jailed for first offenses, the United States is way out of kilter (from my reading on wikipedia).
I keep thinking of how we exclude people based on things we were taught through the televison set, but the same corporations who put together our television programming are the ones guilty of so much crime that we are also expected to excuse them from. We need to put some corporations in jail, and get our heads examined for what we believe are laws strong enough to make people not want to do certain things: some people have a hard time controlling their impulses, prisons are proof. We don't expect young people whose brains are not fully formed to live up to adult standards, but we have no problem putting away an adult who hasn't learned how to use their brain, and then excluding them from any further education. it's insane to think what we are doing is working, we know it isn't, but we lack the political will to change it. We have to find some way to energize the community to force change from the bottom up...the politicians will never lead us on this, we have to make them react by forming effective demands. This obviously doesn't work coming from the prisoners, as we recently saw in Pelican Bay...corporations and government will only cover their asses, not fix problems, unless forced to.
Prisons are set up as a rape factory for several reasons. They are underfunded, understaffed, and not alot of people really know what goes on inside the prison walls. Black criminals who are locked up for lengthy times have a great desire for sex, and with the lack of females, they substitute whats available. Whites, and they target the wearer ones who to them possess feminine attributes. Pale white skin, lesser builds, blue eyes, blonde hair, etc. The poor white gats manipulated in several ways, First, is the initial sexual assault, where they are broken physically. Then after that, becomes the mental assault where by force or threats of force they are able to continue the physical assaults and control the white to do as they please. Ask me, it happened to me.
