'I Think DHS Is Going To Be Shut Down for a While'

Plus: More evidence that immigrants are good for America, Trump's call to "nationalize" elections, and more...

The mini shutdown is over, for now. On Tuesday, President Donald Trump signed a spending bill to end a brief, partial government shutdown and fund the federal government through the rest of this fiscal year—with one crucial exception.

Funding for the Department of Homeland Security (DHS) is set to lapse at the end of next week after lawmakers stripped the DHS appropriations out from the broader funding package. That maneuver creates a brief opportunity for lawmakers to negotiate reforms to Immigration and Customs Enforcement (ICE) and Border Patrol tactics in response to public outcry over the Trump administration's heavy-handed, bloody crackdown in Minnesota and elsewhere.

It's still unclear what those reforms might look like, however. House Minority Leader Hakeem Jeffries (D–N.Y.) says immigration enforcement needs to be "dramatically reformed" and has called for ICE to "conduct themselves like every other law enforcement agency in the country," which means not wearing masks or behaving like unaccountable thugs. That's a good place to start.

The Reason Roundup Newsletter by Liz Wolfe Liz and Reason help you make sense of the day's news every morning.

This field is for validation purposes and should be left unchanged.

Some Republicans seem to be conceptually on board with ICE reforms that require officers to ditch the masks or receive better training. Speaker of the House Mike Johnson (R–La.) does not seem to be among them. At a press conference on Monday, Johnson said he opposed unmasking ICE agents and added that it is "not necessary" to require immigration agents get judicial warrants for arrests and searches.

Q: You're a constitutional lawyer. Can you detail the 4th Amendment protections someone has if an ICE agent approaches their home with an administrative warrant?

MIKE JOHNSON: When ICE goes to execute a warrant, it's an administrative warrant and it's issued by an immigration… pic.twitter.com/805boNlop0

— Aaron Rupar (@atrupar) February 3, 2026

With so much disagreement over what should be done, some lawmakers are skeptical a deal can be reached in 10 days. "I think DHS is going to be shut down for a while," Sen. John Kennedy (R–La.) told The Hill.

Sounds great!

Seriously, though, it's good to see Congress at least considering the possibility of getting off the couch. If it takes more than two weeks to accomplish some meaningful changes to DHS and ICE policy, then Democrats (and sober Republicans) should not blink.

Combined with polls showing that the public largely rejects Trump's immigration tactics and a court ruling this week that blocked the administration's attempt to revoke temporary protected status for Haitians (as Reason's Elizabeth Nolan Brown detailed in this newsletter on Tuesday), it feels like the tide might be starting to turn in the war on immigrants.

Speaking of those immigrants, a new study from the Cato Institute's David Bier shows that immigration has been of fiscal benefit to the United States in every year since at least 1994. In other words, immigrants contribute more in taxes (across all levels of government) than they consume in taxpayer-funded services.

Today @CatoInstitute published our report providing the first look at the fiscal effects of the wave of legal & illegal immigration over the last 3 decades. It shows immigrants created surpluses every year, by a combined $14.5 trillion, even as deficits grew pic.twitter.com/0HHFZWvtwN

— David J. Bier (@David_J_Bier) February 3, 2026

Overall, immigrants have reduced budget deficits by over $14 trillion in the past 30 years, Bier calculates. That hasn't been sufficient to cancel out the massive amount of debt the federal government has piled up during that period, but it would have had to borrow even more heavily in a world where immigration was severely curtailed.

"Immigrants are subsidizing the US government," Bier concludes.

Scenes from Washington, D.C.: Trump has been saying he wants to "nationalize" elections, and Speaker Johnson is now echoing that idea.

Here's the president on Tuesday trying to clarify what he means by nationalizing elections—though he gets some very basic facts wrong, like claiming that "a state is an agent of the federal government in elections." That is simply not true, as the Constitution gives states control over elections.

Collins: What exactly did you mean when you said that you should nationalize elections?

Trump: If you think about it, a state is an agent for the federal government in elections. I don't know why the federal government doesn't do them any way. pic.twitter.com/MM369u8rBY

— Acyn (@Acyn) February 3, 2026

Johnson is previewing how Republicans will try to sell this idea: by spreading more conspiracies about election results.

Mike Johnson on Trump calling for Rs to "nationalize" elections: "We had 3 Republican candidates who were ahead on election day in last cycle, and every time a new tranche of ballots came in they just magically whittled away until their leads were lost. It looks on its face to be… pic.twitter.com/wmeatnYZcF

— Aaron Rupar (@atrupar) February 3, 2026

If Johnson watches the Super Bowl on Sunday, will he turn it off at halftime and declare whichever team is leading to be the winner? This argument would be laughably silly if it weren't intended to undermine the most basic function of a federalist republic.

Nationalizing elections: A bad idea when Biden proposed it. Still a bad idea now.

Thankfully, not all Republicans are willing to indulge Trump's nonsense. "I opposed nationalizing elections when Speaker Pelosi wanted major changes to elections in all 50 states. I'll oppose this now as well," Rep. Don Bacon (R–Neb.) posted on X.

QUICK HITS

  • Stephen Miran, who has held posts at both the White House and the Federal Reserve since September, announced that he would end that unusual arrangement by resigning as an economic adviser to the Trump administration. Miran is one of the chief architects of the president's second-term tariff plans.
  • The Trump administration continues its rhetorical assault on the Second Amendment.
  • "There is no reason that someone should be banned from exercising their Second Amendment right simply because they use marijuana," says Colorado Gov. Jared Polis, weighing in on a case going before the U.S. Supreme Court.

immigrants contribute more in taxes (across all levels of government) than they consume in taxpayer-funded services.

Note the debate is about illegal and other abusive groups like refugees and not all immigrants. As usual Boehm and the left generally are measuring what is easy to measure and not what is relevant.

Probably their own supporters are too stupid to understand the difference, but opponents are not.

Reason loves polls until they dont.

    https://legalinsurrection.com/2026/02/new-poll-shatters-narrative-voters-overwhelmingly-back-deportations-and-ice/

73% say coming here illegally is breaking the law.

    61% support deporting illegals.

    58% oppose defunding ICE.

54% support ICE enforcing our immigration laws.

The generic ballot flips from D+4 to R+0 if Democrats oppose ICE.
If Democrats force a shutdown to defund ICE, Republicans take a 2‑point lead; that’s a 6-point shift away from Democrats over a single issue.
Swing voters shift a staggering 16 points toward Republicans under a shutdown scenario.

...a court ruling this week that blocked the administration's attempt to revoke temporary protected status for Haitians (as Reason's Elizabeth Nolan Brown detailed in this newsletter on Tuesday), it feels like the tide might be starting to turn in the war on immigrants.

Why are we calling this a newsletter all of a sudden? What's going on here.

Also, it does no one a service to frame this as a war in immigrants, per se. More like a push against unrestricted immigration that many on paper support (until the feds classically fuck some things up in the execution and corporate media pumps the narrative, almost forcing the errors).

A leading U.S. medical organization issued a statement Tuesday urging doctors to delay gender-related surgeries for minors, warning that the scientific evidence supporting irreversible interventions remains weak.
The American Society of Plastic Surgeons (ASPS) said it found insufficient proof that gender-related breast, chest, genital, or facial surgeries provide a favorable risk–benefit outcome for patients under 19. The group advised its members to postpone such procedures until adulthood, framing the recommendation as a matter of patient safety, scientific integrity, and medical ethics.

A de-transitioner won a lawsuit for $2M, proving that sane juries are going to find against doctors who push kids into this. The ASPS statement is just an industry seeing the writing on the wall and looking to limit their liability.

It should soon be obvious which boards have been completely infiltrated and corrupted by Marxists. I suspect the APA and AMA are already lost. If they don't backtrack on transitioning kids, it will be confirmed.

“I am calling all 55 gangs in my beautiful city,” Martinez said. “I’m calling the Latino gangs. I’m calling the Cambodian gangs. I’m calling the Filipino gangs. I’m calling the black gangs. The "crackdown" is only "bloody" when civilians interject themselves violently into the law-enforcement process, often in riotous fashion.

Change the laws or get out of the way. Please, protest all you want, peacefully, from the sidewalk...chant, scream, blow whistles (although be prepared for common noise ordinance and disturbing the peace violations). Video all you want from a non-interfering distance. Don't block streets without proper permitting. Don't throw things at law enforcement. Do NOT drive your vehicles at law enforcement.

These simple guidelines prevent 99.99% of tear gassings, flash finger bangings, rubber bullets, and the super-rare already officer-involved shootings.

    Cleanest election ever!

    https://townhall.com/tipsheet/josephchalfant/2026/01/31/fulton-county-n2670452

Georgia state-law requires that voters register using their primary residence rather than a P.O. box or any other type of address. In Dolezal’s newly released video, he revealed numerous allegedly fraudulent registration locations across Fulton County according to the January voter rolls.

He discovered that 70 people were registered at a single UPS store, 19 people registered at an abandoned home, 138 people registered at a location run by virtual mailbox business Physical Address, 1900 people registered at a homeless shelter outside of the Georgia State Capitol, 70 people registered at a homeless shelter that closed nearly a decade ago, and 96 people registered at a second UPS store.

Dolezal also revealed that thousands of people were registered to vote with a birth year of 1800 or 1900. Jason Fraizer, who did much of the background research for Dolezal, claims that these birth years are used when an individual does not know their date of birth, and therefore cannot be verified as a legal resident. Frazier also stated that the voter rolls contain hundreds of duplicate registrations or multiple variations of the same name of a registered voter at a single address.

FYI - homeless people are allowed to vote. If you don't like it change the law, but until then they can vote. As for the UPS addresses, this is a common problem and most of the people using UPS addresses don't understand that it is illegal. Also most of the people do not cast any extra votes just the ones they are entitled to vote. It is more a problem of understanding than of criminal intent.

That law needs to be ruled unconstitutional. Despite what MAGAs believe, the homeless have a right to vote, and requiring an address disenfranchises them.

Sure, they have the right to vote. And it should be possible to vote even if you don't have a permanent address. But I'd question how many actually give enough of a fuck to register and vote and how many are being registered by activists and what happens when it comes time to vote.

The first recognition of citizenship by the first Congress, before the BOR passed, had a 2 year residency requirement. Even native-born children whose fathers weren't residents didn't get citizenship. The first change to the requirements for recognition of citizenship, shortly after the BOR passed, was to increase the residency requirement from 2 yrs. to 5 yrs.

There was no notion of a "right to vote" until after The Civil War. The notion of a right to vote as distinct from free assembly isn't consistent with any notion of natural rights deigned by a creator or granted to the people by themselves. The Government will *always* be telling you who you can and can't vote for and how.

There is a reasonable case under "takings" and "taxation without representation", but that relegates the "right to vote" into the "right to drive" or the "right to collect social security" territory rather than "Congress shall make no law..." or "... shall not be infringed (nominally)".

This all is working backwards from "from each according to ability, to each according to need". Poor people and illegal immigrants are owed a right to vote by the people who pay taxes. It's a known bug.

I repeatedly point out that ~50% of murders go unsolved so the statement that "Immigrants (of any variety) commit fewer murders." isn't provably true one way or the other.

It's dishonest selective reporting from the grass roots and they *still* have to use the "Illegal immigrants = immigrants" cheat *on top of that*.

Fuck you, Eric. There is not a war on immigrants. There is a strong push to legally remove unauthorized, deportable aliens.

You know who's really unhappy with unauthorized (illegal) aliens? Legal immigrants. Ask them. Just about any naturalized immigrant has a lot to say about line-jumpers making demands.

That is a false statement. Trump has also targeted legal immigrants to be abused. Dramatically cutting down visas, raising fees, de-naturalization quotas, turning legal immigrants into illegal ones, deporting people who are legally here, and violating the civil rights of all immigrants.

No, but I tell you, if the referees put more time on the clock after the end of the game, and then retroactively say that they found more points for team that is behind, if they review every call made and change rulings they have already made in the middle of the game in ways that are clearly not consistent with the rules printed in the rulebook, and if all such actions skew one way and one way only, then maybe I'll say the game is rigged, too.

I don't want to federalize elections either. OTOH, only US citizens are supposed to be allowed to in elections for federal office, and a uniform citizenship check before voting would be helpful and a de minimus action for virtually any citizen.

I'd even be willing to allow non-ID voting in exchange for affidavit stating that the person is a citizen, with a possible death penalty attached (minimum life in prison without parole) for perjury on the form. Ok, maybe that's too harsh? A $1M mandatory minimum fine. "Since no one would ever do it."
