Congratulations to Our Own Sam Bray, Cited Repeatedly in Justice Gorsuch's Nationwide Injunction Concurrence
Today's opinion concurring in the issuance of the stay, also joined by Justice Thomas, comes in Dep't of Homeland Security v. N.Y.; Sam's article is Multiple Chancellors: Reforming the National Injunction, 131 Harv. L. Rev. 417 (2017). I'll let Sam or others blog on the substance, but I just wanted to congratulate Sam on the citations.

Despite the ruling in this case, and the two vote, we'll get the next national injunction probably next week.
Ginsburg, Breyer Kagan, Sotomayer all in dissent - Odd since Ginsburg is such a stickler for standing.
Only when ends justify the means....
The left loves national injunctions because all they have to do is find one district judge in a liberal circuit and *poof* just stopped anything it wants.
Of course, if the right were to use such a tactic, say in arguing against gun control as violating the Second Amendment, the libs would cry foul.
Quit whining, clingers. If you want to start being competitive in the culture war, ditch the bigotry and backwardness. Otherwise, you get what you deserve.
I think it is time for you to be quiet Kuckland...
Ask the Volokh Conspiracy’s Board of Censors to ban me for offenses against clingerdom.
How about for just being a stupid rube....
We've been trying to ditch the bigotry and backwardness but you keep coming back.
So the ends justify the means w.r.t. abuses of power?
Just trying to clarify.
Look forward to it.
Did I also see a shout-out to Prof. Tolkien in that one injunction "to rule them all" phrasing?
Indeed, though I neglected to draw the academic connection -- nice.
