What Do Justices Sonia Sotomayor and Stephen Field Have In Common?
Both of their bodyguards shot someone.
Last week, a Deputy U.S. Marshall, assigned to protect Justice Sotomayor, shot a carjacker:
A member of Supreme Court Justice Sonia Sotomayor's security detail shot an armed man during an attempted carjacking in the early morning hours, according to court documents.
It happened as two deputy U.S. Marshals were on duty in a government car in Washington, D.C., about 1 a.m. on July 5. They were confronted by a man who got out of a silver minivan and pointed a gun at one of them through the driver's side window, according to a criminal complaint. The car was unmarked but the pair were dressed in U.S. Marshals shirts.
The deputy pulled out his department-issued gun and shot the man about four times, hitting him in the mouth. He then gave the man first aid while the minivan drove away, charges state. The suspect was hospitalized and placed under arrest on suspicion of attempted carjacking and resisting officers.
In 1889, the Attorney General appointed David Neagle, a Deputy U.S. Marshall, to serve as Justice Stephen Field's bodyguard. Neagle fatally shot a man while the Justice was riding circuit in California. No actual statute authorized the Attorney General to appoint the bodyguard. But in In Re Neagle, the Supreme Court held that the Attorney General could rely on the President's obligation to take care that the laws are faithfully executed.
This might be one of the few things Sotomayor and Field have in common. I suspect that Sotomayor would not agree with Field's concurrence in Bradwell v. Illinois.

Oh yes, the quaint charm of living in the District of Colored Peoples. Had the misfortune of working in DC pre-Heller, in NW, supposedly the nice part of DC (sort of like the nice part of Gaza City) back when guns were supposedly outlawed. It's one place I made a point to always be armed (A-Always, B-Be, A-Armed, Always be Armed or you don't win the set of Steak Knives)

In the first case, it arose from some personal feud. In the second, it was unrelated directly to the justice attempted carjacking.
Another difference is someone was killed the first time.
...and another difference is that they took place in different parts of the country.
(I think that if we're gonna play, "Spot the differences between Photo A and Photo B" in this case; we're gonna have a million valid responses.)
I don't think the fact it took place in a different part of the country is much of a relevant difference. OTOH, it being a result of a personal feud against the justice & the person dying, appears more relevant.

The article I read about the incident was unusually equivocal, the man allegedly shot an alleged carjacker.
That seems to be the case with every federal LEO involved shooting.
Kentrell Flowers, 18, of Southeast Washington was a passenger in a silver Toyota minivan that pulled alongside a parked unmarked government vehicle and stopped, according to court documents. A marshal was seated inside the vehicle as Flowers left the van’s rear right passenger door and approached and pointed a handgun through the window in an apparent attempted carjacking, charging documents say.

Didn't Justice Sotomayor explicitly reject the proposition that people have a fundamental right to keep and bear arms for private self defense services, in the MacDonald decision?
I wonder how she feels about that today? Because if she still maintains that argument, the hypocrisy is deafening.
1) This was not "private"; this was law enforcement.
2) Even if it had been private, there's no contradiction between saying that something isn't a fundamental right and doing that thing.
Commeter_XY’s point, I take it, is that Justice Sotomayor thinks that private citizens parked the next block over shouldn’t be able to be armed the same way as her government-provided guards were. And yes, I suppose it’s theoretically possible that she thinks the private citizens should have that option but that the constitution allows the DC government to prevent it even though it’s a bad idea, but… come on.
(Presumably Justice Sotomayor’s response would be that, if her preferred gun policies were in place, private citizens wouldn’t need guns because the attackers wouldn’t have had them either.)

I am not aware of her stating that privately.
In opinions, she joined statements saying firearm policies should generally be left to democratically elected legislatures.
Grant Sotomayor does want to treat private citizens differently. Why is that hypocritical? A private citizen didn't stop the carjacking. And, even if the person did, she might still say it is overall the best policy even if at times it might lead to bad results.
She supports every US citizen having a Deputy US Marshall assigned to them going forward.
The basic alternative argument is that the 2A protects the RKBA to further an official militia, not an independent personal right for self-defense.
How is that violated here? A government security officer was armed. As a matter of policy. Where in the dissent in McDonald v. Chicago (which she joined) did it say that was unconstitutional?

What you don't seem to get is that the Constitution, via the Bill of Rights, reserves these rights to the people; it's not up to the government to allow us to exercise them.
My comment is that the argument that Sotomayor signed on to does not make her hypocritical in this situation.

Of course a private RKBA furthers the stated goal of an official, well-regulated militia.
Just envision an emergency where the government calls up the militia and the commander has to show his men what a gun is, and how to hit the broad side of a barn with it.
If there was a private right to keep and bear arms, the men might have more experience in handling firearms and aiming them in the proper direction.
(and if the militia system is outdated, then by all means pass a constitutional amendment saying so)

The capital is only Washington DC for historical reasons-- at the time it was a central location, but not any more. Query whether it makes sense to relocate to somewhere that's central now and doesn't have the local predator population. This is becoming a national security issue, it's only a matter of time before one of these thugs kills an ambassador, judge, or congresscritter.
Send them to New York City, one of the safest large cities anywhere in the country.

? Why would I use a slur or bring race into this? To my knowledge, the demographics of the attackers on Biden's granddaughter on Sotomayor have not been publicly revealed; if they have been, then I assure you I don't know that information. This is a race neutral concern for having our nation's capital in a city with a high concentration of criminal predators. To the extent you're troubled by the crime or the demographics of who the criminals happen to be, take it up with the criminals; they could do anything with their lives and are choosing crime. If this makes you think of any particular race, that's on you, not me.

Somewhere central like Kansas City or St Louis? Those cities both have higher crime rates than DC. In fact, the most dangerous cities in the US are mostly in the middle of the country.

Realistically, crime doesn't actually vary on a city basis, it varies on a neighborhood basis. Averaging it over a city conceals that.
So, most of DC is pretty safe, small parts of it are insanely dangerous. Just like Kansas City or St. Louis, or Detroit, or Chicago.

While not 100% on point (there are more obscure cases directly on point), In re Neagle is the case I use to point out how Qualified Immunity is wrong as an Originalist matter. The law used to be that anything without lawful authority is void. In this case, Neagle was acting under the orders of the President, but it did not matter. He could be prosecuted under state law unless the President had the Constitutional authority to authorize him to be a bodyguard for a Supreme Court Justice.
