After the Uvalde School Shooting, Politicians and Pundits Search for Panaceas
Plus: Florida social media law violates First Amendment, against populist antitrust action, and more...

It's hard to know what to say about yesterday's tragedy in Uvalde, Texas, during which at least 19 children and 2 adults were killed by 18-year-old gunman Salvador Ramos. Ramos reportedly shot his grandmother before crashing his car and getting into a shootout with police before running into Robb Elementary School, going on a killing spree, and being shot to death by a Border Patrol agent who had responded to the scene. It's still unclear if the school was Ramos' deliberate target, why he chose to commit such terrible acts of violence, or what type of gun he used (initial reports say he had both a handgun and a rifle). What we do know is that this is the second-deadliest school shooting in U.S. history, following the Sandy Hook Elementary School shooting almost a decade ago that left 26 people dead.
Sgt. Erick Estrada of the Texas Dept of Public Safety tells @andersoncooper the shooter crashed his car near the school, got out with a gun and wearing body armor, was engaged by law enforcement, but made his way into the school anyway and went classroom to classroom shooting.

It's understandable that people want someone other than one deranged (and now deceased) individual to be at fault here. It's understandable—if unfortunate and unproductive—that human anger and fear tends to take the form of looking for larger forces to blame and lashing out at whatever is available. It's incredibly difficult and depressing to process tragedies like these. People want an easy solution, and obvious villains to incur their wrath and sadness.
With smug righteousness, many keep asserting that we could stop mass shootings if only a certain type of gun were banned, or all guns were banned, or some specific new gun restrictions were enacted. But these are fantasies. Even if Congress could pass any gun restriction that advocates desire today—including a total ban on all guns—it would be impossible to enforce and almost definitely fail to have the impact people wish for.
Banning abortion isn't gonna stop abortions it's just going to drive people who want abortions into unsafe situations but banning guns will stop guns. Same people.

There are more guns than people in the U.S. and Americans aren't going to simply cooperate with a gun buyback program, for example, the way many Australians did when their government started such a program.
A bigger black market in guns would most likely just create more violent crime, and a bigger effort by police to confiscate or crack down on guns would inevitably lead to more police violence.
People may be emotionally soothed by platitudes around all this—an insistence that we could at least try—but the reality is that the trying itself could lead to a lot of violence.

And banning certain types of guns, enacting longer waiting periods for gun purchases, and requiring enhanced background checks often fail to prevent homicides and would have failed to prevent many of the mass shootings we've seen recently. What makes people so sure they would work against future mass shootings?
Even "red flag" laws (which allow for courts to order the confiscation of guns from people with mental health issues) are not the panacea people purport them to be. "Predicting violence is much harder than supporters of red flag laws often imply," notes Reason's Jacob Sullum. "Psychiatrists are notoriously bad at it, and people who display what might look like 'red flags' almost never commit crimes like these."
The "ban guns" crowd is far from alone in irrational blame laying, of course. On the right, this impulse has taken a particularly ugly form, with some suggesting, based on the gunman's name, that he is an immigrant and that lax immigration policies or border control are somehow the issue here.
The idea that one immigrant committing a crime implicates all immigration is absurd and xenophobic. On top of that, Ramos was born in North Dakota.

And of course no tragedy can take place these days without someone on the right trying to blame gender politics or transgender people. This time, it was Rep. Paul Gosar (R–Ariz.), who has since deleted his tweet saying, sans evidence, that the Uvalde shooter was a "transsexual leftist illegal alien."

Now is a time to grieve those lost, memorialize their lives, and support the families and communities of the deceased. As hopeless and unsatisfying as it sounds, there's not much more we can realistically do. And while I'm sympathetic to the urge to do something in the wake of horrors like these, investing so much argument and emotional energy in doing things that won't actually make a difference only serves to divide people, center the emotions of bystanders, and detract from the very real lives and communities at the center of this shooting.

Florida law requiring social media to host political candidate speech violates First Amendment. A federal court has partially blocked Florida's social media law, which required large online platforms to indiscriminately host messages by political candidates and media outlets. A three-judge panel of the U.S. Court of Appeals for the 11th Circuit said the law ran contrary to the First Amendment. You can read the full ruling here.
The law (S.B. 7072) was "passed by Florida Republican lawmakers and supported by Gov. Ron DeSantis," notes Reason's Scott Shackford. In addition to threatening social media platforms with fines of up to $250,000 per day for failing to spread the messages of all political candidates, it "had a host of terrible provisions," Shackford points out.
Tech groups sued to try to block the bill's implementation and quickly got an initial temporary injunction last June, ordered by U.S. District Judge Robert Hinkle of the Northern District of Florida.
The three 11th Circuit Court of Appeals judges, all of whom were appointed by Republican presidents, ruled Monday that, no, Florida cannot do what it's trying to do here. Facebook, TikTok, Twitter, and others are private companies with First Amendment rights and cannot be required to serve as platforms for political content nor host media outlets' content against the tech companies' own wills.
Judge Kevin C. Newsom, who wrote the decision, bluntly rejects Florida's efforts to try to portray social media platforms as neutral "common carriers" like phone lines or public utilities:
"Platforms are private enterprises, not governmental (or even quasi-governmental) entities. No one has an obligation to contribute to or consume the content that the platforms make available. And correlatively, while the Constitution protects citizens from governmental efforts to restrict their access to social media … no one has a vested right to force a platform to allow her to contribute to or consume social-media content."
The Florida law is similar to a law passed in Texas that an appeals court recently said the state could start enforcing.

Pushback against Biden's antitrust cops. A bid by semiconductor company Broadcom to buy VMware has antitrust debate raging again. From The New York Times:
The country's top deal cops, the Federal Trade Commission head Lina Khan and the Justice Department's Jonathan Kanter, have been pushing for the government to have more authority to block corporate deals. But criticism is mounting that antitrust efforts have gone too far, the DealBook newsletter reports. This week, Lawrence H. Summers, a Harvard University professor and former top adviser in the Obama administration, tweeted that a new era of "populist antitrust policy" could lead to an economy that was "more inflationary and less resilient."
In the past, a deal like Broadcom's potential acquisition of VMware would not have been an issue. The two companies are not direct competitors. Instead, the acquisition in deal terms is closer to what is often called a vertical integration — when one company buys another in a related industry. Horizontal deals, where the two companies are direct rivals, have traditionally been the ones that the government has policed, fearing that fewer competitors in one market would lead to higher prices.
Government officials are signaling that vertical and other deals are problematic as well. "By myopically treating transactions as vertical or horizontal, we may miss important details that a broader perspective can provide," the F.T.C. commissioner Rebecca Slaughter said last year. In addition, the Senate majority leader Chuck Schumer is reportedly pushing for a vote by early summer on legislation that he and others argue will address the way Big Tech has exploited gaps in antitrust regulations to eliminate competition.

Much to early to know the whole story about the Texas shooting, but it appears as if once again the warning signs were missed.
The problem is that lots of kids (OK, let’s be honest, mostly boys) say threatening things all the time.
I got called into the principals office when my son was in fourth grade because he made a sarcastic remark above bombing the school (he was reading Hunger Games at the time). He had no intention of actually doing it, or means.
It might work if the bar is set higher. As in an actual violent incident. I don’t know. I don’t claim to know what to do about mass shootings, and I’m willing to listen to any reasonable person’s ideas.

Like broken clocks, Mike can be right once in awhile. You can't look at the "missed signs" without putting it in context. The person made a threat? Said bad things? Millions of people do that every year, and do not shoot up schools.
Just recently, the FBI investigated a mother who was protesting at a school board meeting. The "Red Flags" justifying that case was that she belonged to a right wing political group, and that she owned guns. We do not want the government in the business of interviewing and investigating people for such benign attributes.
I don't know the specifics of this case, so which specific signs were known to authorities that would uniquely identify this person as a threat without falsely selecting for millions of other people?

Isn't that part and parcel of there simply being too little intellectual/viewpoint diversity in education, news/social media, entertainment, and too often business (amazon comes to mind)? Thus the rapidly changing pronouns, the frequent changes of hair color, the claims of neurodivergency. All to mask what is in fact a dull, dim, and quite normal -in no way special, life.

Mass shootings happen every week in black communities. MSNBC, CNN, ABC, NBC, CBS won't cover the pandemic unless it's a white shooter. Even Fox News is reluctant to call it what it is, a black on black crime tsunami.

There's a very small subset of the population that are committing these mass shootings. A deep dig into them will be WAY more effective at stopping shootings than passing laws that wouldn't have stopped it.
The politicians that are pushing AR bans and more background checks are lying, disingenuous, stupid, or all of the above. When they propose more background checks that all of these shooters have passed, there are no good intentions. I see morons saying AR-15's are too powerful to need for hunting, without realizing that a .223 is on the very low end of the centerfire spectrum.

Daily Mail had an article today about how Ramos had bullied. I didn't dignify it with a click. When bullying is worse than murder, it's impossible to stop the murders.
Saying "This guy was bullied before he snapped" isn't saying that bullying is worse than murder or justifying what he did. Why would you think that?
Look at how it's handled in schools. There is almost never anything done to these kids before they snap. They have years of problems, but it always gets swept under the rug or kicked down the road. Bullying can be a problem, but it's treated way more severely than bad behavior. There's no easy solution, but as long as everyone is afraid to address it, this will keep happening.

All to often the bullies aren't the ones bullied, instead it's the ones who are bullied and finally strike back that get punished. It's because bullies have learned to do it where the teachers can't see it, as while the other kids don't have that discretion when they fight back. In my day the teachers sometimes turned a blind eye, they knew who the bullies were, but could rarely catch them in the act. During 7th grade there was a kid who had bullied and harassed me since 5th grade. Problem was once puberty hit, I grew faster then he did, and was taller with more muscle mass, while he remained fairly short and skinny. He was doing his thing in shop class. We were up in the classroom while the teacher was in the shop helping another student with his project. I snapped grab the kid, twisted his arm between the shoulder blades and slammed him against the wall. The teacher walked in at that moment, told me 'Jeff let him loose' then turned to the other kid and said 'Brian, next time I'm going to turn around and go back downstairs and pretend I didn't see anything, do you understand?' I never had a problem with that kid again.
The best way to deal with a bulky is through swift, ruthless action. They don’t usually like it if you go all scorched earth on them. Don’t expect schools to do a damn thing. As most teachers and administrators are leftist idiot pussies.
Long ago, when I was working a restaurant job in college, one of the younger employees who was still in high school was complaining about three guys who bullied him. I showed him a few basic defense moves and gave him a plan to deal with the head bully. A few weeks later he ended up in a fight with him. He got bruised up pretty good, but he managed to break two of the bullies fingers and the bridge of his nose.

Politicians banning followers runs afoul of public records laws.
Which means barring politicians is also in violation of the public records laws and addressing of grievances portion of the 1A. If we hold that politicians have to allow all followers on a social media account so the public can address grievances (which is what the courts ruled) then by the politicians not having a social media account, that too bars or restricts addressing of grievances.
Many warned of exactly this line of argument could be used to force social media to host politicians.
Or, it could force politicians not to address public policy matters under their purview on social media.

Fine. Then let them be liable for the content they "publish". If they are going to be privileged to be shielded from liability for content, then it is reasonable to demand in return that they not engage in viewpoint discrimination. The guy in Texas was so obviously dangerous that his grandmother begged the police to do something before he harmed others. He as much as wore a sign around his neck saying "future deranged mass murderer". The problem isn't guns or evil talk show hosts, or evil immigrants or racists or anything like that. The problem is we have a society that refuses to institutionalize anyone, no matter how obviously dangerous they are until it is too late and they have done something horrible.
The percentage of the population willing, desiring, and able to do this stuff is very, very small. It would be way easier to target them than to target the 400 million or so guns. I bet this guy had a license, so if he got his hands on a red suv, the outcome would have been similar.
I see your point and want to agree, but then I think about how it would be abused. When people can be investigated and locked up for threats, the definition of threat will be greatly expanded. Many institutions were houses of horrors, making prisons look safe and tame by comparison.

I disagree. You're talking about punishing people for pre-crime. Locking people up not for something they did, but for something they may or may not do. That's a very dangerous power that I do not want the people who run our government to have. Because it will be abused.
I don't think there should be punishment involved, but it wouldn't hurt to flag their profile in the NICS background check database so there's at least a level of scrutiny when they buy a gun. Every time something like this happens, the politicians start screaming about background checks, all while ignoring that the shooter just passed the background check.

The option to slow a background check already exists. It can be delayed up to three days while they do a further investigation.
But at the end of the day, this would not have stopped this crime from happening. As with Sandy Hook, people who are crazy are going to get their hands on a gun no matter what. Or an SUV. Or a bomb.
I really do think there is a choice here. Either we accept that some times crazy people get away with totally crazy shit, or we institute a system of pre-crime detention that will snag far more people into its jaws than actually would have done crazy shit even when it isn't being abused. When it is (inevitably) abused, the system will be used to investigate, persecute and otherwise harass people with (politically) inconvenient viewpoints.

No disrespect to you HorseConch, but, it wouldn't hurt to have the information that needs to be in the NICS database, actually be IN the database. The Virginia Tech shooter was being treated for mental issues that should have, by law, been reported to the database. The School's medical staff didn't report him because they didn't want to stigmatize him. Nothing was ever done to the medical staff.
A while back a guy ran his pickup truck and trailer into a group of motorcyclists. It was later found that he had a DUI in Massachusetts that should have resulted in his license being suspended. When that was investigated it was found that State employees, public sector union members, were stashing thousands of boxes of documents in storage in order to qualify for their bonuses. When the boxes were looked at, they included people who should have been placed in the NICS database. No action was ever taken against those employees.
I'm glad our government is run by morons. It's the only thing preventing tyranny.
That's where I was heading. I don't want some bureaucrat to have authority to violate my or anyone else's constitutional rights. It's no different than the no fly list. The problem is that the system they devised for safety reasons is absolutely not working. Even if it requires someone getting a court order to inhibit the purchase, there should probably be some way to stop it while allowing due process and not violating the rights of anyone.
Most of these shootings could have been prevented based on existing procedures. Democrats just want more laws that they can abuse.

My wild guess theory is that a lot of these heavy anti psychotic drugs not only have terrible side effects for some people but that these side effects are magnified when the drugs are mixed with alcohol and other drugs. So, they give these drugs to people who are not institutionalize and there is no way to stop the person from self medicating with drugs and alcohol on top of them. And this causes some people to go full on psychotic like this.

You don't compete at that level without an enormous amount of anxiety and pressure. That is not a mental illness that is what comes with being a top level athlete. It is a total shame that the lefty victim cult got its fangs in this poor woman and has convinced her that she somehow has a right to compete at the top level without ever feeling anxious.
It doesn't help that she's actually a Japanese citizen, and it's not like the Japanese are known for their love of mixed-race individuals. The sports media that likes to push black liberation ideology has to walk a fine line there since Japan can heartily tell them to fuck off if they ever want to visit, so they mainly focus on alienating her from the American tennis fan base and the US in general by pushing the Black Lives Matter crap.

Elite sports is a fucked up culture that is abusive to kids. I don't know about tennis, but they tag kids at very young ages as having potential, and then put them into some pretty grueling training pipelines. While they're in the pipeline, they're pampered and spoiled and praised and loved. But if someone better comes along, or it looks like you might not make the Olympics, you're cut and all that love and praise is gone. Not to mention all the time and money that gets sunk into them. It's a huge amount of pressure for kids who are too young to deal with it. Plus, your entire value as a human being becomes tied up in the sport and your performance. I've known a couple of people in my lifetime who were in Olympic training pipelines as kids, didn't make the cut, were tossed aside, and spent the next several years of their lives pretty fucked up over it.
If you haven't, watch the Netflix doc about the pervert doctor who molested all of the elite gymnasts. What is most shocking about the documentary is not that the doctor did that. Perverts getting access to young girls has always happened. What is shocking about it is that in some ways the doctor was the least abusive of all the people involved. Those girls were taken to camps away from their families for months at a time where they were starved and abused on a daily basis. Honestly, the doctor fingering them was one of the milder forms of abuse they endured. Anyone that would let their kid be subjected to that has lost their minds.

1. There is no correlation between ownership rates and gun murder. Some of the states with lowest ownership have highest murder rates (CA, FL, DE, MD). And some of the states with highest ownership have lowest murder rates (ND, UT, WY, ID, MT).
2. Gun ownership rates do correlate with suicide deaths, about 60% of all gun deaths. Suicide is a tragic problem but not the same issue as murder.
3. The strongest correlations I found relate murder to race. Murder rates drop as percent white people increases (R2 = .23, pretty weak correlation). And murder rates increase as percent black people increase (R2 = .64, pretty strong correlation). I found no correlation of percent Hispanic population with murder rates.
4. Considering murders committed by race nationwide, black people are 5 to 6 times more likely to kill than white people.
On sn international comparison, both Australia and Jamaica have stricter gun control laws than the U.S.

There's probably a whole bunch of socio-economic factors that correlate more strongly than race, because most of our violent crime is an urban poverty problem and race is just a proxy.
I've done similar analysis looking at our local San Diego County crime rates.
On page 12 of the San Diego County SANDAG agency report https://www.sandag.org/uploads/publicationid/publicationid_4683_27645.pdf (Table 5), we find the percent of criminals by race for the top four major crime categories – murder, rape, robberies and aggravated assaults. Compared with the average crime rates in San Diego County, Hispanics commit major crimes at a 10.6% higher rate than their percent of the population. But blacks on average commit such crimes at a startling 340% higher rate than their percent of the population.
With 33% of the San Diego County population, Hispanics committed 31% of the murders – actually BELOW the county murder rate per capita. On the other hand, blacks constitute only 5% of the county population, but committed 24% of the murders – 4.8 times their population percentage.
This high San Diego County black murder rate is NOT an aberration.

But bad as this disparity is, this comparison understates the black crime frequency. The statistically correct way to look at the crime rate is NOT to compare black crime rate with the overall average, but rather the black crime rate vs. the total crime rate of everyone else.
Using that criteria, we find that -- compared to the average for all the other races -- with 5% of the San Diego County population, per capita:
* Blacks committed murders SIX TIMES more frequently than everyone else.
* Blacks committed rapes SIX TIMES more frequently than everyone else.
* Blacks committed over TWELVE TIMES more robberies than everyone else.
* Blacks committed FIVE TIMES more aggravated assaults than everyone else.
Refusing to report such statistics is supposed to somehow protect blacks, but what it really does is to hide the very high BLACK ON BLACK crime rate. At least 87% of the victims of black violent crime are indeed black themselves. Apparently the MSM considers "virtue signaling" to be more important than ending the murderous carnage rife in black communities.

The Utah solution to such horrific school attacks has been to allow school employees with concealed carry permits to pack heat on campus.
Utah school districts can't prohibit that right. As a result, a potential Utah school shooter doesn't know which adults are armed.
The Utah law has been in place for at least 15 years. No such Utah school shootings have occurred during that time.
Texas law allows teachers to be armed at schools, but almost all TX school districts prohibit it.
At least 10 other states allow school staff to pack heat, but they leave it to school districts whether or not that's acceptable. As a result, almost ALL school districts in those states prohibit any firearms at schools. Utah is the only state I'm aware of that overrides school district restrictions.
It's past time for lawmakers and school officials to reconsider such prohibitions. There is no doubt in my mind that armed teachers WILL defend their kids with deadly force if needed.

A lot of schools already have "school resource officers" in place. Some of them were removed after the Floyd riots, but for the most part, there should be someone on site fully capable of engaging an armed shooter (the Parkland dipshit who pissed himself and hid being a notable exception).
I'm not really supportive of the notion of arming teachers, if only because if we're at a point where teachers have to arm themselves, we're at a very serious breaking point in our society from a cultural standpoint. I get that it appears to have mitigated incidents in Utah, but to me, that's not the point. A fundamentally sick society has to allow school teachers to be armed just to go about their day, not a stable, high-trust one.
A high trust society requires that everyone be trust-worthy. And that means formal and informal education and encouragement of trust, as well as expulsion of people who are not worthy of trust.
I don't know about specifically arming teachers as some kind of policy or program. But allowing those who want to to carry concealed would at least provide some doubt to a potential attacker about how soft their target really is.

There are some things that can be done, but our politicians don't have the will. For one, we need a national "adult age law". You can buy a gun, vote and get drafted at 18, but can't buy alcohol or cigarettes. Make a decision when people are adults, and if we pushed it to 21, that may stop some younger people, like the two recent shooters from getting weapons.
Second - mandatory five years in jail for being caught with an illegal weapon. Period. No parole, no good behaviour. Let everyone know you buy a gun legally or you go to jail.
