Kyle Rittenhouse's Call of Duty Habit and Post-Arrest Silence Aren't Evidence of His Guilt
Judge Bruce Schroeder rightly reprimanded Assistant District Attorney Thomas Binger for what he called a "grave constitutional violation."

Kyle Rittenhouse is the star witness in the Kyle Rittenhouse trial. And today the 18-year-old took the stand, testifying that he acted in self-defense when he shot three men, ultimately killing two, during unrest in Kenosha, Wisconsin, on August 25, 2020.
The testimony was arguably the climax in the proceedings against Rittenhouse, who is facing multiple homicide charges and has become symbolic of just about everything the viewer wants to see. To many on the left, he's a vigilante upholding racist structures; to some on the right, a protector who filled a void left by law enforcement.
But there was another courtroom fixture centerstage on Monday: Assistant District Attorney Thomas Binger, who—no matter how you feel about Rittenhouse—should serve as a reminder of just how pitifully low prosecutors will stoop while in pursuit of a conviction.
Binger's Rittenhouse cross-examination should have been a big moment, which it was, but not for the reasons Binger would have hoped. He began with a probe of Rittenhouse's interest in purchasing an AR-15, asserting that Rittenhouse must have declined a pistol or a shotgun because of his Call of Duty habit. There are a few problems here: Players use many different sorts of guns in simulation games, including pistols and shotguns. But more fraught is the implication that playing violent video games somehow makes you a murderer, or more likely to murder someone—a hysterical assumption that is not based on fact.
The questioning was desperate, but it quickly moved from breathless to potentially unconstitutional as Binger faced off multiple times with Judge Bruce Schroeder after the former noted Rittenhouse's post-arrest silence with the insinuation that it somehow indicated his guilt.
"I was astonished when you began your examination by commenting on the defendant's post-arrest silence," the judge said. "That's basic law. It's been basic law in this country" for decades, adding, "I don't know what you're up to."
They also squared off over Binger's attempt to introduce evidence to the jury that Schroeder had already said was likely inadmissible. The chain of events prompted Rittenhouse's defense to ask for a mistrial with prejudice—meaning the state would not be permitted to bring the same charges—which Schroeder said he would take under advisement. "Don't get brazen with me," Schroeder told Binger. "When you say that you were acting in good faith, I don't believe that."
Binger is not the first prosecutor to receive such admonishment.
"Prosecutorial immunity, which basically provides absolute immunity to prosecutors, has served as essentially a perverse incentive in this type of a situation," Anya Bidwell, an attorney at the public interest law firm Institute for Justice, tells Reason. "Prosecutors—especially when they act inside of a courtroom, like in this case—they are 100 percent immune from any kind of civil liability, so they can lie, they can bend [the facts] whichever way they want…and they will not be held accountable." A recent example: A prosecutor in Louisiana was given immunity after working to derail rape allegations against an assistant warden at the Louisiana State Penitentiary.
That case remained low-profile. High-profile cases like Rittenhouse's tend to turn a swell of brief attention to the criminal justice system, at which point people may find their preconceived notions challenged. That's doubly true here with people on both sides of the aisle holding up Rittenhouse's actions as indicative of whatever narrative they want to believe.
Consider J.D. Vance, for example, the Republican candidate for Senate in Ohio. Binger is a "lawless thug," he said—unexpected words from someone who has touted the importance of law-and-order. And then there was conservative commentator Matt Walsh, who tweeted that the prosecutor is a "corrupt piece of shit brazenly violating the constitution" as well as "a raging asshole."
"Based on what I've seen, objectively it does seem like the prosecution really messed this up. I think that's a fair assessment. But I'm not the least bit confident that folks like J.D. Vance and Matt Walsh and whoever else have just come to that decision through neutral civil libertarian principles," says Jay Schweikert, a research fellow with the Cato Institute's project on criminal justice. "On the other side, I've seen tons of nominally progressive people who in their day jobs care a lot about criminal justice, and yet seem to be howling for a conviction, and convinced that anything the judge is doing to push back against the prosecutor is because he's racist and biased."
After the trial's conclusion, both sides will probably retreat back to their respective corners. But a criminal defendant's right to due process should not hinge on how sympathetic he is, and a prosecutor's disdain for the rules is by no means constrained to the assistant district attorney in Kenosha County, Wisconsin.

There's one charge that should stick, illegal possession of a dangerous weapon by a person under the age of 18.

Do you have a source for that? My sons all went through hunter safety training in Wisconsin in the last 10 to 15 years. As minors, they were allowed to go hunting with their guns and without me.
Since Rittenhouse was from Illinois and wasn't participating in licensed hunting, those rules aren't relevant but it's not universally illegal for a minor to possess a firearm in Wisconsin.
There's a disputed reading of the law in this case.
The law talks about "dangerous weapons," but has a specific carve-out that excludes long-barreled shotguns and rifles. The exception is there to make a distinction between concealable weapons and weapons typically used in hunting. According to the prosecution, since Nick wasn't using his rifle specifically for hunting, he's not allowed to possess it. According to the defense, he can possess the gun as along as he's not hunting without a license, and since he was not hunting, he's in accordance with the law.
The defense has tried to get the judge to dismiss the gun charge but the judge seems confused by the weird way the law is written.
The Wisconsin law about minor in possession of a firearm says:
941.28 and 29.304 are irrelevant here. 29.593 is "Requirement for certificate of accomplishment to obtain hunting approval." So, is everyone who never gets the certificate "not in compliance" with that law, even if they never try to hunt? That would seem like an odd way of phrasing it. I can't say I know the answer - but if it's not obvious to the judge whether this is a crime even when the facts are undisputed, then the rule of lenity should prevail, IMO.
The key word is "only." The only way you can be in violation of section 948.60 while being armed with a rifle (like Kyle was) is if you're hunting without a license. Kyle doesn't need a hunting license because he's not hunting, so he's not in violation of the law.
That's my reading, but the judge seems confused by it. A theory I heard today is that the judge intends to leave it just in case there's a jury that wants to compromise on the verdict; they'll convict on the lowest charge and then he can void the conviction due to vagueness of the law.

I'm not sure what I think about that. If the police aren't doing anything to protect people's property, I'm not sure it's a bad thing for regular people to step up. I'd much rather not be in a place where that becomes something you have to consider. But when civil order breaks down, I'm not sure we shouldn't encourage people to show up and help defend people's lives and property.
That's the issue. He knew there was going to be a riot destroying the town around his work. He put himself into harm's way in order to protect it. The men who he killed were armed and actively attacking him. We can say with confidence that if nothing had changed except that Rittenhouse was unarmed, then Kyle would have died that night.
The people who should have been there to stop the riot, the police, were ordered to not be there.
When the police actively abdicate their responsibilities to protect the city, then we cannot really blame the locals for taking up arms to protect their own.

South African here. When the police won't/can't do their job, the community has to react this way. During our recent extensive riots and looting, community watch groups banded together to protect our communities from looting, with private guns. In South Africa we know who the real culprit is. A state which is so corrupt that we have a non functional police force which in turn allows rampant criminality to run it's course. The US is experimenting with destroying their own police force and once the people know they cannot rely on the police to protect them, there is no other choice than to protect your own.
Neither the looters or the vigilantes are served by the abrogation of the state to maintain law and order. I hold no water for the looters, but don't forget where the ultimate responsibility for these events lie.

He didn't shoot one guy who had his hands up. He pointed his gun at someone who raised his hands, had a gun in it, and then didn't shoot. Then the guy lowered his gun and lunged at him, and then Kyle fired. Insane trigger discipline because he really did not want to shoot anyone.
Kyle even stopped briefly after shooting the first person who assaulted him and seemed ready to try to render aid (to the psychopathic pedophile that attacked him) until he became aware of the crowd. This kid is a fucking role model and the attacks on his character disgust me.

Should also be pointed put the first shot was fired by an antifa guy when Kyle started to get chased.
He fired at four people. One of them was lunging at him and was essentially touching his rifle, one of them had just kicked him in the head while he was on the ground, one of them had smacked him with a heavy skateboard and was grabbing his gun while he was the ground, and the fourth person lowered a pistol at him while lunging. He did not injure or attempt to harm any individual who did not aggress toward him.

Did y'all catch the testimony of the guy who said, under oath, that the prosecution attempted to hoodwink him into identifying a previously unidentified person in a video? That was trial comedy gold.

The person you mentioned is named Nathan Debruin. He has a bit of a speech impediment and he appears like he might be somewhere on the autism spectrum based on his behavior. I don't know if that's true, but that's how he comes off. The prosecutor's office thought they could sweet-talk him and get him to alter his statement regarding their prosecution of a separate case because this prosecutor thought he could take advantage. Instead, this guy realized what was going on and immediately obtained a lawyer.
Today, this prosecutor violated procedure by trying to sneak something past the judge which was under a motion in limine. That is to say, it was excluded, at the start of the day the judge confirmed that nothing had happened which would cause him to reconsider those motions, and then, in front of the jury and without approaching the judge first, he mentioned this evidence that he's not allowed to bring. The Judge was PISSED and sent the jury out so he could yell at the prosecutor for being a slimy son of a bitch.
And yes, there's the violation of the 5th amendment where the prosecutor commented on how the victim had been silent about the case since his arrest. Which is a constitutionally protected right and is improper and is, as I understand it, the most basic rule for any prosecutor and has been basic law for half a century. The judge informed him that if there's any more improprieties he absolutely will order a mistrial with prejudice, despite this judge being very insistent that he wants this to go to the jury to decide. This is a judge who is very proud of our jury system and wants to prove it works so he's being very loose on many procedural issues, but he's quite irritated with the prosecutorial overreach.
Even after that, he misrepresented to the judge that zooming in on your phone with Apples "pinch and Zoom" is the same as using a magnifying glass and does not alter the image, even after his own expert had previously testified that it DOES add pixels and, therefore, alters the image. The judge didn't buy that for a second even though he claims he's quite ignorant about technology. He told Binger if he wanted to introduce this, he had to affirm through his own expert that this was not altering the image. Binger, of course, could not find an expert to call to back up his lie.
This guy Binger is pure scum and deserves to be sanctioned if not disbarred.

NGL, I thought putting Rittenhouse on the stand was fucking suicidal, whether the defense team wanted him to go up or he insisted on taking the stand, if only because he's an 18-year-old going up against a slimy Democratic ADA.
All things considered, the gamble worked because Binger did a hell of a lot more to hurt the prosecution's case than Rittenhouse did to help his own, and all things considered, Kyle did pretty decent. I wasn't a fan of the crying jags, even if he did have residual trauma from that night, but that may have even helped considering he has a majority-female jury who probably have kids of their own. And overall, he was very consistent in his answers.
But Binger absolutely butt-fucked himself today, first by pissing off the judge, and then by boring the shit out of everyone in the courtroom by asking the same thing over and over and over and over again for several hours. The defense probably didn't raise too many objections because they saw how the jury was reacting to it and decided not to press their luck by waking them up and keeping them engaged.
Just imagine spending tens, if not hundreds of thousands of dollars to get a law degree, only to get humiliated in court by an autistic bottle factory worker and an earnest 18-year-old who didn't want to see the city that he worked in get burned to the ground by a bunch of leftwing cancer cells.
I didn't watch his whole testimony, but he did really well. He was consistent, he was respectful, he was truthful.
The crying probably helped him. He has a baby face, and he came off as very traumatized by the whole thing. Followed up with the prick DA being a snarky asshole and using dirty tricks, Rittenhouse was a VERY sympathetic.
He came off as a kid who fucked up bad, and found himself in a shitty situation that he's now traumatized over.

He was good, but it's not worth it. If you're predisposed toward the defendant, everything he told you is stuff you'd already believe, and you don't need to see him cry. If you're predisposed toward the prosecution, you did see the prosecution score a few points on Kyle's willingness to use a gun because he got worn down on questioning.
Defense should have avoided calling him entirely and gone straight to their expert witness.

I disagree. If your opponent is making a mistake in trial, you object, which calls it out and gains the jury attention so it's more visible that they're fucking up. And you get the judge, who in this case is really irritated with the prosecution, to agree with you that the prosecution is being shitty.
I understand there's other witnesses you might let them hang out there because they're firing back on the prosecution, and the Debruin guy was a top tier example of it. But you can't just let the prosecutor badger and misrepresent the words of the defendant when they're on the stand. Kyle was looking pretty scared somewhere in the third hour of that cross-examination and defense needed to slow down the prosecutor and not let him repeatedly ask the same question until he got an answer he liked (which he did, constantly).

The prosecution's theory of the case is that Kyle's presence in the city was the incitement that caused people to attack him and he was reckless by bringing a gun.
Kyle was collected but not properly coached-he should have had the word "deterrent" drilled into his head by his counsel. The prosecutor kept hammering that Kyle must have had guilty intent by bringing a deadly weapon into a situation, implying that Kyle would be forced to use it since he had it. Obviously, standing there with a visible weapon is a deterrent that should stop people from messing with you or your property, and Kyle wanted to use the weapon as a deterrant without any intention of using it. I think the prosecutor was able to get Kyle to look bad to people who are generally disposed to dislike guns, and the defense refused to object when the prosecutor asked the same question ten or fifteen times.
Kyle was getting extremely flustered and had to look at his defense counsel a few times, which the prosecutor even pointed out. Overall his defense team has been very poor when it comes to raising objections when necessary and today was some of the worst because he needs to protect his client from being badgered. Binger was able to get away with putting words in his mouth at times as well because defense counsel didn't object to his mischaracterizing what Kyle said.
I think Kyle did a great job all said, but he probably only came out neutral. Defense was insane and should not have had the poor kid take the stand and it's bordering on malpractice to put him in a position to be cross-examined. Seeing him break down in tears because he really didn't want to shoot Rosenbaum was heartbreaking, and it pisses me off because I saw all the leftists on Twitter claim he was acting. It's not going to be convincing to people who've already made up their minds and it doesn't add any substantive that the jury needs to know.

Like I said, Rittenhouse didn't help his case so much as the prosecution hurt his own. And I get your point about the defense--if I'm Kyle, I'd probably be ripping their asses tonight for not raising more objections and just letting him get grilled for hours with no intervention.
I was hoping for more objections on the cross also but the whole ordeal was so tedious and absurd l don't see how it could possibly have engaged the jury. I sat through hours of pointless boring testimony on a jury once and it sure didn't help the party's case. Jurors know when they're getting played and they don't like lawyers wasting their time.
These people have already been pulled away from their regular lives to serve in a highly charged case being tried by media bluechecks. I guarantee they just want to get this thing over with and aren't going to take kindly to that shit.
Add to that, the prosecutors are trying to force the judge to declare a mistrial by repeatedly defying his orders and he doesn't want to do it. That would at least get the jury off the hook. At this point it looks like they're gonna get stuck with it.

Well I've heard people allege that, but he did point out in his testimony specific gaps in his recall. So he doesn't have perfect recall, he just has a very strong memory of some specific events.
Prosecution thought he was stupid and thought they could take advantage of him. He clearly disproved that notion and had the prosecution spend over an hour on the defensive about their own unethical behavior that had nothing to do with this case.
FWIW, unlike a whole lot of other criminal cases, you generally need the defendant's testimony if you want to assert self-defense. So, Kyle was testifying, even though that's generally a bad idea in a criminal case.
I thought we learned from the OJ case that there are a whole lot of incompetent people practicing law, and many of them are in the DA's office. Christ, docket call during my divorce proceeding was a parade of the incompetent, or merely shoddy, before and after we had to elocute. It's not just .Gov who's really bad at their jobs.

I don't know anything in this case other than the partial story that the media spread so I have no idea what happened.

Zimmerman was on the phone with the 911 dispatcher for several minutes after losing sight of Martin. After hanging up and heading back to his vehicle, Martin attacked him.

Maybe, if he had given it to two of them I'd reconsider, but we can't go back even though Rittenhouse, I'm sure, would love to. Far be it for me to judge anything here, but I have seen all the evidence presented and I still can't do what is needed to get a conviction, and that's read Rittenhouse's mind. I can't put myself in Rittenhouse's situation because I know I would never be in that situation as an adult, I could only be there as an immature kid with no sense whatsoever. That can't be what convicts him. I am conflicted about the prosecutor, at first I thought he was trying to get Rittenhouse off and then I switched, but now maybe he was always trying to have him acquitted through any means, it just happens to be with a mistrial with prejudice since he has prosecutorial immunity.

Jurors aren't going to consider the impropriety of the prosecutor's tactics. Even the judge hedges his argument by stating that the evidence would not LIKELY be admissible. The prosecutor got the evidence admitted in the Juror's minds. Huber was also convicted as a domestic abuser, but it fell short of felony level. Still, if you look at the complaints against him, you could definitely characterize him as a "scumbag."

Wisconsin is a Constitutional Carry state. If you aren't otherwise a person prohibited from possessing firearms, you don't need any permit for open carry.

That's not what Constitutional Carry means. Constitutional Carry is when you can carry a firearm in any manner you choose, whether concealed or not, without a permit. If you have to have a permit to conceal carry like in Wisconsin, it is not a constitutional carry state.
