Don't Make Every Day January 6
The Capitol riot was awful, but it shouldn't serve as an excuse to violate civil liberties.

Today is the one-year anniversary of the Capitol riot: On January 6, 2021, hundreds of President Donald Trump's most militant supporters overran the police, smashed the windows of the building, and forced their way inside. They vandalized congressional offices and halted the certification of Joe Biden's win.
It was an embarrassing spectacle, and one for which Trump bears significant responsibility. Not antifa, not Democrats, not the deep state, but Trump. For weeks, he had made false statements about the election outcome and asserted his loss was illegitimate. He fed his voters lies and promised them that the results could be overturned—perhaps by the Supreme Court, perhaps by Vice President Mike Pence. On January 6, he spoke to the crowds in Washington, D.C., and told his supporters "we will never give up, we will never concede." He said "we will stop the steal," and encouraged his people to march to the Capitol and "give our Republicans…the kind of pride and boldness that they need to take back our country."
What followed was certainly bold: Among the thousands gathered, a smaller number stormed the Capitol and trashed it. The incident was so humiliating and seemingly counterproductive that many conservative media figures firmly entrenched in MAGA world privately reached out to Trump to demand that he stop it while it was happening. Indeed, members of Trump's own family were concerned: Donald Trump Jr. texted his father's chief of staff, Mark Meadows, and begged him to ask the president to denounce the out-of-control violence and destruction. They all knew—or at least, they presumed—that mob violence, stoked by Trump, would destroy his legacy and prevent him from ever running for president again.
That prediction has proven to be wrong. One year later, Trump still enjoys tremendous support from the Republican Party. Many Republican figures who condemned the rioting, on the other hand, have paid a steep price.

Certainly, the McConnells and Pences of the world would have preferred for Trump to go away voluntarily and quietly. He has refused to do so, and has given every indication that he will run again in 2024.
The surest option for preventing him from returning to the Oval Office was conviction during his second impeachment trial, but the 57–43 vote in the Senate (which did attract some Republican support) fell 10 votes short. A conviction for inciting the riot would have correctly located significant responsibility for the chaos where it belonged—with Trump.
Alas, this did not happen. Instead, the U.S. House of Representatives convened a select committee—the U.S. House Select Committee to Investigate the January 6th Attack on the United States Capitol—that continues to search for new answers and information, and seeks to question figures like Steve Bannon, Devin Nunes, and Katrina Pierson, and also tangential figures from outside the administration, like Alex Jones and Roger Stone. By demanding testimony and records from people who were not government figures at the time of the riot—and had the First Amendment right to organize peacefully in opposition to the election results—the committee's work should be of increasing concern to civil libertarians. In any case, there is no mystery to solve: Trump should have been held accountable, but given the failed Senate vote to convict, there's nothing more to be done.
As for the individuals who entered the Capitol and engaged in property destruction, they should face charges that are in line with their actual crimes. Like Trump, they should be held responsible for their actions. But on this front, many Democratic politicians (unlike the Department of Justice as it weighs sentences) have given every indication of following a post-9/11 script, treating the criminals as not mere vandals but as domestic terrorists of a sort. Senate Majority Leader Chuck Schumer (D–N.Y.), for instance, called on the Department of Homeland Security to add January 6 protesters to the no-fly list, a "civil liberties nightmare," as Reason's C.J. Ciaramella explained at the time. Some January 6 detainees have been held in jail awaiting trial for months, subjected—in some cases—to solitary confinement for 23 hours each day.
Jacob Chansley, the "QAnon Shaman" whose horns and lack of a shirt drew the media's attention and made him the riot's de facto leader, was sentenced to 41 months in prison—after already spending 10 months in solitary confinement. Chansley had no real opportunity to prove his innocence in court. Faced with a potential 20-year sentence, he made the wise decision to plead guilty, as virtually all defendants do.
The events of January 6 were tragic and disturbing. It was beyond the pale for the sitting president to falsely contend that he won reelection and encourage his supporters in a violent fury that culminated in vandalism at the nation's Capitol. It's important not to understate the damage done by both the mob and by Trump himself.
But it's also important for the government to avoid overreaction. The 9/11 terror attacks inspired the Bush administration to launch a disastrous war on terror, invade sovereign nations, kill American citizens abroad and engage in routine surveillance of Americans domestically, and violate civil liberties in a dozen other far-reaching ways. Frustratingly, mainstream media outlets have given every indication that they would provide intellectual cover to any Biden administration effort to respond to January 6 in a similarly extreme way. "Every Day Is Jan. 6 Now," wrote the New York Times editorial board. Let's hope not.

The Reichstag Fire was used as propaganda by Hitler, after being freely elected, to make a power grab and gain a majority in parliament by the Nazi Party (and National People's Party) over the Communist Party who currently ruled. While the Reichstag Fire Decree helped them secure power, it wasn't until later, with the passage of the Enabling Act, that Hitler had his totalitarian regime.

Article is not well organized... But down the page we learn that a conservative group has gathered surveillance video and phone geolocations that they say show over 5,500 drops by ballot harvesters to temporary ballot drop boxes in the middle of the night.
They claim to have a witness who was paid to harvest ballots (perhaps dubious) and claim 5-20 ballots per drop.... Meaning their little investigation has maybe 50,000 votes illegally harvested...

The hypothesis that Ray Epps was an FBI agent provocateur is easily debunked by noting the weakness in the key claim that, based on our knowledge to date, MUST be true if this hypothesis is to be proved true.
This key claim is that the crimes that Ray Epps committed on Jan. 6 are SO egregious and SO heinous, that the FBI would have no legitimate reason NOT to prosecute him for his crimes; the only logical explanation that the FBI, thus far, hasn't prosecuted him is because there was some type of collusion between the FBI and Ray Epps, making Epps an FBI plant and agent provocateur.
But, look at the ACTIONS that Epps committed that day (that we know of):
He rushed through the barricades (like a lot of other people)
He stepped a few feet into the Capitol, and then left.
That's it.
Considering the far more serious crimes that occurred that day - vandalism, property destruction, bodily harm, etc. - it is completely understandable that a rational prosecutor might conclude that what Ray Epps did is not worth prosecuting. This is also backed up by the observation that there were THOUSANDS of people who trespassed inside the Capitol on that day, but thus far, the FBI has only decided to pursue only a few hundred. Are ALL of the rest of the people the FBI decided not to prosecute, agents provocateur? Clearly not.
It is completely logical and reasonable to conclude that the FBI has decided not to prosecute Ray Epps (if in fact that is their final decision on the matter - we don't actually know that) because they concluded his conduct did not rise to their level of concern, just like all of the other thousands of people that the FBI aren't prosecuting.
ALL of the rest of the controversy surrounding Ray Epps is irrelevant and just noise to draw attention away from the weakness of the entire argument. It is totally irrelevant that Ray Epps was going around the day before encouraging people to break into the Capitol - that is protected speech. It is totally irrelevant that he may or may not have had a buddy with his actions. It is totally irrelevant what other FBI plants had done in the past. Those are all red herrings designed to generate a narrative of paranoia, and does nothing to actually prove or disprove the central claim of whether Ray Epps was a FBI plant or not.

NBC News was linked earlier for Jeff showing 80% of the convictions are for simple federal trespassing. But he just feels it is fair.
The very first case, Jared Adams, includes nothing other than a picture of him peacefully standing inside the building in a room with multiple police officers confirmed by map records from his subpoenaed cell phone records. No evidence of assault, property damage or being impolite. No admission of any wrongdoing on his part other than that he entered the building.
The second case, Eduardo Alvear Gonzalez, is similar to the first.
The third case, Rasha Abual-Ragheb, plead guilty and was sentenced to 2 months home confinement, 36 months probation and $500 of probation for trespassing. The only evidence was pictures of her in the building, not even an accusation of any violence.
The fouth case, Thomas Adams, differs slightly. He was also charged with "Violent Entry and Disorderly Conduct on Capitol Grounds" because he was identified outside the building and inside the building, although there is no evidence that he engaged in any violence himself.
Not only is the myth that only the shit-smearers and cop assaulters are getting prosecuted blown out of the water, but the idea that this was a bunch of white supremacists is pretty fucked as well. In the first 4, you have a HIspanic man and a Arab woman.

Here's my big issue: This is basically the only example the media can find of a conservative-issue protest that devolved into a riot from the past decade. The DAY after the riot, all of these protestors were gone. They didn't decide that the rioting was justified, or that the rioting was just unrelated and they should continue protesting, giving cover to more lawless people who would continue rioting.
The night of the first George Floyd protests, a riot broke out with people throwing bottles and rocks at officers, the police station. Officers then deployed tear gas to make the crowd disperse. The next day, looting and arson broke out on a massive scale. Protests continued to fill the city and nobody wondered whether their presence protesting might be condoning the lawlessness, and giving riots a crowd to hide within. Because stuff was burning on May 27th, and rioting continued on May 28th. People spent what limited time they had desperately boarding up doors and windows. "Peaceful" protests continued, once again giving the appearance of condoning the riots. A fucking PAWN SHOP (not a large business) was torched on the 28th with a man inside who died burning to death!
And things continued to burn on the 29th, with nobody starting to wonder if maybe the protests should stop until the violence is contained. Again on May 30. And May 31, with idiots blocking the fucking interstate and nearly being plowed over by an unaware truck driver. And June 1, and June 2...
I'm definitely against riots, and Jan 6 was a riot. NOTHING HAPPENED ON JANUARY 7. I'm fucking tired of hearing about something that was solved because nobody who might be sympathetic wanted to be associated with violence, while there's an opposition that doesn't seem to mind associating themselves with violence.

Reading the affidavits in the first four cases, there is no evidence in those cases of anything other than trespassing. Where the 4th guy was identified outside before the breach and inside the building, he was charged with violent entry.

You do realize that all arguments that exonerating Epps, other than "He was an FBI plant" exonerate Trump, right? If Epps is at the back of the line because he only set foot in the capital and is just an innocent figurehead of a movement that swept out of control around him, then Trump is behind him in line.

Where is the MASSIVE FRAUD crowd demanding audits and recounts to make sure there wasn't rampant fraud corrupting the results and disenfranchising voters in North Carolina? Answer: because it wouldn't benefit Team Red or Trump.
- I have yet to see one person around here, now that the Arizona "audit" is concluded, say something like the following: "Now that the audit is concluded, and it confirmed the results previously certified, I now have more confidence in the electoral process." Many of the most militant BLM and Antifa supporters rioted around the nation, smashing windows of innocent business owners who had never met George Floyd. Thousands upon thousands took to the streets in lawlessness, burning down at least 12 buildings entirely and damaging hundreds more in Minneapolis alone.
It was an embarrassing spectacle, and one for which Democrats and the mainstream. Not police, not George Chauvin, not Republicans, not Target employees, but the President, VP, Joy Reid, Don Lemon, and other race grifters. For months and years they put forward false statements about racist police, systemic racism, and falsely asserted that White Supremacy was on the rise. Democrats, like Maxine Waters fed their voters lies and told them there was no justice to be had in America-not by the Supreme Court, not by their local government, not through legal means. Over the previous years, they've stood in front of crowds, telling them "No Justice, No Peace," and promising them that they have to "Go to the streets, get in their face, and threaten violence."
What followed was certainly violent. Among the millions who were in the streets, many thousands stormed government buildings and small businesses and trashed them. The incident was so humiliating and seemingly counterproductive that many liberal media figures firmly entrenched in CRT publicly pretended it wasn't happening by claiming the rioting was "mostly peaceful," even as they stood in front of burning buildings. It was such a shameful display of gaslighting that many knew-or at least believed-that the cover-up of mob violence would permanently undermine the credibility of the mainstream media.
That prediction has proven to be only partially accurate. 19 months later, outlets like CNN and the New York Times desperately claim to be gatekeepers of information. Many Democrats who encouraged the rioting have chipped in to pay a steep price to bail out the rioters.
Certainly, many moderate Democrats would have preferred for 2020 to springboard new criminal justice legislation. But the party has refused to acknowledge the riots and their own responsibility for inciting the violence, and very few legislative reforms have passed. Desperate attempts from Republicans to propose meaningful legislation-such as Breonna's Law, which would ban no-knock warrants-have been stubbornly resisted by the other party, who pretend that Rand Paul is a racist for even trying.
Alas, no legislation has passed Congress to reform criminal justice. Even though Chauvin was immediately arrested and easily convicted of the death of George Floyd, cries that there is no police accountability still echo from every corner of the country. Attempts to be more honest took an immediate hit when Jacob Blake was shot during a domestic violence incident-a completely justified shooting in which police had already tried to restrain and taze him and only opened fire when he was attempting to break into a vehicle that had innocent children in it. Yet the media only focused on the three seconds of the video prior to Blake being shot, further encouraging riots and anger that led to more deaths in the city of Kenosha. The problems of causing anger and telling the population that our justice system is broken without offering any solutions continues to come from a single side of the political spectrum, and the hypocrisy of the current Vice President, as well as many in Congress, is largely unnoticed.
But it's also important to remember: Both Side.

It would be one thing if Epps’s repeated calls on January 5 to “go into the Capitol” had simply amounted to bluster. But Epps followed through on his stated mission to shepherd others inside. In clips 4-6 of the above compilation, we see Epps actively orchestrate elements of the very first breach of the Capitol barricades at 12:50 p.m, while Trump still had 20 minutes left in his rally speech.
It is noteworthy that this Ray Epps breach occurs just one minute after Capitol Police began responding to reports of two “pipe bombs” located at DNC and GOP headquarters, respectively. Rather conveniently, the already-handicapped Capitol Police thus had still-fewer resources with which to respond to the barricade breach in question.
While the “pipe bombs” turned out to be a dud, the Ray Epps breach proved fateful. Today, the official stories told by the New York Times, the Wall Street Journal, and the US Justice Department all depict the apparent Ray Epps-orchestrated 12:50 p.m. initial breach of metal barricades as the “Big Bang” event of January 6.
In large part, this description is hardly an exaggeration. Indeed, it was the 12:50 p.m. breach of the Capitol grounds, in conjunction with a handful of suspicious individuals ripping down fencing and signage, that set in motion the conditions allowing for 1/6 to turn from a rally into a riot.
In this report, we will blow open this network of still-unindicted key operators who appear to have been at work either with or around Ray Epps during the initial Capitol grounds breach. You, dear reader, will be scandalized — though perhaps unsurprised — to learn that none of the actors covered in this report have received attention in the mainstream press, despite their active and indispensable roles in the events of 1/6.
As we explained in detail in our previous report, the FBI originally put Ray Epps’s face on its Capitol Violence “Most Wanted List” on January 8, 2021, just two days after 1/6. They offered a cash reward for information leading to his arrest. In fact, rank-and-file FBI agents initially deemed Epps’s role as an apparent riot organizer so important that they named him Suspect #16—one of the first 20 high-profile FBI targets in a database now packed with more than 500 suspects.
Then, six months later on June 30, 2021, both Revolver News and The New York Times published inconvenient stories that encouraged a more aggressive interrogation of the “Ray Epps third rail,” leading reasonable people to wonder why this publicly identified man on the Most Wanted List still had no charges filed against him.
The FBI responded to these important media stories the very next day. But their response was to quietly purge all online Ray Epps files from their website, then switch to a posture of “What? Who? Ray Epps? Never heard of him.”
Agents of the FBI Field Office in Phoenix (where Epps lives) have gone so far as to explicitly deny knowledge that Ray Epps even exists. Instead of pursuing Epps, FBI agents have instead pursued journalists who had the temerity to ask Epps in person if he was a government operative. “I understand that, but I can’t say anything,” is all Epps would tell them.
The sham Congressional January 6 Commission seems to be going along with the charade of Ray Epps denialism. For all of its recent gesticulations about Mark Meadows’s benign text messages, the Commission has yet to express even a basic interest in Ray Epps or his communications leading up to and on January 6.
But the specter of Ray Epps, and the ominous questions his immunity raises, loom too large to be memory-holed by poorly coordinated efforts of government denial. In light of the above, it is both amusing and symbolically appropriate that despite the FBI’s attempt to purge Epps’s face from its “Wanted” database (and public denials of his existence from authorized agents), the FBI DC Field Office still features Ray Epps as a “Wanted” man in its current pinned Twitter image (look closely and you’ll find it).
If Epps turns out to have been some kind of government operative, which at present is the only clean and simple explanation for his immunity, it is game over for the official “MAGA insurrection” narrative of 1/6. Epps was the day’s loudest riot recruiter, and its apparent leader of the very first breach of Capitol grounds. If Ray Epps is a Fed, the “Insurrection” becomes the “Fedsurrection” in one fell swoop.
These are the stakes at play in unraveling the Ray Epps enigma.
But it is imperative to note that if Epps was just a cog in a much larger federal operation, he would not have been deployed alone. Historically speaking, when Feds have orchestrated fake mobs of fake protesters, or contrived fake conspiratorial plots, the Feds’ own assets have commonly comprised between 16% to 25% of the plot’s participants, at least in its key respects. Indeed, the FBI once flew in 1,600 rowdy spooks to infiltrate a single convention with just 10,000 protesters.
In recent times, attacks blamed on right-wing militias have blown past the 16% mark on the Fed Saturation Index and have been clocking in at a whopping 25-50%. As Revolver has previously noted:
Students of FBI history should quickly absorb the lesson that infiltrating Feds are like roaches: whenever you spot one, it is guaranteed there are dozens of others nearby. Feds simply never, ever, operate alone. This is how you end up with at least 12 FBI informants in a tiny “right-wing” Michigan militia plot from October 2020 (that’s just informants, not even agents), 15 informants in the “right-wing” 2016 Malheur plot, dozens in the 2014 Bundy Ranch affair — including six FBI undercover agents posing as fake documentarians shooting a fake documentary — and the list goes on.
So if Ray Epps was instructed by the government to play his part in various recruiting, breaching and crowd control efforts that day, we would expect many other informants to be set up around him.
To test this hypothesis, Revolver spent the past six weeks comprehensively mapping Ray Epps’s network of interactions on January 6, and profiling the key people around him who complemented his efforts. We did a deep dive into other key figures involved in the initial breach of the Capitol grounds, as well as figures who played an instrumental role in fence removal and crowd control. In short, we investigated key players whose early actions on 1/6 turned the rally into a riot.
The bad news for Fedsurrection Deniers is the results are in, and they look even worse for the FBI than Revolver’s already low expectations. For brevity, we profile five of the most egregious cases in this report, and tell the story of how they crossed paths and interacted with, and in some cases coordinated with Ray Epps to make 1/6 possible. Some of these cases are so wild as to constitute Epps-sized scandals unto themselves.
But first, it important to note that Feds at the mere informant level are seldom told by their handlers of the presence of other government informants around them. From each individual informant’s perspective, the agitators around them would look as lawless to them as they did to the crowd.
This exact strange situation played out in the climax of the Whitmer Kidnapping Plot. The car that prosecutors say “cased” the Governor’s house had five passengers—two homeless patsies, and three secret Feds. But only the agent-level Fed in the car had total operational awareness. Each of the two informants in the car probably thought the other was a legitimate insurrectionist.
So it is not necessary for all or any of the individuals covered in this report to know each other or to have affirmatively “worked together” to have formed a “team” through collective effort. A simple text message from a federal handler to “Be at the Peace Monument at 12:45 p.m. and flush out the crazies” would be all that’s needed for a large ring of provocateurs to simultaneously be in the same place, at the same time, contributing to the same breach.

2. An unknown number of federal agents were actively involved stoking emotions and inciting a trespass.
3. Capitol Police oddly cooperative, DC Police understaffed, surely they knew demonstrators were coming.

Your asking for evidence that requires active participation on government to prove evidence of an action. Does an unsolved murder not count as a murder since nobody was convicted?
In a criminal proceeding, the question is guilty or not. To be guilty, one must commit a positive act. Not guilty means they committed no act, or a different act.
Voting is a positive act. Thus the presumption of innocence, based as it is upon presuming non action, is not valid.
Further, it is not a person in question but a vote. The question isn't of guilt vs non guilt, but valid vs invalid.
When someone is charged with fraud, only then may we presume innocence.
