'We're Not Doing Anything Wrong': This Pennsylvania Brewery Refuses To Obey State's Indoor Dining Ban

And it isn't alone. Pennsylvania has banned indoor dining through the end of the year, but dozens of businesses are banding together to defy the mandate.

It's a few days before Christmas in Bethlehem, Pennsylvania, and there is plenty of room at Seven Sirens Brewing Company.

The brewery's 7,000-square-foot tasting room has a fire code capacity of 320, but during happy hour on Monday, there are only about a dozen patrons scattered around the place, sitting in ones and twos at socially distanced tables and sipping beers served by two masked bartenders. Whether they know it or not, everyone here is engaged in an act of civil disobedience, challenging Pennsylvania's ban on indoor drinking and dining that will continue through New Year's Day, at least. It's a policy that assumes all establishments in the state are equally risky—that a tiny, crowded diner or coffee shop is no different than a massive, mostly empty beer hall.

"We're not doing anything wrong," says co-owner Jordan Serulneck, a 32-year old with a full beard and surprisingly cheerful attitude given everything that's happened since Seven Sirens opened in mid-February—just weeks before the pandemic hit. "It was the best timing," he says with a weary laugh.

When Pennsylvania Governor Tom Wolf ordered indoor dining to close in March, Serulneck dutifully shut his doors. But what started out as a temporary shutdown was extended several times before the restrictions were finally lifted during the summer. When a new statewide shutdown of bars, restaurants, and breweries was ordered for the Wednesday night before the Thanksgiving holiday—typically a major night for social gatherings—Seven Sirens refused to yield. The newest ban on indoor drinking and dining went into effect on December 12, but 10 days later the beer is still flowing here.

"We've been enforcing the same measures here that we did during the summer and we've had no problems," says Serulneck, pointing to the tables spread around the tasting room. With his 67-year-old mother living with him, Serulneck says he takes COVID-19 as seriously as anyone and understands the importance of mask-wearing and hand-washing. Where he draws the line, however, is in listening to orders that come from "people who haven't missed a paycheck in nine months" and who don't seem to appreciate the toll that shutdowns have taken.

"It's been nine months and I don't know how much longer they think people are just going to completely put their lives on hold," he says.

The pandemic, of course, isn't letting up. According to the state Department of Health, Pennsylvania is "in the midst of a spike" in positive COVID-19 tests, with more than 581,000 cases statewide as of Wednesday afternoon. There have been 14,442 deaths caused by the virus in Pennsylvania—a little more than 4 percent of all COVID-19 deaths in the country.

The real crisis in Pennsylvania isn't centered on restaurants or breweries, but nursing homes. Almost 70 percent of the COVID-19 fatalities in Pennsylvania have been tied to nursing homes. According to a New York Times analysis of COVID-19-related deaths in nursing homes, six of the 10 deadliest facilities in the country were located in the Keystone State.

Indoor dining has been identified by some studies as a major vector for the spread of COVID-19, and people should be aware of the risks. But after nine months of being warned about avoiding crowded indoor spaces, the government should trust proprietors and individuals to make their own assessments about what risks to tolerate. After all, the government appears to trust shoppers who packed the parking lot of the Lehigh Valley Mall a few miles down the road from Seven Sirens.

Serulneck is hardly alone when it comes to ignoring the state's shutdown order. PALockdown.com, a website that encourages residents to patronize businesses "standing up to the unconstitutional mandate," lists dozens of restaurants, bars, diners, breweries, and other establishments defying the dining ban. A Facebook group promoting the website has more than 68,000 members.

But the state is striking back. Last week, at least 150 businesses got notices from the Wolf administration threatening legal action, including fines of up to $300 per day, if they refused to comply with the indoor dining ban. On Wednesday, the administration ordered 40 restaurants closed for defying the governor's order.

So far, Seven Sirens has avoided the government's hammer—though Serulneck says the brewery has received warnings from local and state agencies. He's hopeful that a groundswell of civil disobedience will leave law enforcement overwhelmed, or simply unwilling to punish their neighbors.

In some places, that's already happening. The sheriffs of Elk, Lancaster, and Westmoreland counties say they will not enforce the state's indoor dining ban this time around. Westmoreland County Sheriff James Albert told Trib Live that his 40 years of experience as a law enforcement officer and judge have taught him to find a balance between enforcing government mandates and "protecting individual civil liberties."

Judges will have their say too. In September, Judge William Stickman struck down large portions of Wolf's previous COVID-19 lockdown mandate as an unconstitutional use of the state's police powers. By then, however, much of the earlier mandates had been lifted.

Now, a group of bars and restaurants have filed a new lawsuit against the Wolf administration, hoping to build upon that September victory to overturn the newest lockdown. But it seems unlikely that there will be a ruling in the case before the shutdown is scheduled to expire on January 4.

In the meantime, business owners like Serulneck are risking their licenses and livelihoods to stay open—doing the best they can to respect public health guidelines and keep employees and patrons healthy. He has to duck out of our interview to participate in a conference call with other business owners who are banding together to defy the state.

"You have an inherent right to provide for yourself and your family, and that's not suspended during a time of emergency," he says. "Those rights weren't granted by a governor, so they can't be stripped away by a governor."

    Call me a postmodernist if you will, but this by no means an established fact. I'm not saying the virus isn't potentially deadly. As a survivor, I know that I have some "underlying conditions" the odds were very much in my favor and I wasn't in much danger. But there is incentive to pump up the numbers to justify the various governments' economy-wrecking mitigation demands, just as there were incentives to work to wreck or save state businesses depending seemingly on respective governors' political affiliation.

    Philadelphia's reported numbers doomed the rest of the commonwealth to Harrisburg's dictates. Western Pennsylvania - even Allegheny County - didn't see numbers to justify Wolf's various actions. But the Pajama Class* - with their own similar agenda - who live in urban hot zones hyped this police-enforced destruction (even as they hoisted the BLM flag) while minimum wage deliverymen paraded to their doorsteps with life's essentials. It was just too bad this guy's living wasn't essential to them. END OF RANT.

        My hospital here in Florida has definitely suggested we increase the tally of corona deaths.
        Any case that is borderline, we are to code as corona death.
        If we can get above a certain percentage of deaths/corona deaths, the hospital gets a lot of money.
        So it is official policy to make as many diagnoses as possible

    That's how you do it, you keep rolling over 30-day "temporary" emergency orders and by the time anybody can get a lawsuit before the courts, oops, the temporary emergency order has expired and the whole thing gets mooted out of court.

    Oh, and by the way, Boehm, great work on outing these fuckers to the authoritahs so they can be sure to get the beatdown they so richly deserve for openly defying the state - you did a wonderful job by not using pseudonyms or anything so the Gestapo know exactly where to find them. You wanna tell them where Anne Frank's hiding, too?

    I must take umbrage with your characterization of Indoor Dining being a major vector for Covid-19 infections. That just isn't the case, and the numbers don't bear that out. And, to top it off, the studies do not distinguish between diners and restaurant workers that have contracted the virus. The large number of confounding variables to the studies indicate that it is way too early to draw those conclusions and it doesn't look like we ever will get to the root causes for many infections.       I agree with you that it is unknown due to confounding variables. You don’t need a lot of statistics for that. Same as the mask debate.

      What we do know is transmission is mostly respiratory. The virus does not magically go from one person to the next. Thus distancing, hygiene, and possibly masks in certain situations are probably a good idea.

      Like other similar diseases we know just from experience that crowded indoor spaces make it more likely to catch a cold or flu. Someone shows up at work with a cold next thing you know you got it, Marsha has it and so on.

      Restaurants could be done safely enough and sounds like these folks are doing that. So I don’t see what the problem is.

            Nursing homes, jails and some meat packing facilities have accounted for many (perhaps most) super spreader locations.

            Home visits with family and friends have accounted for the majority of other covid transmissions.

            But Gov Tom Wolf (whose disastrous March nursing home policy spread covid among the most vulnerable) has once again banned all indoor dining to make it look like he's doing something to "protect the public" from covid, while destroying thousands of small mom and pop businesses run by Republicans.

              My view is the data seem to agree with common sense, that restaurants are risky for spread, even if they aren't the very riskiest.

              I agree that there is a parallel disaster of economic damage, but it's not caused by Democrats practicing disaster capitalism (Republicans are the ones doing that, or have they raised taxes to pay for covid relief lately?).

              If those moronic assholes would get out of the way we could do the right thing and quarantine everyone while providing money to prop up the economy until the crisis is over. We could have done that months ago at less expense in money and lives. But that's typical. Ignore the problem, engage in magical thinking, then bitch when someone else has to clean up their mess.

                Indeed Tony, why doesn't Uncle Sam just shut down all businesses and then mail everyone a check for the money they've lost? Where would the money come from? Why a printing press of course. Actually, why stop there? Why only mail them what they've lost? There's no way to calculate a price for potential business or especially loss of freedom. How much money is grandpa due because he had to spend the last nine months of his life in what is essentially prison (only to die of a heart attack) instead of enjoying things? So why stop there? Why not just mail everyone a million dollars, or a billion dollars, or a quadrillion dollars. You may think I'm reducing this to the absurd but I'm not. Every dollar you print with no plan to repay it devalues the money already out there, and the people who get killed (yes killed, literally killed to death) by inflation are the poor.

                Or you could just leave everyone's freedom intact, not bankrupt and imprison them, and recognize that the disease (while dangerous) is orders of magnitude less dangerous than things like heart disease or cancer and preventing people from socializing, concentrating vulnerable populations, only makes it worse.

      in California all state government workers were deemed essential. even if they were working from home and not answering the phones at the DMV for months. Newsom did cut everyone's pay 10%, which was surprising, but state revenues were down 40%.

      While continuing to ignore actual real-life data that shows -- OVER AND OVER AGAIN -- that the virus reaches roughly 20% prevalence and then starts crashing.

      This is because many people have t-cell immunity from previous related viruses. This has been known since JULY and Fauci NEVER EVER brings it up. He simply pretends we don't know this.

        It is interesting point about T Cells. Concerning cross reactivity of T Cells from similar viruses what I have found is more questions than answers. It is far from known. I found one preliminary report showing some cross reactivity in the lab. But that says nothing about what actually happens in vivo.

        It is far from clear what the role of T Cells is in infected patients. They are produced but that does not mean they are successful in fighting off the infection. Remember it is always a race and sometimes the virus wins.

        One of the cardinal clinical signs of this infection is that patients who are infected have a decreased lymphocyte count, not an increased one like most infections. So something is going on here.

          The most common reason for a decreased lymphocyte count is an underlying viral infection. As more and more lymphocytes will be involved in fighting off the infection, the count of the lymphocytes would be low when tested.

                That is a basic start. Mayo Clinic has a nice website geared to the layman searching online.

                So it is not so simple as having more lymphocytes fighting and dying. It may be that the viral genome provokes less of a memory cell response or blocks other cells from mounting an effective response.

                Nor is it at all clear that T or B cell memory cells convey effective immune response from past exposure from similar viral exposure.

                I would add that we are talking about a sign not a symptom.

                So in differential diagnosis decreased lymphocytes leads to a very broad ddx. Now narrow it down doc.

        I can assure you that our ICU and isolation beds have the same utilization as before the pandemic.
        I went past the MICU today after doing 2 cases on heist as day.
        There was one patient with a corona diagnosis.
        On nasal bipap.
        We are not and never were close to being overwhelmed with corona.

    The police standing with the business means nothing if the state health department can issue fines and revoke licenses or the power company can cut power or water to establishments that disobey them.

    Some sheriffs are anti lockdown. But when cops are refusing to enforce lockdown, most of that has to do with their reluctance to run into another BLM situation. They'll still patrol Jewish neighborhoods or go after a little boy skating by himself.

    It doesn't even matter. The realignment is inevitable. We're going to see several states become new Detroits in our lifetime. That process used to take 50 years but Covid kicked the can light speed to the end. Talent, resources and assets will start leaving states like CA and NY.
