Leading libertarian legal scholar Randy Barnett talks about abortion, gun rights, and worrying trends at the highest court in the land.

As the most momentous—and controversial—Supreme Court term in recent memory comes to a close, are things looking better or worse for libertarians?
Georgetown Law's Randy Barnett, arguably the most important and influential libertarian legal scholar walking on the planet today, applauds some of this term's rulings. But he's also worried that the new 6–3 conservative majority may be too quick to sign off on laws restricting the explicit and implicit rights of individuals guaranteed by the Constitution.
In an episode of The Reason Interview With Nick Gillespie, Barnett and I talked about the Dobbs decision that struck down a women's right to an abortion, the Bruen decision that struck down a New York state law limiting the ability of gun owners to carry weapons, and other major rulings. We talk about the general direction of the Supreme Court and whether it's headed down a more—or less—libertarian path.
And we discuss the treatment of Ilya Shapiro, the former Cato staffer who was going to join Barnett at Georgetown until a controversy erupted over one of Shapiro's tweets, which led to him ultimately taking a job at the Manhattan Institute. The university's refusal to strongly back Shapiro's speech rights, says Barnett, was shameful but indicative of where law schools are these days.

Pointing out that only pregnant women (exact word "potential life") do not get a well established "right to privacy" from the Constitution is EXACTLY striking down an Individual Right of certain 'icky' people.

If bodily autonomy is not a recognized right when it comes to vaccines, or when it comes to wanting to inject yourself with ivermectin or hydroxychloroquine, then how can it be a right exclusive to abortion? But should some of those people travel to state B to get an abortion, state B ought to be under no obligation to help state A enforce its laws either inside or outside the state. As we have seen with abortion, slavery, drugs, and guns, when the feds are involved, every national election ends up being a referendum on whatever issue is deemed so important that the federal government must impose one way of doing things on everyone. The end of Roe v. Wade may end up emphasizing the political and cultural divisions in America by forcing many Americans to recognize that the United States is not one place. It is many places. This is not a problem, however, if we relearn that rather than employ federal coercion to "solve" the world's problems, it's perhaps better to tolerate others doing things differently in other parts of the world. On the other hand, if Americans can't shake the idea that the regime must force one way of life on everyone, we can expect national political divides to grow ever more bitter.
Constitutional rights apply to all Americans and people don't generally live in states because of the government, or that's a pretty thin read to grasp onto. They live where they live because of family and work.

The court is going back to the basics that always existed before the liberal and woke liberals tried to change America with their "living document" theory. It was Joe Biden that said he would radically transform America, but note he did not say for the good.
Reason lies:
Abortion rights struck down - No it was found to be a states right. Yes some states will ban abortion but others like NY and California will enshrine abortion into their states laws.
Gun rights expanded - No the were wrongly infringed, you cannot expand a right that cannot be infringed in the first place.
Prayer on the 50-yard line of public school football fields approved. - Prayer in public has never been banned. Reason is misinterpreting the Constitution that says there will be no state religion. The courts have said you cannot force people to pray, like in a class room. But people have always been allowed to pray voluntarily, even in public. If others want to join you that is their right too.

A conservative majority would simply have attributed personhood to fetuses and banned abortion. The majority we have is an originalist and textualist majority. And that's a good thing.
Barnett is right to worry that SCOTUS isn't going to hold up "the implicit rights of individuals [he believes are] guaranteed by the Constitution". That's because his views of what the Constitution guarantees are fringe views and make little sense.
More importantly, he, like many other "libertarians", suffers from the delusion that you can impose liberty from above. If SCOTUS could do what he wants it to do, it would instantly become a tool for the worst authoritarians in the country.
Originalists who believe in states rights are the best shot at liberty in this country; if Barnett's views prevail, we can kiss individual liberty goodbye in the US.
This leaves me very disappointed with Barnet. I'd have been a lot happier if he'd admitted that Thomas' P&I reasoning is on VERY strong grounds in terms of originalist reasoning.
It's probably not changing America much at all, since there are large swaths of people who aren't much interested in following the rules.
To the extent that the Constitution = the original rules, and to the extent that the current Court is saying, "folks, we have to follow the rules," it's a wonderful development from the Court that said "Rules? We don't need no stinkin' rules."

It’s likely that constitutional scholars (both liberal and conservative) would unanimously agree that the “practices of the 18th Century Redcoats” are unAmerican and unconstitutional. Maybe federal officials should not be embracing these practices contrary to America’s constitutional rule of law?
The American system - by design and by Constitution - also supports “Freedom of Religion and Freedom from Religion” and does NOT support “theocracy” - where government imposes it’s religious interpretation onto it’s citizens.
So far the entire 21st Century seems to have forgotten these core American values - from the unconstitutional 9/11 Preemption Doctrine to Cointelpro style blacklisting to public school officials (government entity) imposing their religious interpretation onto our students. The U.S. Supreme Court (Judicial Branch) has a top duty to prevent this from happening.
