To Save Bars and Restaurants, California Extends Relaxed Booze Rules
Newsom makes the smart move by preserving liberalized alcohol policies.

California Gov. Gavin Newsom signed a trio of good alcohol-related bills last week. The measures extend relaxed alcohol rules for bars and restaurants that were put in place in response to the COVID-19 pandemic.
"Two of the three bills extend outdoor dining permits and alcohol sales at the pandemic-era parklets for a year after the state of emergency ends, giving businesses time to seek permission for permanent approval," the Associated Press reports. "The third allows restaurants, bars, breweries and wineries that sell food to continue offering to-go alcoholic beverages with food orders through Dec. 31, 2026."
Generally, deregulatory measures of this type enjoy widespread public support. And while the California Restaurant Association, Distilled Spirits Council of the United States, and other groups hailed the California vote, not everyone's happy with these laws.
As I reported in 2020, alcohol prohibitionists always opposed Covid-related deregulation that benefited bars, restaurants, and consumers. For example, an April 2020 report by Movendi—a Sweden-based anti-alcohol group—claimed only one U.S. state, Pennsylvania, had "improved alcohol laws" in response to the pandemic. How exactly had Pennsylvania improved its alcohol laws? Movendi hailed Pennsylvania for having "close[d] all liquor stores and other alcohol distributors."
This spring, the Wall St. Journal noted anti-alcohol forces had increased calls for state and local governments to re-ban to-go cocktails and axe other Covid-related alcohol deregulation. So it's little surprise that a coalition of anti-alcohol groups, including California-based Alcohol Justice, opposed the recent California measures.
Generally, Alcohol Justice, Movendi, and others argue so-called "Big Alcohol" is behind these Covid-related deregulatory measures. And while it makes sense that large alcohol companies support efforts to remove barriers that make it harder for adult consumers to buy their products, much of the impetus for extending deregulatory alcohol measures put in place over the past year or so come from small, locally owned bars and restaurants—businesses that have been among the hardest hit by the pandemic.
In fact, for all their talk about "Big Alcohol," opponents of extending Covid-related alcohol deregulation, including Alcohol Justice, find some of their top allies in opposing alcohol deregulation to be, well, "Big Alcohol"—namely, "trade groups representing liquor stores"—which don't want bars and restaurants competing with them for consumers' to-go alcohol dollars. It's yet another spin on the old concept of Bootleggers and Baptists.
Reached for comment this week, Alcohol Justice told me the group would be unable to comment by my deadline. But the group made its position on the recent California legislation clear in a media release it shared last week.
"Choosing public drinking over public health is a social justice issue for low-income and communities of color, pedestrians and drivers already severely compromised by heavy policing, lack of resources, and limited access to walkable and family-friendly city streets," Alcohol Justice wrote. "In addition, promoting the need for non-union, low paying jobs for communities of color to justify alcohol deregulation co-opts social justice and equity to advance alcohol-related profits."
Really? As the Sacramento Bee reported last week, Gov. Newsom signed the new alcohol legislation at a Jamaican restaurant in Oakland that might have been forced to close without alcohol deregulation.
"The restaurant's owner, Nigel Jones, said the state's temporary rules that allowed him to sell takeout drinks helped keep his business afloat during the pandemic," the Bee reports. "He said his restaurant has 'bounced back' thanks to the to-go drinks and the pandemic rules that let him expand his restaurant's eating area outside."
Jones isn't some anecdotal outlier, either. As last week's A.P. report notes, a state lawmaker who sponsored one of the three bills "said six of 10 restaurants in California are owned by people of color, whom he noted have been hit harder than others in the pandemic."
In a 2020 column, I hailed "the loosening of state and local alcohol regulations [as] perhaps the most noticeable, welcome, and widespread" deregulatory effort undertaken in response to Covid. I hailed Iowa for making permanent some of its deregulatory measures, and noted at least four other states looked set to follow suit. They did, and others have, too. In April, for example, a bi-partisan group of Washington State lawmakers extended to-go alcohol rules in the state for two more years. And this summer, Massachusetts lawmakers extended a similar law in that state. They're among at least 20 states, CNBC reported in June, that have moved to make permanent their Covid-related rules allowing to-go cocktails.
In my 2020 column, I noted my own support for alcohol deregulation "before, during, and after the pandemic." I'm pleasantly surprised to see so many lawmakers around the country agree.

The idea that booze is some poison is a cruel myth perpetuated by the puritans who brought us the temperance movement and Prohibition.
During the Revolutionary period, the only way to get reliable and healthy water in the colonies was laced with alcohol. You drank all day because you had a lot of work to do, and having beer, and fortified wine (the only way to preserve wine at the time) was the only way to stay hydrated.
To be sure, there are downsides to a day filled with alcohol. Namely, it is a depressant that can lead to sluggish thinking. There are studies saying that a good amount of the revolutionary period can be tied to the rise of coffee houses in Europe, and the switch of scholars to a stimulant as they held court at the time.
But the idea that walking around buzzed all day was some sort of death warrant is a complete fiction sold by the same nannies who claim second hand smoke will creep through your windows and kill your baby in the crib. I had my IPA faze. Over it years ago. A good red or Scottish is way better. But even getting back into pilsner for the lighter content for hot days.
Then again, I drink mostly whiskey and scotch concoctions.

I've actually had really refreshing honey meads. But spurs are so hit and miss. Either excellent or shit.
I like milder sours, just not the really sour ones. I have a friend that makes mead. It’s delicious. His blackberry is my favorite.
The best sour I ever had was a flemmish brown- not the over the top sour, just slightly sour- that had been finished in bourbon barrels. The sweetness of the bourbon complemented the sourness- almost canceling it, and allowing the malt to really shine through. It was the first time I really decided there was something in sour beer crafting. Unfortunately, just as many IPA makers figured that "good" meant as much grass clippings as possible, many sour beer makers think it's all about making you think you are drinking vinegar.
I love the craft beer movement, especially home brew. I try not to judge anyone actually creating stuff. But please guys- if your goal is a beer that will only be drunk by 20-something Finance-Bros on a dare, you are missing the point.
I love a really potent West Coast IPA, but I have really enjoyed the rise of New England IPAs. With kess bitterness you really get the layers of flavor fromnthe various hops.
Living in Delaware, I am only about 90 minutes from the Dogfish brewery. One of the best things is they constantly make brewery exclusives, which are basically experimental beers or versions of existing beers. They usually have about 10 or so of them. One of my favorites was when they made 5 versions of their 120 Minute IPAs, each with a different strain of hops. That flight was one of the best tasting experiences I've ever had. And they do things like that all the time.
If you're ever in southern Delaware, I highly recommend going to the brewery and trying the unique beers.
English-style hard ciders are great, especially the ones using traditional cider apples and not sweetened. Dry, tart, and layered. Apples like Yarlington Mills, Ashmead's Kernel, and Roxbury Russet make awesome ciders.
We have a long cider tradition, given its prevalence in Colonial and Revolutionary America. It's nice to see the craft coming back.
And no, Woodchuck and Strongbow don't count.

If anyone has a good porter recommendation, I'd love one. They are so hard to find. Most times they are basically created as thin stouts. Something with layers of flavors (possibly finished in a liquor barrel).

The fact that two of the bills are designed to last until a year after the end of the state of emergency and the third until December 31 of 2026 makes me suspicious that they already know how long the state of emergency is going to last.

Biden has decided to not even hide the political prosecutions of congress and his DoJ. In an exchange with reporters yesterday:

The subpoenas in question are a mix of requests from private citizens, gop groups, and Trumps own white house staffers. The latter was deemed executive priveledge and fights over that priveledge are often done in court, not through arrests.
But Biden and Pelosi have so politicized the government that they are doing everything they can to criminally indict those they see as political enemies. Just like the J6 pritestors getting enhanced sentencing for non violent actions of parading while BLM arsonists often had charges dropped.

The narrative around January 6 is of immense importance to progressives, especially as their legislative agenda is experiencing hiccups--much of it caused by their own and Biden's unpopularity. They're latching onto it in the hopes of revitalizing their popularity. From an ethical and rational standpoint, Reichstagging January 6 is disgusting on both counts, but what else should they emphasize?
What part of the progressive agenda or Biden's agenda is popular with Independents? They score points for going after Big Tech and social media, but the part Biden and the progressives don't like about social media--the part that tolerates "misinformation" and free speech--isn't necessarily the part that Independents don't like.
You know how there's a turnover in the news cycle at the end of every week--like how the Haitian immigrant crisis and Afghanistan seem like they happened a year ago already? I think something like that will happen at the end of the year, too. Once society breaks for Thanksgiving, it's like the end of the weekly news cycle, and when we get to after the New Year, it will be like the news cycle begins again. And the stories will all be from the perspective of the 2022 midterms.

In the meantime, Manchin's demands seem to be getting bolder--which may indicate that the moderate Democrats are gaining resolve rather than losing it. It's no longer enough to pass the infrastructure bill first and cut $1.5 trillion out of the bill. They're also demanding that specific provisions be eliminated. Time is not on Biden's side. He is not getting more popular.
And as far as Bernie Sanders running blurbs in the newspapers in West Virginia, I don't think there's a better endorsement. All those Trump voters in West Virginia are likely to think, "Well if he's being denounced by Bernie Sanders for his behavior, then Manchin must be doing a good job!" Being denounced by Sanders is probably even better than being endorsed by Trump in West Virginia. Those people started voting for Trump because Trump was denounced by progressives like Bernie Sanders, too.

I went home to my Alma mater for homecoming this weekend. They are apparently ranked Number 2 in football. I went to the homecoming parade and sat to watch with my wife. We found my sister, my niece and her kids. I did my part collecting candy for the kids - my long arms could reach through the fencing. When the Chinese student organization came through I cornered one and asked if he was a communist. I got a "No" on that one.
When the first political party came through, I shouted an encouragement - "Lets Go Brandon". They seemed to ignore it so I kept it up quite loudly and until they all went past. They would not look my way and they looked sad. My wife, sister, and niece were asking who is "Brandon?" I just said "They know Brandon."
The next political group came through at the end. I also gave them the encouragement - "Let's Go Brandon" They reacted quite differently. I got a thumbs up from the pretty girls carrying the sign. And they were all laughing and acting confident.
My niece had googled who Brandon was by then and at the end I told her "These people want to make slaves of us, Don't let them." And she agreed. Her husband, who I believe is a converted liberal, came over and shook my hand and smiled at my courage. We were in the most liberal city in Iowa.
I may never have to go to a parade again with my wife.
The football team lost in an embarrassing manner.
And this year the queers did not march. No awkward pause when everybody looks away and distracts their children from the parade. Quite nice actually.

I will say this: blaming objects that lack consciousness for the decisions we make is a red flag indicating a terrible manager--at the very least. Other governors in the same situation made different decisions than Newsom did with different consequences, and because there are no good options, doesn't mean we aren't responsible for choosing the best options among the bad ones. In fact, that's his job as Governor of the state of California.
I'd rather see a manager defend his own bad decision than blame it on market forces, physics, inanimate objects, or unthinking viruses. If Newsom isn't responsible for the choices he makes, and he thinks his choices are being driven by viruses, then maybe he needs to be observed in a rubber room for 72 hours by a professional to see if he's a danger to himself or others.
