FDA Approves Novavax COVID-19 Vaccine, but Feds Undecided on Who It's for

Plus: The story of a 10-year-old rape victim who sought an abortion is confirmed, inflation hits a record 9.1 percent, and more...

The Novavax vaccine | Utrecht, Robin/ZUMA Press/Newscom
The FDA has approval the Novavax vaccine for emergency use. (Utrecht, Robin/ZUMA Press/Newscom)

The Food and Drug Administration (FDA) has granted emergency approval to the Novavax vaccine, which is distinct from the Pfizer and Moderna vaccines in that it does not use mRNA technology. Federal health officials hope that some Americans who remain unvaccinated—about 22 percent of all people in the U.S.—will be more comfortable opting for the Novavax vaccine.

The Novavax vaccine will also be a strong option for vaccinated but unboosted Americans. According to The New York Times, the side effects of the Novavax vaccine appear to be milder than the other vaccines, which produce aches and fatigue in many people.

Even so, federal health officials have yet to determine who the vaccine will be for.

"Advisers to the Centers for Disease Control and Prevention will meet next week and are expected to discuss who should get the Novavax vaccine," the Times reported. "The two-dose vaccine was authorized as a primary immunization series for adults, rather than a booster, which is likely to limit its market at first."

Meanwhile, the BA.5 variant of COVID-19 is spreading, causing cases to rise throughout the country. The variant has a high rate of reinfection: People who previously recovered from COVID-19 are contracting it. This has translated to an increase in hospitalizations, due to the sheer number of vulnerable people contracting the disease—but importantly, the variant has not caused a spike in deaths.

The disturbing story out of Ohio that a 10-year-old girl had sought an out-of-state abortion after being raped was confirmed on Wednesday.

The story initially went viral on social media and was even mentioned by President Joe Biden as a reason to oppose the new strict limitations on abortion that Republican-controlled states are implementing. In attempting to confirm it, The Washington Post cast some doubt on whether the story was actually true; Post fact-checker Glenn Kessler could find no evidence that such a crime had actually been reported to the authorities. In response, some conservative media figures began to openly doubt the allegations. A Wall Street Journal editorial described it as "An Abortion Story Too Good to Confirm."

It is now confirmed.

Columbus Dispatch writers Bethany Bruner, Monroe Trombly, and Tony Cook reported that police have arrested 27-year-old Gerson Fuentes for the crime:

Gerson Fuentes, 27, whose last known address was an apartment on Columbus' Northwest Side, was arrested Tuesday after police say he confessed to raping the child on at least two occasions. He's since been charged with rape, a felony of the first degree in Ohio.

Columbus police were made aware of the girl's pregnancy through a referral by Franklin County Children Services that was made by her mother on June 22, Det. Jeffrey Huhn testified Wednesday morning at Fuentes' arraignment. On June 30, the girl underwent a medical abortion in Indianapolis, Huhn said.

Huhn also testified that DNA from the clinic in Indianapolis is being tested against samples from Fuentes, as well as the child's siblings, to confirm contribution to the aborted fetus.

It was not insane to approach the story with some skepticism, given that its single source was someone with only secondhand knowledge of the circumstances. But it is now known that the horrible occurrence was regrettably very real.

Wasn't unreasonable to be a little wary of the story of a raped 10-year-old traveling out of state to avoid govt making her carry her rapists' baby when there wasn't confirmation.
But now there is.
If you told yourself it was made up, time to face what these new laws really do. https://t.co/24niUBQy15

— Nicholas Grossman (@NGrossman81) July 13, 2022

Fuentes is believed to be in the U.S. illegally, which is now likely to become the main focus of the conservative response to the story.

A look at the goods hit by inflation. Inflation just hit its highest point in 40 years. According to the consumer price index, prices are up 9.1 percent since this time last year.

Gas price increases were largely responsible for the trend. The price of gas increased by 11 percent since last month and nearly 60 percent over the last 12 months. Food and rent costs also rose precipitously.

Biden said in a statement that fighting inflation was his "top economic priority," but also contended that the numbers were "outdated" and that the price of gas is now falling.

Inflation woes have prompted Sen. Joe Manchin (D–W.Va.) to swear off any new federal spending due to concerns that the government pumping more money into the economy would only exacerbate the problem.

"No matter what spending aspirations some in Congress may have, it is clear to anyone who visits a grocery store or a gas station that we cannot add any more fuel to this inflation fire," said Manchin.

One encouraging note: Costco is refusing to raise the price of its iconic hot dogs.

In an interview Monday on CNBC's "Squawk on the Street," CEO Craig Jelinek had a one-word answer when asked whether he would raise the signature food court item's price: "No."…

The hot dog and soda combo has sold for $1.50 for decades, and was the subject of a Mental Floss article from 2018 that recently began circulating again.

The article recounts a time when Jelinek approached Costco co-founder and former CEO Jim Sinegal. He told him the company was losing money over the iconic food item.

"I came to (Sinegal) once and I said, 'Jim, we can't sell this hot dog for a buck fifty," Jelinek said, according to the Mental Floss article, which cites 425Business. "We are losing our rear ends.' And he said, 'If you raise (the price of the) effing hot dog, I will kill you. Figure it out.' That's all I really needed."

That the arrest only came after conservative media was asking why no arrests if she was raped?

It's also pretty strange that some guy came out of the woodwork and confessed to a serious felony just as the story was falling apart.

Well golly. Is that particular detail of the law written in invisible ink and locked in the AGs political campaign office? Or is part of the law that doctors themselves are able to find out.
Because that AG also kept explaining how all rape investigation and lab evidence goes through his office - so therefore he knows all the legal processes re rape - and therefore if he doesn't know or want to know something then someone else is lying - until AFTER the munis actually arrested a suspect.

The way I hear it, all conceptions seem to be immaculate, since the unwilling pregnant people are so unhappy and surprised.

        2. MatthewSlyfield   3 years ago

Also, I read something where the Ohio AG said they have a rape/incest exception, so she shouldn't have had to travel out of state to get an abortion.

          1. JFree   3 years ago

The Oho AG is lying. There is no such exception. He was perfectly happy to previously assert there was no such exception before an actual case popped up. And now he is content to lie. And you are content to lie.

            1. Spiritus Mundi   3 years ago

The exception was for the health of the mother. A pregnant 10 yo is considered a hazardous pregnancy and has a medically necessary exception under Ohio law.

              1. JFree   3 years ago

Ah ok. Well what about an 11 year old? Is that the age of medically normal by default pregnancy in Ohio?

I'd be more comfortable if you all weren't so willing to lie about the circumstances and consequences of a kid being raped.

There is a good reason that no one should ever support whatever issue/policy you assholes are willing to lie about. And your ilk attitudes about abortion are about to hit that backlash

                    1. Red Rocks White Privilege   3 years ago

I'd be more comfortable if you all weren't so willing to lie about the circumstances and consequences of a kid being raped.

You're the one imposing ridiculous assertions about what constitutes a hazardous pregnancy.

There is a good reason that no one should ever support whatever issue/policy you assholes are willing to lie about. And your ilk attitudes about abortion are about to hit that backlash

Screech all you like, that doesn't change the fact that abortion with no restrictions has never gotten more than 20% support even after 50 years of Roe. The vast majority (i.e., not you) support at least some restrictions on the practice, even if they support abortion as a general policy.

Maybe your ilk should stop lying that abortion all the way up until the feet emerge from the magic birth canal has majority support.

                    2. JimboJr   3 years ago

"that doesn't change the fact that abortion with no restrictions has never gotten more than 20% support even after 50 years of Roe."

This. The lefties like to tout that "complete ban on abortion has extremely low approval, only 15%" without telling you that completely unrestricted abortion has a very similar, very low approval.

They obfuscate and try to pretend the majority group that essentially aligns with "legal, safe, rare" and reasonable restrictions are lumped in with the no restrictions group. They absolutely are not.

It would be like lumping in the majority group that thinks trans weirdos shouldn't be physically harmed or harrassed with the group that thinks its a good thing to introduce trans weirdness and talk about sex acts with kindergarteners.

These groups are absolutely not the same, and the overlap is significantly smaller than the lefties gaslight they are

                    3. Red Rocks White Privilege   3 years ago

They obfuscate and try to pretend the majority group that essentially aligns with "legal, safe, rare" and reasonable restrictions are lumped in with the no restrictions group. They absolutely are not.

Like I've pointed out before, I don't agree with the "every sperm is sacred" types, and think there needs to be some actual scientific discussion as to when a fetus becomes a conscious being, in order to determine when it's actually deserving of legal protections. If people can be charged with unlawfully terminating a pregnancy when they kill a pregnant woman or cut out the infant against her will, then there's an assumption of legal protections there already that deserve a broader discussion as to when that should happen across the board, and what kind of exceptions might be made.

However, at least the fundies will take a hard stand on when they think life begins, and so will the majority of abortion supporters, since they think some kind of restrictions should be imposed, whether it's at the first trimester, second one, or whatever. The abortion maximalists, however, will wave their hands and cause misdirection, because the second they acknowledge that their position is the minority one, they know they've lost the argument.

Can't you hear Trump blowing the dog whistle?

It is possible that that was what Trump was trying to do, but there is does not seem to be anything he explicitly said that can be considered an order to the protesters to invade the Capitol. The committee is assuming that there must be some evidence because they know what was really going on inside Trump's head.

        1. Ronbback   3 years ago

Even if he ordered a protest that is also legal

          1. Derp-o-Matic 6000   3 years ago

He didn't "order" it, though. First of all, he is free to organize a protest, just like any other politician, and people can choose to show up or not. Second, as I recall, there were various groups ranging from "somewhat conservative but concerned about the election" to "crazy right-wingers" planning to show up in DC to protest that day.

Literally hundreds of thousands of people showed up. The coverage of January 6 constantly ignores that detail. This was one of the biggest protests in DC in decades. It wasn't just some small cabal of Trump foot soldiers or whatever nonsense they're trying to convince people.

        1. markm23   3 years ago

If you're paying Costco's $60 a year membership fee just for the cheap hot dogs, you'll have to eat an unhealthy amount of hot dogs to break even. If you're also shopping in Costco, they expect to make far more than they lose on the hot dogs from your purchases.

Loss leaders aren't at all uncommon. Some supermarkets have been pricing milk below cost to draw in customers ever since supermarkets were invented. The Alsup's convenience store/gas station chain used to set the price of gasoline 1 cent lower than the nearest competitor to draw in more customers for the food - that isn't losing a lot, but gas stations are so competitive in normal times that if it was possible to drop the price a cent and still make a profit after overhead, they'd all do it.

"Ohio man" - ok, I guess that's true? Uncertain though, because he's an illegal immigrant.

      1. Nardz   3 years ago

Collectivistjeff thinks he's got a gotcha.
        Collectivistjeff isn't bright.

The really sick thing is how much leftists/journalists celebrated the fact that a 10 year old girl really was raped and impregnated.

        1. JesseAz   3 years ago

And yet the entire story they initially pushed is still wrong since she could have gotten the abortion in Ohio still.

        2. Social Justice is neither   3 years ago

And before that they were celebrating the Dr. Who helped dispose of the evidence.

    2. Super Scary   3 years ago

      Republicans (will probably) pounce!

    3. Diane Reynolds (Paul.)   3 years ago

The "conservative media" have two talking points: Illegal immigrant AND the fact that the Ohio law wouldn't have prohibited her abortion.

      1. Moonrocks   3 years ago

Yeah, but leftist media is going to ignore the latter so they can pretend they got this one right.

    4. Earth-based Human Skeptic   3 years ago

Let's see. The original (D) narrative: A ten year old girl got raped (a terrible thing) and had to travel out of state for an abortion (a devastating, civilization-ending, evil incarnate thing).

Now the true story seems to be that a ten year old girl got raped by an illegal alien, who is possibly her relative, a doctor (and presumably other people) declined to report the rape, and the abortion was probably available locally.

So let's refocus the narrative on how conservatives will fixate on the illegal alien.

      1. JesseAz   3 years ago

They already dropped the J4 shooter from the news after his antifa leanings showed up.

Could you blame conservatives for using progressive "logic"?

      1. A gun (illegal alien) did a terrible thing.
      2. All guns (illegal aliens) are dangerous and evil.
      3. Get rid of all guns (illegal aliens)!

      1. I, Woodchipper   3 years ago

Except being an illegal alien is not a constitutional right.

        2. Á àß äẞç ãþÇđ âÞ¢Đæ ǎB€Ðëf ảhf   3 years ago

Ummmm .... RKBA is not a constitutional right. It is a human right, a natural right, protected by the Constitution.

And immigration control is nowhere in the Constitution. Aren't libertarians supposed to believe in a government limited to enumerated powers?

          1. JesseAz   3 years ago

Go fight it in court. The precedent for federal immigration has been seen since the constitution was written.

              1. Uilleam   3 years ago

His point and yours are not mutually exclusive. You can advocate both legal immigration and limited government.

              2. JesseAz   3 years ago

I do, except the link actually states where the powers came from and the founders were apparently in agreement with that interpretation since, as I stated, it has been the precedent since the constitution was written.

          2. I, Woodchipper   3 years ago

I mean, i'm all in favor of extremely loose immigration laws but.. comparing the issue of 'illegal aliens' to 'guns' is fucking retarded and one big reason is that the constitution, (yes it is written by and enforced by big guv statists ) does not recognize the right to freely cross into the territory of the USA, whereas it does recognize the citizens' right to keep adn bear arms, both implicitly and explicitly in the 2nd amendment.

            1. Á àß äẞç ãþÇđ âÞ¢Đæ ǎB€Ðëf ảhf   3 years ago

Show me where the Constitution recognizes the right to marriage, or living indoors.

Next show me where it authorizes the government to control immigration. Do you support a government of limited enumerated powers? Or only when it suits your goals?

              1. I, Woodchipper   3 years ago

                You misunderstand the constitution then.

It implicitly recognizes ALL your rights by virtue of the fact it is only providing for limited and enumerated powers of the government.

Not only that, it further goes on to EXPLICITLY enumerate some of your rights that are extra important and should not be overlooked, such as free speech, keep and bear arms, right to be secure in your person etc.

Then it goes even FURTHER and add not one but TWO explicit amendments, the 9th and the 10th, that reiterate the fact that any thing any one can think of as a right is protected and the governmetn cannot infringe them except with the powers and scope explicitly listed here in this consitution.

So yes, the right to marriage and living indoors is definitely protected by the consitution. So is the right to just about everything they have made illegal today! The vast majority of the federal governments' reach and operation is unconstitutional in my opinion.

The rights of foreigners to cross over the border willy-nilly is not protected by what i just described. It is a quite different issue and you know it..

Zero proof of that, either. When asked about that specifically, the doctor refused to answer. And has a history of not reporting underage abortions.

        1. JFree   3 years ago

You're right. The rape was not reported. Instead, the authorities just rounded up the usual suspects on their Friday night roundup. Bludgeoned an illegal into confessing to a rape the authorities didn't know about. And then searched social media for someone who claimed they were raped around then. And then bludgeoned everyone into making sure all the narratives could work. Then arrested the suspect.

You are CLUELESS as to how the economy works. With inflation, either Costco is going to have to raise the prices, or find cheaper parts that will inevitably reduce the quality of their products. This is what exactly happened in the Soviet Union. What part of that do you not understand?

        Not true

The United States federal excise tax on gasoline is 18.4 cents per gallon and 24.4 cents per gallon for diesel fuel.[1][2] The federal tax was last raised October 1, 1993 and is not indexed to inflation, which increased 93% from 1993 until 2022. On average, as of April 2019, state and local taxes and fees add 34.24 cents to gasoline and 35.89 cents to diesel, for a total US volume-weighted average fuel tax of 52.64 cents per gallon for gas and 60.29 cents per gallon for diesel.[3]

"Fuentes is believed to be in the U.S. illegally, which is now likely to become the main focus of the conservative response to the story."

    Stop deflecting.

The rape and pregnancy are unfortunately confirmed, but that still doesn't explain why the child was taken to Indiana when she would have been able to get an abortion under Ohio's law. Ohio has an exception not just for life, but for health as well, so there's no reason why the child had to go to Indiana.

By shifting focus to what you think conservatives are going to focus on, you're ignoring what they're ACTUALLY focused on- that this story still misrepresents Ohio's law, and that does a huge disservice to women in Ohio.

    1. damikesc   3 years ago

The Left will happily kill people to protect their narrative.

    2. Cronut   3 years ago

The story also says he's been in the US for 7 years. So, he just randomly decided to rape a 10 year old girl this June, and has never raped or assaulted anyone other children during those 7 years?

People don't just randomly decide to rape children. Chances are, he's been raping- or at least molesting- children long before this. People don't just wake up and decide they're violent pedophiles on a random Tuesday morning.

      1. damikesc   3 years ago

        I dunno.

"Hmm, do I want to open a food truck...OR do I want to rape underage kids" seems to be the fundamental debate illegals must have.

I'm saying, if he's a pedo, he's always been a pedo. There are probably other child victims out there.

          1. JimboJr   3 years ago

but those victims weren't useful to the dems at that time, because highlighting them at that time would also put a spotlight on an illegal pedo rapist.

THIS IS WHY ILLEGAL IMMIGRATION IS BAD, ELIZABETH. It creates an underclass of shadow people who fear deportation, and are easily victimized by predators.

      1. The Team Struggling   3 years ago

Like, levels of immigration are actually not directly connected to the process of immigrating if we're willing to say no to people. We could do so much to simplify the process and make it more clear and then talk about numbers and things like that.

      3. mad.casual   3 years ago

And what's the legal status of the parents of the child? Is this a large community of illegal aliens?

It's there for you to parse Cronut. Fuentes is almost certainly a male relative of the victim. Key features (aside from general background 'Stranger Danger!' statistics Reason quotes ad nauseum):
-No known address means Fuentes wasn't a frustrated cop or a skiddish pastor or sexy teacher or some other authority figure or pillar of the community that people would otherwise (auspiciously) trust their kids with. He shouldn't have had access unless he was otherwise known to the family.
-No known address and getting picked up in the area (assuming he's not a scapegoat) means he's likely got ties to the community. At least, he up and left Guatemala for whatever reason but, despite having committed a rape, didn't leave OH.
-Testing the remains *and siblings*. If he were a random stranger or a teacher or whatever, there would be no reason to test the siblings. The only reason to test the siblings is to rule them out and make his paternity more clear. The only way that works is if her siblings are related to him (and also potential suspects).
-Despite all of the above, multiple rapes (according to confession) and 6 weeks between a rape and the abortion. So, Fuentes didn't just rape her an leaver her in a back alley for someone to find, figure she was fine, and discover a 'bump' 6 weeks later. He was able to rape her and remain present to enforce her silence until the bump became obvious.

It creates an underclass of shadow people who fear deportation, and are easily victimized by predators.

More specific to ENB's sensibilities; for the vast majority of human and even primate species' history males have been the physically dominate gender, sweeping away large swaths of culture enables a return to more primal arrangements. Rule of law vs. rule of men vs. rule of jungle.

I, of course, don't know anything for certain. Maybe Dad was at work and the girl was raped by a brother and Dad is trying to shield him. Regardless, tell the 10 yr. old girl who got raped that her borders are just abstract social constructs or figments of peoples' imagination.

        1. Cronut   3 years ago

          Exactly.

The whole story is revolting. One of the things that stands out to me, as the parent lf girls, is that when girls first start getting their periods, they're not regular. They don't have clockwork 28 day cycles. It's not at all unusual for a girl who just started menstruating to go more than a month between periods. So, unless you took her to the doc for something else, why would you assume she was pregnant? Docs are mandated reporters, so if the doc found the pregnancy, I assume the doc would report it as required. But the mother made the report, not a doctor.

So, two questions. Did a doc not report to child rape as required, which is a huge fucking problem, or did the parents know she was being sexually abused and assume she was pregnant because she was being sexually abused?

Like you, I know nothing for certain. But there's a lot of questions about what the hell lead to a 10 year old girl getting an abortion, and an arrest made three weeks later and only after the story came out?

    5. MatthewSlyfield   3 years ago

"but that still doesn't explain why the child was taken to Indiana when she would have been able to get an abortion under Ohio's law."

It was likely done so the family could keep anyone else in their community from finding out.

But then the abortion provider blabbed in and effort to make it about Dobbs.

      1. Nardz   3 years ago

She's an activist with something like a dozen media appearances in the weeks prior to the story about the girl.

      2. Social Justice is neither   3 years ago

It would also confound law enforcement since the states don't share all reporting.

        1. mad.casual   3 years ago

I'm not entirely convinced this isn't specifically the case. Not because of abortion or Dobbs, but because the victim's relationship to her attacker, and likely her mother, is complicated even without her Dad being an illegal immigrant.

Even assuming no guilt and/or some guilt-obliterating tragic story between the victim and Fuentes, that pretty much means this was deliberately set up to be a hush-hush situation and Dr. Bernard is only slightly less unscrupulous than your average coyote and threw them under the bus.

    6. BestUsedCarSales   3 years ago

Even that's kind of shifting the blame. Should Ohio have been able to have their law? Is this a state issue or not? I know Reason is taking a purely consequentialist stance now, and believes that children have limited to no value, but don't fall into their argumentation.
Colorado will almost certainly continue to allow late-term abortions as well. I find this to be despicable but it is a question for their state to make those rules.

      1. Cronut   3 years ago

Good point. States have a right to make whatever laws they want about abortion.

        1. BestUsedCarSales   3 years ago

Maybe Ohio will change it's law and add a rape and incest exception. I don't know. It's not an absurd stance for them to not include one though. It's consistent with the idea that the baby is a human with rights as well. But maybe Ohio doesn't actually want that. Maybe they'll give exceptions for extreme cases like this one (and it is an extreme case, as much abortion discussion loves to focus on the extremes).
The voters of Ohio can argue over this and they'll slowly arrive at some position that pisses everyone off, but not enough to fight about it more. Same story everywhere. It will probably arrive even sooner due to the fact that people will just be able to go over a state to get an abortion still.

          1. mad.casual   3 years ago

As we've seen elsewhere, there's nothing that stops a DA or AG from simply not prosecuting, throwing a case, or pleading out a sweetheart deal. Or even a Governor from stooping down and granting executive clemency. It's all a bit harder since the victim was transported across state lines but, still, pretty sure your local DA, AG, or Governor doesn't want to see pictures of a 10 yr. old girl in handcuffs or crying on behalf of the Dr. that helped her on the cover of his local newspaper. Making them (the AG and LEOs) look like asshats by blabbing the story to the papers first and LEOs second doesn't help things at all.

      2. mad.casual   3 years ago

I know Reason is taking a purely consequentialist stance now, and believes that children have limited to no value, but don't fall into their argumentation.

Yeah, my line of thinking is/was like this: Anyone who thinks the worst part of this little girls' ordeal was the 2 hr. trip from OH to IN needs to be raped a couple times by one of their male relatives and giving them the option of getting immediate treatment rather than waiting 6 weeks would be relatively merciful.

The entire brief is really just a reiteration of the same tired argument that the bloviations of a Senator are equivalent to a direct threat that impermissibly violates the Constitution. This is just absurd.

So if a Senator says, "I think Facebook should do more to censor misinformation", that is equivalent to the Senator directly threatening Facebook to censor on behalf of the government? Really? What about the Senator's freedom of speech here? Is he not allowed to state his opinion on a matter and not have it construed as some type of ominous threat?

If we follow this legal theory to its logical conclusion, it would mean that it would be unconstitutional for any Senator to criticize any business at all.

      1. I, Woodchipper   3 years ago

The entire brief is really just a reiteration of the same tired argument that the bloviations of a Senator are equivalent to a direct threat that impermissibly violates the Constitution. This is just absurd.

It is not absurd. It's the equivalent of "nice store you got there would be a real shame if Mario and Paulie burned it down."

Only in this case the threat is coming from the biggest gang there is. it's definitely a threat of government action if you dont mollify the Senator. Only a blinded partisan could be able to miss that.

Thought experiement: Flip the principals. Right wing website that bans all pro-choice and pro-union talk etc and Trump sends them a threatening letter. I know you can do it!

        1. chemjeff radical individualist   3 years ago

It is not absurd. It's the equivalent of "nice store you got there would be a real shame if Mario and Paulie burned it down."

OR, it is the equivalent of expressing an opinion of "I think Facebook should do more to censor misinformation" without any threat implied at all.

Thought experiement: Flip the principals. Right wing website that bans all pro-choice and pro-union talk etc and Trump sends them a threatening letter. I know you can do it!

It's still not unconstitutional because a "threatening letter" is not the same as a formal government action.

Thought experiment for you: Suppose you are Liz Warren and you want Facebook to crack down on misinformation online. Based on your standard, what public comment could you make, in any context, that would criticize Facebook or urge them to censor misinformation in some way, that would NOT be an unconstitutional threat?

          1. JesseAz   3 years ago

You understand there is a long history of government coercion cases that exist right? So you don't have to prove your ignorance here.

            You didnt read the brief.

            1. chemjeff radical individualist   3 years ago

I read the brief. There is absolutely nothing in that brief that constitutes the government formally ordering or directing any private company to censor anything.

The entire thing is just bitching about Section 230, and a compilation of senators bloviating about social media.

              1. Mother's Lament   3 years ago

"There is absolutely nothing in that brief that constitutes the government formally ordering"

Note how Lying Jeffy snuck "formally" in there, despite Woodchipper's actual point being that this breaks down to "nice store you got there would be a real shame if Mario and Paulie burned it down."

Again, stop arguing from ignorance. Prof Volokh has quite a few panels he has posted regarding this.

You did not read the brief. Because it explains cases that show this.

          2. I, Woodchipper   3 years ago

Any involvement in commerce is a violation of the constitution and senators should keep their fucking mouths shut about the businesses of the free citizens of the USA.

So that's where I stand. And yes, any Senator commenting on the business practices of any business is a fucking threat of federal power being used against it.

            1. chemjeff radical individualist   3 years ago

and senators should keep their fucking mouths shut about the businesses of the free citizens of the USA.

So if Trump's, "Arrive early. Huge crowds expected" is a call to violent insurrection, that Senator could easily be construed as asking for censorship on behalf of the government.

"So if a Senator says, "I think Facebook should do more to censor misinformation","

That's just what the Senator said publicly.

"that is equivalent to the Senator directly threatening Facebook to censor on behalf of the government?"

We have no idea what the Senator may have said to Facebook privately. That there should be discovery on this issue is not absurd.

I'm opposed to my government throwing money at problems in a panic. Doesn't matter whether it's a vaccine to prevent a pandemic or a bank that's too big to fail or an automaker that overleveraged itself or a shit-ton of poor people who ate their way into diabetes and heart disease and can't insure their way out. It's a fantastic way to abjectly and permanently warp people's perceptions and produce abjectly terrible solutions and firmament them for all of time.

In addition to my childhood vaccines, my HepB and TDAP are up to date, which most adults can't say. I'll get the shingles vaccine in a few years as I fall into the recommended demographic. I'll almost certainly never get a COVID nor an HPV vaccine, and probably never on influenza. I'm undecided, but leaning towards, probably for Pneumonia vaccine(s).

  35. Thomas L. Knapp   3 years ago

I'm a clinical trial volunteer (aka "guinea pig") for the Novavax vaccine.

One reason THE AUTHORITAHS are hopeful that it will encourage more vaccinations is that it is not (like Pfizer/Moderna) a "messenger RNA" vaccine. It's an older technology, "protein subunit," used in several other vaccines. So people who are skeptical of mRNA's possible side effects might be interested in this one.

Anecdotally, I think it works. There are five people in my household. Recently, four of them fell ill and tested positive for COVID-19. Despite spending the entire week surrounded by COVID-19-positive people in a not terribly large dwelling, I never got sick and never tested positive, unlike the one un-vaccinated person and the three Pfizer-vaxxed-and-boosted people.

The issue they will have is that they lied, frequently, about the prior vaccines. Even if this one is pure as the wind-driven snow --- so many lies about the other ones have been told ("The vaccinated cannot transmit it", for example)...it is going to be a challenge to trust their word.

      1. Red Rocks White Privilege   3 years ago

Sure, but a lot of the vax-skeptics have been pretty explicit about the fact that they won't take the ones currently available. That's where I've been. If it's essentially the same as the flu vaccine with annual updates then I might get it. Of course, I don't get the flu shot most years and have only gotten it a few times since I stopped working at a retirement home 10 years ago.

  38. Big Chief   3 years ago

Robby - The story about the raped 10 year old going around was that she COULDN'T get an abortion in OH. From what I've seen that part seems to be false. I've only seen a few pundits address it, most seem to ignore that part of it. But that was ultimately what the story was about, that new post-Roe laws would force her and others in a like situation to carry the child to term. It's sad the incident is true, good the perpetrator was arrested, but is it true that the family was forced to go out of state because of current OH law?

    1. Earth-based Human Skeptic   3 years ago

Even if that part is not true it has to be true because the true narrative tells us what is true.

    2. Gaear Grimsrud   3 years ago

A pregnancy clearly is a threat to the life of a 10 year old girl. It's an exception in my Ohio as I understand it. The story actually has almost nothing to do with abortion law.

    3. Spiritus Mundi   3 years ago

Still got the abortion didn't she. I don't see what the problem is. People have to put in a little more effort? The horror!

      1. mad.casual   3 years ago

And not even really that much more. There are plenty of places *in IN and OH respectively* where you have to drive just as far if not further to get less routine and more critical care.

Sorry, we're not disrupting the amber waves of grain so that abortion clinics can be more numerous and accessible than highway rest stops. Maybe focus on preventing the rape of a 10-yr.-old girl instead.

    4. BestUsedCarSales   3 years ago

I don't really know, though I don't think it changes much. If Ohio didn't have a rape/incest exception that's their state's prerogative and is probably more logically consistent anyway.
Someone in NY being mad about what's going on in Ohio isn't that meaningful. The same is true in reverse. There are extremes where this is not true, but in general each state doing things is that states business.

    5. Mike Laursen   3 years ago

Yes, it is true. The Ohio law makes no exceptions, despite what any Ohio attorney general or other politician said.

        1. Red Rocks White Privilege   3 years ago

Novavax not having any good connections in the government like Pfizer and Moderna is the far more likely reason this took so long to get approved than anything else. It's actually a lot more suspicious that it took the FDA so long to approve it in the first place, considering how the trials went.

Seriously, there's plenty of discussion on this vaccine going back for well over a year. If it was like the mRNA ones, it would have already been mentioned.

        1) They really don't have any basis to make a guess. For the flu, they look at what is circulating in Asia, because that usually makes its way over to us. For COVID, what will be circulating in 6 months probably hasn't been discovered yet.

        2) Close probably counts. The flu changes far more than COVID does, so scientists need to make an accurate prediction for the flu, but it isn't as big of a deal for COVID. The important parts change slowly enough that the antibodies can still bind to a new variant, just with decreased efficiency. So, if they make something for BA.5, it will probably be close enough to what is circulating in 6 months to be effective.

    • Twitter is suing Elon Musk for backing out of his deal to acquire the company.

Twitter being forced to go through discovery is going to be *finger-kiss* magnifique

    1. BestUsedCarSales   3 years ago

This is certainly a winding and useless tale. Which reminds me of my own storytelling and so I like it.

  44. A Thinking Mind   3 years ago

It was not insane to approach the story with some skepticism, given that its single source was someone with only secondhand knowledge of the circumstances.

How very generous of Robby. Maybe you were wrong to question this story but you weren't INSANE to do so.

Beyond that, there's a lot of untruth spread about Ohio's abortion laws. The first is that this pregnancy would have qualified as an emergency situation and she could have gotten an abortion there. The second is that Ohio's law is not a "6-week" ban, it's a heartbeat ban, and there's no confirmation over whether the baby had a detectable heartbeat.

What's craziest to me is to learn that a 10 year old was raped and it seemingly was not a family member. These cases where you hear of girls that young being raped, it's almost always involving someone related to her who has access.

What's craziest to me is to learn that a 10 year old was raped and it seemingly was not a family member.

I believe she was raped more than once... so there's some dark shit going on here for sure.

      1. A Thinking Mind   3 years ago

Or maybe it was a family member, but it's not being reported that, which is kinda crazy. I suppose they're worried about the victim's anonymity.

        1. Mother's Lament   3 years ago

Or it's made up bullshit for propaganda purposes.

They already published his name. Everyone in the community familiar with them probably already has a good idea of who the kid is by now.

Assuming they didn't all already know.

        3. mad.casual   3 years ago

I'm almost certain it was a family member. Even if it wasn't the man currently accused.

I actually think the lack of reporting is a Twitter-era, real-time news, clusterfuck. Nobody's sure who they can pull their dick out of and stick it in without fucking the wrong person.

      2. Fats of Fury   3 years ago

How do we know she was raped according to Guatemalan customs and law? For all we know she could have been the alleged offender's wife. Thanks to this dolt of a president we don't know who's in this country or where.

Even so, federal health officials have yet to determine who the vaccine will be for.

Then how in hell can it be "approved"?
Who or what was it tested on? Surely it is "approved" for that group.
I love "emergency" approvals when there is no emergency. The Communist Chinese Virus in its various forms has been around for years. The 'emergency that never was' is long over.

Not looking good for regaining the little bit of trust they had before those damn bats messed us all up.

Columbus police were made aware of the girl's pregnancy through a referral by Franklin County Children Services that was made by her mother on June 22

The Dobbs decision was on the 24th, the purported abortion happened on the 30th.
What kind of game are you playing ENB?

    1. Mother's Lament   3 years ago

Oops, Robby. Same pile, better hair.

The point being she got the abortion nine days after being discovered, and seven days after Dobbs. That's not how the lefty meme went.

What's really hilarious about Jill Biden's gaffe there is that San Antonio's taquerias are, for the most part, absolute garbage. You can get far better Tex-Mex at an average hole in the wall in New Mexico than you can get anywhere in Texas except, perhaps, some places in the Rio Grande Valley.

San Antonio is known more for having a bunch of "big ol' women," as Charles Barkley so eloquently put it, than good food.

Well one of the consequences of new medical abortion restrictions is that at least eight states now require that any prescriptions for methotrexate not be used to end a pregnancy with felony charges if violated. That now means many doctors are no longer taking the risk of prescribing it even for - rheumatoid arthritis.

You prolifers have not even begun to receive the backlash that's coming

    1. Red Rocks White Privilege   3 years ago

That now means many doctors are no longer taking the risk of prescribing it even for - rheumatoid arthritis.

Get fucked with this bullshit made-up hysteria. No doctor is going to be charged with a felony for providing a prescription for methotrexate to a patient with arthritis.

You abortion maximalists are REALLY pissed that you can't get more than 20% support for your position, aren't you?

      1. BestUsedCarSales   3 years ago

I mean, maybe. But it will settle down over time as things are defined a bit more. The SC just confirmed that doctors acting in good faith aren't responsible for the side-effects of medications. This was specifically about opioids, but could easily be applied here.
I can easily imagine doctors are a bit shaken up after a big change in jurisprudence, observing this is actually a very Burkean conservative observation, but things will resolve over time.

Say whatever you want about Bill Gates or Jeff Bezos, they never tried to sell me a fucking popsicle for ten bucks. I just cannot even imagine the level of cognitive dissonance required to charge ten dollars for a crappy ice cream snack and still pretend you're somehow "subverting" capitalism.

As a former Nuclear, Biological and Chemical NCO at Fort Bragg, NC I can tell you that you CANNOT VACCINATE against a biological agent. DOD tried to do it for Anthrax and all they did was put 12 shots of poison in us. You can TREAT a biological agent but CANNOT VACCINATE AGAINST IT. Since whoever created this bio weapon in WuHan made it so that it mutates and changes and adapts this BIOWEAPON will be around for a long time. So people are going to continue to get sick and infected and some may even die because they don't have an IMMUNE SYSTEM BUILT UP to fight off the infection. STOP WITH THE CDC STUPIDITY AND DR. FRANKENFAUCI LIES!
