ICE Funding Freeze

Plus: detention center NIMBYism and why you shouldn't walk on the semifrozen Potomac river.

An ICE funding freeze? Congress has a little less than two weeks to agree on a funding bill for the Department of Homeland Security (DHS), and the prospects of a deal are looking pretty bleak.

As we covered yesterday, Democrats are demanding that any funding bill for the DHS include a number of immigration enforcement reforms. They want to ban agents from wearing masks, require them to wear uniforms and ID, and abide by a "reasonable use of force policy."

The New York Times reported that Republicans are not having any of it. Sen. Katie Britt (R–Ala.), who chairs the Senate's homeland security subcommittee, has called Democrats' demands a "ridiculous Christmas list."

If nothing changes, DHS funding will lapse at the end of next week.

The Reason Roundup Newsletter by Liz Wolfe Liz and Reason help you make sense of the day's news every morning.

This field is for validation purposes and should be left unchanged.

The DHS should be abolished completely, so one can't help but root for it to shut down. Unfortunately, there's minimal immediate practical upside to a shutdown. The administration can draw on previously appropriated money to keep its immigration enforcement operations running.

TSA screeners might not get paid during a DHS shutdown, but you will still have to submit to their abuse when getting on your flight.

The fact is, we don't have real shutdowns anymore. So much of the federal government works on autopilot, regardless of whether Congress has voted to fund it or not.

Detention Center NIMBYism: In an ironic bit of NIMBYism, Sen. Roger Wicker (R–Miss.) has come out against the DHS' plan to convert a warehouse in Byhalia, Mississippi, into a 10,000-person Immigration and Customs Enforcement (ICE) detention facility.

Wicker says that he supports immigration enforcement, but does not believe this corner of his state is the right place to stash all the people he'd like to see deported.

I strongly oppose DHS's proposed plan to turn a warehouse in Byhalia, Mississippi, into an ICE detention center. I am all for immigration enforcement, but this site was meant for economic development and job creation. We cannot suddenly flood Byhalia with an influx of up to…

— Senator Roger Wicker (@SenatorWicker) February 4, 2026

This is not the first detention center to get hit with NIMBY complaints.

As the "zoning theory of everything" would predict, local governments from New Jersey to Portland, Oregon, have tried to use their zoning codes to keep ICE out of town. Activists have sued under the National Environmental Policy Act (NEPA), the same environmental law used to gum up all sorts of federal projects, to delay Florida's "Alligator Alcatraz."

People like myself, who like both open borders and building things, can be forgiven for having mixed feelings about these maneuvers.

Liberal localities' use of zoning codes or environmental lawsuits to try to block these facilities is pretextual and cynical. The people doing so don't object to immigration detention centers' impact on their neighborhood. They object to immigration detention centers, period.

This is yet more evidence of how easy it is to hijack local land-use processes and environmental review laws for reasons that have nothing to do with mitigating the local effects of a development or protecting the environment.

On the flip side, Wicker's complaints are more of the garden-variety NIMBYism one expects to hear about a highway project, power plant, or new subdivision. "This project is great, I just don't want it in my backyard."

This is a reminder that there's a plus side to the federal government getting in its own way when delivering big projects. The much-in-vogue "abundance agenda" likes to complain that endless red tape prevents Washington from building everything from new solar farms to new semiconductor factories. The same red tape makes it a lot harder to pull off mass deportations.

As the old adage goes, a government big enough to give you everything you want is powerful enough to take away everything you have.

Scenes from D.C.: Some very brave, but very stupid souls, have been walking out onto the frozen Potomac River in Washington, D.C. Fun as it looks, I have to agree with Scott Thuman that you should not do this.

DON'T DO THIS! People out walking on the Potomac River which was iced over but highly dangerous…especially that far out where a current makes the ice thinner and more likely to break. First responders have been pleading with people to refrain from walking on any frozen… pic.twitter.com/UDrotGfJdI

  • According to three anonymous sources, President Donald Trump told Senate Minority Leader Chuck Schumer (D–N.Y.) he'd release funding for a major rail project connecting New Jersey and New York if Washington-Dulles International Airport, sort of near D.C., and New York City's Penn Station were renamed after him, reports Politico.

Maybe. But I want to return the House to the same ratio of voters to reps stated in the Constitution: 30,000 to 1. That would require almost 12,000 Representatives. And guarantee that nothing would ever get done.

Hey, I wrote this just this week. Currently, each House member represents approximately 800k citizens. There is no way to hold them accountable to that many. And no way that lobbyists could capture 12000 representatives.

30,000 is a medium-sized town, which is about the smallest level at which we ever see politicians actually being held accountable. We have the technology today that Congress could meet without the need to be physically present.

The guarantee that nothing would be done would just be a wonderful bonus.

Another illegal alien semi-driver kills a family.

    https://www.msn.com/en-us/news/crime/semi-truck-driver-held-on-ice-detainer-after-4-killed-in-head-on-crash/ar-AA1VLbPr

"The investigation shows that a 2019 International semi tractor trailer, driven by Gert Pretoruis (44) of Geneva, was traveling east on State Road 67 near County Road 550 East when it slowed down for traffic," Indiana State Police said. "A 2022 Freightliner semi tractor trailer, driven by Bekzhan Beishekeev (30) of Philadelphia, PA, that was also eastbound did not stop and swerved into the westbound lane hitting a 2011 Chevrolet van that was driven by Donald Stipp (55) of Portland."

Indiana State Police, citing the Jay County Coroner’s Office, identified the four victims killed in the collision as Henry Eicher, 50, Menno Eicher, 25, Paul Eicher, 19, and Simon Girod, 23 of Bryant, Ind.

"Not only was Bekzhan Beishekeev released into our country by the Biden administration using the CBP One app, but he was also given a commercial driver’s license by Governor Shapiro’s Pennsylvania. These decisions have had deadly consequences and led to the death of four innocent people in Indiana on Tuesday," added DHS Assistant Secretary Tricia McLaughlin in a statement. "It is incredibly dangerous for illegal aliens, who often don’t know our traffic laws or even English, to be operating semi-trucks on America’s roads. These sanctuary governors must stop giving illegal aliens commercial driver’s licenses before another American gets killed."

Not only that: The company operating this truck and about 300 others is all Kyrgyz, apparently operates out of a suburban residence outside of Chicago, has failed every inspection, and is still reporting miles driven, even though its authorization has been revoked - among other things.

This particular carrier network lists its phone number with a +996 country code (Kyrgyzstan) and their website displays their flag, so they aren't even hiding it.

They also have nearly 100 accidents on their record, and operate multiple 'brands' with different USDOT numbers but all the same terminal addresses. Apparently using them like burner phones - when one starts to get in hot water, they switch to a new one. Rinse, repeat.

That’s not uncommon. These guys usually get several USDOT numbers so if they get in trouble, they just switch to the next one. Their guys even plaster over the old name/number at truck stops while getting fuel.

              More:

              https://x.com/maybedanielleee/status/2019231064061857862?s=46&t=qeA47-JjK6vq0pfnxg60dA

Public FMCSA records show multiple active trucking authorities tied to the same VINs, addresses, and officers, including KG Line Group Incorporated, Tutash Express Inc., Sam Express Inc., AJ Partners, and others.

These carriers present themselves as independent businesses. But court filings, service records, and publicly available authority data suggest otherwise. They share officers, overlap in operations, and appear to rotate trucks, drivers, and license plates between authorities.

Months before the Indiana crash, this operation was already the subject of a federal civil complaint filed in the Northern District of Illinois, not for a crash, but for how it was doing business.

At its core, the case alleges that several Illinois-based trucking companies, operating under different DOT and MC numbers, were never truly separate businesses. They were run as one outfit.

According to the filing, drivers are recruited with promises of a high percentage of revenue, legitimate dispatch services, proper insurance, and compliant logging.

Written leases are either incomplete or never provided. Rate confirmations, which are required so drivers can verify what a load actually paid, were not given. Despite that, money kept coming out of paychecks, without receipts or explanation. Fuel, insurance, dispatch fees, repair charges, and ELD fees.

The lawsuit also alleges that drivers were quietly shifted between different carrier authorities [for reference, scroll back to the top of the article and watch the videos]. Loads might be dispatched under one DOT number, while insurance or logging was tied to another. On paper, everything stayed “active.” In practice, responsibility was constantly moving. If something went wrong, it wasn’t always clear which company was actually on the hook.

Danielle over on X has been on top of this for a while and tracking it, trying to get USDOT to do something.

Another example of government incompetence. DOT could shut down this shitshow in a week. The evidence is staring them in the face. Instead it takes FreightWaves and X accounts to investigate.

Not going to unmute to see exactly what was said, but will say this: Sure, citizen drivers also sometimes kill whole families with their semi-trucks, and they usually have perfectly valid CDLs. But these 4 people would almost certainly be alive today if this individual had been prevented from coming to this country or removed when first caught. His criminal actions started the moment he crossed the border and continued right up until he killed this family.

Another illegal alien fleeing police in high-speed chase kills.

    https://www.msn.com/en-us/news/us/exclusive-illegal-immigrant-released-under-biden-catch-and-release-allegedly-kills-driver-in-police-chase/ar-AA1VGnQc

An illegal immigrant from Colombia killed a motorist in Southern California last month during a police chase, authorities said.

Darwin Felipe Bahamon Martinez, 21, was caught entering the United States near San Diego in 2023 and released by the Biden administration, U.S. Immigration and Customs Enforcement (ICE) said.

"Bahamon Martinez illegally entered the U.S. near Chula Vista, California, in August 2023," a statement from ICE Los Angeles field office leadership said. "He was released into the U.S. under the Biden administration’s so-called ‘catch-and-release’ policies, but if that hadn’t happened, the innocent 59-year-old driver he allegedly killed may still be alive today."

Martinez was driving a Jeep Gladiator in Anaheim on Jan. 21 when police officers initiated a traffic stop for reckless driving. When the officers approached the Jeep on foot, Martinez sped away, authorities said.

A brief chase ensued before the Jeep collided with a Honda driven by a 59-year-old man in the neighboring city of Placentia.

If Mr. Martinez had been granted a legal work permit and allowed to live here completely legally, the high-speed chase wouldn't have occurred either.

Or, if ICE hadn't made it a policy of trying to detain and arrest immigrants who are here legally with pending asylum claims, the high-speed chase wouldn't have occurred either.

This crime was a traffic citation for reckless driving, which became escalated only because Mr. Martinez feared that a simple citation would lead to him being deported to a torture prison in El Salvador. Maybe if this administration hadn't bragged about deporting non-criminals to torture prisons, people like Mr. Martinez wouldn't escalate simple traffic citations in this way.

If you thought a simple traffic stop could lead to you being sent to a torture prison, you very well might have acted the same way.

David Bier is going to ignore and lie about this data.

    https://cis.org/Report/Welfare-Use-Immigrants-and-USBorn-2024

The 2024 SIPP indicates that 53 percent of households headed by immigrants — naturalized citizens, legal residents, and illegal immigrants — used one or more major welfare programs. This compares to 37 percent for U.S.-born households.
The rate is 59 percent for non-citizen households (e.g. green card holders and illegal immigrants).
Compared to households headed by the U.S.-born, immigrant-headed households have especially high use of food programs (35 percent vs. 22 percent for the U.S.-born), Medicaid (39 percent vs. 27 percent for the U.S.-born), and the Earned Income Tax Credit (15 percent vs. 10 percent for the U.S.-born).
Our best estimate is that 51 percent of households headed by legal immigrants use at least one major welfare program. Among illegal immigrants, also called the undocumented, we estimate the rate is 61 percent. We have no evidence that this is due to fraud.

Immigrant welfare use is common among both newer arrivals and established immigrants. Of households headed by an immigrant in the U.S. for less than 10 years, 48 percent access one or more programs as do 54 percent with a head in the U.S. for 10 or more years.
The high welfare use of immigrant households is not explained by an unwillingness to work. In fact, 86 percent of all immigrant households have at least one worker, compared to just 74 percent of U.S.-born households. Income determines welfare eligibility, so many low-wage workers access welfare.

Youre a fucking moron sarc. Posted the reply yesterday to retard Biers dishonesty.

You dont care about truth. Doubt you even read the study by Cato to see the obvious issues, such as mixing illegal and legal. Also the factors used to up wealth generation while ignoring thr cost side. For example Bier claimed they drove ip housing prices but didnt count rental costs as a cost. He assumed general population ratios instead of using bayesian estimates of costs and benefits.

As usual Cato lies and it is obvious to anyone with a brain as seen in the comments to Biers post who called out all the emthodology issues.

The fact you and him claim this despite multiple states going bankrupt due to illegal immigration is just amazing.

        Youre fucking retarded sarc.

By the way sarc. This isnt even CATOs own study. They took a flawed NASEM model from 2017 that has been heavily criticized and projected it forward, manipulating the obvious recent costs. Lol.

This report is an update of a 2017 report by the National Academies of Sciences, Engineering, and Medicine (NASEM) on the fiscal effects of immigration.1 The NASEM authors shared their model with the Cato Institute, which allowed for further expansion and refinement.

You knew this right. Because you read the study??

Why is new york and California running deficits?

Cato is so dishonest, but works on useful idiots like sarc.

They even remove the cost of "legal children" from the costs of immigrants despite those costs only existing because of them.

They claimed upward pricing on housing as a 2T benefit, despite it creating less disposable income to spend for other taxation.

They literally claim immigrants have almost zero cost on social programs for fucks sake, despite knowing blue states were fraudulently using medicaid and STAMP for the benefits towards illegals.

They claim an absurd number of illegals who pay taxes and ignore the black market employment.

It ignores local costs for basic infrastructure and roads.

It is honestly a joke of a study where anyone honest and even a tiny bit educated can see through it. Hence why sarc did not.

    https://www.msn.com/en-us/news/us/los-angeles-democrat-mayor-karen-bass-covered-up-part-of-report-into-pacific-palisades-fire/ar-AA1VHaJO

Los Angeles Mayor Karen Bass has been accused of a cover-up, with insiders claiming she watered down a report on the fire department's failures to respond to the deadly Pacific Palisades fire.

The LA Fire Department released its after-action report in October on the blaze that killed a dozen residents, destroyed 7,000 homes and caused damage worth $150 billion when it tore through the wealthy coastal neighborhood of Pacific Palisades for 24 days straight, beginning in January 2025.

But an investigation at the Los Angeles Times revealed that there were several edits made in the report to downplay failures by city and fire department officials.

Two sources with insider information now tell the outlet that after receiving an early draft of the report, Bass told then-interim Fire Chief Ronnie Villanueva that the report could expose the city to legal liabilities.

They said two people close to the mayor informed them how she wanted key findings about the LA Fire Department's response to the massive blaze removed or softened before the report was made public.

-Colorado Democrats advance bill to allow individuals to sue ICE agents-

I am told that Trump is responsible for the violence of ICE - who is responsible for this?

I can think of a few ways the lefty media could spin this to being Trump's fault:
      - Trump should have caught him sooner.
      - If Trump wasn't so busy focusing only on Minneapolis he would have had a better chance at catching this guy.
-The driver, riddled with fear of ICE agents getting him, stayed in his truck longer than he should have and as a result, got involved in a car incident. If ICE wasn't so evil he would have gotten a proper rest.

Its funny - its ok to NIMBY detention centers but you're a horrible person if you don't want them to put an immigrant hostel in your neighborhood.

'Fortunately, there's minimal immediate practical upside to a shutdown. The administration can draw on previously appropriated money to keep its immigration enforcement operations running.'
    Fixed.

I'd say Trump's about half-way there at best. Slobberin' Joe (or his doppelgangers) made a real mess, trying to import D voters.
You have a choice: Mob rule and fixed elections or rule of law and honest ones.
I see Christian is coming down solidly on the side of mob rule I guess the SOB is too stupid to understand what that means.

They want to ban agents from wearing masks, require them to wear uniforms and ID, and abide by a "reasonable use of force policy."

I'd like to know whether Republicans state on the record that these specific requests are unacceptable. Or are they using other Dem requests as an excuse to not allow what any normal person would consider to be basic policing.

"What are the 85+ 'poison pill' riders in the Republican's spending bill?"

The 85+ Republican poison pill riders refer to controversial policy provisions attached to draft spending bills that aim to advance ideological or corporate interests unrelated to government funding. These riders have been identified in various House GOP appropriations bills and include measures that:

      - Restrict reproductive rights, such as banning federal funding for abortion care, including for veterans, and blocking access to contraception and women’s health programs.
      - Undermine environmental protections, by blocking climate change mitigation efforts, rolling back EPA regulations on carbon emissions, mercury pollution, and vehicle emissions, and rescinding funding from Inflation Reduction Act programs.
      - Promote discrimination, including riders that allow discrimination against same-sex couples in federally funded programs and prohibit displaying LGBTQ+ pride flags on federal buildings.
      - Benefit corporate interests, such as blocking FDA rules on menthol cigarettes and flavored cigars—measures tied to Big Tobacco—while providing special favors to agribusiness and polluters.
      - Limit federal agency actions, with riders that halt rulemaking, block funding for diversity, equity, and inclusion (DEI) initiatives, and prohibit support for critical race theory education or gender equity programs.

These provisions are labeled "poison pills" because they are seen as ideologically extreme or unpopular policies that could not pass on their own but are bundled into must-pass spending legislation. Advocacy groups like the Clean Budget Coalition and Public Citizen have criticized these riders as undemocratic and harmful to public protections.

I'd ask which democrats are opposed to these riders but this has been the core of the DNC platform since at least 2016. To the point that even AIs will regurgitate the legal, logical, and fiscal inversions of things like "Not paying for abortions is robbing women of their reproductive rights" out of hand.

You act like this is the first time you've ever seen poison pills and false flags added to legislation and then get the cherry-picked narratives from the media.
