Amy Coney Barrett Will Be Better for Freedom Than Ruth Bader Ginsburg
When it comes to criminal justice and abortion, Barrett and Ginsburg may have far more in common than conservatives and progressives seem to realize.
HD DownloadWhen Donald Trump nominated Amy Coney Barrett to replace Ruth Bader Ginsburg on the Supreme Court, Democrats screamed bloody murder about the legitimacy of appointing a justice this close to an election while calling attention to Barrett's Catholicism and anti-abortion animus.
But according to Reason Senior Editor Jacob Sullum, when it comes to criminal justice and abortion, the two may have far more in common than conservatives and progressives seem to realize.
More important, he says, "Barrett will be better than Ginsburg on issues that libertarians care about and will be nearly as good or as good on other issues that progressive tend to care about."

Trump's judicial picks have been a whole lot better than anyone expected, and whole lot better than any Dem could ever come up with. In my mind, it outweighs his economic ignorance, because both sides have that in spades. and economic ignorance can be worked around pretty quickly, but getting the judges right or wrong will last for a couple of generations.
Tax cuts are ignorant. Libertarians against tax cuts!
Regulation decreases are ignorant. Libertarians for regulations!
Tax cuts combined with spending increases is pretty dumb. Or evil. Saddling future generations with untenable amounts of debt could be either dumb or evil.
He did okay on regulations, but he's still fighting and losing the War on Drugs, like every other president in the last 40 years. Tariffs are always a bad idea and he loves them. He also still seems to think that you can have an effective health insurance market with guaranteed issue. On the whole, I'd say he's above average compared to other presidents, but that's not saying much.
Don't buy into the nonsensical lefty dream that by raising taxes through the roof somehow congress will then start balancing the budget. What a joke.
They will never, EVER stop borrowing more than they spend, no matter how much revenue they make. So your options are:
1. Pay exorbitant tax AND the govt is deep in debt.
2. Pay lower tax AND the govt is deep in debt.
I think that tariffs will become the substitute for actual wars. Although as other countries jump on China it could spark China to become more belligerent.
What do you do with a country like China which is protectionist to a high degree but wants you to open their products with open arms.
I'm come around to the idea that money is a fiction.
Tax cuts put downward pressure on spending.
The resulting inflation (or other financial shenanigans) are the only way to transfer the costs of welfare to the middle class. They won't pay overt taxes.
Government spending is what counts. They could borrow 100% and reduce all taxes to zero -- would that make you happy?
Your puny grammar joke is puny. Matches your economic knowledge.
Sure, why not?
Then your children and grandchildren can pay that bill instead of me.
I mean, what's the point of having a government if it won't do things for me for free.
Nah, no one has to pay government debt. You just print more moeny. It's been tried a number of places. They have really cool collectible currency.
getting the judges right or wrong will last for a couple of generations
Or until Biden and the Democrats pack the courts
The Democrats like to rattle their sabers about packing the court, but they don't realize that an attack like that will likely result in the second Constitutional Convention, where every state has the same representation. No population advantage for NY and CA. The convention. I don't think they'd like the new rules.

Op-Ed: Why Judge Barrett's legal philosophy is deeply antidemocratic
I link to the above to show you how bat-shit crazy the left can get!
Summary = any "textualism" (holding Congress's writings about laws passed by Congress, to be the law) is utterly crazy! The laws should be saying whatever the "politically correct" people say that the laws are saying! I didn't read the editorial super-close, but I bet the same is "true" of the words in the USA Constitution!
"Barrett, who has been on the federal bench for less than three years, is a conservative star because of her writings supporting the theory advocated by the late Justice Antonin Scalia known as “textualism.” This judicial philosophy is fundamentally at war with democracy. It would allow the court to rip apart laws that voters need and want."
Wow, that's pretty bad.
Deconstructionism.
At the university, it was kind of fun, and sometimes interesting, to play around with. It has no place in law. Words do, in fact, have meaning.
It has no place out of the classroom, and serves no purpose other than a way to while away time. That said, it is the basis for much of the left's current tenets, in particular their pathetic habit of telling people the true meaning of their statements and finding -isms/phobias under every rock.
"It has no place out of the classroom, and serves no purpose other than a way to while away time."
True. Although, I did find it an amusing intellectual exercise. Sort of like composing chess problems.
"Words do, in fact, have meaning."
How dare you say that!
🙂
🙂
Emojis do, in fact, have meaning.
The author, Victoria Nourse, was a nominee for the 7th Circuit, a professor at Georgetown Law, and VP Biden's personal counsel for the 2014-2015 period. Heavily worked on the Violence Against Women Act, when she was a counsel for the Senate Judiciary Committee. https://en.m.wikipedia.org/wiki/Victoria_F._Nourse
Just so you know where she's coming from. Aside, anyone else think it weird that she only stayed in the VP Counsel job for one year?
What's the average tenure for that position? It has to be very demanding. Regardless, she'd be a terrible judge/justice. How much is she willing to let democracy trump the law? Would she support a lynching if a majority of the town was in on it?
Yeah, the creppy old guy sniffing your hair repeatedly has to really make this job tedious...
LOL She was nominated and then a Dem Senate blew her off. That's how nuts she is.
laws that voters NEED???
Seriously? WTF!!!
I didn’t like that as well.
Easy to identify the ideologues by the lies they use.
So, totalitarianism is OK as long as it gets the votes?
How about slavery?
This judicial philosophy is fundamentally at war with democracy.
Isn't that kind of the point? A lot of what the constitution is supposed to do is to restrain the excesses of democracy.
Democracy is not an ideal, it's a tool.
I thought that was the point of having a Constitution to begin with. If voters wanted laws that would intern some people in concentration camps for some arbitrary reason, the Left would seem to be OK with this. It's democratic after all. Sane people would appreciate the role of a Constitution and a court that upholds it in preventing laws like this.
Lol. Nurse, the author, couldn't even make it through nomination to the 7th under Obama in 2010.
If nothing else, it might be better to have a real, live human being on the Court rather than a mummified lich.
Mummies and liches are completely different.
[takes Jerry Skids' nerd card and rips it up]
But is not the difference what enables the combination? You can't very well have a burrito sandwich, but if you can have an open face sandwich, can you not have an open face burrito, and can you not place that between two slices of bread to make a burrito sandwich?
Can you not mummify a lich? Or raise a mummy from the dead?
According to my authorities (Ambrose Bierce and Gary Gygax), a lich is a malicious spirit inhabiting a body which was never its own - the soul formerly inhabiting the body is not there.
wrap it in bandages voila! mummy.
PS, maybe I was wrong about the D&D definition,
https://dungeonsdragons.fandom.com/wiki/Lich
As for Bierce:
"His arms hung helpless at his sides; of his eyes only he retained control, and these he dared not remove from the lusterless orbs of the apparition, which he knew was not a soul without a body, but that most dreadful of all existences infesting that haunted wood - a body without a soul! In its blank stare was neither love, nor pity, nor intelligence - nothing to which to address an appeal for mercy."
http://ambrosebierce.org/halpin.htm
A lich has more hit dice and was also a high level magic-user when it was alive.
On the other hand, retarded Marxist cunts and you are exactly the same. Kill yourself, cunt.
Gillespie's leather jacket put down its scotch, leaned forward and said in a deep, gravelly voice "Amy Coney Barrett will be better for freedom than Ruth Bader Ginsburg".
Suderman flinched and reached for his lime-strawberry mojito. The B-team started to quiver. You could tell they were mad, but the jacket had already told them once and they didn't need another.
Nick just cocked an eyebrow and said "Go on".
Gillespie's jacket leaned back and sparked up another Sobranie. It wasn't big on ostentation, but a good smoke was a good smoke. Robby started to fake cough a little so the jacket sent an extra-large puff his way.
Putting its boots on the table it said, "Barrett will be better than Ginsburg on issues that libertarians care about and will be nearly as good or as good on other issues that progressive tend to care about".
There was silence in the room.
"That'll be the subject of the next podcast. Nick, you're going to be the host."
Nick nodded.
"Lets see now... Sullum, you're going to be the presenter."
"Me?" squealed Sullum.
All of a sudden ENB let out a loud hiss like a snake and flew from the room.
How many months back rent do they owe your head?
Be glad his fan fiction doesn't take a more X-rated turn.
As Katherine Mangu-Ward strolled out of the room, young Boehm took a deep breath.
He could still smell the perfume of her shampoo, Herbal Essences Colour Care.
He knew because he'd sniffed every bottle at Walgreens last Friday. Once he found it, he'd bought a bottle and rubbed it into his pillow, but it just wasn't the same...
Story of my life......
That was barely PG-13, I expect better degeneracy from libertarians.
Yeah, but that's about as far as I wanted to think about it.
Don't leave me hanging.
The boys were excited and were jumping up and down.
For Binion, Boehm and Britschgi it was their very first Reason Seminar cruise and they'd been invited by former Reason Editor in Chief, Virginia Postrel herself, who was the special guest.
Nick sighed and shook his head. He knew how Virginia liked her meat. Young, dumb, and full of... well, something.
"She's gonna eat them alive, Nick", his jacket said. Nick just nodded. It would be a good lesson for them, he thought.
Kinda mailed in the ending there. Then again you didn’t really want to keep going, but Bubba and Drug Habbit kinda pressured you into it.
Haha, rent free amirite? I'm not the NPC, YOU'RE the NPC!
Isn't the joke "rent free"? So, they don't live there rent free, they're just fucking deadbeats? Or is this some commentary on Trump and the evicition mess?
Libertarians dont do anything for free.
@Juice
I don't think you understand what living rent free in somebody's head means.
'Will be nearly as good or as good on other issues that progressives tend to care about,' spiteful mockery of the out-group and feigning concern for the disadvantaged? 'Fair-trade' coffee that is picked by brown people who live in squalor, for a pittance? When they can get the newest iPhone? Vigorously agreeing with each other at all times and telling each other how brave they are to be in 'the resistance?' All progressives' issues come down to virtue signaling.

Why are they similar on abortion?
because they won't change anything?
RGB was a known critic of RvW. Though she agreed with the outcome, she knew, just like any right thinking person, that the line of argument was an abortion of its own.
Like John Roberts, many SC justices are going to be something on something right up until they aren't.
Whatever..!!! Trump literally got a backfire from corona after his rigid attitude against healthcare. So let him live alone in peace.

I don't understand this worship of RBG. She was an activist who expressly despised our Constitution. She was not a prudent or influential jurist, she was a bit vain and self-aggrandizing, and to the degree that she will be remembered at all, she'll be remembered as a last gasp of progressive judicial activism.
I think the best thing about her probably was her personality: she seems to have been clever, intelligent, and sociable.
Just look at her picture, and ask yourself, do I want her in charge of my life?
I wouldn’t even invite someone her to a party.
I totally agree. The fawning over her helped increase perceived legitimacy of ignoring the law and deciding based on your personal views of correct public policy.
As it always has been with demagogues.
She was so vain she thought her continued service was more important than letting Obama pick her replacement.
She had a hard-on for feminist symbolism.
She was an asshole who came down on the wrong side in Raich, Kelo, and Heller.
-jcr
I'm sure the left will find some way to deep six her nomination. Possibly democrats will not show up so there's no quorum. They are capable of any lie, deceit, and degenerate behavior.
A quorum for the Senate is 51; if they try that tactic it'll be close.
It looks like they don't have any good ideas on how to get rid of her. I saw that NYT posted a headline yesterday that said 1500 of her UNDERGRADUATE classmates signed a petition stating that they had concerns about how she would decide on the bench.
Not even her law school classmates, just people that happened to be occupying the same campus as her on the same year. How is that news? Why would those people's concerns possibly mean anything? Is this the best they have?
They're hoping for a big revelation, meanwhile they're making the best use of what they have, including the virus.
"have" = have an opportunity for mischief, not that they invented the virus.
Their playbook doesn't have anything for this situation.
She's a woman, so that takes out like 75% of the things they had planned. The only other options that have available are related to her Catholicism, but they can't sink her for that while Biden is running for President.
Oh, is Biden still pretending to be a Catholic? Does the abortion industry know about this?
-jcr
Can one not believe abortion is a mortal sin yet believe that abortion should be legal?
Not only a mortal sin, a violation of human rights, just like (say) rape.
Can one believe rape is a mortal sin yet believe that rape should be legal?
Is it not possible that others believe differently? Most you force your views upon them? Everybody in all cultures believe that rape is wrong. Not all people or cultures believe abortion is wrong.
“Must”
"Everybody in all cultures believe that rape is wrong."
Oh, really? Tell that to the village elders of Muzaffarabad, Pakistan:
https://lebanon-express.com/news/world/pakistani-village-elders-order-retaliatory-rape-of-17-year-old-girl/article_6cb2fb18-ba13-5ad4-9e59-937aa2323673.html
Why are you forcing your persona, deeply private anti-rape opinions on these elders?
Someone never read the Koran
Yeah, apparently a couple weeks before RBG kicked the bucket his campaign was putting together a bunch of talking points about how him being a Catholic was a good thing and how virtuous the whole deal was.
The timing of the whole thing almost makes you think there is a God, and he's got one hell of a sense of humor.
"I saw Goody Barrett consorting with the devil." - Christine Wasaplymouthnota Ford
You're expecting logic and reason from the NYT? It's all about the feelz and sucking up to Communist authorities.
1500 random people who don't actually know her?
Fun fact, Rhodes College has a 54% acceptance rate. That doesn't seem terribly selective.
Of course ACB is a much better fit to libertarians than RBG. Duh!
The question is how will decisions change. To me, I see more circumscribed and precise decisions on very specific questions of law. No penumbras for ACB. I can also foresee many decisions chipping away at Executive authority, which we should welcome.
after reading the headline my first reaction was... "Duh!"
[Used to express disdain for something deemed stupid or obvious, especially a self-evident]
...to which i'm sure people could respond likewise to my extra clarification
Good point.
How many Catholic SCOTUS justices before we have a religious tyranny? Does no one see a problem with this? Our founding fathers who penned the Constitution did.
"Although in January 2017, after seven years with no Protestant justices serving or nominated, President Donald Trump nominated Neil Gorsuch to the Court, as noted above it is unclear whether Gorsuch considers himself a Catholic or an Episcopalian.[102][80] Following the retirement of Justice Kennedy, the Catholic majority on the Court was extended by the appointment of Brett Kavanaugh,[103] leaving five Catholic members of the Court, or six if Gorsuch is classified as a "Catholic."[80]
This development led to some comment. Law school professor Jeffrey Rosen wrote that "it's a fascinating truth that we've allowed religion to drop out of consideration on the Supreme Court, and right now, we have a Supreme Court that religiously at least, by no means looks like America"
https://en.wikipedia.org/wiki/Demographics_of_the_Supreme_Court_of_the_United_States#The_shift_to_a_Catholic_majority,_and_non-Protestant_Court
And now with RBG's passing and assuming ACB's confirmation by the Senate it is six or seven Catholics on the dais. This does not bode well for America.
Don't worry, Roberts and Sotomayor are on your side.
Another random bigot arrives...
I can't tell... are you trying to be funny?
If you want to see "religious tyranny", look at progressive atheists or democratic socialists. And I say that as an atheist myself.

That is the reason for Libertarians to vote for Trump. His judicial nominees will move things in our direction. They will last far longer than the executive orders that will be reversed and similarly abused by the next President.
