Prince George's County Sheriff's Department Delcares Itself Blame-Free in Cheye Calvo Raid
Last summer, officers intercepted a package of marijuana at a delivery service warehouse. Despite the fact that they already knew of a drug distribution network in which dealers were sending packages of marijuana to random addresses with the intent of having them picked up by accomplices working for the delivery companies, the Sheriff's Department raided Calvo's just seconds after his mother-in-law brought the package into the house with no investigation into who actually lived there.
Police and county officials have since admitted that Calvo and his family are innocent. But they stubbornly refuse to acknowledge any wrongdoing, such as not doing the least bit of investigation before sending the SWAT team to take down Calvo's door, not knocking and announcing before entering, or slaughtering Calvo's two Labrador retrievers.
In fact, Prince George's County officials have been stunningly callous about it all, at various points praising the officers for their "restraint," and commenting that everyone involved in the investigation and raid "deserves a pat on the back."
So the announcement yesterday that the internal review cleared the department isn't surprising. But Sheriff Michael Jackson's comments at the accompanying press conference are really something to behold. From the Washington Post:
The findings of the internal review "are consistent with what I've felt all along: My deputies did their job to the fullest extent of their abilities"…
In an interview, Jackson reiterated his explanation that a scream by Calvo's mother-in-law, Georgia Porter, who saw officers in SWAT gear running toward the house, justified the shooting.
Porter "corroborated that she did scream out 'SWAT.' She admitted to that, and [Calvo] admitted to hearing that upstairs in the house," Jackson said. "That threw out the procedure of knocking and announcing, because now [officers were] compromised."
One dog was shot four times by the front door. Calvo has said his younger dog was running away from officers when it was shot twice, including once in a hind leg. Jackson said deputies thought the dog was running toward another deputy in the home…
"I'm sorry for the loss of their family pets," Jackson said. "But this is the unfortunate result of the scourge of drugs in our community. Lost in this whole incident was the criminal element. . . . In the sense that we kept these drugs from reaching our streets, this operation was a success."
First of all, the police intercepted the package at the warehouse. At that point, they had already kept the marijuana inside from "reaching the streets." Everything that happened next was at the discretion of the officers who carried out the investigation and raid well after the marijuana had already been confiscated, which means they and they alone own the results of the raid.
Second, what happened to Calvo isn't the "unfortunate result of the scourge of drugs in our community," it's the result of a bumbling, overly aggressive, wholly incompetent police department. And it's the result of a drug warrior mentality that believes invading someone's home with guns and filling their pets with bullets is an appopriate response to a possible violation of state marijuana laws. The raiding cops didn't bother to notify the Berwyn Heights police chief before sending in the SWAT team, which would almost certainly have tipped them off to their mistake. They didn't bother to do any investigation at all of who lived at Calvo's residence. Their first resort was to use the most overwhelming force possible.
Third, the purpose of a knock-and-announce requirement is to notify a home's occupants that the police are outside to serve a warrant, and to give them the opportunity to come to the door and prevent the use of force and violence. Jackson's excuse that officers feared Calvo's mother-in-law's scream when she saw men in black running up the lawn tipped off the drug dealers inside doesn't fly. Because, again, the entire point of the knock-and-announce requirement is to "tip off" occupants that the police are outside.
Finally, Jackson's comment that "[m]y deputies did their job to the fullest extent of their abilities" may actually be the only accurate thing he said yesterday. Just not in the way he intended.

A clever state's attorney will try to make sure that Calvo has to pitch his case to an all-black jury (not too hard to achieve in P.G. County), then will portray Calvo as a whiny honky yuppie. (Of course, if Calvo's lawyers are smart, they'll make sure to remind the jury that this is the kind of treatment that P.G.'s finest can visit on them any time.)

Oh it's already happened: a ICE team kicked down the door of an ICE officer in New York a few months back. Once they figured out they were raiding the home of a fellow parasite, they left. Procedures weren't changed, and nobody kicked up much of a fuss, aside from the victim's threats to sue his bosses.

I think part of the problem is, that law enforcement equates marijuana dealers with street gangs, drug cartels and organized crime (right or wrong). In their minds, there's no such thing as your friendly neighborhood weed man. Now, having said that, it seems to me that that would give them all the more reason to do the proper background work, before committing to a raid of that magnitude. But what fun is that?
Another part of the problem is, that these highly trained and equipped SWAT teams need to justify their existence. If there isn't much "work" for them, they'll go out and find it. Just so that they can say say "we had x number of raids, which netted y amount of [whatever], and required z amount of dollars. Therefore, you shouldn't cut our funding" (our taxes).
Highly trained and SWAT is like military intelligence and the Army. Marginally trained maybe, their requirements to qualify on their weapons are pretty lax. Some departments have stricter physical PT qualification. The odd thing is I don't know of a single SWAT that has to undergo more training in the law and civil rights. It would make sense that more power and authority would be accompanied with a better understanding of the law, especially since most officers can just regurgitate statute and nothing more, their education is centered around not violating such and such to ensure a better chance of conviction.
There shouldn't be SWAT teams at the local level, there shouldn't be a fucking Drug War. There shouldn't be Byrne grants and federal programs arming civilian police. The federal government shouldn't be arming anyone except the military. We've learned that lesson internationally more than once. I guess the guys running the show are just too stupid to draw the connection to what might happen locally.
The problem is at the root of, and in the language of The War On Drugs. All's fair in love & war, everyone knows that. Also, in wartime, there is reduced cooperation between Marines and the Army, and between Police and Sheriffs' Departments.
Finally, we see how competence and care are the first casualties in wartime. Indeed, as the Sheriff himself says, his deputies did their job to the fullest extent of their abilities.
That is, this really was the very best that they could do. Compare and contrast to bungler stories we hear from Iraq, Afghanistan, &c. Young men chugging Red Bull with a DVR subscription to COPS and a strong potential for anabolic steroid abuse should simply be held to a different standard than the citizens they serve. The sheriff believes it should be a lower standard.
I believe the standard could be higher, but as has been pondered throughout the ages--who will enforce this standard--and to what standard shall these enforcers be held?
The wording is the same as any prohibitory legislation. The "War on" rhetoric and the the "czar" bullshit is all added by politicians. There should be no fucking war on anything prohibited to civilians, never mind what the hell is government and government agencies doing prohibiting things. You do not wage war on your populous, that is exactly what was feared.
The problem isn't just calling it a war, that is just a symptom of legislating prohibition and trying to stop a demand by attacking the supply. There doesn't need to be a standard for local SWAT teams, there needs to be no federally funded or otherwise local SWAT teams.

I always laughed at the justification of destroying evidence for no knock raids. If the amount of evidence can be flushed or destroyed quickly, why are you raiding to begin with? If I understand this case correctly, weed was being shipped, via FedEx, to bogus addresses, and intercepted by drivers? Did they get the driver? How ironic that one of the addresses was the mayor's. Coincidence? Nobody would check a package addressed to the mayor, right? I know of someone that had a similar scheme. But he had it sent directly to his house. Somehow, the local police picked up on this, intercepted the driver, and placed their own undercover officer as the driver. The weed was in a new TV box. The officer delivered the package, he, and his buddies, promptly arrested the man. But when the case got to court, the attorney argued that the man had no idea what was in the box; he thought it was a TV. You see, the police didn't wait for him to actually open the box. And he got off.

I moved to Gwinnett County, GA (Atlanta metro area) less than a year ago, and already, the county cops have:
1) Raided the wrong house (Lawrenceville) in broad daylight after an (alleged) three month drug investigation; GPD will not divulge Officer Clueless O'Dumbass' name.
2) Another GPD goon was skulking around the wrong address looking for a "material witness" in a trial and shot a Dalmatian eating dinner in his own garage. Again, GPD will not divulge Officer Sneaky McDogkiller's name.
3) In February, a GPD officer tased a Waffle House employee for no apparent reason. ("I ordered patties, not links, scumbag!" *BZZZT!!*)
Officer Sparky resigned just this week and is charged with battery and with violating his oath as an officer. Two GPD sergeants who witnessed the whole thing and did nothing also resigned this week and will not be charged.

If you look at the picture of the SWAT team, on the far right, you'll see an old man, in plain clothes. That's his father. They called him first. He lives in the same town. He said he would go over to the house and get him, but the local cops wouldn't let him. Instead they called SWAT. The funny thing is, the dude grew up in that town, and went to school with half of the damned cops on the force. But SWAT never did enter the house. They busted down the front door and threw in a communication device. He was passed out on the couch. After that, he just walked out, as you can see. (Man, he really let himself go. He looks like Gollum from Lord of the Rings). My point is, the local cops knew he wasn't a threat, and the County SWAT team and bomb squad must have used this "opportunity" as a training mission, or a "justification" to even have a county SWAT team. Charges are still pending for aggravated assault. From what he said, the guy (they never published his name) stole something from his house and when Kevin confronted him, he took a swing at him. So, Kevin, showed him the door, and his knuckles.
I'm thinking we can surplus out some F16s, A10s, and an Eagle or two and just start using air strikes for those dangerous raids. A 2K JDAM will surely make sure no nonbad guys get hurt.
Might even consider an Apache squadron or two. The flir and M230 30mm explosive rounds should neutralize any bad guys easily.
It has reached the point that the police are so violent and so dishonest that I would turn my back on a cop is distress. If I saw a cop being shot I'd forget everything I saw when it came to cooperating. I would not give a police officer the time of day and I would urge kids and adults to stay as far away from them as possible. Do not go to cops if you are in danger. Seek help elsewhere but cops are a bigger threat to you, your family and your pets. It used to bother me when a cop got killed, but watching how American cops are acting these days I can't say I'm bothered when one of them meets justice.

Not to go off-topic, but you're wrong; Anbar Province was a mix of Marines and Army, and we worked together very well.

One of the problems is the litany of reasons people and property can be searched without reason. Arizona v. Gant didn't even put a dent in the exceptions to a warrant list and didn't address the good faith excuse, it just an excuse, abuse of courts and officers. You need a warrant that is properly formed otherwise your actions are illegal. If I fill out my IRS forms wrong I can charged, if the warrants are filled out wrong they should be charged if the warrant is executed.
