Congressional Democrats Want To Vote Themselves Into a Supreme Court Majority

New legislation to be introduced in both the House and Senate today would add four justices to the U.S. Supreme Court. If successful, this would bring the number of Supreme Court justices to 13.

"The number of justices on the court, which is set by Congress, has fluctuated throughout the course of the nation's history, reaching as many as 10 seats before settling on nine in 1869," notes The Intercept. So, it would be perfectly legal, and not unheard of, for Congress to shift the number of justices.

And yet…a  Democratic-controlled legislature doing so at a time when conservative justices outnumber liberal justices 6–3 seems—and adding not one or two more spots but enough justices to see that, if appointed under President Joe Biden, liberals would once again hold a Supreme Court majority—smacks of partisan politics, not fulfilling legitimate legal needs.

The Senate bill will be introduced by Sen. Ed Markey (D–Mass.) and the House bill is backed by Reps. Jerry Nadler (D–N.Y.), Hank Johnson (D–Ga.), and Mondaire Jones (D–N.Y.). As a reason why, Jones cited cases that were decided in ways he didn't like.

They're slated to hold a press conference about the effort on Thursday morning.

"But there's little chance the bill will make headway," notes The Wall Street Journal.

Republicans are united in opposition to a plan that would undo the conservative majority on the Supreme Court, and even many Democrats critical of the court are reluctant to prejudge the issue while Mr. Biden's commission is at work.

Moreover, some liberal-leaning scholars and jurists, including Justice Stephen Breyer, have suggested that altering the court's makeup for ideological reasons would damage its reputation as an apolitical body.

Mr. Markey disagreed, arguing that adding four justices—thus allowing President Biden to create a 7-6 liberal majority—"will shore up the public's confidence in the court and its legitimacy in the public's eyes."

U.S. will finally withdraw troops from Afghanistan. Biden announced on Wednesday that, after nearly two decades, it is "time to end the forever war" in Afghanistan. "War in Afghanistan was never meant to be a multigenerational undertaking," Biden said. From The New York Times:

Speaking from the same spot in the White House where President George W. Bush ordered the start of the war after the Sept. 11 attacks nearly two decades ago, Mr. Biden made a case that there was no longer any justification — if there ever was — to believe that the United States military presence could turn Afghanistan into a stable democracy.

The roughly 2,500 American troops on the ground there, he said, would be gradually withdrawn starting on May 1, with the process complete by Sept. 11, a timetable intended to signal his determination to end a vexing and largely failed chapter in American foreign policy.

Military officials suggested the exit could be even more rapid, leaving only a token guard force for the American Embassy. NATO forces, which today have a far larger presence than the United States, would also depart, European officials said.

Mastercard caves to anti-porn groups. Under pressure from religious groups, Mastercard is tightening the screws on adult businesses. In order for Mastercard to be used in interactions with online adult businesses, it will now require those businesses to have identity verification on all content creators, review all content prior to publication, and enact a slew of other specific content moderation processes. Since these rules go way beyond what is required of Facebook and other social media sites—which have been found to have a way bigger problem with criminal sexual content than, say, Pornhub—this is clearly more of a political move than anything else.

Mastercard and other credit companies have been under pressure from anti-porn religious groups (such as Exodus Cry) and others to stop doing any business with Pornhub, OnlyFans, and other purveyors of online adult content, much like they were pressured to stop doing business with Backpage and Craigslist a few years ago.

          Joe Biden won the first presidential debate BECAUSE Trump had spent myriad months lying about Biden's mental status, claiming Biden has dementia, that he can't finish a sentence, and that he has to take "performance enhancement" drugs to prepare for public speaking events. In a very nonsensical maneuver, Trump insisted they do a drug test in advance of debate 1.
          (What would they test for? Caffeine and nicotine? It's not as if meth has a reputation for turning people brilliant and articulate.)
          So everyone, including Trump State Media, was expecting Biden to be slow-thinking, drooling, and no match for Trump.
          When viewers saw that Biden was calm, collected, and capable of expressing himself in entire paragraphs -- while Trump was his usually bombastic-buffoon self who could not abide by the debate rules he had agreed to -- Biden overwhelmingly came across as winning.

        So did I. They must be pretty confident of Roberts' vote going forward, to risk a nominal 1 vote majority.

        I don't see it passing unless the Democratic leadership engage in some pretty dirty procedural tricks that would guarantee losing Congress in 2022.

        So I think they either won't do it, or if they do it, they'll go on to rig our elections to the point where they simply can't lose next year.

        No middle ground.

            No because of the presidential veto. You need the presidency and both houses of Congress. Also, slashing downwards creates the problem of who's off the court. Therefore, you can only increase the number of justices, and you need unified government to do so.

        I wouldn't call Roberts a conservative anymore. Frankly, I believe Obama's spies (you do remember they illegally spied on the Senate Intel Committee staffers' computers, and also on Trump's campaign) spied on the conservative judges and found dirt on Roberts which they continue to use to blackmail him. You can call it a conspiracy theory, but IMHO, it's the logical explanation for Roberts' behavior. Thus, I'd call Roberts a compromised, flawed, individual like most of us, who made a mistake he regrets.

          If Roberts did anything to be blackmailed I would think that someone would have spilled the beans by now. I always suspected he took a bribe. He gave every indication he was going to vote to strike down the ACA and was hoping Kennedy would uphold it.

                  Ultimately, I don't think that will be possible if the Dems keep trying to turn us into Venezuela. The pandemic and the mass hysteria that the media fomented in its wake has made it impossible in the long run for any real reconciliation. The only long-term solution is going to have to be a national divorce if we want to avoid some really bad shit happening.

                    Like i said, if they really tried that, all bets are off. Every red state would be fully justified at that point to tell the feds, "fuck off, we're going our own way."

                    It would be utter chaos--when you look at the electoral map, a lot of these states consist of population-dense deep blue urban areas that are surrounded by low-population red exurbs and rural areas. So you'd have intra-state revolts with the red hinterlands and blue cities breaking apart, with real, actual road wars and sabotage taking place. And the irony of it all is that every 20th century communist made it a point to cultivate support in the rural areas, not the cities.

          I think there is a very real threat to Republicans, especially in districts with an influx of blue-state city dwellers that are shifting the balance from reliably red to purplish. If they succeed in nuking the filibuster and packing the court, they won't need a supermajority, they'll just need a simple majority, especially if they manage to rig election laws just enough that they can rely on a democrat VP. All the really need to ram their agenda through is to maintain the situation they have right now.

        Plus, gay men tend to be pretty generous tippers because they're usually in the upper income brackets. When I waited tables in college, gay men always gave the wait staff the best tips, while the church groups were the worst--other than seniors, but that was because they were stuck in a paradigm where a slice of pie cost a dollar and ten cents was plenty for a tip. The church groups were just cheap-asses.

Plus, we figured if they got shitty service, they'd be less likely to stop by in the future.

              Groups like that are the reason that "all parties above ____ will automatically have ______% added to their bill" was put in place--because they would cheap out, or in some cases, couldn't do math.

              Splitting the check sometimes helps overcome that, because they end up going off of their own specific bill rather than the poor math they're doing in their head from the consolidated one. Even if they're still leaving a shitty tip, the cumulation can sometimes get you at least something manageable for the time spent.

              Another trick I figured out for larger families (7-12 tops), if they had grandparents with them, was hand the bill to the middle-aged father when he and grandpa ended up fighting over the check. The grandpa would, almost without fail, tip no more than 12%, while the dad would tip 20% or more 9 times out of ten.

          Doctors are the worst tippers of all. They feel the world, including waitstaff, owes them something because they are a doctor. Work in a bar/restaurant near a hospital like I did and you'll see. On Friday's, I used to come in an hour early to make seven pizza's for a doctors' weekly staff meeting at the hospital. Then, I would carry the seven pizzas two blocks to them in the hospital. I never got so much as a penny from them; they would give me a check for the exact amount. The only time I ever got a tip, their secretary had to receive the order. She asked what they usually tipped. I was honest and said zero because at that point I would rather get a shitty tip but make them look bad in the eyes of their staff. She ended up giving me $5, which was still a shitty tip on seven pizzas, even in 1989.

      - Represented slave holders whose goal was to maintain slavery,

      - Opposed Lincoln's Emancipation and Constititional amendments that freed and gave rights to slaves/blacks,
      - Attacked blacks who ran for political office or vote in the South,

    It's become painfully obvious that Donald Trump losing the presidency in 2020 was the biggest disaster for libertarian capitalism since FDR, and may prove to be even worse than the New Deal over time. Being painfully obvious, however, isn't really good enough.

    The fact is that as the Democrats become increasingly authoritarian and increasingly socialist, it is entirely appropriate (and maybe even absolutely necessary) for libertarian capitalists to become increasingly Republican. In pragmatic terms, there is no way to stop the country from becoming more authoritarian and more socialist without the Republicans winning significant victories in 2022 and 2024.

    No, it isn't enough to admit that Donald Trump losing in 2020 was a disaster for libertarian capitalism. It's also necessary for us, as individuals, to acknowledge that to whatever extent we contributed to Trump's loss, we are responsible for the country becoming increasingly authoritarian and increasingly socialist--to the same extent.

    Without that acknowledgement, how do we warn people away from making the same mistake again in 2022 or 2024? Is it possible that the Democrats losing control of the House to the Republicans in 2022 could be bad news for libertarian capitalists? Is there any way that could be considered anything other than good news? Is it realistically possible for the Republicans to nominate someone worse than Joe Biden has been on authoritarianism or socialism? I don't think it is!

They concluded that voters who waited until election day to make up their minds, went heavily for Trump. One conclusion: voters shouldn't be given the opportunity to vote 4-5 weeks before Election Day as late-breaking news (e.g. Hunter Biden corruption) is likely to sway votes.

            That's not a given. It would be after electoral votes were cast. However, it's conceivable that if the presidential candidate died after early votes were cast, there'd've been time for their respective parties to pick another presidential candidate who would not show up on popular ballots but be known as the person they'd tell their electors to vote for. Depends a lot on timing and the popularity of the vice presidential candidate. Harris did so badly in the presidential primaries, it would seem the DNC would've been eager to not have her as the effective presidential candidate. If the replacement were found early enough, some states' ballots could have a new name sent by the Democrats' state secretary.

        Selection of electors of a state is determined by the laws of that state. So if a candidate dies after votes are cast but before election day, that state’s election law would need to have addressed that possibility. Absent that, the state government would decide. There likely isn’t any resolution at the Federal level.

        Some individuals are professional writers and wrote articles trying to persuade people that there wasn't any substantial difference between Trump and Biden on policy--because neither of them were perfectly libertarian. And to whatever extent those individual writers persuaded some voters to stay home in swing states or stay home during the Senate runoff elections in Georgia, those individuals are personally responsible for whatever authoritarian and socialist policies are a result of that--to the extent that their articles contributed to making those policies both possible and a reality.

        We are responsible for what happens as a result of our choices to the extent that our choices have an impact on what happens, and to the extent that the authoritarian and socialist policies we suffer are a result of our failure to persuade others to do the things we needed them to do in order to avoid these authoritarian and socialist outcomes, we are responsible for them.

        Unless we accept the responsibility for our actions last time, it is likely that we will make the same mistakes in 2022 and 2024.

        I am generally not a fan of Ayn Rand or her writing, but the best thing she ever wrote was in Atlas Shrugged, where she went through the cars in the train when everyone suffocated, with something like a Gunther Grass floating camera eye and showed how each person had contributed to their own deaths in their own way--to various extents. One was a philosophy professor who taught his students that they weren't personally responsible for what they do--it's just a function of outside forces. He suffocated to death because the system tolerated other people's incompetence. Person by person, they had all contributed to the state of society that made the conditions of their deaths possible.

        The people of Venezuela didn't only suffer starvation conditions because Maduro is an awful person and made bad decisions. They suffered starvation conditions because they supported Hugo Chavez all those years ago and failed to oppose him when he nationalized food distribution. To the extent that anyone contributed to the election of Hugo Chavez is the same extent to which they contributed to the starvation experienced by the Venezuelan people as a result of those policies. Those policies were not a surprise, and after they were instituted and it was clear what would happen, a majority of Venezuelans voted for him again!

        There was no mystery about what the policies of Biden and the Democrats would be before the November election in 2020 and the Georgia runoffs on January 5, 2021. To whatever extent we failed to do what was necessary to avoid this outcome, we are to blame. Because some people are far more to blame than others doesn't mean we didn't contribute to these policies. To the extent that I failed to persuade my fellow libertarians and my fellow Americans to vote for Trump and the Republicans, I am responsible. I don't want to make that mistake again, and the first part of that is admitting that I made a mistake.

          But the real problem with your claim is if court packing bills are dead in the House for this session that means next session it will be an election issue.

          I get it that the pinko commie creep dems want to pack the courts but they are a small, and seemingly getting smaller, group and lots of more moderate dems are pushing back.

    Article I (Congressional Power) says only this about courts "To constitute Tribunals inferior to the supreme Court"

    Clearly, this means the Founders did not want Congress to be able to change the number of SC Justices. Can someone point to Letters from ~1800 discussing this issue? My take is the number of justices needs clear a high hurdle to change the number of SC justices. If Congress can constantly change the number of justices, then this would make the three powers unequal.

      It does identify a supreme court.
      (Article 3, section1: The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish . . . )
      Later it identifies that the supreme court will have a chief justice, in that the chief justice is judge in an impeachment trial.
      So congress gets to pick what the supreme court is, as long as it has a chief justice.
      Maybe 2020 will teach voters that minor detail.
