Glenn Youngkin Withdraws Virginia From California's Electric Vehicle Mandate
Youngkin's administration says the state will adhere to federal emissions standards beginning in 2025.

On Wednesday, Virginia Gov. Glenn Youngkin, a Republican, announced that at the end of the year, the state would no longer comply with California's electric vehicle (E.V.) mandate.
"The idea that government should tell people what kind of car they can or can't purchase is fundamentally wrong," Youngkin said in a statement. "Virginians deserve the freedom to choose which vehicles best fit the needs of their families and businesses. The law is clear, and I am proud to announce Virginians will no longer be forced to live under this out-of-touch policy."
California first adopted its Advanced Clean Cars (ACC) standard in 2012. The rules required automakers to gradually increase sales of zero-emission vehicles as a percent of total sales in California, culminating in an 8-percent share in 2025. Plug-in hybrids, which use both electric and gas-powered motors, counted for partial credit toward the total.
The Virginia General Assembly passed House Bill 1965 in 2021, which directed the State Air Pollution Control Board to adopt low-emission and zero-emission vehicle standards equivalent to California's. The bill was signed into law by then-Gov. Ralph Northam, a Democrat, whose support helped guarantee the bill's passage. Virginia is among 18 states and the District of Columbia that have adopted some or all of California's regulations.
But the following year, California adopted Advanced Clean Cars II, which greatly expanded the requirements of the original standard. Under the new rules, the zero-emission requirement would jump from 8 percent of automaker's sales for model year 2025 all the way to 35 percent in 2026, increasing each year until 100 percent of all new vehicles sold for model year 2035 must be electric.
The following day, Youngkin and the Republican-controlled Virginia House of Delegates indicated their intent to repeal H.B. 1965 and uncouple the state from California's rules, but the Democrat-controlled state Senate squashed their efforts the following year. In the 2023 elections, Democrats regained control of the House of Delegates while keeping control of the Senate, and the state Senate once again defeated efforts to repeal the law in January 2024.
Ultimately, California's more aggressive rules provided the legal justification for Virginia's withdrawal. Youngkin's press release claims that H.B. 1965 merely authorized the state to follow Advanced Clean Cars I, the rules in place at the time that went through 2025. "An opinion from Attorney General Jason Miyares confirms the law, as written, does not require Virginia to follow ACC II," the press release continues. "Therefore, the Commonwealth will follow federal emissions standards on January 1, 2025."
"We are alarmed that Governor Youngkin thinks that he is above the law," Nicole Vaughan, communications director for the Virginia Conservation Network, tells Reason in a statement. "Legislation passed in 2021 directs Virginia's Air Pollution Control Board to adopt Advanced Clean Cars and subsequent updates to the program. In doing so, Virginia exercised an option under the federal Clean Air Act to follow the more stringent standards adopted by California and several other states to address tailpipe pollution."
"Virginia's legislature chose to adopt Clean Car Standards in order to increase consumers' access to electric vehicles, improve our air quality, and save lives," Wyatt Gordon, senior policy manager for land use and transportation at the Virginia Conservation Network, told Reason in a statement. "To unilaterally pull our Commonwealth out of these shared standards is undemocratic, short-sighted, and wrong for Virginia."
The federal standards, released by the U.S. Environmental Protection Agency in March, are less stringent than California's but still anticipate that by 2035, more than 70 percent of new vehicles sold in the U.S. would be all-electric or hybrids. Even this is a daunting prospect, as E.V.s currently account for only 6.5 percent of all vehicles sold in the U.S.

Not only are there not enough charging stations, and won’t be enough charging stations, but the current power grid of any state cannot handle tens of thousands of electric cars in addition to the air conditioners, washer, dryer, lighting, and everything else.

And, again, all the copper, cobalt, lithium, etc., etc., etc. for all of the above isn't in any way guaranteed. Not that oil was guaranteed when Ford rolled out the Model T but he was just a car salesman with a goal and it was Hoover who committed to one in every garage and neither one of them intended it as an explicit do-or-die mandate the way the watermelons do.
Tailgating on California's legislation will inevitably lead to a legislative pileup. Auto-adopting these measures paves the road to hell. And really, no one cares what that air-bag Newsom thinks. He's not exactly a bumper crop of great ideas. You can see why people tire of his rhetoric. Virginian voters were like deer in the headlights when they were driven into this. It was a matter of time before Youngkin would begin to drift away from these policies. It's clear that all of these regulations would eventually exhaust the voters.

And Oakland is so bad, contactors refuse to repair streets in fear of being assaulted and robbed. Stop lights have been replaced by stop signs as the drug addicts stole the copper wiring used to power the lights. San Francisco is a dying city that will never recover.

Funny, I just reread HR 1965 and I don't see anything that "directs Virginia's Air Pollution Control Board to adopt Advanced Clean Cars", much less that requires it to automatically implement any and all subsequent updates to that program.
HR 1965 directs the Board to establish standards supporting the federal Clean Air Act. It merely allows the Board to cooperate with other states - it does not require it or forbid them from dropping out. So either Vaughan is ignorant of the law she is purporting to defend or just she's lying.

That said, I do not think that paragraph says what Vaughan (and maybe you) think it does. That paragraph requires the Board to create a credit system that complies with the CA act "unless and until the required regulations are superseded by regulations updating the Advanced Clean Car Program". That said, the clause does not clarify whether the program being referenced is the CA Advanced Clean Car Program or the (newly created) VA program of the same name. If it refers to the CA program, then the VA AG is right that any updates invalidate the obligation. If it refers to the VA program, ... then I'm confused because that seems to create a circular logic problem with no clear interpretation.

This is a very good development. There’s no way that it makes sense for Virginia to hook its trailer to California’s legislature. You just know that will end badly, because California is a single-party state. Thank you Governor and AG for putting a stake in the ground.
However, Republicans need to take back control of both Virginia legislative chambers so they can fully decouple these central-planning laws. There are many other laws that the Democrats have passed than just this one. For example, Virginia is on the hook to expand solar power exclusively until it completely replaces all other forms of electricity production. That's brain-dead. Politicians don't make good energy engineers. They have no business making those kinds of decisions.
Virginia, it's more than time to give the Republicans a turn at the wheel.
Virginia Republicans lost that chance last November. Their next chance is in 2027.
And it is unlikely that they will succeed as long as Trump is running the Republican Party.

Y'know, if they would focus less on trying to pretend the evil sun monster is going kill us all, and more on perfecting the tech that will ultimately make it affordable and practical for the average person, eventually most folks would make the transition to hybrid/electric on their own.
But the problem is that American society is in NO WAY ready for this. It's reflected across every single metric - everything from generating the necessary energy (which the cult of gaia is hamstringing), to preventing power loss in high heat/cold, to making the charging stations faster and more convenient, to the cost of materials (both financial and environmental), to the literal physical stress it puts on the existing infrastructure, to the effects on the insurance markets, the lack of trained mechanics, and so on and so on.
They anticipated NONE of this. But they're so committed to proving how pious they are to the gaia cult (whose bible apparently omitted a Matthew 6 type admonition) that they don't care. And so it's the rest of us who'll have to suffer as they try to forcibly replace an existing technology with an emergent one, with literally nothing under their feet to stabilize the transition. Which A) builds up resentment towards the emergent technology; and B) slows the transition that market forces would propel if the government and its gaia cult just got the heck out of the way.
