Salvadoran President Says He Won't Return Kilmar Abrego Garcia
And while U.S. officials admit the deportation was a mistake, they say they're not obliged to bring him back—despite the Supreme Court's ruling.

Salvadoran President Nayib Bukele said Monday that he will not return a Salvadoran man who was wrongfully deported to El Salvador from the United States, despite a U.S. Supreme Court order instructing the U.S. government to facilitate the man's return.
"How can I return him to the United States? Like if I smuggle him into the United States?" Bukele said during a meeting with President Donald Trump in the White House. "Of course I'm not going to do it. The question is preposterous."
Kilmar Abrego Garcia was among the roughly 200 individuals deported to El Salvador in March as part of a deal in which Bukele agreed to detain alleged gang members in exchange for a hefty sum. But Abrego Garcia is not a gang member, his lawyer says; he lived in the U.S. for more than 14 years, is married to a U.S. citizen, and is the father of three children. He has no criminal convictions in either the U.S. or El Salvador.
The Trump administration claimed he was a gang member, citing a 2019 finding by an immigration judge that he was affiliated with the MS-13 gang. But U.S. District Judge Paula Xinis found that "the 'evidence' against Abrego Garcia consisted of nothing more than his Chicago Bulls hat and hoodie, and a vague, uncorroborated allegation from a confidential informant claiming he belonged to MS-13's 'Western' clique in New York—a place he has never lived." The court granted him protection from removal to El Salvador, citing credible fear of persecution by gangs there. Nevertheless, he was arrested on March 12 by immigration authorities in Maryland and deported shortly after.
In an April 4 ruling, Xinis ordered the U.S. government to "facilitate and effectuate the return" of Abrego Garcia by April 7. Last week, the Supreme Court upheld that order, labeling the deportation "illegal" and requiring daily updates on efforts to return him.
Justice Department officials have acknowledged Abrego Garcia was mistakenly deported due to an administrative error. Yet the Trump administration said Sunday that it is not required to negotiate with El Salvador for his return and argued that Abrego Garcia is "no longer eligible" for the protection that should have initially prevented his removal to El Salvador.
In the Oval Office meeting, Secretary of State Marco Rubio echoed that position, saying that the Trump administration is not bound to follow the court's order. "No court in the United States has a right to conduct the foreign policy of the United States," Rubio said.
"I don't understand what the confusion is," Rubio added. "This individual is a citizen of El Salvador. He was illegally in the United States and was returned to his country. That's where you deport people back to their country of origin."
Attorney General Pam Bondi said the U.S. could provide a plane to facilitate his return, but emphasized that "that's up for El Salvador if they want to return him. That's not up to us."
Bukele, however, suggested that he wouldn't comply with such a request if he were asked. "We're not very fond of releasing terrorists into our country," he said. "We just turned the murder capital of the world into the safest country in the Western Hemisphere and you want us to go back into releasing criminals so we can go back to being the murder capital of the world? That's not going to happen."
Even if Abrego Garcia were returned, Stephen Miller, the White House's deputy chief of staff for policy, said he would simply be deported again. "No version of this, legally, ends up with him ever living here," Miller said.
Sen. Chris Van Hollen (D–Md.) has requested a meeting with Bukele while he is in the United States to discuss the matter. "Abrego Garcia never should have been abducted and illegally deported," he said. "The courts have made clear: the Administration must bring him home, now."
Abrego Garcia is currently being held at El Salvador's 40,000-person mega prison, Centro de Confinamiento del Terrorismo (CECOT), a facility known for its human rights violations. His lawyers have warned that Abrego Garcia faces a serious risk of torture or death.
During the White House meeting, Trump thanked Bukele for cooperating with the administration's mass deportation efforts. "You are helping us out, and we appreciate it," Trump said, adding that the U.S. would like El Salvador to accept as many deportees "as possible."

Both an immigration judge and his asylum judge believed he was a member of MS13. Despite that he was merely banned from being deported to ES. Ironically due to fear of attack from a rival gang.
Once MS13 was declared to be a foreign terrorist group, none of the parole options open to immigrants belonging to MS13 were valid any longer due to the prior judicial rulings on MS13 membership.

Due process is notice, and a hearing Abregos-Garcia was represented by counsel at the 2016 bond hearing when an immigration judge ruled he was deportable as a member of MS-13, and when the Board of Immigration Appeals let that determination stand.

So the only reason he didn't get asylum was because he submitted his application too late.

So the judge decided to rely on this Form I-213, even though it is internally contradictory and also contradicts the Gang Field Interview Sheet, because an an anonymous "past, proven and reliable source" told him so, and because Garcia couldn't prove that he WASN'T in a gang.

What I don't get is the judge references Guatemala then shifts to El Salvador. He was ordered deported. He is a citizen of El Salvador so where else would we deport him to? How do we force a government to send their own citizen who is a terrorist into the US which would be an act of war? The finding that he was a member of MS-13 only came up because he asked for bond. The immigration judge reviewed the evidence and found that it "show[ed] he is a verified member of MS-13." and therefore that Abrego-Garcia did not demonstrate "that his release from custody would not pose a danger to others."

There is a LEGAL PROCESS to get the 'withholding of removal' order revoked. Trump didn't do that. Maybe you are right and the original gang that threatened him is no longer a problem. The SCOTUS did not order the US government to facilitate Abrego-Garcia's return to the US. That is just a lie or miscomprehension of the order. They ordered the US government to facilitate his release from custody. Does this district court judge have the authority to just dismiss the appeals court and immigration courts determinations just because she didn't like the determinations? She didn't go into how the immigration court or the appeals court erred in their determinations that he was in the country unlawfully and is a member of MS-13. She only says they used his clothing and a vague uncorraborated allegation which the immigration court didn't rely on nor did the appeals court.
Here is the relevant part of the SCOTUS ruling:
"The rest of the District Court’s order remains in effect but requires clarification on remand. The order properly requires the Government to “facilitate” Abrego Garcia’s release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador. It wasn't the judicial branch that declared MS-13 to be a foreign terrorist organization. Trump did that with one of his executive orders, in February of this year. The immigration court (not a real Article 3 court) determined that Garcia was in MS-13 based on the sole testimony of one anonymous informant who claimed that Garcia was in a branch of MS-13 in New York which Garcia has never even visited. That was in 2019. The evidence is flimsy.
But the way Jesse carefully phrases his statement, he would have you believe that it was a court (presumably a real court) that declared Garcia to be a terrorist. That is not true.
What they are really doing, is taking a judge's ruling from 2019, and using that to justify a claim that is far worse than it really is, that Garcia is some type of terrorist.

I have to believe that if Mr. Trump called the president of El Salvador and explained to him that it would be to his advantage if he promptly returns Abrego-Garcia to us and to his extreme disadvantage if he doesn't return him promptly and in good health, Abrego-Garcia would be on the next flight out of El Salvador. Of course, El Salvador may have quietly executed or tortured him by now and can't return him in one piece.

Without casting judgement on this individual, this is a title 2 versus title 3 showdown. The Supreme Court told the district court that commanding the government to "effectuate" the return of this man would likely illegally intrude on the constitutional powers of the executive and suggested that the decree could only command the government to "facilitate" his release. The only path to that outcome involves foreign policy which is outside the jurisdiction of the courts. Bukele says El Salvador will not release him. Check mate. Sorry folks. Trump wins. This doesn't exactly make me happy personally. But we are witnessing a major historical event and maybe it needs to happen.
