Brickbat: Bad Bus Behavior

Tyler Zanella, a paraprofessional with Colorado's Poudre School District, has been charged with three counts each of felony assault against an at-risk juvenile, misdemeanor assault, and misdemeanor knowingly or recklessly causing child abuse. Police say video captured Zanella striking a kindergarten student with disabilities on a school bus on at least three different days. The school system has placed Zanella on administrative leave.

Zanella had previously pleaded guilty to a misdemeanor charge of negligent child abuse in Adams County in 2012, court records show. He was sentenced to 18 months probation, which was later reduced to 13 months. Additional information on that case was not available Thursday, and most of the court documents had been destroyed, an Adams County court official said in an email.

There is such a shortage of school bus drivers right now that they have further lowered an already low bar, even overlooking DUIs and child abuse records. Wouldn’t be surprised if they hire chimpanzees to drive the school busses.

Dear PSD families and colleagues,
This is a follow up to our communication last week about ex-PSD paraprofessional bus attendant Tyler Zanella’s arrest and termination from PSD.
Our staff work with children every day because we want to see them grow and succeed, make sure their needs are met, and be a source of stability and security.
“This traumatic situation represents the exact opposite of everything we stand for. We are heartbroken for those impacted and committed to supporting the investigation by police to ensure the suspect is held accountable,” said Superintendent Brian Kingsley.
On Monday, PSD staff finished reviewing 190 hours of footage of Mr. Zanella on bus route 2253. This is all of the available footage of Mr. Zanella on PSD buses.
While reviewing footage, PSD staff recorded clips of video showing other possible instances of misconduct by Mr. Zanella and provided these clips to law enforcement. At this time, it appears that Mr. Zanella may have physically abused six students, according to Fort Collins Police Services. PSD has contacted and is working to support the parents/guardians of impacted students.
Today, May 31, it was announced that Fort Collins Police Services and the District Attorney’s Office for the Eighth Judicial District are adding charges for Mr. Zanella based on videos submitted by PSD. These charges are associated with the six identified students. The contents of the FCPS release are below:
****Updated Press Release Regarding School District Employee (5/31/23)****
Detectives have continued to work with the Poudre School District regarding the investigation of Tyler Zanella who was a paraprofessional with the district. Detectives reviewed hours of surveillance video from the bus routes that Zanella rode, and multiple additional assaults were discovered. All Zanella’s victims, a total of six, were discovered to be at-risk due to their disabilities. Detectives worked to notify the involved victim’s families of the incidents, and on May 30, 2023, met with the Larimer County District Attorney’s Office. The Larimer County District Attorney’s Office accepted and filed the following charges:
30 counts of 18-3-204 Assault in the Third-Degree At-Risk Person, a Class 6 Felony
30 counts of 18-6-401 Child Abuse, a Class 1 Misdemeanor
49 counts of 18-9-111 Harassment, a Class 1 Misdemeanor
19 counts of 18-6-401 Child Abuse (different section than the previous charges), a Class 2 Misdemeanor.
“This case highlights the strong collaboration Fort Collins Police has between its School Resource Unit and its Crimes Against Persons Unit, to help protect our children. The assistance and cooperation from the Poudre School District have helped to hold this suspect accountable,” said Lieutenant Sara Lynd who oversees the Crimes Against Persons Detective Unit.

Due to these cases involving at-risk juveniles, no additional information will be released because of statutory protections. All charges are merely allegations by law enforcement, and every individual must be presumed innocent until proven guilty in court.

On May 23, 2023, Fort Collins Police were notified of a possible assault on a Poudre School District student by a Poudre School District paraprofessional who rides the school buses. This was brought to our attention by the Poudre School District. Our School Resource Officers began an investigation immediately in conjunction with the Poudre School District. Officers were able to view surveillance video from the school bus which showed the paraprofessional, Tyler Zanella (DOB: 10/31/1986), hitting the kindergarten victim, who has disabilities, on several occasions. Officers were able to determine that the juvenile victim was struck by Zanella on April 25th, May 19th, and May 22nd based on the video surveillance that was reviewed.
On May 24th, Fort Collins Police Officers arrested Zanella on the following charges:
3 Counts of 18-6.5-103(3)(c) Crimes Against At-Risk Juvenile – 3rd Degree Assault – Class 6 Felony
3 Counts of 18-3-204(1a) 3rd Degree Assault – a Class 1 Misdemeanor
3 Counts of 18-6-401(7)(b)(I) Child Abuse – Knowingly or Recklessly – Class 2 Misdemeanor
Zanella was subsequently booked into the Larimer County jail. All charges are merely allegations by law enforcement, and every individual must be presumed innocent until proven guilty in court.
Officers have reason to believe that there may be additional victims. Anyone with information regarding this case or other cases involving Zanella is asked to contact Officer Dexter Rowe at (970) 472 3705.
“I’m grateful for the swift and thorough investigation by our School Resource Officers and the Poudre School District to prevent the suspect from continuing these reprehensible actions,” said Sergeant Andy Ferraro who oversees the Fort Collins Police School Resource Officer Team.
Due to this case involving an at-risk juvenile, no additional information will be released because of statutory protections.

Route 2029: morning routes on Oct. 13, 20, and 27.
Route 2030: morning route on Sept. 9.
Route 2090: all day Aug. 31; morning routes on Sept. 1, 8, and 12; and afternoon route on Sept. 14.
Route 2253: Sept. 23-27, Sept. 30, Oct. 3-12, Oct. 17-19, Oct. 21-26, Oct. 28-May 23.
Route 2305: all day Sept. 15; morning routes on Sept. 14, 20, 21, 22, 28, and 29; and afternoon route on Sept. 19.
Route 2309: all day Sept. 13 and afternoon routes on Sept. 20, 21, 22, 28, and 29; Oct. 13, 20, and 27.
Route 2310: Sept. 2, 6 and 7.
Route 2311: afternoon routes on Aug. 30 and Sept. 1, 8, 9, and 16.
Route 2312: afternoon route Sept. 12.
While all video footage has been reviewed by PSD and law enforcement, there may be other potential victims. If you have any information about this case or suspect your child may have been physically abused, please contact FCPS Investigator Brandon Wooten at 970-472-3705. Mr. Zanella is presumed innocent unless proven guilty.
PSD takes all concerns around this case very seriously and staff continue to partner with police as they investigate.

I believe the agreement is that we have an over-incarceration problem, and convictions just make it harder for people to find a job which exacerbates the conditions which lead to poverty, homelessness and more crime. Some kind of diversion program is probably the solution here.
A diversion program is probably a good idea. I suggest a diversion program involving the use of a nearby lamp post and a rope, to both keep this guy out of prison and make sure he doesn't have to worry about finding a job after conviction.
