No, You Don't Have a First Amendment Right To Get Your Speech Aired on Cable News
On Tuesday night, Trump spokesperson Liz Harrington made the baffling claim that, if mainstream news channels failed to air the former president's campaign announcement in full, it would mean that "we do not have the First Amendment."

It seems obvious that a cable news channel choosing not to show a lengthy speech in its entirety does not violate the First Amendment. However, Liz Harrington, a spokesperson for former President Donald Trump, hasn't seemed to have gotten the memo.
On Tuesday night, Trump announced his 2024 presidential run in an hour-long speech from his Mar-a-Lago residence. In the lead-up to the speech, Harrington appeared on right-wing news station Real America's Voice. During the discussion, host Steve Bannon asked Harrington if stations like Fox or CNN are going to "cover this live" or "still going to try to embargo" the speech or "shut him down."
"They don't want the American people to hear directly from the biggest leader of the greatest political movement in our history," Harrington replied. "So I do suspect they'll try to censor and cut away. However, the people are anxious to hear from him. So they will go right around the major networks if they do indeed cut away… because that's what you have to do now. We do not have the First Amendment, it's under attack."
That assertion is plainly incorrect. Not only is it obviously true that failing to cover a political speech in full—especially to cut away for political commentary—is a normal feature of cable news, but such a practice is also hardly in violation of the First Amendment.
"Fox News, MSNBC, CNN, and other media outlets aren't the government. They're private entities with their own First Amendment rights to decide what content to air. The true attack on the First Amendment would be taking away that freedom," Aaron Terr, the director of public advocacy at the Foundation for Individual Rights and Expression, tells Reason. "Of course, that doesn't mean people can't or shouldn't criticize what they perceive as unfair media bias. The First Amendment protects that too."
While no television news network is in danger of violating the Constitution for failing to air an uninterrupted Trump speech, Harrington's legal gibberish portends the low quality of discussions to come during Trump's third presidential campaign.
"It's important for Americans to have a correct understanding of the meaning of the First Amendment," Terr tells Reason. "And it's not helpful when people invoke it inaccurately for narrowly political or partisan ends."

I'm pretty sure the 'First Amendment' never existed until Trump verified that it's great. So I will believe whatever Trump defines it to be.

Trump's campaign says that showing sports instead of Trump speeches is illiberal abuse of the First Amendment. Don't forget that: Trump wants to stop the NBA, NFL, and NHL being televised. Obviously Nascar, too. He wants you to watch Trump speeches on repeat.

Explanation so you can become a bit more libertarian (hopefully): while you are correct that there is not a literal Constitutional or natural right to have your opinions broadcast by private organizations, it is also correct that a society that does not appreciate or respect Enlightenment-era values will not vehemently defend said rights and regularly attack them. This is why there are so many blatantly illegal and unconstitutional restrictions against 2A, even though "shall not be infringed" cannot be made any clearer.
Trump spox is completely correct to say that the lack of respect for speech in refusing to air such an important announcement shows these orgs couldn't care less for 1A. Freedom of speech is about freedom only at face value. This is a common Democrat/leftist tactic to pay lip service to rights without appreciating the spirit of the law. Also the idea that the only natural rights we have are the ones codified in law, even though the founding fathers were very explicit in their debates about writing a Bill of Rights that they did not want anyone to misinterpret that the only rights possessed by the American people are ones codified. Some of the founders even opposed the Bill of Rights because they thought there was no need for it! 1A has just as much to do with informing the American public. This is why the Federalist Papers were written. The founders knew the public had to be informed. When the press, public or private, refuses to inform the public, we do not have 1A.
It would go along ways if anyone cared to hold specific congressmen accountable for their OBVIOUS attempts at abridging the Press (i.e. Censoring Trump). For F'Sakes their criminal intents are documented.
I might be wrong, but I think she means that they're going to edit Trump's speech like a Zimmerman phone call. That might not be an infringement of the 1st amendment, but it is disgustingly partisan and inherently dishonest.
Amusingly, the people abusing the 1st amendment here are the journalists but that's really nothing new now is it. They can make it sound or look like Trump is saying something entirely different than what he's saying, but this is of course not misrepresentation or anything icky like that.
The irony, of course, is that Trump is more than capable of beclowning himself without outside help. If they really wanted to silence him, they should just let him speak.
Of course it isn't a first amendment issue. But they are trying to avoid giving exposure that could be positive to a major politician who is apparently running for office again. Whatever you think of Trump, that doesn't seem like the actions of an honest and impartial media.
