Trump, Not the Whistleblower, Has Acted Illegally
The president's threats might prevent future whistleblowers from coming forward to expose executive abuse.

Partisans of this president are looking for every way to undermine and smear the Ukraine whistleblower. They have accused the person of being a Democratic hack. They have questioned the whistleblower's motives and integrity. And they have speculated that he or she is part of a deep state conspiracy to take down President Donald Trump.
But Trump himself took the cake when he demanded to know the identity of the person while saying that whoever did so was "close to a spy."
"You know what we used to do in the old days when we were smart with spies and treason, right? We used to handle it a little differently than we do now," he said, hinting that the person deserved severe punishment—perhaps even execution.
But there is a vast difference between a domestic spy who sells out his country to another for personal gain and a whistleblower who tries to protect his country from corrupt officials abusing the powers granted to them.
If anything, Trump's actions are more in line with a spy's given that he is using his public office for private gain. As Frank Bowman, University of Missouri law professor and author of High Crimes and Misdemeanors: A History of Impeachment for the Age of Trump, notes, in authoritarian states like Vladimir Putin's Russia, it may be seen as normal for a leader to use state power to ensure his continuation in office. In this country, a president's interest in getting re-elected is considered to be a private, rather than a public, interest. (Dislosure: Bowman is my tenant.)
That's why, argues The Volokh Conspiracy's Ilya Somin, to the extent that Trump threatened to withhold congressionally authorized aid to Ukraine until President Volodymyr Zelenskiy promised to dig up dirt on Trump's political opponent, he basically demanded an in-kind political contribution, a kind of private benefit that 18 USC Section 601 explicitly outlaws. Soliciting foreign contributions for a political campaign is not illegal, per se. But what is potentially criminal—along with being unconstitutional—is that Trump tried to use congressional aid as leverage to do so.
The whistleblower, by contrast, has scrupulously adhered to the law.
University of Texas' Stephen Vladeck points out that the amended 1978 Foreign Intelligence Surveillance Act (FISA) laid out the channels and procedures that whistleblowers must follow in order to expose wrongdoings by higher-ups in intelligence agencies—both to protect classified information and themselves from retaliation. This means that the whistleblowers dealing with sensitive intelligence cannot leak the information to the press or the public. Rather, they must share their concerns with the Office of the Inspector General (OIG) who, in turn, is required to transmit credible concerns to the director of national intelligence (DNI). The director then has seven days to transmit this information to congressional intelligence committees along with his (or her) own comments.
In this case, the whistleblower did exactly what he was supposed to do. Unlike Daniel Ellsberg of Pentagon Papers fame and Edward Snowden, the National Security Agency contractor who exposed government surveillance of ordinary Americans, both of whom illegally (and heroically for anti-war, anti-surveillance libertarians!) copied classified information and released it publicly, the whistleblower, in this case, did none of those things. He stayed within official channels.
But the folks whom he reported his concerns to didn't. Vladeck notes that for the first time in the 21-year history of the revised FISA statute, DNI Joseph Maguire did not forward the whistleblower's complaints to Congress. Why? Because the Department of Justice told him not to, even though the DOJ Office of the Inspector General, a quasi-independent watchdog, deemed it worthy of congressional scrutiny.
Yet the president has the temerity to accuse the whistleblower (and those around him) of being spies who have committed treason while advocating that we deal with them like we used to do in the "old days" when we were apparently smarter. These are the kinds of threats that, if not unambiguously rejected, could prevent future whistleblowers from coming forward to expose executive abuse. They are more worthy of banana republics led by authoritarian rulers who have contempt for any law that holds them accountable.
Trump has gotten himself into big trouble. And he will seemingly stop at nothing to get himself out of it—even if that means personal attacks, threats, and trashing of the institutions and norms painstakingly erected over the course of the last 250 years.

Why is all this not a valid exercise of Article II powers by POTUS Trump = The latest Ukraine chapter in the ongoing saga to overturn the 2016 election.
To me, the POTUS pretty much gets a 'hall pass' on the conduct of foreign policy. He can talk to unsavory people, say unsavory things, lie his ass off, make outrageous demands. Presidents do this every day.

It is not so much that Hunter Biden was found innocent of anything, it is that the investigation that could have found out if he was innocent or not, was shut down before it could be found out.

(1) Trump strong-armed a foreign government to serve his personal ends – traded the favor of the United States for private gain – and colluded with another country to influence an election. These are not acceptable actions.
(2) It was pure quid pro quo just by what we know already, only slightly more subtle than a mafioso boss. And we'll surely learn more in the coming days about other (sleazy) approaches.
(3) We've been "good" to you; we expect "reciprocal" action; we demand a "favor". Yet it's only when Trump get to his demands that the case for impeachment becomes clear.
(4) First came Crowdstrike. Trump’s former Homeland Security Adviser, Thomas P Bossert, was interviewed on television yesterday about this. He said Trump was briefed on CrowdStrike conspiracy theories several times - both by himself and others. They led DJT step by step thru the evidence which proves those theories false. But evidence or truth wasn't relevant to Trump's ends.
Instead, he walked the Ukrainian President through the narrative, telling Zelensky exactly what he wants parroted. The Ukrainian president then was instructed to work with his (Trump’s) personal attorney to have the story more properly engineered. The CrowdStrike nonsense is bat-shit crazy lunacy; Trump was soliciting a lie.
(5) Then followed Shokin. Hunter Biden was mentioned only briefly to set the story; everything thereafter was about the prosecutor's firing. Trump made clear to Zelensky just who he wanted targeted : Joe Biden.
(6) But it's only another crude lie. When Biden pressured Ukraine over Shokin he was following the orders of the President, the policy of the State Department, and the aims of the European Union, World Bank, and International Monetary Fund. He was also cheered by every reform group in Ukraine itself, where street protests demanded Shokin's ouster.
(7) Over at the National Review, Jonah Goldberg said “the charge that Joe Biden was freelancing foreign policy to protect his son simply doesn’t hold water if you spend five minutes reading up on it. Biden was acting on orders from President Obama in coordination with allies and State Department policy to force the former Russia-backed Ukrainian regime to fire a dirty prosecutor who was failing to properly investigate corruption, including at the firm Hunter Biden worked with.”
(8) As Goldberg says, Shokin wasn't even investigating Burisma - (the company that gave Hunter Biden a position on its board). In September 2015, then-U.S. Ambassador to Ukraine Geoffrey Pyatt publicly criticized Shokin’s office for thwarting a British money-laundering probe into Burisma’s owner, Mykola Zlochevsky.
(9) The "Biden was protecting Hunter"meme is lying on a grotesque level. Biden was ordered to pressure Ukraine and was following the directives of the President and State Department.
(10) Nonetheless, Zelensky was led through another falsehood word by word. It's the only sure way to suborn perjury.
(11) So Trump didn't just strong-arm another nation's leader to support his reelection, he demanded that leader lie to do so. How can anyone support that?

Even without that transcript, the CIA is a clandestine organization shrouded in secrecy, and they engage in covert operations. Using subterfuge is their standard operating procedure. What they say isn't necessarily false just because they said it, but because their entire organization is committed to concealment and deception, their claims alone would be insufficient to justify removing an elected president from office without evidence to confirm their claims.
In this situation, we have evidence regarding their claims, and all the evidence we've seen so far--the transcript of the phone call--has contradicted their claims rather than confirmed them.
It appears that your desire to see Trump impeached is such that it makes you believe an accusation of an unnamed source at the CIA, even after that claim has been shown to contradict the evidence in the form of the call transcript. Just saw 90-year-old Daniel Ellsberg interviewed about his days as a whistleblower—back when there was no such thing as a law to protect whistleblowers. Brought to mind that probably the best thing the whistleblower can do to stay safe is to go public, like Ellsberg eventually did. The preface says that the ICIG must be in possession of first-hand information. Not that the whistleblower must be the one to deliver it.
It's the ICIG's job to investigate for a period of time to uncover whatever first-hand information he/she can and then deem the report "credible" if he/she is successful.
You helpfully quoted the entire law above. All can see how there is nothing in the law that requires only first-hand info before submitting a complaint. On the contrary, it's the ICIG's job to investigate it and come up with that first-hand info if he/she can. Here is the relevant section of the law that you yourself quoted:

(A) An employee of an element of the intelligence community, an employee assigned or detailed to an element of the intelligence community, or an employee of a contractor to the intelligence community who intends to report to Congress a complaint or information with respect to an urgent concern may report such complaint or information to the Inspector General.

Nothing there says that the report must only contain "first hand information".

Case Two : Trump pressures Ukraine for his own personal gain. He holds up military aid to a country fighting a Russian invasion. He colludes with a foreign leader to affect a U.S. election. And his demand was two "investigations" where he laid out the story he wanted told, step by step - signaling to the Ukraine president who to target and what lies to support. Because both of Trump's faux-investigations (CrowdStrike tin-foil-hat lunacy and the Biden Was Protecting Hunter canard) are clear lies. We're all used to Trump's obsessive lying, but this time he was demanding lies from a foreign leader.
Yep. Case One & Two are different. Only a partisan, knee jerk moron could deny it. And that's why impeachment is justified.....

(3) Secretary of State Mike Pompeo finally admitted he was on the call after several days of evasive weaseling. Apparently he didn't get the word from Trump that the call was "perfect" and "good", because he's been trying to duck any connection to it. Today we also learned Pompeo pressured U.S. Representative to Ukraine Negotiations Kurt Volker to resign after the whistleblower news broke, apparently as some kind of damage control. Volker rejected Pompeo's demand that no one from State testify. Let's hope he speaks freely.
(4) Oh, and Trump had an out-of-control meltdown news conference while sitting alongside Finnish President Sauli Niinistö today. The guy is already losing it (not the Finn)
