Brickbat: Well, Schertz

A Schertz, Texas, police detective will be given "employee coaching" after an investigation determined he provided false information to get a search warrant. Cpl. Chris Martinez told Guadalupe County Attorney David Wilborn that an informant had seen marijuana inside a home within the past 24 hours in a search warrant affidavit. Based on that, Wilborn approved a warrant request, and a judge signed the warrant. But Martinez had earlier told two employees of the county attorney's office that the informant had not seen any drugs. Martinez later admitted the information on the affidavit was false and blamed it on a "cut-and-paste error." The search found nearly 200 grams of marijuana brownies, but Wilborn says he cannot file any criminal charges because of the misinformation in the warrant.

Sounds like that's exactly why he should be filing criminal charges... against his man.

He'll be 'coached' to lie better and cover his tracks.
Well, Schertz!
I suppose he won't be getting any brownie points for this one.
Hah!

Was that wrong? Should I not have done that? I tell you, I gotta plead ignorance on this thing, because if anyone had said anything to me at all when I first started here that that sort of thing is frowned upon… you know, cause I’ve worked in a lot of offices, and I tell you, people do that all the time.
Ok George.
No warrants based on "confidential informants".
There must be a real live named person who can b questioned by the DA and/or Judge, or the warrant is evidence of fraud.
And Nancy Pelosi is a caring truthful statesman, not a lying weasel.
(excuse me, time for my meds)
How is this not included in the right to confront your accuser?
Since when does the political class want their accusers named? Like the guy whose tale about what Trump allegedly said on the call with the Ukrainian president, that led to his impeachment, where this "source" never testified or was questioned. They much prefer to just say you broke the law, and throw you in jail if they don't like you.
Seeing marijuana inside a home??!! What kind of animals are these people? I say lock em up anyways!
Huh, 200 grams of marijuana brownies? So assuming a two inch square brownie that's how many - 3, 4 if they're thin?
My thoughts exactly. 200 grams of brownie is not very much....
Also, I would be very suspicious that the testing of the brownies involves ingestion.
Like they started out with 800 grams of brownies, but 600 grams were consumed in 'testing'.
Brownies. Who the fuck cares? Why did anyone even think this was police worthy? What is this, 1990?
THE WAR ON POT IS OVER! Except in Texas. Sigh.
Exactly. Problem is, if you make a law against something, cops [and prosecutors] are going to pursue it no matter how stupid it is.
But just think; if Sleepy signs an executive order put in front of him banning most types of guns, look at all the work the ATF and police will have to choose from. Wonder if someone will "think they saw" and "assault rifle/ weapon of war" through my window and go and get themselves a handy little warrant?
MJ remains illegal in the following:

Georgia
Idaho
Indiana
Iowa
Kansas
Kentucky
Nebraska
North Carolina
South Carolina
Tennessee
Texas
Wisconsin
Wyoming
I recently travelled South from my home in Michigan, and learned [by chance from a hotel clerk; I don't use the stuff since many years ago] that if a person were to transport marijuana across the State line, from where recreational use is entirely legal in Michigan but illegal in Indiana, you could be charge with felony transportation of an illicit substance.
It is like guns; fine in some States, but will land you in jail in others [like New Jersey].
It was not obvious to you that transporting a substance to a place where it's illegal would be... illegal?
Well since I wasn't transporting any, I did not think about it. My point, Mr. Snark, is that one should never get comfortable with something that is completely legal where they live and ass-u-me that it would be ok just across a State line.
200 grams of brownie is a snack not a crime what the fuck
Behind every bad cop is a bad police chief and prosecutor, ready to help cover up the cop's crimes.
Read the linked article. It claims that the cop is not being fired or prosecuted for lying on the warrant application because he "accidentally" carried over the language about a confidential informant seeing marijuana when he copied from previous warrants, and didn't intend to lie.
But before this, he had told a prosecutor about the evidence he really had - watching across the street while the suspect apparently sold something unknown out of his garage - and was told it wasn't enough. Then he went to someone else and told them the lie about the confidential informant orally, and finally he put that lie in writing and signed it. He intended to lie, and the prosecutor is lying when he claims otherwise.
