If He Thinks It's Such a Good Idea, Why Won't Rand Paul Name the Whistleblower Himself?

Not illegal to out "whistleblower." Sen. Rand Paul (R–Ky.) has been calling on his colleagues to put a public spotlight on the man who introduced the world to the Trump-Ukraine scandal and shaming the press for not printing the suspected whistleblower's name. This has earned Paul accolades from the MAGA crowd but has elicited mixed feelings, at best, from libertarians, who argue that doing so could have a chilling effect on future reporting of possible corruption.
Paul has defended himself by arguing that there's nothing illegal about outing the government employee who first raised concerns about President Donald Trump's July call with the Ukrainian president.
"The whistleblower statute protects the accuser from being fired but says nothing about skeptics revealing his name," said Paul in an emailed statement Wednesday. "There is absolutely no statute that prevents anyone, other than the inspector general[,] from releasing the accuser's name."
That's true, as Andrew C. McCarthy points out at National Review:
The law imposes this highly qualified confidentiality requirement only on the [inspector general of the intelligence community]. It does not bind other government officials, much less members of Congress, the media, and the public. The point of the law is to shield whistleblowers from reprisals (being fired, demoted, denied promotion, transferred to Anchorage, etc.), not from public identification.
What's more, the figure in this case may not fall under the statutory definition of a whistleblower, in which case he isn't owed any special legal protections at all.
"Under that statute, protected status is given to an official who reports on intelligence activities within the jurisdiction of the director of national intelligence," writes McCarthy. "The statute does not apply to the president's conducting of foreign policy, including his communications with foreign heads of state."
And yet… The question of whether people can legally name the whistleblower is separate from whether they should.
Paul could legally name the person right now. What's stopping him? ("Naturally, he wants someone else to take the heat while he carps from the well-appointed cheap seats," McCarthy suggests.)
It's also distinct from the question of Trump having a right to "confront his accuser." This supposed right has been at the core of Trump and his people's complaints about the current impeachment goings-on in the House of Representatives. It's also a complete mangling of constitutional law and blatant attempt to confuse the issue.
So, one more time for those with their MAGA hats on a little too tight: Yes, the Sixth Amendment provides certain confrontation and access rights to defendants in criminal trials. But Trump is not a defendant at a criminal trial, and have the impeachment proceedings have not yet reached any phase anywhere analogous to a criminal trial. Which means Trump has no constitutional right or reasonable expectation to publicly face his "accuser" right now.
It may be "reasonable to expect that Trump should be allowed to face the whistleblower if his impeachment proceeds to the Senate and the whistleblower's testimony is used as evidence," as Reason's Scott Shackford suggested yesterday. And "if the whistleblower won't come forward, Paul can use that as justification for declining to remove Trump from office."
But "the way Paul is talking about revealing the whistleblower now—during the investigation itself—is akin to the police revealing the names of witnesses to a suspect long before that suspect has been charged with any crime," Shackford continued. If Paul's efforts occurred "in an actual criminal investigation rather than an impeachment investigation, would look a lot like witness intimidation."
Earlier this week, Paul proposed legislation that would expand current whistleblower protections to government contractors. That's good. But Paul's bill also says this:
Congress reaffirms that, in the case of criminal prosecutions and impeachments arising from the disclosures of whistleblowers, the accused has the right to confront his or her accuser in such proceedings and that right is not superseded by the whistleblower protections.
Let's not confuse a lack of special treatment for Trump with the denial of a defendant's due process rights.

Court strikes down Kansas ban on raw milk advertising off the farm. The victory means raw milk peddlers in the state can start advertising anywhere others are allowed, rather than be confined to marketing their milk only on their own property.
Coraleen Bunner—a plaintiff in the lawsuit, along with her husband—said in a press release that it will "be nice to have the freedom to talk about what we do. We throw out excess milk on a regular basis because we can't talk about it."
With help from the Kansas Justice Institute (KJI), the Bunners challenged the state's rule regarding raw milk ads, arguing that it violated their constitutional right to free speech. "The government's speech-ban was offensive," KJI Litigation Director Samuel MacRoberts said in a statement. "This quick and decisive victory is a win for the speech rights of all Kansans. The Bunners have the absolute right to advertise raw milk."
The Kansas attorney general has agreed not to challenge the state court ruling declaring the raw milk advertising ban unconstitutional.

I'll answer: I think it AT MOST should be considered a distasteful act. Do I think we should be having Impeachment Hearings? Absolutely not.
If Trump legitimately said something closer to what has been alleged, like "Hey, I don't like this Biden guy, go dig up dirt on him or you won't get money", I think that may be sanction-able. I would still consider it less impeachable than Obstruction, which is what all the same talking heads insisted was impeachable when the Mueller report came out.
But that is expressly not what happened. Trump asked that a specific investigation into a specific set of allegations be researched. That is NOT the same as digging up dirt. And, there is not yet any smoking gun evidence that Trump EVER declared a quid pro quo. The only "Witnesses" claiming such a thing are stating hearsay. Nobody has come forward to say "yeah, Trump told me to hold the money until they investigated Biden." The closest they got was Sondland saying "I presumed that the aid suspension had become linked to the proposed anti-corruption statement"- and this is after he had testified and came back later with the written statement. It is a presumption, and it isn't about Barisma- but rather general anti corruption.
Now let me flip this back at you. If you were president, and you saw this timeline from your predecessor, do you really think it would be wrong to investigate?
T-1 year: Executive targeted for investigation hires the children of several prominent government officials.
February: Ukrainian prosecutor steps up investigation, siezing several assets of the executive.
Mid Feb: Children reach out to the number 2 State Department official (who happens to be Dad's ol buddy). They also contact whitehouse and other leaders "for talks"
1 Week Later: Dad holds money hostage unless they fire the prosecutor.
Even if this prosecutor was corrupt, he was targeting the employer of Biden's son- an employer who the State Department had previously alleged as being corrupt; whose bank had lost billions of dollars in US loan guarantees; Who US Aid canceled a co-sponsorhip on an event because they seemed to be a bad actor. Can you really say that it is wrong for trump to expect that to be investigated, even IF it might help him politically? If it was any other official who is not a presidential rival, would it be ok?

Also, a person who seriously wanted to investigate Burisma would not pursue it the way Trump allegedly did it. They would realize it's a complex matter that needs an investigator to head the effort. Any rational President would realize he, and his personal lawyer, are too busy to handle it themselves. A serious person would not just toss off a request for an investigation from the Ukraine in some hallway conversation and a phone call - they would have an investigator working on it full time.

The answer is yes, there is reason for a reasonable, fair-minded person to be concerned. Hence, Congress is investigating (we can argue the way they are going about it). Thusfar, there is bupkis. There just isn't a malign motive or intent here.
What I think you need to think about (concede?) is that a POTUS can pursue a policy that advances US interests while simultaneously conferring a political benefit. That is not by definition, wrong, unethical or illegal. In another day or time, that would have been called smart politics.
There has been zero direct evidence that POTUS Trump explicitly conditioned military aid (which was in fact granted) on Ukraine conducting an investigation on former VP Biden. What we have is a lot of hearsay, and second-fourth hand speculation, but actual hard evidence? Nope.
Why must it be conceded? If the same action (investigating the Bidens) benefits the country by fighting corruption and also benefits the President’s 2020 re-election campaign, then the investigation could have been set up so that the candidate (Trump) is not personally involved. And certainly not the candidate’s personal lawyer.
To do otherwise is to mix governmental and personal political goals unnecessarily.

The POTUS referred President Zelensky to his personal attorney, and the Attorney General. What you propose divorces the POTUS from the conduct of foreign policy (his job) and that is not right.

Personally, I don't think it is unethical to pursue a foreign policy that advances US interests (as in...Yo Ukraine, wtf did you do in our 2016 election?) and his own political interests (Creepy Joe is maybe not so squeaky clean, just look at his son) simultaneously. The average American has a pretty good idea of where the line gets crossed between pissing off the opposition with a policy choice and actually doing something worthy of removal from office. Because until the Committee actually comes out and says who it is, it's all just speculation (well-founded speculation, but speculation nonetheless).
My guess is that Rand Paul has named the whistleblower, he's leaked the name to CNN, the NYT and the WaPo, ABC, CBS, NBC - all the major news outlets. The information doesn't meet their journalistic standards.
Besides, Adam Schiff already told them the whistleblower's name a month ago so they could plan their defenses and counterattacks. You think these people report "news"? That they just throw this information out there and let the chips fall where they may? No, they strategize ahead of time, they anticipate where the story is going and they plan two steps ahead, by the time they report the story they already know what the reaction is going to be and have their counter-narrative at the ready.

Those are all great reasons to subpoena Ciaramella, not as a whistleblower, but as a witness in an investigation into Burisma. He could have started the process of establishing an investigation about four years ago, when the trail was still hot.

We had one in West Palm Beach a year or two back where a young woman said goodbye in a way that offended the judge (I think she said "adios" to a Latina judge), so the judge altered the judgement and threw the book at her, and then proceeded to bait her for several moments, racking up additional time for contempt.
That should not be permissible. We should not allow our jurists to have that level of discretion, where they can turn a $500 fine into a $5,000 fine and a month in jail because they didn't like the way someone looked at them.

That being said, I think it has gotten a lot better. Back when I was in college in the early 80's I wrote a paper on the issue and at that time women got full custody and child support in 98% of contested cases.
I know that in Florida they have a formula that awards 50/50 time and splits the money based on a formula as well. I'm sure it still screws men disproportionately, but it certainly is better than 98% against.

I think the accolades he received for telling Trump not to let the door hit him in the ass on the way out of the state may have gone to his head.
My neighbor's kid worked for Bloomberg's presidential campaign for a couple of years, before switching to Biden. (he can really pick 'em!) He was trying to tell me how Bloomberg was going to be the president and I just shut the whole thing down with "No chance, not with that soda ban. He is completely unelectable with that on his resume."
The room was aghast - a bunch of hardcore democrats that included mom and dad after all - but there was no more discussion of "he's going to win" after that. Even the delusionally partisan know that much.
Bloomberg kept NYC in check; he kept the cops in the street, and the homeless off them. Compared to today, NYC under Bloomberg was a pleasant place to live. Now, under De Blasio, it's a fucking shithole; and I say that as a New Yorker.

If you want to substantiate testimony that is being used by the Speaker of the House in a way that is meant to overturn the results of a presidential election (in an election year, no less), then the witness needs to be cross examined or his allegations need to be substantiated in some other way. The primary concern is that if they remove a president on the basis of insufficiently substantiated testimony, the government of the United States may lose its legitimacy with a tremendous number of people--over the course of years. And if you think what comes after people losing faith in democracy (in its proper place) is Libertopia, think again.

Reviewing the results of the Virginia elections. The Democrats added another MeToo to their ranks of elected officials. Joe Morrissey was elected to the Senate. He was caught having sex with a 17 year old employee of his law office back in 2013.
This is as it always has been.
In the early 90's, sexual harassment was the bludgeon of choice. You simply could not survive if workplace harassment was alleged. One prominent Republican senator was run out of town on a rail because of the "harassment" of dictating his memoirs to be transcribed by his secretary. Said memoirs included some of his sexual conquests - which is entirely unacceptable. So he had to go.
Fast forward a couple of years... we have a young junior employee confronted by a high official in a hotel room that she was summoned to by the same high official. He pulls out his penis and requests that she service him. The same high official later stands accused of attempted rape - in his government office, no less! And later still, he admits to a fairly exploitative affair with an unpaid intern. And those same activists who had spent the prior two decades railing against workplace sexual harassment and demanded that a senator be removed for the offense of including his sexual exploits in his memoir..... completely backed that second high official who was accused of rape, sexual assault and exploiting young office staff. The only explanation - partisan ties.
This "Whistleblower" scenario is quite unique, and I'm impressed at the lengths people are going to in order to ignore the uniqueness.
This is not a scenario where some low level employee is trying to tell the world about something a big corporation is doing that is harming the environment, or killing babies with unsafe products, or anything like that.
What is unique here is that we have had allegations that there exists a conspiracy of holdovers from the Obama administration to derail the Trump administration and force him from office. We have a lot of evidence that supports this allegation as well, starting well before he was even sworn in, and publicly attested to by Obama administration officials in a New York Times article shortly after the inauguration.
It is in this climate that the "whistleblower" comes forward. Their first attempt to spy on, plant and manufacture evidence against and impeach Trump had just failed, after more than 2 and a half years of effort. Now comes an allegation from strange quarters - the CIA?? And it very quickly seems that there is more here than meets the eye.
The document he submitted is released after a short delay, and it makes it clear that this isn't just some analyst who feels that it is his duty to come forward and expose corruption. The memo is clearly written by a lawyer, and clearly written in a way that is primarily designed to be of use to Trump's political enemies.
Then we learn that he has been working with the Democrat's primary partisan hack on impeachment for quite some time before this memo is sent up the chain.
All of that presents an environment where the identity of and actions of the whistleblower become very relevant. It is entirely possible that he is simply a very concerned citizen who just happened to think that a politician asking another politician to investigate political corruption was a horrific offense. But it is also entirely plausible that this guy has been a partisan mole for quite some time and his actions are entirely motivated by his partisan leanings.
Now comes the team-based-politics question that reveals which set of blinders you are wearing: Which is worse? A president of the United States asking a foreign leader who took office on an anti-corruption platform to find out what happened with a prior administration that may have been pressured into acting against the interests of the United States by a former US official? Or a president of the United States using the organs of the government to spy on a political rival, setting in motion a set of actions designed to prevent the orderly transfer of power and subvert the presidential election?
