Feds Investigating Hospitals in 2 States That Refused To Perform Life-Saving Abortion

The Department of Health and Human Services (HHS) is looking into two hospitals that refused to perform an abortion on a Missouri woman whose health and life was threatened by the continuation of her pregnancy.
When Mylissa Farmer was just 18 weeks pregnant, her water broke. Farmer first went to Freeman Hospital West in Joplin, Missouri, where staff determined chances were very low that the fetus could be saved and that Farmer could suffer serious complications—sepsis, a blood clot, uterine loss, hemorrhaging, even death—if she continued to be pregnant.
This, however, did not yet constitute the sort of "medical emergency" required by Missouri law to justify an abortion—putting any doctor who performed one at risk of 15 years in prison and the loss of their license. "Missouri law supercedes [sic] our medical judgment," a doctor wrote in Farmer's medical records, according to a complaint filed by the National Women's Law Center on behalf of Farmer. Hospital staff told Farmer she could wait until the situation grew more dire, or travel out of state to obtain an abortion.
So Farmer then went to the University of Kansas Hospital, in Kansas City, where doctors determined that her pregnancy was definitely no longer viable. But doctors also refused to perform an abortion or to induce labor, saying that it was "too risky in this heated political environment to intervene," per Farmer's complaint.
Farmer then traveled to a third state, Illinois, where she was finally able to terminate her doomed pregnancy and save her own life.
On Monday, HHS Secretary Xavier Becerra sent a letter to the hospitals that refused to perform an abortion on Farmer, reminding them about earlier HHS guidance regarding their duties under the Emergency Medical Treatment and Active Labor Act (EMTALA). Last July, not long after the Supreme Court overturned Roe v. Wade, HHS told hospitals that they weren't allowed to deny abortions to women whose life or health was at risk—regardless of what state law says.
This federal guidance combined with state laws prohibiting abortion unless a woman's life is threatened has put hospitals and medical providers in a very difficult position. Perform an abortion to protect a woman's health and they could run afoul of state laws, face the loss of medical licenses and possibly criminal prosecution; decline to perform an abortion and they could be in trouble with the federal government.
While a federal judge last year blocked HHS from enforcing its guidance regarding the EMTALA and abortion, the order only applies in Texas. The Biden administration is currently appealing that ruling. In the meantime, "providers can't assume EMTALA carries more weight than a state ban, at least not until the legal process is carried out," notes Axios.
Now, for the first time since HHS issued that EMTALA guidance last summer, it's investigating hospitals for allegedly violating the law by "not offer[ing] necessary stabilizing care to an individual experiencing an emergency medical condition," as Becerra put it.
The investigation is being led by the Centers for Medicare and Medicaid Services (CMS). "If CMS determines that they are not in compliance, the hospitals could become ineligible for future Medicare funding," Axios points out. Or HHS could refer the case to the Office of the Inspector General for civil enforcement action.
"As we have made explicitly clear: we will use the full extent of our legal authority, consistent with orders from the courts, to enforce protections for individuals who seek emergency care—including when that care is an abortion," said Becerra in a Monday statement. "Today, we send a reminder to hospitals participating in Medicare: you are obligated under EMTALA to offer stabilizing care to patients who need emergency care, and we will not hesitate to enforce your obligations under the law."

The "Kids Online Safety Act" (KOSA) is back and as bad as ever. Supporters of this obviously unconstitutional bill say it would "protect children online and hold Big Tech accountable." But it's simply one more attempt by federal lawmakers to grab control of the internet under the guise of protecting kids. Mike Masnick at Techdirt calls it "unconstitutional nonsense" that would actually harm children while also suppressing a lot of legal speech:
There are vague terms about what creates "harm" to minors, meaning that websites will be pressured to suppress all sorts of content to avoid liability. It will also effectively mandate privacy-invading and problematic age verification technology. Like many other bills, it has a "parental consent" part, which fails to recognize that parents and children (especially teenagers) do not always have a healthy and respectful relationship.
But, to me, the worst part of the bill is the "duty of care" portion. Here's how it's worded. For years, we've explained how a "duty of care" is just a friendly sounding way of forcing censorship on platforms. To understand why, you have to understand how liability works under a duty of care. What it means is that if anything goes wrong after the fact (a child has an eating disorder, dies via suicide, etc.), someone can sue the website and argue they failed in their "duty of care" to protect the child.
But (news flash) even without the internet, people get eating disorders or die by suicide. […] And, with eating disorders, as multiples studies have detailed, attempts to take down content associated with eating disorders or encouraging eating disorders has actually made the problem significantly worse.
Nonetheless, KOSA would impose costly and time-consuming lawsuits on any web platform that someone decided to blame for a minor's mental health struggles or harmful behavior.
Meanwhile, "it will be that much harder for there to be content helping those dealing with suicidal ideation or eating disorders, because even leaving up helpful content, or allowing users to try to help those in trouble will create a massive risk of liability," Masnick writes. "The end result is going to be extraordinarily harmful to children, extremely suppressive of speech, and expensive for all sorts of websites (well beyond the big ones that can afford it)."
"The premise of a duty of care itself is fundamentally flawed," said Ari Cohn, TechFreedom's free speech counsel, in a statement. "Each user experiences content differently, and platforms cannot granularly determine whether content is harmful or preventative with any meaningful precision. The most 'reasonable' and risk-averse course remains to block minors from accessing any content related to disfavored subjects, ultimately to the detriment of our nation's youth."

After reading the story, two things jump out at me, one, the hospital was in the wrong, both on the law and or using the law and there (deliberate?) misinterpretation as an excuse not to do their duty. Second. The youngest infant born alive and survive is currently 19 weeks, at 18 weeks (one week different and fetal aging is not an accurate science) is abortion the only option. The second hospital mentioned inducing labor, so why didn't the first hospital? Is it because the first hospital doesn't have a NICU? And if so, why was she allowed to leave and not offered transportation to a facility with a NICU? The first hospital clearly violated several moral and legal codes/regulations in their actions. Something tells me there is far more to this story than how ENB frames it. I've worked rural medicine most of my career. If you can't provide the level of care, legally you are responsible for arranging proper transfer to a facility that can, i.e. ambulance or air ambulance service. And you are required to provide supportive and emergency care until that transportation is available. This story stinks to high heavens.

As a nurse and mother I can understand the want to do everything to save both patients, but at 18 weeks gestation there are medical and ethical concerns. If the mother is septic then there is no question; do everything to save her. Just because there has been a few cases in the past of a 19 or 20 week fetus surviving doesn't mean that kid is without deficits. The question becomes just because we can, but should we play "god"?
Also a nurse. Don't pull the appeal to authority. And it didn't say she was septic, it says her membranes ruptured which can lead to septicemia. As a nurse I expect you know the difference.

One clear example is judge not allowing questions regarding who is funding her trial. She has already lied in a deposition regarding this, so it would be proof of her character in telling the truth. The judge is disallowing it to be presented.

As others have said, there's an 18 page motion for mistrial that you can look up. If you actually care about THAT, it's not terribly difficult to find. You can do some amount to try to educate yourself. I doubt you're really interested in reading it, though, so giving you a cite doesn't do anything for you.

I would suggest that Mr. Tacopina's request is a direct result of his failure in the cross examination of the plaintiff. This trial will undoubtably end up as a "she said vs he said" case. But I think the defense lawyers underestimate the determination of Ms. Carrol. What I can say is that Carrol and Trump share something in common they both hold a grudge.

The pro women ride 2/3 the distance of the men and still only manage 85% of the speed of the Pro men. Note, the best women racers race against the men in training.

The Delaware Way is all about putting a positive spin on bi-partisan political corruption to explain how things are done. But Chicago is long past that. That’s what Chicago was told to believe decades ago, what we used to tell ourselves about the grease lubricating “the city that works.” It was the price we thought we paid to make the machinery run.
But now it lubricates nothing. There’s no longer machinery in Chicago sensitive to the people and working to serve them. All that remains is debt and the exercise of power and perpetual grift.
The Daley Machine and the general corruption surrounding Chicago politics, like a lot of other early-mid-20th century Democratic urban machines, was still based on the principle that there had to be value for the payoff. You still had to have a city that functioned properly on the day-to-day stuff, because a functional city will ultimatley provide better payoffs on the backend.
This model started to deteriorate in the 1970s, briefly came back in the 1990s-early 2000s thanks to the governance model of Guiliani as a well as the Clinton Machine Democrats. Modern Democratic machines since the Obama era started don’t bother with any of the machinery of city government. Like all marxists, they think it just happens by magic if you have enough money, and thus operate on the principle that you need to grab as much as you can while you’re in office. If someone or something brings any kind of negative attention to their incompetence, they whine that they’re being oppressed by systemic power structures; not surprisingly, they’re almost all minority/female/queer leaders these days. The white males in this system are a bit better at deflecting the arrows, but that’s damning by faint praise. These people are basically doing the urban equivalent of eating the community’s seed corn, and the sloughs of despond that are modern US cities are the result, where the air reeks of human desperation, urine, and fecal matter.

The Daley machine literally got it's start based on a Mayor whose administration ineffectively plowed the streets during a particularly bad Chicago snowstorm, stranding thousands of residents.
That was actually the end of the first machine. in 1979, Michael Bilandic (who had taken over from King Richard I when he died in office) was running for mayor against Jane Byrne. At that time, there were three massive snowstorms in a row, and the city could not keep up with the plowing. Add in to that the CTA L skipping stops and that people were told to take their cars to unplowed lots so the streets could be cleared. Byrne, rightly, made political hay out of it by doing a commercial in front of one such unplowed lot. She went of to win the election, and was bounced out in 1983 by Harold Washington.
This machine was originally put together that Anton Cermak in the 1920s/early 1930s. This was the same mayor assassinated in 1933 while riding next to FDR in Miami. There are those who believe Cermak was the target, not FDR.

What piqued my interest were two operations, in particular: People’s Unity Platform and Journey for Justice Alliance. As if you can’t tell by their titles, each is concerned with more Left-leaning ideals.

The Journey for Justice Alliance, formed in 2012, has an educational mission to ensure that only pubic schools exist. Their belief is that doing so will be the only way to support just and equitable education for all. Apparently, the CTU’s insistence on keeping CPS schools closed during Covid warrants the idea that charter schools, parochial schools, and private schools be banned from discussions to better children’s education.

Personally I oppose both unrestricted abortions and outright bans on abortions. Neither the Pro-Abortion or the Anti-Abortion side is completely virtuous and are fundamentally dishonest, however both have valid arguments amongst their propaganda.
Striking down Roe v Wade was a good decision. Returning the abortion discussion back to the states is a good thing. Writing laws for an outright ban of abortions or unfettered access to abortions are misguided reactions.
Setting some limits in the 15 week time frame with procedures to account for certain circumstances seems reasonable. At 15 weeks, consideration of the rights of the infant in the womb should carry more weight in the decision.
Setting the time to consider the rights of the infant in the womb after deliver defies scientific reality. Setting the time at conception is hostile to the rights of the mother.
There are the rights of at least two humans to consider, but related to the two most affected the mother and infant should be measured on a sliding scale.
Early in the pregnancy the rights of the mother should carry more weight, but late in the pregnancy the rights of the infant should carry more weight.
Using simple math, a pregnancy is typically 38 month. If you divide 38 by 3 there is approx 13 weeks in each third.
First Trimester: Abortions allowed (roughly weeks 1-12)
Second Trimester: Abortions are limited (roughly weeks 13-26)
Third Trimester: Abortions are illegal (roughly weeks 27-40)
The debate should be about the rules within the Second Trimester and not within the First and the Third Trimester.
