Milei Brings His Chainsaw to Argentina's Regulatory State
If passed, the new libertarian president's omnibus bill of reforms could help Argentina reverse decades of government failure.

A little more than two weeks after assuming office, Argentinian President Javier Milei on Wednesday presented his most extensive reform bill to Congress aimed at deregulating South America's second-largest economy.
The 351-page bill includes 664 articles aimed at deregulating and modifying laws pertaining to several sectors, including labor, commercial, real estate, aeronautics, and health. According to Milei, the omnibus bill contains two-thirds of all of his reform proposals.
"Argentina is immersed in a serious and deep economic, financial, fiscal, social, pension, security, defense, tariff, energy, health and social crisis without precedent, which affects all levels of society and the very functioning of the State," the bill states.
These crises were caused by "an innumerable number of restrictions on the exercise of constitutional rights, especially those of trading, working, and exercising lawful industry," the bill continues, adding that these restrictions "severely limit competition" and "artificially distort prices" while "burdening the real income of citizens."
The first measure in the bill calls for the declaration of "a public emergency in economic, financial, fiscal, pensions, defense, tariff, energy, health, administrative, and social matters until December 31, 2025." If approved, this would mean that Milei would have both the executive and legislative powers and would be able to decide on issues that are currently only regulated by Congress. The measure can be extended for up to two years.
An entire chapter of the bill is dedicated to privatizing several state-owned companies in order to generate "greater competition and economic efficiency, reduce the tax burden, improve the quality of services, promote private investment and professionalize management." The bill mentions 41 companies it proposes to privatize, including the flagship airline Aerolíneas Argentinas, the oil company YFP, the country's largest bank, Banco de la Nación, the news agency Télam, the water company AYSA, the Argentine mint, and the country's rail system.
Milei's proposal aims to simplify, digitalize, and de-bureaucratize the administration "to promote transparency and due administrative process…to obtain efficient regulations for market competitiveness, job creation, and everything that contributes to raising the standard of living of citizens."
The bill proposes to eliminate the primary elections and switch to a single-ballot system. It also seeks to move the chamber of deputies from a system that determines the number of representatives proportionally with the population to one of single-member constituencies.
The bill also extends the government's new anti-protest measures, increasing penalties to up to four years in prison for those who use arms to disrupt public transportation and up to five years for those who "direct, organize, or coordinate a meeting or demonstration that impedes, hinders or obstructs circulation."
Another chapter specifically addresses oil and seeks to ensure affordable oil supplies by leaving prices up to the market. Currently, the government can meddle in crude and gasoline prices, according to Bloomberg. The new bill will not allow the executive branch "to intervene, or fix, prices in the domestic market."
Other measures in the bill include the resale of sports tickets with "no limit to the number of times such operation may be carried out;" the authorization of self-driving cars for individuals, passengers, or cargo; abolishing price ceilings on rent; easing price caps for private health services; and "express divorces."
The measures will be reviewed by Congress during the extraordinary sessions that began this week and will last until January 31. But Milei's opposition, which holds the majority of seats in Congress, has vowed to not let the decree pass. Meanwhile, protests have sprung up in response to the omnibus bill. Several social organizations took to the streets in Buenos Aires, and Argentina's main labor union called for a general strike on January 24 in protest against the reforms.
Should Milei's sweeping reforms pass, Argentina would move from being one of the world's most regulated economies to a deregulated, free market economy that could reverse decades of government failure.

Yes, but his remedy is that, rather than making the fix himself unilaterally via executive order or some such device, he proposed cuts through the Argentine legislature via a bill that they can vote upon, and probably amend.
Typically, only the legislature can initiate bills regarding the spending of money and whether an agency/dept. of something exists or not. Milei's bill is similar to our president's annual suggested budget.
Declaring an emergency typically gives political leaders more power and flexibility, and Milei's proposed emergency powers would only last 2-4 years, so doesn't necessarily qualify as a "totalitarian method".
Regardless of what happens, I look forward to the outcome. Either the State (Argentina's political class) stops him, and gets the blame for the outcome further strengthening Milei's popularity.

In a way it's like Trump: he forced the RINOs to cut taxes (and keep their word to do so in spite of the fact they were lying) and deregulated by EO freeing up the economy. The political class hated Trump's results because it shows the emptiness of their promises and how much prosperity they've been stealing from the working class. That forces them to either reduce our prosperity (as Biden has done very quickly) and lose politically (assuming they aren't stuffing ballot boxes) or return to free markets where they don't get so rich and have to earn a living instead.
Democracy is a means to an end, freedom. If it fails to advance freedom, it should be abolished and replaced with advances in freedom.
Autocracy usually isn't the way to achieve that.

Sure, but giving the president powers to bypass other branches of government to enact his reforms does smell a bit like “just give me more power and I’ll fix this for you.” It sets off alarm bells but could be the best option for Argentinians.

John Locke stated that if government leaders did not honor citizens' rights, then the people have the right to revolt against such corrupt leadership and replace it with one that does respect such rights. If that's morally permissible, then why do you find it a problem for a democratically elected individual to make reforms in a far less violent manner? Milei is taking action in behalf of his voters to put an end to the damages caused by the previous leadership and reduce the size of the government.

The reforms he proposes are impressive and would bring Argentina closer to Libertarianism. However, you are correct that Milei assuming both executive and legislative powers would be very bad if he were deposed and a Statist assumed those powers,
A better approach to avoid that possibility would be having Libertarian advocates in executive, legislative, and judicial positions simultaneously.
Also, I am still skeptical about the outcome, since Milei has stated that he is keeping the social “safety nets” in place. He should at least wean everyone off of them slowly while ramping up privatization and de-control of the economy.
His positions on demonstrations on public thoroughfares are not the offense to free expression his opponents portray them to be.
The right to free expression does not mean violating the right to freedom of movement for travel and commerce, and opposition can always rent meeting halls, parks, vacant lots, and other pieces of real property for their expression.
Also, there are countless means of expression with Information Age and personal maker technology such as Cricut or Badge-A-Minit or 3D printing. If those are left alone, anyone can express themselves and speak their mind.
It would be interesting to know if the Congress might pass portions of the omnibus bill; and whether the President has line-item veto powers over bills the Congress passes. Presumably any employee of a state company (you know - the ones Milei proposes to privatize) who strikes could be fired by the President. It would also be nice to know in some future reporting whether the police who would be instrumental in arresting protestors who block the streets are supportive or opposed to Milei's measures.

The argument for toll roads is fairly libertarian and predates the Koch Brothers entry into the discussion. It transfers maintenance and construction onto those who use the services rather than making everyone, rather or not they use said services, pay. It's like the argument for tariffs as federal funding vs income taxes.
Let me once again make it explicit: democracy is not my goal. Representative government is not my goal. Effective government is not my goal. None of those things should be YOUR goal either.
My goal is liberty, defined as the most personal freedom possible with the minimum government authority and action necessary to preserve individual freedom. Government power consistently limited by clearly written Constitutional authorities is a tool. Democratically elected representatives us a tool, not a goal. Everything else is either a tool for maintaining liberty or an obstruction to liberty.
