More Accusers, More Denials Ahead of Thursday Kavanaugh Hearing: Reason Roundup

The New Yorker details alleged flashing from the Supreme Court nominee. It's only Monday and this week's news cycle is already promising to be a hot and enraging one.

Christine Blasey Ford has agreed to testify before the Senate Judiciary Committee on Thursday regarding her sexual assault allegation against Supreme Court nominee Brett Kavanaugh. (Kavanaugh will also testify on Thursday.) But since yesterday, Ford's story has taken a back seat to new allegations against the nominee, some reported by The New Yorker and some tweeted by lawyer Michael Avenatti.

The New Yorker story, penned in part by celebrity journalist Ronan Farrow, details an alleged 1983 incident in which Kavanaugh supposedly exposed himself to a Yale classmate named Deborah Ramirez. The story drew swift praise from the expected corners and became potent fuel in the fight from Democrats against Kavanaugh's nomination. But it's also full of doubt-inducing details. For instance:

  • Ramirez admits to "significant gaps in her memories" of the night in question.
  • Ramirez herself said she was reluctant to definitively name Kavanaugh as one of several men who flashed her and others at this party. Ramirez decided she was certain it was Kavanaugh only after consulting with an attorney last week and supposedly recovering hidden memories.
  • The New Yorker contacted six Kavanaugh and Ramirez classmates who were allegedly around for the incident in question or may have known about it (according to Ramirez) and none said they remembered it happening.

Meanwhile, The New York Times says it contacted "several dozen" people "in an attempt to corroborate her story, and could find no one with firsthand knowledge." The Times also notes that "Ramirez herself contacted former Yale classmates asking if they recalled the incident and told some of them that she could not be certain Mr. Kavanaugh was the one who exposed himself."

Unlike Ford's story—in which Kavanaugh and his friend Mark Judge allegedly attacked her after pushing her into a bedroom alone—the penis incident Ramirez has described supposedly took place in a crowded dorm-room party and involved people yelling up and down the halls about Kavanaugh's antics. So a lack of corroborating witnesses poses a bigger problem to its credibility.

As some Republicans claim that all the accusations against Kavanaugh are politically motivated, the New Yorker piece is also attracting criticism for helping people conflate Ford's more believable and serious claims with charges that could be more easily discounted.

Others are defending its publication, no matter how flimsy the underlying story may be, because Senate Democrats and Republicans allegedly knew of the claim and are looking into it, making it newsworthy regardless of its veracity.

Meanwhile, Michael Avenatti—most well-known recently for serving as Stormy Daniels' lawyer in her dealings with Michael Cohen and Donald Trump—claims that there is a third person who claims Kavanaugh sexually assaulted her. Avenatti has not yet revealed the person's identity or details of the story, but he has tweeted an email suggesting (without evidence) that Kavanaugh and his friends regularly accosted drunk girls at parties and gang-raped them.

"I represent a woman with credible information regarding Judge Kavanaugh and Mark Judge," said Avenatti on Twitter last night. (Judge is the person accused of assaulting Ford with Kavanaugh 36 years ago.) "We will be demanding the opportunity to present testimony to the committee and will likewise be demanding that Judge and others be subpoenaed to testify. The nomination must be withdrawn." Avenatti specified that his client is not Ramirez.

In other Kavanaugh-related news: Ed Whelan, the author of last week's crazy mistaken-identity theory that accused a random man of attempted rape, offered to resigned as president of the Ethics and Public Policy Center, but the board did not accept his resignation and has instead placed him on indefinite leave.

Perhaps in order to help sell the president's terrible trade war, the Trump administration plans to launch a brand new anti-Chinese propaganda effort, according to Axios. Two administration sources have told the outlet that an "administration wide" campaign against China would be broad and substantial.

"We're not just going to let Russia be the bogeyman," said one, using a term for bad guys who are by definition mythical.

"Neither administration official explained why the administration is pursing this now," writes Jonathan Swan.

      What's really sad about these people is that they're among the small minority of Americans who support abortion all the way up to and including the moment when the baby's head emerges, but they have an outsized influence on the debate because the mass media class is part of that group. Most everyone else supports restrictions on it, including "pro-choice"ers, it's just a question of the degree to those restrictions.

    Roy Moore was just a dry run for Kavanaugh. In the Moore case, you had one accusor who said he assaulted her. That accuser turned out to be a complete nutcases that no fair person could ever believe. Then you had a bunch of women who didn't accuse Moore of anything other than being a single guy in his 20s who dated young but of legal age woman and never did anything illegal or wrong except offend the fashionable sensibilities of our elite class. But, somehow that turned into "he has so many accusers you must believe him" as if enough people telling a lie enough times makes it true. And since Roy Moore is some evangelical hillibilly who didn't go along with gay marriage and everything else our elites tell us to go along with, the GOP establishment media turned on him and laughed when it ended his carreer.

    Now those same people who bought these same sorts of lies are shocked that the liberals would do it to one of them. Kavanaugh is a prep school Harvard man. He is associated with the Bush's and the right people. You can't treat him like some deplorable. Yeah well, Progressives and can will. They are doing to Kavanaugh exactly what they did to Moore. It doesn't matter that the woman's story is even more absurd than the first accusation. Hey, if enough women say it, he must be guilty.       As a left-libertarian, I usually agree with you, but you're wrong here. "Just get a new one" isn't a viable option for the Drumpf regime ? and that's a good thing for us! There simply isn't enough time to confirm anyone else before the #BlueWave Senate is in session. And if Putin's Puppet's party even tries, the progressive / libertarian alliance will find a way to block that person too.

      What Whelan did was no different than Pizza gate. If you assume the person is guilty, suddenly all of the dots connect. If they were ever to catch Jon Podesta sodomizing a child in a Satanic ritual in the back of a pizza joing, everything said in pizzagate would make sense. Without that, it is just connecting dots by assuming your conclusion, otherwise known as confirmation bias. The exactly same sort of BS was seen when the 4chan idiots alledegedly "solved" the Boston Marathon Bombing.

      It would be one thing if Whelan had spouting this theory in some drunken tweet or in a private conversation. But, he took his time and thought about it and developed it and really seemed to think he had solved the case. The fact that it never occured to him that he was assuming the guy's guilt and was making a completely baseless slander against an innocent person, even though he had that long to deliberate before doing it, is a devistating critque of both Whelan's character and intelligence. This wasn't a mistake or a case of speaking out of turn. It was a deliberate act by him and one that he honestly thought was the correct path.

      No one that stupid has any business being in charge of anything and certainly shouldn't have a law liscense. What a moron.

    In light of the recent accusations against Kavanaugh, and with the help of my therapist/lawyer - who moonlights as a NYT reporter, I have finally mustered up the courage to tell my own story.

    It was February 29, 1983 somewhere in Minnesota and I was headed over to the local Whole Foods to pick up a cake for my dorm's yearly beach party. As soon as I got to the bakery section, I heard catcalling. I looked over to see Brett Kavanaugh, who was the bakery clerk on duty. He was sneering and making a horribly sexist gesture that I don't quite recall. It was awful and I almost felt embarrassed for wearing nothing but a towel in the store. But I assured myself that it was my right to wear whatever I want without any man so much as looking or talking to me....

    I do find it interesting to consider, assuming that Ford's story is a deliberate lie, how libel laws may be modified to accommodate this behavior. Right now I think it must be the case that a prosecutor has to prove that Ford knowingly and intentionally lied. So would her "recovered memories" be enough of a defense? If so, *should* they?

    Others are defending its publication, no matter how flimsy the underlying story may be, because Senate Democrats and Republicans allegedly knew of the claim and are looking into it, making it newsworthy regardless of its veracity.

    Didn't they play the Steele dossier the same way? Plenty of news outlets had seen the dossier and passed on reporting on it because it was too sketchy even for their low standards, but once Comey talked to Trump about it, why suddenly it became "newsworthy".

    Look, I'm not saying that the Democrats are running a child sex-slave trafficking ring out of a DC pizza joint, I'm just saying that some people are taking the story seriously enough that they feel compelled to defend Democrats against the charges.     Gee, what was NOT included today? That would be a FOURTH witness (and personal FRIEND of ford) of the supposed ford fiasco submitting a written statement until penalty of perjury stating that the incident did not happen.

    Instead we get same vague hand waving that this second, pathetically weak and already refuted allegation somehow INCREASES the credibility of Ford's fever dreams.

    So for the record:

    Four statements under penalty of pejury that the incident didn't happen. One statement NOT under penalty of pejury (she submitted the letter to a congresswoman and not feinstein) that it did. Totally uncredible. But add in a second allegation again with no corroborating witnesses and witnesses saying it didn't happen and suddenly it all becomes more credible.

    Realize that this has destroyed reason's credibility for years. Not that that matters to the stable of pre-Vox millennials or aging leftist boomers, but the foundation should be appalled at what its publication is issuing as they will have to live with the consequences. Good job.

    A little background on the sheriffs stealing from jail inmate food budgets (I grew up in prison town and retired as a corrections officer from the Seattle jail.) A hundred years ago it was common for both jail and prison inmates to eat extremely well by historic (and modern!) standards.

    The reason is that large jails (like Seattle's) and state prisons usually had prison farms, to include dairies, butcher shops (with real knives), bakeries, and very large gardens verging on commercial agriculture, especially of potatoes and corn.

    Consequently, inmates often had to face breakfast with a choice of sausage or bacon, fresh baked bread, fresh eggs, and fresh milk. The other meals were just as sumptuous. Being incarcerated in the old days was tough because discipline and order were tough and no disrespect was tolerated, but eating well was a major consolation, especially during the great depression 1930-1942.

    What ended the good meals for jail inmates in Seattle was that the farm land simply became too valuable and the county sold it off. Today inmates eat meals calculated by dieticians to keep them alive and costing about 65 cents a plate. Michelle Obama might approve of some of the dishes, but to most people the fare appears a lot like cruel and inhumane treatment.
