One month ago today: Exactly one month ago, Hamas terrorists brutally attacked Israeli civilians, killing 1,400 innocent people in a brutal pogrom and kidnapping 240 (most of whom are still being held hostage).
You probably know what's followed. The Israel Defense Forces (IDF) began a massive attack on the Gaza Strip, designed to weed out the group responsible for the massive slaughter of civilians. International observers have criticized Israel for hitting civilians in the course of trying to reach their targets. The whole region looks like a powder keg about to blow; Israel's northern front with Iranian-backed Lebanon, where Hezbollah operates, has been heating up, and many fear the cascade of events that will ensue—Iranian-backed groups entering the conflict—if Israel makes a misstep.
Now, after one month of strikes and a ground invasion that started a week ago and has succeeded at splitting Gaza in two, separating north from south, the Israeli military has now killed more than 10,000 Palestinians. Children comprise about 40 percent of the total killed. It's unclear how many of the total dead are Hamas terrorists. Estimates are from Gaza's health ministry, which is controlled by Hamas and thus not always reliable; but when pressed to corroborate death tolls after President Joe Biden cast doubt on them, officials in Gaza "released a list with the names, ages, genders and ID numbers of all those it counted in its death toll, except for 281 whose remains were unidentifiable," per New York Times reporting. "Gaza is becoming a graveyard for children," Union Nations Secretary-General António Guterres told reporters this past Sunday.
Israeli strikes have led to massive civilian death tolls, but the IDF insists that this is due to the way Hamas conducts its operations, using Gazans as human shields. "Hamas fighters, numbering perhaps 30,000 by Israeli estimates, embed within Gaza's population of 2.2 million and store weapons in or under civilian sites," reports The New York Times. Israeli politicians have also turned toward citing massive death tolls imposed by other large Western democracies: the atomic bombs dropped in Hiroshima and Nagasaki by the U.S. (which killed 200,000 civilians); Britain bombing a Gestapo headquarters in Copenhagen, accidentally hitting a school instead (killing 86 children and more than a dozen adults); a U.S. airstrike in Mosul that ended up killing 100 civilians instead of Islamic State targets.
Attacks on refugee camps keep upping the death toll. One on the Maghazi refugee camp killed 40 over the weekend. A few days prior, an attack near Bureji refugee camp killed 13.
"Very unfair": Yesterday, former President Donald Trump took the witness stand in Manhattan during his civil trial, in which he has already been found to have defrauded banks and insurers by overstating his net worth and property valuations. (This trial will determine penalties and charges.) Referring to financial statements submitted to banks on his behalf: "I would look at them, I would see them, and I would maybe on occasion have some suggestions," said Trump.
"I think I am probably more expert than anyone else," said Trump, referring to his ability to help his lawyers and accountants with property valuation statements they submitted to banks. "I can look at buildings and tell you what they're worth."
"The net worth of me was far greater than the financial statements," said Trump at a different point, to state attorney Kevin Wallace, who was questioning him. "People like you go around and try to demean me and try to hurt me," he added to Wallace. (The trial was "very unfair," added Trump.)
Trump apparently just couldn't stop exaggerating, even on the stand. He was asked about the square footage of his residence at Trump Tower, which he initially claimed was 11,000 square feet. Then he upped it to 12,000, and then to 13,000. He oscillated between minimizing the importance of the asset valuation statements in question and talking up his own contributions to crafting them. But mostly, Trump's impressive showmanship was on full display, as he called the trial a "witch hunt" and reverted to campaign-like soliloquies about the deck being stacked against him.

It's long, long been my position that there's plenty to criticize Trump about, and Trump's critics are much more wrong than he is. They often focus on the smallest, pettiest things, like his bloviating nature or mean tweets. When they're not doing that, they're focused on the wrong things entirely, even things that are blatantly untrue, like Trump being crazy and trying to start World War III, or being a payed Putin stooge.
I can disagree with him and want him not to be President again and still believe we shouldn't abuse the system to go after him, violating all his rights and all our principles about an unbiased system of justice. These two positions are not mutually exclusive or contradictory to me.
You'll be better served if you don't oversimplify the arguments of people who disagree with you and actually seek to understand them.

The amendment actually doesn't trust voters who already settled on a 21 week regulation. It is a broadly worded amendment to involve the courts in future suits and pass over the voter.

When beaches in Los Angeles County finally reopened, only certain activities were allowed. Walking and running on paths and the beach was allowed, but bike riding was not. "Ocean activities" such as swimming and surfboarding was allowed. Sitting or sunbathing on the beach was not allowed.
WTF? You could walk or run, but not ride a bike? How is that rational with respect to COVID? You could swim or surf, but not sit quietly on the beach? How is that rational with respect to COVID?
I think their thinking was like, many people are having to sacrifice by missing gatherings for various activities, so it's only fair to make surfers suffer with them.
It's like when a jurisdiction has a water supply restriction due to a drought, and then also bans filling swimming pools from other water sources, because why should they have fun just because they can afford to bring in water?

He, on his authority, decided it wasn't a valid legal argument and disallowed that as a defense. And even though he's already ruled against Trump and this goes to damages, he won't let Trump talk about it as a mitigating factor for damages.
Beyond that, he's the jury in this case anyway. He doesn't need to shut up Trump's ability to say something prejudicial. If he thinks Trump is bringing up something irrelevant, he just has to ignore it. He's the sole fact-finder. The only thing it affects is the public perception of the trial, which is, of course, why the judge wants to silence Trump for bringing it up. This whole thing is a big show and the only thing the judge wants in are those things which are damaging to Trump.

In order to be guilty of a material misrepresentation, you have to
1) Make a statement.
True, he did that.
2) That is false
I won't concede that Trump's statements were false. Simply because the tax assessment of a property doesn't match Trump's listing is immaterial-you can't really know the value of a property unless you sell it, and Trump MIGHT be able to sell these properties at the values he listed. But going on.
3) That is relied upon by another party.
Which is why Trump is arguing that his disclaimer absolves him of liability, because he's told the other party they don't and shouldn't rely solely upon his statement.
4) To the party's detriment.
Not proven even slightly. The banks were repaid. The banks never filed a complaint. There's no complainant in this case, nobody who got ripped off. The case is filed on behalf of the people of New York, who weren't a party to these agreements.
The additional element needed for Fraud is Intent. A knowing, intentional lie for the purpose of ripping someone off. That's even further removed. But they can't even meet the 4 criteria for a material misrepresentation because the statements weren't relied upon and weren't to the detriment of another party.
That's what I still don't get at all about this. What are the damages? Who was damaged? And why the hell is the state of NY suing over this? I don't see how they could have been damaged at all. Or have standing to sue.
The damage is in the price he paid for the loan. If his fraud resulted in him getting the loan for less money than he would have had to pay had he not lied, the difference is his gain and the lender's loss.

Also, while I do get tired of All Trump Every day, there's so much more to discuss when it comes to this case. Trump does exaggerate, we all know this, and doing so does create problems for him. But if his exaggerations are not material to the facts of the case, they should be irrelevant. Trump thinks the 10,000 square footage calculation is wrong and he says it should include things like elevator shafts and other dimensions that the floor plans exclude from that calculation. It's an exaggeration but also not based on absolutely nothing.
That's the side show, though. The biggest issue that came up today is the behavior of the judge, especially in the infringements upon the rights of the accused, and the greatest example of that was after Trump was DONE testifying.
The defense has been gagged from discussing this judge's clerk. It's a prior restriction on speech made out of court. He says it's to protect the safety of his court staff, but there's been no finding that any speech amounts to endangering this clerk, nor anyone else associated with the court. So after Trump finished testifying, Trump's attorneys said they had to file a motion for mistrial based on their concerns. (They're not allowed to say her name but I'm not bound by the judge's order because I'm in a different state-beyond that I have a First Amendment Right to comment on a public official in a public proceeding on a matter of public interest so her name is Allison Greenfield)

Well, at the end of the day, the defense says they need to make a motion, and is asking the judge how to do it because they're literally prohibited from talking about the person in question. They believe the conduct of the clerk, both before the trial and during the trial, including her appearance of undue influence on the judge, is grounds for a mistrial. The judge says he's 100% prohibiting any discussion of anyone on the staff and says, "You can appeal me."
Well the defense attorney, Chris Kise, points out that he can't actually file that appeal without violating the judge's order. How are you supposed to appeal a gag order when you, the attorney, are gagged from discussing the subject of the gag order?
The judge flat-out says, "Don't file that motion, Chris." He addressed him by his first name, just out of nowhere.
The trial judge blatantly ordered them not to file an appeal of his ruling. Essentially, he's claiming his ruling precludes them, by restricting their speech, the ability to file an appeal to that ruling. He's declaring himself the ultimate authority.
Now, to be fair, judges do have a ton of discretionary authority, and often appeals are fruitless because the higher court is just going to say, "Appropriate use of judicial discretion." But the judge blatantly told him he can't even FILE an appeal because his orders prevents him from discussing the thing that the appeal would be about! It's a total clownshow.
Honestly that was the biggest take-away from the day. I know seeing Trump testify is the real draw, it's what the people showed up at court to watch yesterday, but Trump being Trump is such a tiny part of what this trial is about. There's much bigger issues than whether Trump is using his testimony as an opportunity to give a campaign speech, because OF COURSE he's going to do that. What's interesting is how the judge is manifesting bias against the defendant and people should be paying attention to it, the way processes are bent to punish a man instead of an action.

I said this down below, but, I'll say it up here again. Depending on which standard you're using to calculate square footage, yes, elevators, stairwells, and even public corridors do get figured in sometimes.
The BOMA standards for rentable / leasable typically space divvy / apportion that 'extra' square footage among the tenants of a given floor or building. If you are the only tenant of a floor, your 'rentable' square footage would likely include elevator shafts and stairwells, as well as mechanical shafts and everything else.
There's also another calculation that people use, where they divide the net square footage of tenant space by the overall square footage (the 'gross' sf) to determine the 'efficiency' of a layout. The more of your footprint is taken up by elevators, corridors, stairwells, lobby space, public restrooms, etc, the less 'efficient' it is. But the renters are still paying for the entire square footage regardless.
For instance, my office is located on the 2nd floor of a 3 storey building, with 2 other tenants. It's about a 40,000 sf office building on the 2nd floor (gross) and we have about an 8,000 sf office (net). The other 2 tenants combined use about 24,000 sf of the space (net), and the rest is made up of common space like corridors, elevators, stairwells, restrooms, and an open atrium down to the first floor.
At 8k/32k total net leasable space, our office is using 25% of the net tenant space on the floor, so because the floor is 40k sf, we pay for 25% of the floor. Our 'rentable' sf is 10k sf. Our building has an efficiency rating of 80%.
If Trump as a tenant is using the entire floor, he's paying for the entire floor, elevators included. If it's only part of the floor, he's still partly correct. If you look at him as the CEO of the company that's renting the elevators to him, they're still his elevators.
BTW, BOMA stands for the Building Owners and Managers Association - they are a real estate centered way of thinking about buildings, and as a developer, probably the standard Trump would be most familiar with, as opposed to building or fire codes.

There are in fact more than one way to measure the square footage of a space, and different standards depending on why you're measuring it. Net or Gross square footage for occupancy limits (life safety stuff) are measured one way, and set by the building code. And then you have the BOMA standards, which are about how you calculate a space for rental purposes, and can actually include square footage outside the space, like stair towers, elevators, corridors, etc. Those standards are set by realtors and bankers and building managers.
I don't know if that is what he did here or not, (probably not) but it might be worth looking into. I'm quite certain that this court doesn't know that you can come up with 3 different correct answers to a question like that, because they don't know the difference between a tax assessment, property value, and their own asses.

According to police, Groves returned armed with a pistol equipped with a 0.357 SIG cartridge. Under current law, Mr. Groves was legally prohibited from owning or possessing either a weapon or the ammunition he used to commit this crime.
While Johnson is correct in stating mass shootings are not unique to Chicago, they are more prevalent in the Windy City than elsewhere across the country. The most popular definition of a mass shooting is a single incident in which at least four people are shot. Since Johnson assumed office in May, Chicago has experienced an unsettling 27 mass shooting incidents, which have claimed 19 souls and left another 139 wounded. A 175-day period, simple math reveals Chicago experiences a mass shooting every 6.4 days.
Although there is no evidence to show more gun control — background checks, registration procedures, or bans on certain kinds of weapons — would have prevented Groves’ crime, Mayor Johnson insisted in his statement the blame for Groves’ mass shooting should fall on guns. While gangs account for most mass shootings and the issue of possible mental illness looms large in any discussion of motive, no proof exists to demonstrate either played a role in Graves’ crime.
To avoid the ignominy Lightfoot suffered only months ago, Johnson does have alternatives, one of which is to review the crime situation and consider publicly criticizing Cook County’s non-prosecutor, Kim Foxx. Johnson should also forego endorsing Clayton Harris III as Foxx's replacement until a moderate Democrat emerges as her possible replacement in the election for State’s Attorney in 2024.
