The Attorney General Says He Hasn't Seen Any Evidence of Fraud That Could Have Changed the Outcome of the Election

In a TV interview on Sunday, Donald Trump complained that the Justice Department and the FBI have not taken his wild claims of massive election fraud seriously enough. He speculated that "maybe they're involved" in the vast conspiracy to deny him his rightful victory. Today Attorney General William Barr confirmed Trump's suspicion.

"To date, we have not seen fraud on a scale that could have effected a different outcome in the election," Barr told the Associated Press. Alluding to claims by the president, former Trump lawyer Sidney Powell, and current Trump lawyer Rudy Giuliani, Barr added: "There's been one assertion that would be systemic fraud, and that would be the claim that machines were programmed essentially to skew the election results. And the DHS and DOJ have looked into that, and so far we haven't seen anything to substantiate that."

According to Barr, the Justice Department has investigated various election fraud claims but has not found anything like the contest-flipping chicanery alleged by Trump, Giuliani, and Powell. "Most claims of fraud are very particularized to a particular set of circumstances or actors or conduct," he said. "They are not systemic allegations. And those have been run down; they are being run down. Some have been broad and potentially cover a few thousand votes. They have been followed up on."

The Trump campaign was unfazed by that assessment from the nation's top law enforcement official, who has heretofore been a vigorous defender of the president. "With all due respect to the Attorney General, there hasn't been any semblance of a Department of Justice investigation," Giuliani said in a press release from the campaign. "We have gathered ample evidence of illegal voting in at least six states, which they have not examined. We have many witnesses swearing under oath they saw crimes being committed in connection with voter fraud. As far as we know, not a single one has been interviewed by the DOJ. The Justice Department also hasn't audited any voting machines or used their subpoena powers to determine the truth."

For a sense of what the affidavits cited by Giuliani actually show, here is a sampling of the dubious evidence on which he is relying. Giuliani promised that "we will continue our pursuit of the truth through the judicial system and state legislatures, and continue toward the Constitution's mandate and ensuring that every legal vote is counted and every illegal vote is not."

Clearly you didn’t read the actual statements Barr made given that he said they are investigating fraud and that, of those investigations that have completed so far, there is no evidence of widespread fraud on the scale alleged by Trump. But even so, they are still investigating some of the allegations. No where in there is “we shouldn’t investigate for fraud at all…” you’ve made that up.

      We know there was fraud on a small scale, which Barr admits. We know that fraud has been committed both to favor Trump and to favor Biden. (see the Florida spoiler campaign for an example of a pro-Trump case of election fraud.)

      So no, don’t ignore the lawsuits. Just be aware that no matter how hard Republicans wanted to hold on to the Whitehouse, they lost in a fair election just as they won in a fair election in 2016.

      Large, organized, election fraud of the sort, which would cross multiple states and take different forms as required, would involve so many people that the sort of conspiracy needed to pull it off is extraordinarily difficult. Not one of these conspiracists appears to have been poorly chosen. Not one made a mistake. The conspiracy was so well managed that there isn’t even a pattern or any notable trend to point to.

      So either that is true or it was a fair election and Trump simply lost. Which if these is more likely?

    Fact: The FBI investigated a sitting Pres. using a fabricated dossier paid for by the DNC. But hundreds of affidavits plus witness testimony plus detailed forensic evidence in front of 3 State Senate panels are considered zero evidence of election fraud. This will not end well.

      Hundreds of affidavits that read “I saw election officials roll their eyes when they saw a tRump ballot” is not evidence of fraud.
      You need something like I saw them throw out 100,000 tRump ballots and replace them with Biden ones. (with an army of monkeys filling in the circles. With 1000 people, it would probably take 1/2 hour or more.) Of course that is assuming that 100,000 tRump ballots even made it through a counting area controlled by Democrats.

        One characteristic of cheating in general, is that those who cheat recognize the risk of getting caught and tend to avoid cheating if that risk is perceived as too great. If you lower the risk of consequences, you’ll get more cheating.

    Brickman, the GOP head of one of the country’s largest counties and a veteran county elections worker, submitted her testimony in a sworn affidavit under penalty of perjury. She testified that she and her Democratic partner witnessed “more than once” Trump votes default and shift to Biden when they were entering votes into Dominion machines from ballots that couldn’t be read by machines.
    She alleged that she was later threatened by election supervisors at the Maricopa County Tabulation and Election Center (MCTEC) for speaking out about what she had witnessed.
    “I observed, with my Democratic partner, the preparation of a new ballot, since the original one was soiled, or wouldn’t go through the tabulators. I read her a Trump Republican ballot, and as soon as she entered it into the system, the ballot defaulted on the screen to a Biden Democratic ballot,” Brickman told GOP Arizona State legislators on Monday.
    She remarked that when she reported the issue to election supervisors, others in the room also commented that they had “witnessed the same manipulation.”
    “We were never told what, if any corrective action was taken,” Brickman continued. “All I know is the next day, I was called outside the room that I was working in for signature verification by a supervisor who said, ‘I understand you caused some problems this week and you thought our machines were not working correctly.’
    “I was told at that point in time that I could not discuss anything or talk about what was going on.
    “Many people were threatened,” Brickman told the hearing. “They were told that their voices would be suppressed, they would have to leave the room and not work there again. I’m here because I think this is our duty to speak the truth.”
    She told the hearing that she was yelled at and “reprimanded” by her own supervisor, who accused her of causing trouble and “bringing things up that I shouldn’t have.”
    She also said that during testing and certification of the Dominion voting machines on Nov. 18, she had refused to approve the certification of the Dominion system during a meeting with Secretary of State Katie Hobbs because the machines had malfunctioned during the test, and were shut down and reset by Dominion staff instead of corrected.
    She said that no explanation was given about the errors. “We could see the machines but we could not see or observe the software behind the machine to confirm what had really gone on,” she added.
    Trump’s legal team had previously pointed to witness testimony alleging that election results from Dominion Voting Systems are susceptible to manipulation—an allegation that the company has repeatedly denied.
    Writing for The Wall Street Journal in a piece published this week, Dominion CEO John Poulos said recent claims against the company “fueled the harassment of election officials and Dominion employees across the country,” including death threats.
    “The lies and smears have no basis in fact but they do real damage to our democracy by casting doubt on the legitimacy of the electoral process. The false allegations should be retracted immediately,” he said.
    Dominion has not responded yet to a request from The Epoch Times for comment.

Brickman in the hearing also testified to a number of other voting irregularities that she directly observed, including the constant lowering of signature verification standards by her election supervisors in order to “move more quickly” and process the higher amount of early and mail-in ballots received for the November election.
      “Standards were lowered from approximately 15 points of similarities … reduced to a minimum of three, and then lowered to one, and ultimately none,” Brickman said, recalling that she was told to “just pass each signature verification through.”
      “We were told, ‘Too many rejections have already been turned in … we need to move more quickly.’ This is not the way an election should be run. Where’s the integrity?” Brickman challenged.
      The GOP chairwoman also said she observed signatures on envelopes that were completely different from the name of the listed voter being let through by election supervisors.
      “So the ones who signed the envelopes were not the actual voters, but these were allowed to go through with ‘Maricopa County verified’ stamped on the outside of each affidavit envelope,” she said.
      Batches of envelopes bearing the same handwriting for different signatures were also observed, she said.
      “There were at least 30 ballots that I saw at one time, that were signed by the same handwriting but on different voters’ names,” Brickman testified. “When I asked if the county attorney would be alerted for possible fraud, I was told ‘no,’ that supervisors would take care of it.”
      One of the most “egregious” irregularities, Brickman said, was the turning away of Trump votes as duplicated votes or “overvotes” because the voter filled checked both the bubble for Trump on the ballot but also wrote in the president’s name under the write-in candidate.
      “This would continue on as an overvote, which means no vote was counted at all despite the policy having been changed to allow these overvotes. Supervisors contradicted their own policies where the [voter’s] intent was clear,” she said.
      “I am here today again not as an expert in the Dominion software but as a voter in Maricopa County who wants to hear and speak the truth even though myself and others have been suppressed to speak before you now,” Brickman told the hearing.
      “There should be integrity,” she said.

      1) The Libertarian and GOP representatives invited to the pre-election check of the voting machines never showed. The Democrats did, however.
      2) The hand recount rules in AZ were changed by the Republican majority from precincts to centralized voting which created problems when the GOP wanted to only recount votes in heavily Democratic districts.
      3) The “evidence” provided regarding fraud was done at an unofficial hearing where the people giving testimony were not doing so under oath.
      4) In several counties, the post-election hand recounts weren’t attended by GOP and/or Libertarian representatives. [Apache, Gila, Graham, La Paz, and Yuma counties]
      5) The Maricopa county hand recount (2% of in-person and 1% of early voting) which was attended by Democrat, Libertarian, and Republican representatives, showed a 100% match across 8,200 votes.

    Here are the results of that (slightly expanded) analysis.

    tl;dr: PA mail in ballot numbers seem very consistent with other states.

    First I’ll look at voter turnout data (follow links on that page to a spreadsheet if you want to follow along). I’ll then turn to mail in ballots.

    First, the mean voter turnout (what they label as VEP Turnout Rate, which is the ratio of people who cast ballots to the eligible voting population, or VEP) is 67.7% and the standard deviation across states is 5.8 percentage points. In PA the turnout was 71%, less than one standard deviation from the mean. Conclusion: PA is consistent with other states.

    Now let’s look at the fraction of all ballots that voted for the highest office. I get this by dividing “Vote for Highest Office (President)” by “Total Ballots Counted (Estimate)”. Note that these numbers are not available for every state. The mean is 99.07% and the standard deviation is 0.75 percentage points. In PA it was 98.62%, less than one standard deviation from the mean. Conclusion: PA is consistent with other states.

    1. Now lets look at early vote statistics. This is provided by the same United States Elections Project. Data is available here, though it doesn’t seem to be in as convenient a format.

      I went through each state for which they provide data and transcribed it into a spreadsheet on my own. Feel free to do the same to check my analysis (I would actually appreciate someone doing this to make sure I didn’t make a transcription error). Note that I am taking the eligible voter population (VEP) from the other spreadsheet referenced above.

      Some caveats up front. Different states report differently, so this is not quite an apples to apples comparison. For example, Minnesota does not differentiate between mail-in ballots and early in-person ballots in their reporting, so the website I am getting data from combines those numbers. Another example: Louisiana, Tennessee, and Texas don’t report requested mail-in ballots, just total returned (RED STATE CONSPIRACY?? — I’m joking, I’m joking). Nevertheless, I am leaving out Louisiana, Tennessee, and Texas from the results reported below. Another: The numbers from Idaho are only from its most populous county. Also, not all Ohio counties report vote by type, so I am also leaving Ohio out of the results reported below (otherwise it combines in-person and mail-in voting). There are others you can read about at that website. I am acknowledging these limitations of the data up front in order to be transparent. With those caveats in mind, I will do the best I can with the data in hand.

      First let’s look at the number of requested mail-in ballots as a percentage of VEP. First thing to note is that there is quite a large spread. Only 5.97% of eligible voters in Arkansas requested a mail in ballot (the lowest of any state), while in New Jersey 98.3% requested ballots. That stood out to me, and it turns out that NJ sent mail-in ballots to all registered voters, so “requested” really isn’t the right term to use here. Colorado seems to do something similar, and I know a few other states did as well. Even considering that, the request rate was still pretty all over the place. Having said that, the mean request rate was 41.88% and the standard deviation was 28.04 percentage points (but, again, that is being influenced a lot lot lot by outliers). How about PA? Request rate was 31.56%, well within one standard deviation. Concerned about the outliers throwing things off? The median was 32.55%. Conclusion: PA is consistent with other states.

      Now let’s look at the number of ballots returned as a percentage of ballots requested. This is much more consistent, though not without some outliers. Only 32.76% of requested ballots were returned in Nevada. But most were in excess of 60%. The mean is 79.06% with a standard deviation of 14.71 percentage points. The median was 82.98%. PA was 85.17%, well within one standard deviation of the mean and very close to the median. Conclusion: PA is consistent with other states.

      Now, on to rejection rates. I am reporting the number of rejected mail in ballots as a percentage of the total of accepted and rejected mail in ballots. Unfortunately only five states have rejection numbers on that website. That makes this analysis susceptible to small-number variations. But, for what it’s worth, here are the numbers:

      Georgia: 0.203%
      Iowa: 0.147%
      Michigan: 0.065%
      North Carolina: 0.808%
      Pennsylvania: 0.281%

      With such few states, mean and standard deviation are not particularly helpful, but if you are interested the mean is 0.3% and the standard deviation is 0.29 percentage points. What we can say is that PA has the second highest rejection rate behind North Carolina. Iowa is lower than all but Michigan, and Iowa (and North Carolina) went for Trump. Maybe with more time we’ll get results from more states and we can do a more robust comparison. Or, if you have a different source, please let me know. But so far, PA is not looking particularly inconsistent.

      We can also compare these rates to 2018. The following numbers for 2018 come from Ballotpedia. I report only the states reported above. The numbers in parentheses are the ratio of 2018 rejection rates to 2020 rejection rates.

      Georgia: 3.1% (15.3)
      Iowa: 1.6% (10.9)
      Michigan: 0.6% (9.2)
      North Carolina: 6.1% (7.5)
      Pennsylvania: 4.4% (15.6)

      Some observations: rejection rates were higher across the board in 2018 by between 7.5 and 15.6 times. The mean ratio between 2018 and 2020 is 11.7 and the standard deviation is 3.2. PA had the biggest drop in rejection rate between 2018 and 2020, but it is only 1.2 standard deviations from the mean. Again, these are small numbers, so I wouldn’t read too much into it, but a 1.2 standard deviation difference is not generally considered significant.

      Conclusion: Need more data, but the data we do have in hand doesn’t make PA look like that much of an outlier. I would call this consistent.

      What is inconsistent is the low rejection rate compared to 2018, but this is true for all the states I have data for, including two states that Trump won.

      So, is the drop in rejection rates in and of itself suspicious? Again, without more data, it’s tough to be definitive, but at this point I lean towards no. I will admit my priors are playing a role here, but consider that there was a major get-out-the-mail-in-vote effort this year, particularly from Democrats. I think it’s reasonable to assume that voters were better educated about how to properly complete their mail in ballots. And I also suspect that if you look at other characteristics, the population of mail in voters in 2020 will look a lot different than the population of mail in voters in 2018, so it’s not really an apples to apples comparison.

      Overall conclusion: PA mail in ballot numbers seem very consistent with other states.

      As always, I’m happy to accept constructive criticisms and to be pointed to additional data.

          2. Different states emphasized mail in voting differently.
            Ohio sent every registered voter an application for mail-in voting. PA did not (although in PA, its legal for someone else to request an application for a mail in – and as I understood it, the Democratic party requested one for every registered Democrat).
            So in Ohio everyone got an application, in PA, every Democrat got one.

        The rejection rate really should be evaluated on a historical basis. Meaning, the last 6-10 elections. And as you say, that does have to be looked into. Note that the examples you cited could easily change the election result.

        The data for ballots requested is a total hash. With a std dev that big, ~30-points either way from a 40-point mean, you cannot say anything about consistency. So I disagree with you on that.

        We will not have answers by December 14th to these questions. I suspect it may be a few years before we can really say one way or another. I do think there should be a forensic analysis so we can know with certainty one way or the other.

        1. Historical basis may not say much given the pandemic and how it altered voting behavior and how the politicization of the pandemic meant that voting by mail changed dramatically for one party over another.

          Just as I wouldn’t be surprised to find that a large number of new voters popped up in 2016 because Trump’s message resonated in ways no other politician had for certain voters in a long time prior.

          These things happen. Historically, a bunch of white nationalists registering and voting in large numbers is probably rare but in 2016 it mattered a great deal. Historically, presidents manage their affairs with a certain amount of tradition and decorum. Since Jan 20 2017, we’ve had a president that isn’t afraid to say wildly controversial things and piss off large numbers of his own supporters. So it comes as no surprise that downballot Republicans did well but the president did not.

          I don’t know that the average trends for mail-in votes over the last handful of major elections is going to be very informative here. The claims of fraud with these votes are easy enough to cross reference regarding deaths and relocations. Getting 140,000 fraudulent (dead or not a resident/citizen) mail in ballots would be quickly spotted in a single state with some rudimentary auditing.

          IMHO, the biggest fraud in this election is Trump’s use of a “fraudulent election” hoax as a means to generate donations to pay off his debts and set himself up for whatever he does next. It’s a scam that is eating away at our democratic (small ‘d’) foundations and threatening the country as a whole. A month after the election there is still zero evidence of any fraud of any consequence. If you want historical basis, Trump’s claims of fraud in the 2016 elections were investigated and found nothing and so far that is repeating this election as well.

    1. Trump aside, our election process has serious problems now that we’re doing mass mail in ballots. There is no way to verify that most mail-in ballots were cast legally. If there is no paper trail to audit and no observers were allowed to watch the envelope be opened and information verified, then you’re just running on faith.

      And then PA raises all sorts of questions about what state legislatures and Governors can do right before an election. How much can they arbitrarily/illegally change the election process before it becomes election interference?

      We need to rework how we do elections. Even if you don’t think there was a significant amount of fraud, you have to admit that much of the country has no confidence in our election process. Even if you think those people are being irrational, they aren’t going away any time soon. We’d all be better off fixing the system so they can’t complain next time around.

        2/3rds of states have a no-excuse vote by mail system. I live in one of them. A few state do all voting by mail. The remainder require a valid reason to receive an absentee ballot. There have been comprehensive studies on voter fraud over the years and they all come up with the answer that actual voter fraud is rare and never enough to sway an election. Even Trump’s own 2016 fraud investigation came up with nothing. There is no data to support that election fraud is a problem.

        Yet, here we are discussing fraud. Why? Because people like Trump bring it up, spin it up, publicize it, hype it, and it gets re-broadcast on partisan news and feeds conspiracy theories amplified by social media. Trump has been claiming fraud since he *won* in 2016. Back then it was because he lost the popular vote by nearly 3 million voters. Now, it’s because he just plain lost the vote. But in all cases, there is no evidence of any meaningful fraud.

        So, to your logic: if you think there was a significant amount of fraud and have no confidence in elections, well, you’re doing so despite all actual facts so it is unlikely that anything anyone does is going to sway your opinion. If you think people are being irrational, well, you’re right because they are and the facts make that clear. So the conspiracy-believing crowd isn’t going away and they cannot be convinced by reality. What then?

        You posit that we “fix the system.” But the system (meaning: voting) isn’t broken. It can always use a tune-up, of course, but it ain’t broken. “Fixing” it doesn’t fix the problem, anyway, since any real improvements are unlikely to sway people who believe in the unreal.

        Rather, I say we figure out how to bring the conspiracy-believing people back to reality because that’s the real problem here. “Fixing” the voting system doesn’t fix the problem. People who are willing to believe carpet-bagging scam artists today will believe them tomorrow no matter what the facts on the ground may be.

        Now if you want to talk about voter suppression and other anti-vote tactics designed to keep one or another group from the polls, then that can be fixed. If you want to talk about gerrymandering, that can be fixed. Both of which would be helpful in the long run. If we cannot fix conspiracy-crazed whackos, we can at least limit the damage they can cause.

Get an ID, register, look up your ballot online (at the library, if need be), and show up at your poll on election day. It takes all of an hour a year, on average to manage all of that, even if you move. If someone can’t manage such a simple task once or twice a year, then how can they be competent enough to choose who will next wield the monopoly on violence?

    – A Plan by the Mayors of Wisconsin’s five largest cities (Milwaukee, Madison, Kenosha, Green Bay and Racine) and funded by an out-of-state organization known as the Center for Tech & Civic Life to implement a new form of balloting in Wisconsin using un-manned, absentee ballot drop boxes without adequate or uniform chain of custody standards and security protocols contrary to the Wisconsin Election Code.

    – Directives by the Wisconsin Elections Commission that facilitated the unlawful, un-manned absentee ballot drop box Plan by endorsing illegal drop boxes (which were then ultimately used throughout the State in the election), failing to adopt uniform chain of custody and security protocols for the ballots in the drop boxes and failing to ensure public access to the process.

    – Directives by the Wisconsin Elections Commission to election officials to tamper with witness certifications on absentee ballot envelopes which facilitated the counting of unlawful ballots in the election in violation of the Wisconsin Election Code.

    “The United States Constitution prevents the rules in a Presidential Election from being changed at the last minute by un-elected bureaucrats and local politicians who may have a more narrow interest in the outcome of the election.
