4 Key Republican Senators To Watch as Trump's Trial Rolls Into the Weekend

It's Friday, but not for members of the U.S. Senate, who will remain in D.C. through the weekend (though they do get Sunday off) for President Donald Trump's impeachment trial. The House Democrats' impeachment managers will likely finish making their case against the president today, and Trump's attorneys will start their defense on Saturday.

As Reason's Peter Suderman wrote yesterday, there's really not much question about the facts of the case at this point. The first article of impeachment says Trump tried to get a foreign government to conduct an investigation of one of the president's chief political rivals—something that clearly happened, since Trump literally did it while standing in front of TV cameras on the White House driveway. As for the second article of impeachment—the one about obstructing Congress' investigation—Trump seemed to concede the gist of it while he was summing up how things have been going so far:

"We're doing very well. I got to watch enough. I thought our team did a very good job. But, honestly, we have all the material; they don't have the material."

If the facts aren't really in dispute, then one of the few big remaining questions before the almost inevitable acquittal is whether the Senate will take testimony from new witnesses. Removing Trump from office would require a two-thirds majority, but a simple majority could approve additional witnesses—meaning that only four, rather than 20, Republicans would have to switch sides to allow it.

The Senate won't decide whether to have more witness testimony until after both sides finish their opening arguments, likely in the middle of next week. Already, three Republicans have expressed an interest in hearing from additional witnesses: Sens. Susan Collins (R–Maine), Lisa Murkowski (R–Alaska), and Mitt Romney (R–Utah). The key swing vote could end up being Sen. Lamar Alexander (R–Tenn.), who is retiring from politics at the end his current term and is therefore something of a wild card in the impeachment process. Alexander has opposed Trump's border wall and has been critical of the president's trade policies, The Wall Street Journal notes, so he isn't a typical Trump lackey.

Would additional testimony change the course of the impeachment trial? Probably not. But it might at least cause some senators to put down their crossword puzzles and fidget-spinners for a few minutes to pay attention. It would also drag the impeachment trial out for significantly longer—White House attorneys say it could add weeks or months to the process, according to Politico—which is probably the best reason to believe it won't happen.


FREE MINDS

The Chinese government took campus free speech issues to a whole new level this week by detaining Luo Daiqing, a University of Minnesota student, in his hometown of Wuhan. Luo has been sentenced to six months in prison, Axios reports, for the crime of "provocation." Specifically, he made social media posts "denigrating a national leader's image." More specifically, he shared memes comparing Chinese President Xi Jinping to Winnie the Pooh.

Here's the kicker: He posted those tweets while he was living in the United States, where Winnie the Pooh memes—like many other things—are protected speech.

Writing for the Foundation for Individual Rights in Education, Sarah McLaughlin notes that, unfortunately, international students cannot enjoy the full benefits of the First Amendment because expression protected in the United States could be punished when they return home. "International students should not have to self-censor in the United States, an outcome that harms those students and academic communities that would benefit from a vocal and diverse student body," she says.

But who will build the roads deliver the beer? The Democratic Republic of Congo has one of the world's most corrupt governments, has been embroiled in a decades-long civil war, and has virtually no national infrastructure. What it does have, as The Economist reports, is a population that loves drinking beer—a hangover from the brutally oppressive colonial rule of the Belgians.

Only four of the country's 26 provincial capitals are connected to the national capital by road, yet beer is everywhere in Congo. Thank a makeshift supply chain that involves weeks of travel on crocodile-infested waters, plus bartenders who literally go the extra mile:

After a week Mr. Barcat's barge reaches Bandundu. From here, as in Mbandaka, smaller vessels carry the beers to tiny villages on the banks of the river. At the port in Mbandaka, Christine, a 40-year-old bar owner, picks up 70 crates of beer from the Bracongo depot. She travels to the city twice a month on one of these smaller vessels to collect beers for her bar and to sell to other bartenders. The trips are tough: she has to sleep out on deck in the rain and the muggy heat. "We are exposed to all the elements," she sighs….

Christine's travails are passed on to her customers. Her beers cost a third more than those in Kinshasa, at $1.80. She has to factor in her $60 boat ticket and the money she pays a friend to run her bar when she is away. Her profits are slim. She does not make enough money to save, she says, but enough to survive.

Bloomberg isn't just a killjoy; he's wrong about the facts. A growing body of research shows that people can and do use e-cigarettes to help quit smoking. Unnecessary panic (and, worse, panicky public policy) that drives people away from vaping and back to cigarettes is not helping public health.

In other election news, Foreign Policy published a lengthy essay by Joe Biden yesterday. In it, the former vice president and current presidential candidate outlines his views on, well, foreign policy. Conspicuously absent: a single mention of Iraq or explanation for Biden's 2002 vote to take the United States to war there.

      Kidding aside, this 2019-nCoV RNA virus is a scary one. Very scary. Did the US evacuate diplomats for SARS? I do not recall that happening before = evacuation due to epidemic. With a 3% mortality rate (so far, based on questionable data), it is not time to break out the survival packs, but every American should be extremely concerned right now. Take commonsense precautions now.

      My gut tells me China is not being entirely honest and transparent about the number of people infected, or dead.

              I want to be able to live in harmony with people I disagree with. That used to be possible. It used to be an American virtue, the right to be left the hell alone, so long as I'm not hurting you and you aren't hurting me.

              I wasn't thinking about instilling an anti-Communist purity test in order to practice law. It's anti-American to condition the right to work on whether one holds the correct political views (absent things like government service vice treason). However, if I'm the only one who's going to play by the rules, and the other person gets to do what s/he wants, then I'm going to stop thinking of the rules as mandatory.

              Turning the other cheek works if the other side is fundamentally decent, or you're the Son of God. Otherwise...know anybody who speaks Carthaginian lately?

                Something happened. I think if we look back, the Kennedy assassination seems to be the break-point in time, IMO. Just as Boomers came of age and entered college. Right there in that decade, 63-73, we saw tremendous ideological change that has had profound impacts to the present day.

                I'd like to get back to a time where politics is just not that important.

    I guess Reason didn't get shamed enough in Suderman's piece? This is the dumbest thing I've ever read, and Amash has been pretty dumb the last 2 years. Trump is obviously talking about Executive privilege, which is not obstruction.

    I just don't get the thought process here. Suderman did such a bang up job yesterday we have to double down?

      There have been no facts. The entire House investigation is based on hearsay and conjecture.

          But in all honesty, I see 1 of 3 scenarios playing out: 1. Virginia boogaloo boys kicking things off with the governor bullshit they're dealing with, 2. The libs start something after losing the impeachment, or 3. The libs starting something after losing the 2020 election, which at this point I think is a near certainty (both them losing it, and them starting something).                 They have money and people who can do things that other people will pay them lots of money for.

                Moreover, they have plenty of farmland, at least if we're talking about CA. The Valley used to be very conservative, and that changed when they decided to import a peon class that wasn't. Go look at which counties voted for Trump or the party that represents most of the Congressional districts in the ag areas. I know its a popular right wing trope that the cities will just starve if they get to ornery, but I'm not sure it's accurate for California.

                I don't see them going to war or seceding though. The long term demographic drivers are on their side---absent most of the new immigrants or their children discovering the joys of voting Republican, and even if they do, the Overton Window will have shifted enough that Republican will mean only getting taxed at 50%, and allowing people to use IC cars on weekends. You'd think the Left would realize it and keep on keeping on with the slow frog boil.

              That's actually what I'm half worried about if a civil war breaks out. That China or the UN decides to get involved for "peacekeeping". The other thing I worry about is the breakdown of logistics and supply lines in such a vertical society. Could easily see some mass starvation if a civil war lasts longer than a few months. And lets be honest, since when has ANY war gone according to a schedule?

    The Impeachment jumped the shark weeks ago. There really isn't anything left to do with the series. The episodes are all repetitive, with the same characters saying the same lines, making the same jokes, and the jokes weren't very good the first time around. Everyone is tuning out.

    Pelosi's production company didn't really want to make The Impeachment show in the first place. It's just a vanity project for the finance people at the network. They don't care about the ratings, but, for goodness' sake, the network is even ready to cancel the show at this point. The only problem is that they don't have anything better to run in The Impeachment's time slot.

    The pilot for Bernie and the Okie did poorly with test audiences. He's an angry old white man. She lies about everything. Together they fight crime. That one plays in Peoria even worse than The Impeachment. And Bidin' Time with Joe, that guy just doesn't have the star power necessary to beat the current ratings champ.

    What do they do in that time slot? At this point, the network is just dying for a distraction of some kind. If only there were a big one-time event--like a school shooting or something! Maybe this Coronavirus will get out of control. Aren't the Olympics coming up soon? Is there something they can do with that? Maybe they could use cancel culture. You know, accuse the current ratings champ of sexually assaulting women, paying prostitutes to pee on him, or colluding with the Russians!

    Oh yeah, that's what they're already doing with the The Impeachment show, and it didn't work. Oh well, there's always the 2024 ratings season.

The civil rights movement, the sexual revolution, etc. all happened before millennial were born, and when the civil rights movement and the sexual revolution happened, those were hardly the first times those issues had come to the forefront of society or that the elite had embraced those issues.

      The era we're living in now is a lot like the prudish snobbery of the 1950s in that prudish snobbery has gained the upper hand in the culture and become a force for conformity. If things go as they have in the past, the Millennial's kids will eat their grandparents alive.

      The really sad part is how people fall so easily for this trick.

    Speaking of facts: 1.) The 1999 "Treaty with Ukraine on Mutual Legal Assistance in Criminal Matters” clearly authorizes the very questions Trump asked Zelenski…, regardless whether his intent was to personally benefit or not. There is no such qualifier in the treaty and his questions do not equate to abuse of power. Trump was actually following the Treaty requirements. And unless they violate a U.S. citizen’s rights, international treaties supersede and have greater effect than any U.S. Code. 2.) "Material" is a legal term in a trial. When Trump says we have the “material” he means it in terms of the legal definition, i.e., MATERIAL. adj. relevant and significant. In a lawsuit, "material evidence" is distinguished from totally irrelevant or of such minor importance that the court will either ignore it, rule it immaterial if objected to, or not allow lengthy testimony upon such a matter. Reason's liberal squad might want to check facts first.

    I don't know if this is communist propaganda (The English is a little odd, which may suggest it was translated quickly from Chinese), but it's probably emblematic of the authoritarian communist approach to solving problems:

    They are building a huge hospital that will have enough space for 1,000 patients of the disease in the city of Wuhan. And they are going to do it in just 10 days.

    If they're trying to make the Chinese government look responsible by showcasing that they're building a hospital in Wuhan in ten days, it's having the opposite effect on me.

    You see all those backhoes? There is no good reason to have that many backhoes working at the same time. They're surely getting in each other's way--especially when they're trucking out what's being excavated. You just wouldn't build that way.

    It looks like the government sent a bunch of backhoes into a field and put them to work so they could distribute a photo showing that they were throwing everything they have at the problem.

    It is typical of government to care more about how their responses are perceived rather than whether their responses are effective. To be any more typical of autocratic government and their ham-fisted responses, a sink hole would develop beneath the hospital once it's constructed swallowing the patients whole.

      The map I saw of the site, made it look like it was on a peninsula on one of the big lakes adjacent to Wuhan. It doesn't look to me like a hospital; it looks to me like where you'd put a hasty confinement zone.

      As to hospital space, the Chinese have to have military airfields, with the accompanying giant spaces between runways, taxiways, hardstands, and the like. Just set up tent structures on one or more of those. They should have logistics already for feeding and housing air base staff. Move out the staff, and move in the docs and patients. Plus, most air bases have fencing and access control.

      I dunno. The claim is that this isn't even as bad as the flu. The Chinese are certainly going full retard about containment though. And if those video clips of alleged crowded Wuhan hospital corridors, where they're just leaving the bagged dead to lay there right next to the sick...yikes.
