Former Minnesota Department of Corrections transport sergeant Randy Beehler has been sentenced to 120 days in jail followed by seven years probation after pleading guilty to third-degree criminal sexual conduct. Beehler was transporting a female inmate when he stopped at a McDonald's to get something to eat. The woman said she would "do anything" for some food. After ordering meals for both of them, Beehler stopped the vehicle, took her handcuffs off, and brought her up front with him where she performed oral sex on him as he drove. The woman reported the incident to corrections officials the same day.

She didn't consent, she propositioned. If she didn't want to "do anything" for some food, she shouldn't have offered to "do anything" for some food.

If this was consensual, it was bribery; if not, it was abuse.

Since we know ahead of time that it will be very difficult to tell the difference — and since there is no social benefit to be gained by allowing consensual contact between guards and prisoners — we draw a bright line: prisoners cannot consent to sex, whatever their state of mind.

We do the same thing with children vis-à-vis adults, students and teachers, patients and medical professionals. Yes, it certainly criminalizes some relationships that would — if we had infinite wisdom and insight into the situation — be harmless or even healthy, but it is necessary to forestall cases of abuse that would more common and very damaging.
