Today in Supreme Court History: February 19, 1942
2/19/1942: President Roosevelt issues Executive Order 9066. The Supreme Court would consider the constitutionality of this Executive Order in Korematsu v. U.S. (1944).

Silly comment. If it were obvious, your comment would be redundant. Thus you know it is not obvious, yet refuse to back it up. Thus you are just being silly.
Probably, it was during a major war.
So probably would have the Jay Court and the Warren Court and the Marsha Court etc. Its dangerous to a court's authority to try to overturn a national security matter during a big war. Too much chance of the executive ignoring the decision. Mr. Merryman was not released after all, no matter what Taney ruled.
