Brett Kavanaugh's Illegal Beer Consumption Highlights the Perversity of Drinking Ages
The Supreme Court nominee's teenaged tippling was typical, although the law pretends otherwise.

Supreme Court nominee Brett Kavanaugh mentioned beer 28 times during his testimony to the Senate Judiciary Committee last Thursday, inviting mockery and semiotic speculation. The reason the subject came up was pretty clear: Christine Blasey Ford, the California research psychologist who says he tried to rape her when they were both in high school, described him as very drunk at the time, and one possible explanation for his seeming sincerity in denying her charge (in addition to the possibility that he is innocent) is that he honestly does not recall the episode because alcohol clouded his memory.
In response to repetitive questioning on the subject, Kavanaugh said no fewer than 10 times that he has never experienced alcohol-related memory gaps. But the discussion of Kavanaugh's drinking during high school and college ranged beyond that narrow issue, and his responses were by turns defiant, evasive, implausible, and misleading. The tenor of those exchanges was partly due to Kavanaugh's resentment of questions he deemed nosy and irrelevant. But it also reflected the clash between official expectations and the reality of adolescent drinking in America, a contradiction that he and his interlocutors seemed keen to ignore.
"My friends and I sometimes got together and had parties on weekends," Kavanaugh said in his opening statement. "The drinking age was 18 in Maryland for most of my time in high school and was 18 in D.C. for all of my time in high school. I drank beer with my friends. Almost everyone did. Sometimes I had too many beers. Sometimes others did. I liked beer. I still like beer. But I did not drink beer to the point of blacking out, and I never sexually assaulted anyone." Later he added that "the drinking age, as I noted, was 18, so the seniors were legal, senior year in high school, people were legal to drink."
As several news outlets pointed out, the drinking age for beer and wine in Maryland, where Kavanaugh lived and went to school, was raised from 18 to 21 in July 1982, seven months before his 18th birthday. In other words, it was not legal for him to drink in Maryland at any point during his high school years. It would have been legal for him to buy and consume beer in D.C., which did not raise its drinking age from 18 to 21 until 1986, for most of his senior year, but it sounds like the parties to which he refers generally happened in Maryland. The fact that "the drinking age was 18 in Maryland for most of my time in high school" no doubt made it easier for underage students like Kavanaugh to obtain beer, but it did not make it legal.
Once Kavanaugh started attending Yale in the fall of 1983, the legal picture was more complicated. The drinking age in Connecticut at that point was 20, an age Kavanaugh did not reach until February 1985. It rose to 21 that September, but Kavanaugh would have been grandfathered, since he had already turned 20. In other words, it was illegal for Kavanaugh to drink as a freshman and the first semester or so of his sophomore year, a period when he, like most of his peers, nevertheless drank.
I was born the same year as Kavanaugh (1965), and I had a somewhat similar experience at Cornell. The drinking age in New York initially was 19, but it rose to 21 as of December 1985. Unlike Connecticut, New York did not give a pass to people who were already drinking legally at that point. So I entered college an underage drinker, became legal in September 1984, and a year later became illegal again, a status that lasted for a year. Since I have given up all hope of a Supreme Court nomination, I can readily admit that the varying legality of my alcohol consumption had no impact on it, except that I sometimes relied on older friends to buy liquor for me.
What's true in college is also true in high school: It is quite common for students to drink, even though it's illegal. In last year's Monitoring the Future Study, 56 percent of high school seniors reported drinking, down from 87 percent when Kavanaugh was in his last year at Georgetown Prep. When Kavanaugh says "almost everyone" his age was drinking, he is right. Underage drinking was the rule, not the exception, when Kavanaugh was in high school, and it would be strange to hold it against him. But instead of saying that, he misleadingly implied that his beer drinking complied with the law.
Kavanaugh did admit that he sometimes drank too much, but he was evasive in explaining what that meant. "What do you consider to be too many beers?" asked Rachel Mitchell, the prosecutor posing questions on behalf of the committee's Republican members. Kavanaugh's response beggared belief: "I don't know. You know, we—whatever the chart says, a blood-alcohol chart."
It is, of course, laughable to imagine Kavanaugh and his high school buddies consulting "a blood-alcohol chart" before deciding whether to have another brewski. But even if we take Kavanaugh to mean that he was careful not to drive while intoxicated, that does not really answer the question. For someone who is not planning to drive, the question of how many beers are too many has little to do with the legal standard for DUI. A good rule of thumb might be that you've drunk too many beers if you find yourself vomiting or waking up with a hangover. Young people learn their limits through practice, and those limits vary from person to person.
How often Kavanaugh drank to excess in high school and college, and exactly how drunk he was on those occasions, is a matter of some dispute among people who knew him then. But it is safe to assume that he drank a lot, as was (and is) common for high school and college students. It does not follow that he experienced blackouts, that he became aggressive, or that he assaulted Ford (or anyone else). I drank a lot in college, too much on more than a few occasions, but never found myself in a situation where I could not remember what had happened the night before or needed other people's help to piece it together. Nor was that a common experience in my social circle, although I can't speak for Kavanaugh's.
Whatever did or did not happen between Kavanaugh and Ford, this much we know: As a teenager and young man, Kavanaugh drank illegally, and sometimes he drank too much. In those respects he was not at all unusual compared to his peers, who officially were not allowed to drink, did it anyway, and sometimes "had too many beers."
You might even think there is a relationship between illegality and excess, since prohibition pushes drinking underground and makes it harder for young people to learn from older drinkers who might know a thing or two about how to stop short of too many beers. Instead high school and college students bumble along, learning from mistakes they might have avoided. Nowadays almost none of them are legally allowed to drink, even though many of them are considered adults in almost every other respect. They therefore drink on the sly, which is not conducive to moderation or responsibility. That perverse situation was the unacknowledged subtext of all the beer talk at Thursday's hearing.

Is it even possible to get blackout drunk on only beer?
Yeah that's been my question too. There's so many people acting like there's no way he never blacked out drinking all that beer, but I drank pretty heavily in high school and college and the only time I blacked out was one of the times I drank a fifth of liquor.
Same, I was 5'6 and 125 lbs, drank a case of beer one night...unfortunately remember everything all too well and wish I blacked out for the whole next day but did not...absolutely know I was blacked out for two occasions over a decade apart (I can still remember before and after well)....both extreme hard core liquor....never on just drinking beer and I like beer.
Good point. I can't think of how an inexperienced (i.e. teenager) drinker could get more than 5 to 7 beers down (depending on physical size) before pulling a Willy the Waterbug in the driveway.
Yes I am a bit stymied by Kav and Judge being "inebriated" at the beginning of a pre-party before a party on a Thursday night at 17. Lived similar high school experience...didn't usually have a pre-party ever...and during the week maybe 1 or two beers at most as we would normally have work, school, something on M-F....Friday Saturday Night though....look out...but no pre parties....maybe club first and after party...did that a lot...but they would not have gone to a "club" before 6 pm and be 17....so some of it does not add up. Also as far as slurring your words meaning you were cranked....I would reach that stage quickly but stay there forever and not get inebriated...as far as complete loss of control drunk would take an enormous amount and beer and wine would not get me to that escalation....just a nice happy buzz all night....so not sure that some folks characterization of drinking makes sense.

All these things depend on body weight of course, and on one's personal tolerance for alcohol.
And if you don't know your limits, and you have friends egging you on to chug more and more beers, then it's actually not unreasonable.

You bring up an interesting point...and I suspect some of the yearbooks are a bit of glamorization or making fun of conversation not reality. Sure they could have tried it but that was much more college type stuff. Also the aluminus...my guess is some of them lied about her or just that she was many of his groups fond topic..and again probably over glamorization of anything that happened especially if she showed up in a few spots. So everybody liked her and they talked about her and maybe a few actually got to go out with her. She was obviously an agreed favorite....doesn't mean what everybody wants it to. Which is why the third accuser seems beyond way out there.....this is 1982....15-17 year olds to include rich kid football players were still afraid of their shadow with girls more then they weren't. I would have absolutely thought it was not only wrong but gross and I am class of 83....so...there's that.

My guess is they all lied about her. She had a name that rhymes easily with a lot of words and fits in with rugby songs (which is what I played). Which means that she would have been very unfortunate - and been the object of drunken sing-alongs after games or on road trips to games. And some would've taken that as license to pretend that that is all real and made it even more of an insult like they are living out the songs. Far easier since she would never know as she went to a different school.
Only time I forgot anything about an evening was one while drinking beer. It is about tolerance and BAC. So many other factors are involved. I must be a saint because I never drank illegally. Many of my friends did, in high school. The girl, tat my brother married, had been stealing from the family liquor cabinet by the time she was 10 yo! Almost felt she was becoming an alcoholic, although she did not progress to that point.

Yes if you are a diabetic or an extreme alcoholic where you are always one beer away from blacking out. I have friends with both issues the diabetic refuses to see a doctor and the alcoholic died at 58

Klobuchar's father was an alcoholic. Meaning, she believes that the dear man was corrupted and nearly killed by alcohol. The subtext here is to imply that illegal drinking leads to rape. (She also pushes 'human trafficking' propaganda, which is basically the same: "I thought I wanted to have sex for money but in reality I was forced into it by evil men who corrupted my soul.") This way the government can regulate it more strictly and mandate 'treatment'. But overall, this debacle will discredit the addiction narrative. I can't wait to hear what they find out from Mark Judge, author of "Wasted".

Your right on the subtext...drinking leads to rape...they established that as date rape in the late 80's....problem is that was not all 50 states overnight and it was not well publicized...I saw a pamphlet at a doctor's office and picked it up, shared with my wife and she hadn't heard of it either and it was telling us about the NJ laws which she grew up NJ. But now we all know that if a girl drinks she can't give consent...but a guy is fully in control if "something" happens....and they are playing all of that angle here....why she may have carefully chose "1" beer for her memory...if you listen to her there are que's based on now not how a 15 year old in 82 would have thought about the event....I can tell you "rape" was not even in my vocabulary in high school but both boys and girls like to drink beer and get "loosened" up and yeah boys hoped for the best and no one considered that rape...and I never actually heard of anyone getting "raped" the whole time in high school....and I am sure a few thousand times someone regretted the night before....we always blamed the alcohol not each other.
Well Dr. Ford admitted to being drunk at the party which Kavanaugh said he did not attend. So if Kavanaugh's drinking was illegal then Ford's would be more so because she was younger. So is Kavanaugh drinking any more of a problem than Fords? If Kavanaugh is lying, then cannot Ford be lying also because she was drunk and may not recall what happened which it seems to me that she admitted.
I think, had the article addressed this very point (or the state of any of the supernumerary accusers for that matter), it might have had a purpose.
Can we stop calling psychologist doctors? The replication rate of their studies is under 50%. Would we call a quarter a doctor?
Doctor is Latin for "teacher," derived from the verb docere, "to teach." Why are medical practitioners the only ones who get to use it? Etymologically, college instructors with a PhD have a better claim to it than do medicos who don't teach. In the olden days, any medical man would have apprentices who learned from him, just as lawyers had clerks who "read the law" under their tutelage. I guess they think it classier than "barber-chirurgeon."
Seems to me the idea of what kids did as teens is really irrelevant unless it involves a serious crime (drinking obviously is not, even to excess as Sullum points out many people learn their alcohol limits around that time). Groping someone as a teen would also qualify as not a serious crime in my book. Cory Booker's admitted groping during his teen years also is the definition of hypocrisy given his stance on Kavanaugh's fitness for office.
This whole character assassination via last minute sexual misconduct allegations is a frequent Democrat tactic, and simply for that reason, including their a) violating Ford's request to remain anonymous when they could have, b) holding it to the last minute rather than having it investigated earlier c) the appearance that Ford's lawyers are working for and being paid by the Democrats, and d) all the solid EVIDENCE supports Kavanaugh, we should just ignore the allegation and Kavanaugh should be confirmed.
From a libertarian perspective IMHO, Kavanaugh is a good pick compared to the last dozen justices appointed to the court.

you don't want to dredge up that other part but it looks like they have clamped it pretty good so far...I can't even find some reports I saw with her yearbook and some of her class mates and their claim of the lifestyle....one thing that perplexes me a bit if any of her background is true...she did not look like (at the hearing) or sound like a cheerleader who was allegedly a party girl for at least 5 years after this event allegedly took place....(was claims from high school and college days before she moved). If the event wrecked her and yes it could have and how she acts now could be the result of such a horrible trauma....but I have never heard of someone escalating their behavior for 5 or more years then suddenly buckling into this "church mouse" or "scared rabbit" persona....that normally occurs right after the tragedy if that happens and obviously the opposite happens as well so the 5 or so years of getting drunk and being a party favorite would roll with that ....but both happening and one after the other....seems a little strange...hard to find anything on her even a video before the hearing...She talked in that cutsey young girl shy emotional distraught tone the whole time....so does she talk like that right now...did she before? and did she in high school...seems hard to be a cheerleader and no cheerleader I ever met was that shy that's for sure....would be impossible to be a cheerleader.
Out of curiosity I searched for Ford's yearbooks and hit a dead end in every case, linked page deleted. Tried duckduckgo and got the same result. Pretty amazing that Google would shamelessly censor something relevant to the nomination of a SCOTUS justice.

Just out of curiosity, what was the legal age for smoking dope when Obama was in college? There were no questions raised as to his suitability for office over the issue so presumably he never smoked too much, but I'm not sure what, legally speaking, would be considered "too much".

Depends on what you mean by blackout. When I was a young heavy beer drinker I had a directable tunnel vision type of consciousness that could focus on one thing and do it more or less adequately. Often this would be driving a car at high speed, or getting in a sophomoric intellectual argument that would go on for hours, or singing up all the lyrics from songs of the day (or long ago days) from memory, which I would do on bets.
Anything outside of that tunnel of concentration was very poorly remembered. As I aged into my 30's and had months where I was drinking beer from breakfast until late at night the beer had actually become a staple of diet during very active hard construction work days. Losing consciousness was not a problem. I managed to bang out an amazing lot of passably mediocre work without injuring myself or anyone else.
The main problem I noticed with myself and other severe beer abusers is that although I could keep up certain priorities for awhile, the things I was neglecting to do in life were snowballing. Child care is a responsibility that really suffers around such people
I never did hard liquor or any other type of drugs, so I can testify that a beercoholic can function for much too long. Then when you do quit you are stuck with the gut to get rid of...

Blackouts have nothing to do with passing out from drinking too much. A blackout is merely the inability to form new memories while at a certain stage of drunkenness. Some people blackout at relatively low BAC levels, while others will never blackout before they fall unconscious from too high a BAC.
No, blacking out does not mean passing out. FFS man - these are commonly used terms and you should be familiar with them.
Passing out is just falling asleep. Blacking out doesn't involve falling asleep - though you might pass out later. Blacking out is something people don't even know you did until the next day when they talk about you pissing in the corner of the living room and you tell them you didn't remember it.
Actually blackout is before the passing out...you get so drunk that when you wake up the next morning you can only remember to a certain point and it is obvious that you were wide awake from that point until you passed out or simply went to sleep...both times I "blacked out" in my life I woke up in my room or my bed...had no idea how I got there and could remember up to a certain point in the evening then absolutely nothing at all. I had people thank me for getting them back to their room and I was going to thank them for getting me back to mine (they blacked out too). You can actually black out and seem mostly normal i.e. conduct yourself credibly to everyone around you for hours. On both of my occasions I was told I was perfectly normal when I left and went back to my room and the other everyone involved was blacked out but I went to several bars, took a cab, walked through a secure military gate where underage drinking was a huge flag (so I went through a sobriety point). Walked a couple miles and went to my room and went to sleep. I only know those parts because that was the only way I could have got to my bed...I don't actually remember that....the famous part of the story...my last half glass was sitting by the bed next to me and none of us could explain how I would have got a half glass of liquor from a bar through the sobriety check point (and the liquor itself was not legal/sold on base only in town in Japan).

Which tells me nothing about Kavanaugh's or Ford's drinking effects.
Unfortunately I have had to deal with blackout drunks who swear to be damned they didn't do what they did. One case there was recording and they still didn't believe it.

Speaking as someone from the greater DC area, who was underage at the time, as I've mentioned here before, the drinking culture among teens was such that all the bars I knew let people underage into the bar. The guys who checked your ID at the door would put an X on the back of your left hand to designate that you weren't legal. This is the origin of the straight edge "X"--teetotalers would put an "X" on the back of their hand voluntarily, not just to show they didn't want alcohol. Some of the tough guys used to put an "X" on the back of their hands, and when someone offered them alcohol or weed or whatever, they'd use it as an excuse to get violent--for all you knew, you were offering such things to a minor.
Point is, once you got into a bar, nobody paid much attention to who was buying and who was drinking. Meanwhile, house parties have been house parties since forever, and if the students at George Washington University weren't enough to provide cover for underage drinkers, Georgetown students were all there, University of Maryland students were there, and it's not like Maryland and DC are that far apart.

This is the truth. In fall 1982 U of Maryland and several DC schools regularly sponsored events serving beer. Several dining halls had bar spaces in the evening serving beer. Maryland had a "commuter bar" in the Student Union, next to the big parking garage. Underage drinking was beyond common.
It was the same thing on my summers in San Diego, especially on the beaches. Getting firewood for the bonfire at Del Mar was harder than getting alcohol. It's always been one of the funny things about drinking laws, people assume things about kids that just aren't true--that kids don't drink or that drinking ages are effective at stopping them. It's sort of like talking about sex and kids. My understanding is that the median age that women lose their virginity is 16, which means as many lose it at 14 as lose it at 18. No one wants to believe that kids under 16 are losing their virginity at that rate--and people want to think that drinking laws are effective at keeping alcohol out of the hands of minors. Maybe it's for the same reason--they don't want to worry about their daughters and sons so they tell themselves that their kids don't do the same things they did when they were kids.

Kavanaugh graduated 83; this 'event' supposedly happened in 82. After he finished his junior year, but before he was a senior. He was not a senior when the seniors were legal.

My brother was 17 when they raised the drinking age in Virginia and grandfathered kids who were 18 at the time, just a few months older than him. He never had any problem getting beer through them. As a practical matter, most sophomores could get an 18 year old senior to buy them beer. The legal drinking age may have been 18, but functionally it was about 16.
Listening to Kavanaugh I didn't get that he was saying he was legal. I got that he was in my brother's position - the seniors were legal so they bought the beer. But you hear what you want to hear.
By the time I got there, the drinking age was firmly 21. A high school kid getting a college age adult to buy him beer was more difficult. Raising the legal drinking age to 21 raised the functional drinking age to about 18 or 19. We spent a lot of time in 7-11 parking lots pestering customers to buy for us. Until one of us stole his brother's ID and passed it off to bored clerks who never really looked at it.
That is why the drinking age should be 19, if it is 18 it is too easy for high school kids. That said I never had any problem getting beer underage and the fact it was a little difficult made you appreciate the beer and also not drink beer on a Tuesday.

I, too, became old enough to drink, twice, due to the legal age being bumped up from 18 to 21 in Michigan. I found it merely amusing because I didn't drink at the time.
No grandfathering in Michigan, either.
I grew up in Michigan and I was legal at 18 and, if memory serves me, they raised it to 21 when I was 21. Obviously a lot of pissed off "gap babies" in between but it was a referendum that they could have defeated if they had bothered to vote or so I read in the paper at the time. Then "Alcohol may be possessed or consumed by an underage person in a private residence so long as it is furnished or allowed by a member of that person's immediate family (typically a parent)."
The alleged party at the alleged private residence was allegedly held in Maryland in 1982, not in Saudi Arabia, or even Maryland of 2018.

We used to hide our beer (Milwaukee's Best, $13/cs of 24) in the woods. Evening comes, it's been 98 degrees all day - drink two, hurl, drink the rest. Hurling was just conditioning to drink hot, flat beer.
