The First Amendment Center has posted a Supreme Court wrap-up for this term, concluding that the hallowed 1st has taken a "back seat in the court's jurisprudence." The wrap-up rightly pegs McConnell v. FEC as the term's major free speech case, and cites an attorney in that fight on the decision:
It almost reads like a tax case rather than a First Amendment case. In style, tone and nature, it reads like an opinion about regulation by government of some sort of improper activity.
Can we at least start having tax cases that read like First Amendment cases to compensate?
