CBS Is Wrong About Free Speech in Germany and the Rise of Nazism
Margaret Brennan should immediately Google the Weimar Fallacy.

The weekend programming over at CBS was unusually focused on speech norms and censorship in Germany. First, Face the Nation host Margaret Brennan casually asserted that free speech is what empowered the Nazis to take over the government and implement the Holocaust; then, 60 Minutes conducted an interview with present-day German authorities in which they detailed their efforts to suppress not just Nazi speech but also misinformation, gossip, and insults toward politicians.
It was an alarming degree of contempt for cherished free speech principles, to say the least. News organizations are free to evince a preference for Europe's pro-censorship policies, but the criticism they attract from the right—from Vice President J.D. Vance and Secretary of State Marco Rubio, in this case—was quite deserved.
Moreover, CBS had its facts wrong. Brennan's claim that "free speech was weaponized to conduct a genocide" in Nazi Germany is a profound misreading of history.
This remark from Brennan came during her interview with Rubio, in which she challenged him to respond to Vance's speech on Friday at the Munich Security Conference, where the vice president delivered a thunderous condemnation of European leaders. It is fair to criticize Vance for being overly friendly with Germany's far-right party, Alternative for Germany (AfD), during his visit to Europe; much of the speech, however, focused on the European Union's contempt for free speech and betrayal of "some of its most fundamental values." Indeed, EU commissioners have taken increasingly brazen steps to police speech on social media and have drawn criticism from American civil liberties groups.
Brennan prompted Rubio to defend Vance's conduct, and made the claim that the Nazis "weaponized" free speech to conduct a genocide.

Brennan is wrong, however.
This idea that Germany, during the period between World War I and World War II, was some free speech paradise—and that the Nazis used this to their advantage—is utterly false. In fact, historians of the interwar period have a name for this false claim: the Weimar Fallacy.
On the contrary, fears about rising Nazi influence caused Weimar Germany to take increasingly authoritarian steps to outlaw and censor Nazi speech during the 1920s. Greg Lukianoff, president of the Foundation for Individual Rights and Expression, wrote an excellent article about this in 2022. Far from permitting Nazis to practice free speech, the German government "shut down hundreds of Nazi newspapers—in a two-year period, they shut down 99 in Prussia alone," wrote Lukianoff. "They accelerated that crackdown on speech as the Nazis ascended to power. Hitler himself was banned from speaking in several German states from 1925 until 1927."
Similarly, former American Civil Liberties Union president Nadine Strossen found little merit in the idea that aggressively censoring Nazi speech and advocacy was an effective strategy. Instead, she wrote, the German government failed to take appropriate action to curtail Nazi violence; violence is not speech, and the government could have and should have done more to prevent what was in effect political terrorism.
In any case, Brennan's argument was that free speech empowered the Nazis. It's obvious she's incorrect, because there were significant restrictions on Nazi speech during the relevant time period. The German government tried desperately to censor Nazis; it didn't work. Then, of course, when the Nazis achieved political power, they were able to use the government's vast censorship apparatus to silence their own critics.
To this day, Germany still prohibits certain kinds of Nazi speech. A different CBS show, the Sunday evening news program 60 Minutes, spotlighted the German authorities current efforts to police such speech. What they revealed was fairly alarming; indeed, the German government censors not just Nazi speech but also hate speech more broadly, misinformation, gossip, and even "insults" toward politicians.

The interviewees further clarified that Germans can be prosecuted for sharing and liking illegal content on social media.
CBS reporter Sharyn Alfonsi offered minimal pushback; at one point, she did suggest that surveilling citizens to this degree and prosecuting them for wrongthink was itself sort of Nazi-esque. No one could accuse the segment of being overly critical of the German approach to online speech, however.
Even so, the German prosecutors clearly undermined their own case by astutely demonstrating why any restriction on speech inevitably results in a slippery slope situation. Progressives start by saying that they are all for free speech, they just want to create a new, narrow category of unprotected speech: say, Nazi speech. Next, that is inevitably broadened to include hate speech more generally, and extremism, and misinformation, and so on. In the case of Germany, the authorities also prohibit insults about politicians. The interviewees detailed an infamous 2021 case in which the police raided the home of an individual who had called a local politician an ugly name—a nickname for the male reproductive organ—on Twitter.
Alfonsi summarized the German approach thusly: "So it sounds like you're saying, it's okay to criticize a politician's policy but not to say 'I think you're a jerk and an idiot.'"
This is a textbook example of why Americans are rightly proud of our robust First Amendment traditions, which stand in the way of such nonsense. Never forget that the European bureaucrats who assert the importance of censoring Nazi speech are the same people who want to arrest their citizens for saying a politician is a dick.

The problem with the Weimar Republic was that it was enforced on the German people by the allies (who almost universally ignored their promise to national self determination). A large portion had wanted Germany to become a constitutional monarchy like England (this was also popular in Austria, which actually wanted to be joined to Germany after the loss of its empire). This was most popular on the right and especially with the junkers of Prussia, and to a lesser extent the Bavarian nobles (the King of Bavaria was also forced to abdicate). The left on the other hand was split between socialists and Marxist. There were very few Germans who had an support for the Weimar Republic, that’s why it was known for it chaos, because no one supported it. And no one thought it would last. The question was what was going to replace it. The allies would probably have been better off accepting the Kaiser’s abdication in lieu of the crown Prince and allowing them to form a constitutional monarchy, either with or without Austria. At least that would have had a sizable portion of the German population supporting it and would have made the rise of the Nazis that much more difficult.
And the country that benefited the most from Versailles was Serbia, that got their wish for a Serbian dominated Yugoslavia, which the other countries didn’t really want (Croatia and Bosnia actually were fairly okay with being part of the Austo-Hungarian Empire because it kept the Serbians in check, why do you think both countries allied themselves with Germany when given the chance). The country that started the war, yes, the Serbian government was assisting and funding and directing the Black Hand, was the ones who got the best deal out of the war.

The death of our manufacturing, especially ship building, has really limited our ability to fight a peer or near peer adversary such as China. On the other hand, China isn’t a real naval power and historically hasn’t ever really been a very strong naval power (even when Chinese explorers were reaching Africa and such, they weren’t really a naval powerhouse). In a brown water fight, they might be able to meet the US head to head (largely relying on missiles based on islands) but in a stand up blue water fight, the US still has the edge. Mainly because we have a strong blue water navy, with far more capabilities and far more experience. We have more experience with long missions, more experience replenishing at sea, and more blue water offensive and defensive capabilities. So, I still give us the edge in a blue water fight, a brown water fight on the other hand is more of a toss up.
The problem is the most likely scenario is a brown water fight. Although, on the other hand the Virginia class was specifically built with brown water operations in mind, and merchant shipping is especially susceptible to submarine warfare. And nuclear subs can enter the South China Sea and Sea of Japan submerged, operate completely submerged for the whole patrol, and exit submerged.
So, in other words, we could work at throttling their Navy (and technically it isn’t even a Navy but the naval forces of the People’s Republic Army) with our subs, with our carriers over the horizon for air support.
Plus a gigantic, permanent aircraft carrier that is the Island of Okinawa.
And, not to fault you, but absent this, you’ve completely written off air superiority too.
As I’m sure you know, since the 50s, Strategic Air Command has essentially composed, set up, and practiced things like Operation Chrome Dome and Operation Cover All. Essentially, the plans and/or ability to, in the span of minutes, occupy and dominate, continuously, airspace approximately half the size of the Pacific. We absolutely have diminished material unit capacity in this regard in the last 50 yrs., but the logistical support has more than superseded it.
Well, I kinda alluded to it with the reference to Okinawa. And all that ship building capacity is just meat for the bombers, and cruise missiles, etc. Even floating drydocks are big and slow.
Didn’t mean to write off air superiority, which is a huge thing that often gets forgotten in the analysis. I am not nearly that afraid of the Chinese Navy, though their use of island launched missiles would make operating surface ships in that area dangerous. But we wouldn’t have to operate surface ships in that area really was kind of my point. And aircraft launched anti-ship missiles are just as effective against merchant shipping as sub launched torpedoes. Maybe even more so.
Also, the MK-48 has a range of over 50 OM at 40 knots, and can travel most of that distance deeply submerged, targeting only with passive sonar and only switches over to active when it’s very near the target, which means the sub commander can fire a full four fish spread, each targeted at different target, sneak out, long before the torpedoes even hit. Or, they can stay and reload the tubes and fire another spread and then sneak out with time to spare.
And remember the MK-48 was originally designed to sink Soviet Boomers before they even realized they were under attack and therefore wouldn’t have time to launch their payload.
And one more point, just because the 688 and Seawolf were designed for blue water operations, they aren’t exactly slouches at brown water operations either. Several times during the Cold War, 688 snuck into the port of Archangel, the most secured Soviet Naval Base (home of its Typhoon class missile subs) close enough to take pictures of downtown Archangel with their periscopes without the Soviets realizing they were there.

Yes. Sort of. The President couldn’t pass legislation, but could take executive, regulatory, or enforcement action in the absence of legislation. Article 48 of the Weimar Constitution essentially allowed the President to declare a state of emergency and bypass the Reichstag. It was almost immediately abused to circumvent the Reichstag in the case of deadlock/recalcitrance/obstruction. The Reichstag could, nominally, reel things in after the fact and check the executive… until they couldn’t.

France today has something similar, Article 49.3, which allows the prime minister to enact a bill by decree, at the cost of allowing a no-confidence vote in the next 24 hours, which, if passed, rejects the bill and throws out the prime minister and cabinet. Apparently even legislators who hate 49.3 bills are reluctant to throw the baby out with the bath water, so it seldom is very dangerous to the government, and gives too much power to the prime minister.
I’d be much more impressed by such features if they included firing the prime minister and banning him from office again. Put some real skin in the game; is this bill really an emergency, or just petulance at not getting his way?

The Weimar Constitution itself had Article 48, which was used extensively (almost exclusively for the last several years) to allow the President to take emergency measures without the Reichstag. It was used frequently, from early on (President Ebert used it in 1923, for example) and took a country with little history of democratic institutions and allowed them to forego them.

And why make an international fracas about the matter? Does this current administration want to be viewed as appeasing authoritarian impulses worldwide? If thats the game then Europe should stand firm. Their history of two world wars weighs on their logic.
I think the reason is more prosaic and banal. US social media and tech companies are complaining about Europes approach to regulating social media. Meta in particular has been fined billions of dollars for privacy violations, illegal practices on its marketplace and for disseminating misinformation. Meta is now wishing to secure the US governments support in stopping those regulatory controls of its product.

Some of the laws actually allow the Europeans to try and prosecute US citizens for their posts, made in the US. Reason actually has written about it a few times. They’re trying to enforce their censorship on the rest of the world, and trying to find US companies for US speech, posted in the US, by US citizens. They’ve also tried to force companies like Facebook to disclose data on US citizens, and the social media history. The Europeans aren’t just limiting it to what happens in Europe. Luckily, so far, the US has told them to piss up a rope.

Journalism schools have been full-blown academies for marixist activism for at least a generation. They brag about it on their websites and at conferences. So yeah, we can assume that even if she isn’t squealing “down with capitalism” that her worldview was based on the same marxist theological precepts. Pretty much every professor over the last 50 years has been influenced by Marcuse and Foucault, and lot of their work is just various derivatives of stuff like “Repressive Tolerance” and “Eros and Civilization.”

Have you noticed how often the media puts the “claimed without evidence” on anything Trump says, but not for Biden? Or how “republicans pounce” on democrat mishaps? It’s all part of the same game.
