Patriots Owner Robert Kraft's Bust Is Being Billed as a Human Trafficking Bust, but It Looks More Like Ordinary Prostitution
It's also part of a larger national attack on massage parlors and sex workers.

Robert Kraft, the owner of the New England Patriots, was charged today in Florida as part of a massage-parlor prostitution enforcement effort there. The 77-year-old NFL team owner is one of more than 150 men accused of soliciting prostitution. Police say they've been investigating the spa he visited, Orchids of Asia Day Spa, since October 2018.
Authorities are calling this a "human trafficking operation," with some media outlets invoking "modern-day slavery." But so far all signs suggest this is just an ordinary anti-prostitution effort.
Kraft was charged with two counts of soliciting for prostitution, a misdemeanor. Orchids of Asia's owner, Hua Zhang, was charged with deriving support from the proceeds of prostitution, keeping and frequenting a house of prostitution, and procuring for prostitution. All of these are charges that can apply to prostitution-business bosses even when everyone involved consents.
Martin County Sheriff William Snyder said at a press conference that some of the workers at these spas lived in them and weren't allowed to leave during the day. This is something we frequently hear from police chiefs and county sheriffs at the start of big "sex trafficking busts" that turn out to yield nothing but ordinary prostitution charges. (See, for instance, King County, Washington, cops on Korean sex workers there.)
Police across the country have been ramping up stings at massage parlors, driven by a concentrated effort coming from federal law enforcement (including Homeland Security) and a whole lot of misinformation. In most cases, these investigations don't lead to trafficking charges but do result in arrests for prostitution or people giving massages without a license. In at least one recent high-profile instance, they led to a Chinese sex worker's death.
It's not just undocumented immigrants who face deportation after an arrest in these stings. Prostitution charges can mean deportation even for immigrants here legally.
Florida police shut down Orchids of Asia along with nine other Asian spas and massage parlors around Orlando. The operation includes accusations of prostitution solicitation by 165 men, more than 50 of whom have already been arrested. These men have not been accused of being involved in human trafficking.
Despite some reports referring to the spa workers as "girls," police have not indicated that any employees were actually underage.
Massage parlor workers were also arrested as part of the operation to "help" them, but cops want you to know they wish they had found horrific abuse instead of just sex workers. "Even though we may have charges on some of them, we'd rather them be victims," said Vero Beach Police Chief David Currey.
Details on this story are still coming out, and police say charges are still forthcoming, which means it's possible that we'll find more here than currently meets the eye. But at the moment, it looks an awful lot like so many prostitution enforcement operations billed as "saving girls" from trafficking.

From what I understand, Asian massage parlors are infamously bad about the trafficking thing. Strictly control what their employees can do, etc. This is from other "adult" masseuses. They've said, for years, that Asian parlors are exceptionally sketchy. Other spas are not bad and tend to have some fairly firm limits on what the women can/cannot do (i.e, penetration tends to be a no-no, the client tends to have to request a massage of their junk by placing their hands there when they ask if they need a massage anywhere else, no discussion of what is and is not allowed outside of the massage room, etc), but the owners tend to be fairly shitty and the parlors that are more prostitution rings than happy endings joints tend to become so obvious about it they get busted easily.

I was wondering about that. The fact that so many prominent/?berwealthy customers were frequenting this one shitty little massage parlor in Jupiter, FL seemed bizarre to me. But perhaps, as the saying goes, "Location, Location, Location".
I guess, as Hugh Grant taught us years ago, there are a lot of guys who have a fetish for "gutter sex", and maybe going to the dumpy massage parlor is part of the thrill (as opposed to contacting some established, high-end call girl and having her come to your secure location, like you'd assume someone worth millions might do). Might also seem more anonymous, though obviously risky in different ways.
So if I understand you correctly we need to get rid of the social stigma and make prostitution legal so if one "massage parlor" is treating their employees poorly those employees are free to change employers or set up shop for themselves. If that's the case we agree.
In this particular case, I'd guess that the cops had already had someone on the inside and asked "who's your most famous client?" When they heard it was Kraft the cops and DA just started licking their chops at the juicy headlines. Why else would it take six months? They were waiting to grab Kraft.

Seems like the problem is more with the underlying "crime". I think that soliciting someone to commit murder, for example, should be illegal. But murder is a real crime. I'd say that the problem is more that the law wants to poke its nose in the private business of consenting adults.
Of course, in cases of actual coerced prostitution, it's a different moral situation. Obviously it's a real crime to force someone to have sex. But I don't think interfering with the transactions between consenting adults helps the situations of people who may be forced into things they don't want to do.

But to be clear: conspiracy involves two or more planning to commit a crime. Conspiracy is always a felony, even if the crime in question is a misdemeanor. "Explicit acts taken in furtherance of the crime" are called "overt acts" and are not the crime but ordinarily are required to prove the conspiracy and need not themselves be criminal. For example, Joe and Shmo agree to break and enter a home to rob it; Joe goes to the hardware store to buy a crowbar to break the window. That would be an overt act in furtherance of the conspiracy though not in and of itself illegal.
"I'll pay you $500 to kill Joe Schmoe" is an outright solicitation for murder. "Would you kill Joe Schmoe if I paid you $500" is not yet a solicitation but a mere inquiry and therefore not yet criminal.
In this case, if Kraft asked the masseuse to perform an illegal act, that is solicitation (asking another to perform an illegal act). If the other turns him down he has still engaged in solicitation. If the other took him up on his offer (so to speak) then we have gone from solicitation to prostitution and the crime of solicitation is merged into the greater offense.
As for the SNL babe, that would not add up to anything since even the most casual observer would know that (a) she could not possibly be serious, and (b) nobody in his right mind would take her up on it.

I have to disagree not with the legal opinion, but with the law. Neither the offer to provide payment for a criminal act should not be illegal, nor the request for such. I understand using the "should" word is lame, but I just see this as a violation of the spirit of 1a. If overt acts are taken, fine. If the offer is accepted but no exchange has been made, I'm less sure of whether that *should* be criminal. But it just seems wrong that asking a question or making an offer, no matter the content, is in and of itself a crime.
I imagine someone at some point has made an appeal on this basis?

I don't think we deport people for being charged with a crime, and I don't see why immigrants should receive special treatment before the law. We, presumably, also deport legal immigrants if they're convicted of selling drugs, too. Even if that shouldn't be a crime, it is, and if the American people want resident visas to be contingent on the immigrant not being convicted of a crime, then that's probably the way it should be.
We have an ongoing congressional and legal challenge to President Trump's emergency declaration that's based in part on Congress' enumerated power to set the rules of naturalization, and it would be hard to support that argument on the basis of the separation of powers out of one side of our mouths and then say, out of the other side, that Congress shouldn't have any say on whether a prostitution conviction means an immigrant's visa is revoked.

I would presume that there is still slavery going on in some places, whether sex slavery or agricultural, etc. It would be too convenient if it all disappeared after becoming illegal.

There is still slavery all over the world- Africa, Middle East, India, Haiti etc. Slavery almost always includes sex because people feel they can do what they want with their property. So if you find a massage parlor holding women and not letting them leave or do what they want and forcin them to have sex, then charge them with whatever crimes are considered part of slavery. It is completely clear that what David Currey was saying was that he felt bad about having to charge the women. But you deliberately (incompetently??) interpreting it as cops evilly hoping for horrible abuse? . . . well, that's just dishonest of you.

There is zero evidence of trafficking , the women who massaged Kraft were licensed massage therapists. They do not claim to be slaves. The cops are lying again about trafficking. No evidence of trafficking , despite a 6 month investigation with months of video surveillance , no charges of trafficking.
