"A street vendor isn't offering a sit-down meal out of the weather like Wendy's." True enough, Tim. Maybe a better example would be flower vendors vs. florists, or tables with radios vs. electronics stores.

Lord knows I'm not exactly comfortable defending big corporations vs. independent vendors, but the guys in the stores (or their landlords) are paying taxes to maintain the sidewalks that their competition is setting up on.

I'm somewhat sympathetic to the vendors, and some of what goes on is pretty vile - "The police always confiscate the merchandise and throw it out, and they take the vendors' money." Any bets on whether that money goes straight into cops' pockets? If the cops found Bouley in violation of some law, you think they'd trash the kitchen?

But the self-righteousness of the vendors gets under my skin, too. "The authorities don't understand our culture, our way of life." Excuse me? You came to our country; maybe you should have found out something about it before you tried your hand at breaking the law. (It reminds me of the old joke about the British colonial authorities hanging a native who'd committed some act only the British found reprehensible: "You don't understand! It is part of our ancient and traditional way!" "Yes, and our ancient and traditional way is to hang people who do it.")
Ah well...there are no angels in our worldly disputes, I suppose. As a libertarian, I'm all in favor of the freedom to move and work where you please, but I don't think that just ignoring current law by ignoring people's immigration status is really the way to go.

As far as bringing people into the mainstream, I'm in the middle of "The Mystery of Capital" by Hernando de Soto, which has as one of its main thrusts the need to integrate the marginalized into a larger system of laws and rights, and I'd recommend it to anyone.

I can understand why something has to be done. The Wendy's, for example, has to pay property taxes, meet health codes, etc. Forcing them to comply with the law, while allowing another class of businesses to exist outside of it, is neither moral nor smart.

But in this case, the cure is worse than the disease. There needs to be a way to bring these micro-businesses into the mainstream economy. Just as there needs to be a way to decriminalize the immigration of Mexican guest labor. Neither cracking down nor anarchic openning of the flood gates is wise or politically viable. We need a third way.

There is a way to bring these businesses into the "mainstream." Make the price of the permits negligible. That way money can be spent on equipment instead.

Some locations of some pizza chains have take-out only service, and have nothing more than a bench where you wait for your pizza. Despite that, they still pay property taxes.

But, that's immaterial compared to the human issues involved here. Whether these people are "legal" or not, they're human beings. Simply by arriving in the U.S., they're entitled to everything that a "legal" citizen is. Why, many of them even have had children here, and, by that fact alone, everyone in their entire extended family should be immediately declared a citizen. This country is made up of immigrants just like them. Sure, those other immigrants came here legally through Ellis Island and other portals, and the governments of Italy and Poland weren't constantly trying to meddle in our internal affairs, but, let's ignore that issue entirely.
