You Are Now Free To Swear in Pennsylvania
Thanks to the ACLU, you can now say all seven of George Carlin's seven dirty words in Pennsylvania without fear of being fined by the state police:
Travelers and residents in Pennsylvania, feel free to break open that swear jar — you no longer need it to make bail. This week, the Pennsylvania State Police reached a settlement with the ACLU that retires them from policing the dictionary. This, after 770 people were cited in a one-year period, and faced a fine and potential jail time, for speaking words the state police deemed obscene.
The ACLU of Pennsylvania filed a lawsuit in May on behalf of Lona Scarpa of Luzerne County, who called a motorcyclist an "asshole" after he swerved too close to her and another pedestrian. When she reported the incident to the police, Ms. Scarpa found herself charged with disorderly conduct for swearing and faced a possible $300 fine and 90 days in jail.
The Pennsylvania Supreme Court, and many other courts, have made it very clear that profanity — including dirty words, foul language, and rude gestures — is protected speech. Nevertheless, an ACLU investigation revealed that the state police had, on average, issued more than two such citations per day.
"Using profanity toward someone, whether an officer or not, is just not one of those things that you can put someone in jail for," explains Mary Catherine Roper, senior staff attorney for the ACLU of Pennsylvania. "It may not be very smart, but you have a constitutional right to do that."

Unfortunately, PL, I can't see a way to "punish" government without further punishing citizen-taxpayers in the process.
For example, let's say that as a result, government was required to run billboard ads saying "We violated your First Amendment rights..." Somebody would have to design the ads, rent the billboards, etc. Ultimately, this would be paid for with tax dollars (or fines, forfeitures, etc).
Public firings are about the only meaningful act, but even then you can't be sure if you're getting the actual culprits.
Personal liability is a starting place, at least.

The 13th Amendment's prohibitions on slavery exempt people convicted of crimes. Convict government officials who blatantly violate the Constitution, then make them slaves to the people whose rights they violated for the duration of their sentence.

Well this is good fucking news.
Another appalling and embarrassing example of the police state in this country, when it takes high-powered lawyers to defend basic assumptions of a free society. While it is some kind of victory that cops can't randomly punish those who "get out of line" by swearing, they can still pull out the absurd charges of Disorderly Conduct, Disobeying a Police Officer, etc. As Obama said about the pig in Cambridge, MA, they can still pretty much "act stupidly" 24/7.
And what's worse: Pennsylvania Democrat Robert "Bob" Brady is trying to make it a crime to use "crosshairs" language about a government official. These people need to be punished with a lot MORE brazen speech, or with each act of domestic terrorism, more and more of our rights will be violated.
This is a small, small victory.

Remember when people used to say "the f-word" because it was so wrong to say fuck? Now they say "the n-word".
This is an interesting position for the ACLU. They support the right to use these words, but then wish you to be prosecuted for "hate speech" depending upon where and toward whom you use them.
It must be tough. Is cursing at another person protected speech, or is it hate? How does the ACLU tell the difference? If it is directed at a white male it is about freedom, against all others and it is hate?
