'Domestic Terrorism' Fears Will Be Used To Justify Increased Snooping and Harassment

The Biden administration is greatly increasing FBI caseloads and agents. That's bad news for anybody who is worried about federal overreach.

After the pro-Trump demonstrations and breach of the Capitol on January 6, the Biden administration is promising a new era of FBI snooping, harassment, and provocateuring.

FBI Director Christopher Wray told the Senate Committee on Homeland Security and Governmental Affairs in a statement released on Tuesday that his FBI "has surged resources to our domestic terrorism investigations in the last year, increasing personnel by 260 percent." Those remarks are bad news for anybody who is worried about federal overreach.

The events of January 6, Wray said, prove "a willingness by some to use violence against the government in furtherance of their political and social goals." Furthermore, "the insular nature of their radicalization and mobilization to violence and limited discussions with others regarding their plans," Wray said, "increases the challenge faced by law enforcement to detect and disrupt the activities of lone actors before they occur."

Of course, experience shows us that when it comes to the FBI, "detect and disrupt" often means "encourage and then arrest" people who were no real threat until the FBI itself goaded them. Deciding beforehand that a set of people with certain beliefs inherently require more probing federal investigatory eyes all but guarantees a repeat of the sort of harassment of Muslims in the U.S. that followed 9/11.

As reported in The Huffington Post:

The FBI has more than doubled its domestic terrorism caseload in little more than a year and a half…"from about 1,000 to around 2,700 investigations," Wray said….The Biden administration is seeking more than $100 million in new Justice Department spending to address "emerging domestic terrorism threats," including $45 million for the FBI to add more than 80 new special agents and nearly 100 new FBI positions to help "detect and disrupt domestic terrorism (DT) threats nationwide."

Federal law enforcement officials and their allies often fret about the lack in many cases of specific "domestic terrorism" statutes that can be brought to bear when people commit certain crimes against a person or property. But in America, this is as it ought to be: Crimes against persons or property should be punished by law without worrying overmuch whether someone had a particular political thought or belief that motivated the crime.

Indeed, despite how the protests and Capitol breach on January 6 have been used as a prime example of a domestic terror threat and inspired Wray's anxieties, the 650 arrested so far for their actions on that day have been charged just with the specific crimes they are alleged to have committed, without being formally characterized as domestic terror. For the 62 who have pled guilty already, the majority pled to "Parading, demonstrating, or picketing in a Capitol building" (though at least 50 of the other arrested face charges related to violent assaults on officers). That the charges for January 6 involved what the accused did and not what they believed is the right approach.

Still, increased law enforcement focus on domestic terrorism predates January 6 and the Biden administration. America already saw in fiscal year 2020, as reported by Syracuse University's Transactional Records Access Clearinghouse (TRAC), "183 domestic terrorism prosecutions filed by U.S. Attorneys' offices around the country—the highest total since government tracking began a quarter of a century ago. This compares with 69 such prosecutions in fiscal 2017, the first year of the Trump Administration, 63 domestic terrorism prosecutions during FY 2018, and 90 such prosecutions during FY 2019."

Those prosecutions involved a variety of underlying behaviors for which the "terror" designation was basically an add-on. As Syracuse's TRAC reported, "cases U.S. Attorneys' offices categorized as domestic terrorism were brought using a variety of lead charges, including….assaulting, resisting, or impeding officers or employees….threats against the President and successors….knowingly entering or remaining in any restricted building or grounds….the importation and storage of explosives….civil disorders….interstate communications; and…making threatening communications. In addition, regulatory violations were sometimes the lead charge, such as failure to comply with official signs or creating any hazard on property to persons or things."

In other words, most of these "domestic terror" cases did not involve acts that the average citizen would fear as on par with the colloquial definition: actual deliberate destruction of life or property for a political cause.

A discussion from earlier this summer on the Lawfare blog helpfully summed up just how intrusive federal law enforcement is going to be in the name of fighting domestic terrorism:

the newly established Center for Prevention Programs and Partnerships (CP3) [within the Department of Homeland Security] is intended to leverage community relationships in order to empower neighbors, friends, and family to recognize the signs of radicalization and report them to the appropriate authorities…. Along with the newly minted CP3, DHS established a new domestic terrorism branch within its Office of Intelligence and Analysis in May. The primary goal of the branch is to improve intelligence gathering on domestic terrorism, especially through social media monitoring.… [T]he department is now working to survey social media postings for indications of domestic attacks or DVE-related activities.

That this sort of law enforcement, concerned as it is with crimes that have not yet occurred, requires unlovely levels of snooping is clear from Wray's statement to the Senate on Tuesday that "the problems caused by law enforcement agencies' inability to access electronic evidence continue to grow." In other words, Wray is worried that any citizen can communicate to anyone anywhere without the FBI snooping on them.

These are worrying developments that can and should be checked before Americans find themselves the victims of a massive expansion of the national security state just as they did after 9/11.

My impression of the shooting, based on what I had been told was that there was this massive crowed of angry protesters… rioters (I have no problem with that designation) with one lone officer facing them off. As they crawled through the glass he was afraid of being overwhelmed by 500 angry Trumpists who are Known to be violent murderers.

            In no particular order:

            1. The crowed coming through the glass (yes, violently, smashing the glass and trying to breach the door) was nowhere near as big as I thought.

            2. There were a large contingent of armed federal agents with assault rifles, helmets and body armor with the group. Literally right there behind them.

            3. Those armed federal agents could have taken a more active role in the suppression of the people attacking the window and door.

            4. Various people in the crowd noted the gun and seemed to back off, leaving only a couple of people still trying to get through the window, that being Ashley Babbitt.

            5. As soon as Babbitt was shot, the armed federal officers were standing around the body (once the camera turns to Babbitt’s body), and it becomes obvious how anemic the rioter crowd was. It seems as if they were literally outnumbered.

            this leads me to thinking about the BLM/Antifa riots of 2020 where night a rioter or protester was shot, let alone roughed up. It puts me in mind of very large numbers of rioters assaulting people, smashing themselves violently into buildings, attempting to set occupied buildings, attacking police stations and literally chasing out the police from said station while nigh a protester was even arrested. Attempts to set stations on fire, while locking people inside.

            Videos of a federal building door being attacked, with ambushes set up outside to attack federal officers when they exited said doorway. I could go on.

            The point being is that if the Ashli Babbitt shooting was fully justified, then it would have been absolutely justified to have flatbed trucks piled with the bodies of BLM/Antifa protesters, and nary a peep from the media could be justified.

            If snatching a few violent rioters off the street and detaining them was an affront to human rights that made the Nazi Death camps look tame in comparison, then the shooting of Ashli Babbitt wasn’t even CLOSE to being justified.

There’s an article up on the WSJ titled, “Abolish the FBI” about . . . um . . . how the FBI needs to be abolished–mostly because of the abuses the FBI perpetrated against President Trump coming to light as part of the Durham investigation. I’ll agree that the FBI has become increasingly dysfunctional as its focus changed after 9/11 to include international terrorism, and there’s no question that they will violate the rights of innocent Americans under the guise of fighting domestic terrorism. Their budget isn’t justified without results.

    However, in terms of the ugly truths that are being exposed as part of the Durham investigation in regards to the FBI’s behavior towards President Trump, there’s nothing new about that. It isn’t a question of who is running the FBI or how its being run. You simply can’t have an organization like that with the ability to create power for itself through political subterfuge and leaking to press and not have it trey to abuse its position for its own advantage. The Praetorian Guards engaged in the same kind of subterfuge, and the FBI has been doing the kind of thing they did to Trump since day one.

    The FBI needs to be under constant examination by independent counsels–like a publicly traded corporation needs to undergo scrutiny by outside auditors on a constant basis. There is no question but that the FBI will abuse their position if they can, and if investors can’t and shouldn’t trust someone in a publicly traded company to vouch for their own ledger, there’s no good reason why the American people should trust the FBI to police themselves given their position. Sooner or later, they definitely will abuse their position without constant, outside supervision.

            Ever wonder why the Capital Police have adamantly refused to release any of the thousands of hours of video they have of the protests that day? My theory, shared by many, is that it is because the video would show the vacuousness of the charges. They would have shown an almost entirely peaceful milling around of colorful characters on a lark, and probably most of the rare violence committed that day was by unindicted coconspirators (I.e. most likely AntiFA instigators, several of which have been identified, but none arrested). In any case, release the video, so the rest of us can see what so panicked Harris, Pelosi, and your precious intelligence community.

  41. There was no insurrection. No one brought a gun. There was no logistical support for any military operation. The only shooting was that of an unarmed protester shot by security. I too was mad about the election because in some states they mailed out ballots to every registered voter and in some places activists collected them from the uninterested and turned in ballots by the boatload. I just wasn’t willing to protest or especially riot over it. Is this provable? Probably not because no one is trying to prove it. Did it happen in red areas too? Probably. But since there are no red cities: advantage Democrats. I remain amazed that anyone can, with a straight face, argue that voting is the lone instance where every avenue of abuse won’t be seized with gusto as it certainly is in every other form of human endeavor. So from the Democrats point of view, hiring lots of FBI and snooping etc. is going to be required because they have no intention of stopping what they’re doing. Go back and examine the turnout ratios and the split between the candidates in every prior election and you will find better correlation between similarly comprised areas. The turnout will be similar as will the split between the (R) and the (D) in that particular election. The bluest areas of Atlanta are not that different from the bluest areas of whatever city. Also, examine the ratio between the candidates in any given precinct. Early on a split will develop that will remain fairly constant throughout. When you have a handful of batches that diverge wildly from the pre-established ratios…something is likely amiss. We can’t have half of the country believing something fishy is going on. We need to satisfy most people that everything is above board. Otherwise you’re going to need 3 times the number of FBI and 10 times as much monitoring because it will fester. The ID-free elections, especially in the age of vaccine passports (lol), are over. If you need papers to eat in a restaurant you need them to vote. Same day registration is also an avenue for abuse. No one should receive a mail-in ballot unless they specifically request one online or over the phone. Mass mailing ballots is an in-your-face affront to everyone that values electoral integrity. Fix it before it degenerates into something we all want to avoid. If you wait until one party dominates every national election past any historical precedent it will be too late. Waiting until it is obvious and undeniable will be too late.

  46. The FBI needs more agents. Many of them are members of the groups they are watching such as the Proud Boys, Oath Keepers and 3%ers. After the Jan 6 riot many of the leaders, planners and instigators are being protected by the government. Stewart Rhodes the leader of the Oath Keeper is just one. Maybe getting the FBI out of these groups that never did this until they were infiltrated would be a better idea. The attempted kidnapping of Whitmer involved 18 terrorist with 12 being FBI.
