Donald Trump Should Stick it to Jeff Sessions and the 'Deep State' by Pardoning Reality Winner
The woman who leaked a report showing Russian attempts to infiltrate voting systems gets the longest sentence ever imposed for her offense.

Who will serve more prison time: Michael Cohen, who admitted in court this week that he arranged hush-money payments during the 2016 campaign to keep women quiet about their dalliances with Donald Trump? Or Reality Winner, who was arrested a year ago after she leaked a National Security Agency (NSA) report showing evidence that hackers connected to Russian intelligence had attempted to infiltrate state-level voting systems?
On Thursday, Winner was sentenced to 63 months in federal prison for violating the Espionage Act, the longest sentence ever imposed on someone charged with leaking classified information to the press. She's already spent a year in jail, having been denied bail (unlike Cohen). The law doesn't even permit her to defend her leak as being in the national interest.
Cohen's plea agreement, by complete coincidence, has a maximum sentence that is also 63 months. But the sentence could be as short as 43 months, which means Cohen could face less time for his role in attempting to cover up information relevant to the 2016 election than Winner could face for exposing it.
This morning, President Trump's complicated collection of feuds led to an interesting place where he seemed to acknowledge that Winner's leaking was not a big deal, at least compared to what he believes Hillary Clinton has done:

Note the scare quotes around "classified." Maybe we shouldn't read too much into that—Trump tends to pepper his tweets liberally with scare quotes. Trump's tweet nonetheless got the attention of Winner's mother, who responded that he should consider pardoning her:

Let's be clear about the report that Winner leaked. It did not implicate Trump in any way. It was entirely about attempts by Russian hackers to infiltrate our voting systems. And this was important information that was valuable for state-level election officials to know about. Just last month the Justice Department announced indictments against 12 Russian hackers for allegedly attempting to meddle with the 2016 election. Most of them were charged with infiltrating the Democratic National Committee and Clinton's campaign, then arranging to release the information they uncovered through intermediaries. Two of them, though, were charged with the sort of activity that Winner leaked: attempting to infiltrate voting systems.
Just as with Edward Snowden, there's a strong case here for forgiving Winner's crime because the information serves the public interest. If Trump actually thinks it's "unfair," he should consider pardoning Winner. Unfortunately, it's probably more likely that Trump believes it's unfair that Clinton and his political enemies aren't being arrested too—that Attorney General Jeff Sessions is being too nice, not too mean.

Well, Trump did pardon Kristian Saucier.
I have come to realize "libertarians" are not much into personal responsibility when it fits their pet issues like leaking or smoking pot, but lets wade into this.
1) She signed an agreement to not do exactly what she did. She was granted access to information and abused it by leaking it.
2) It is not her role to disclose this information to anyone. She was a translator, nothing more.
3) Releasing documents like this exposes sources and methods and can potentially close the loophole or backdoor that allows this information to be acquired.

The leaked report was a complete nothing burger. She was a patsy for the Intercept. Basically Glenn Greenwald, who's a Putin stooge, was in a fight with the editors of his own magazine (who were anti-Assad Russiaphobes). They had been publishing articles on both sides. Greenwald said publish it, knowing it would be discredited, which it basically was. Sure there was an attempt to infiltrate, but it wasn't major, and it wasn't in the public interest to leak it. I agree the sentence was unduly harsh. But please kids, don't leak no matter how good your intentions. #dontbeahero

Well that's just crap. Elections are administered on a county-level with significant state-level interest. There is almost NO federal involvement. All the blackbox voting systems have serious potential hacks and flaws anyway. 'Election administration' is pretty much the definition of 'in the public interest'. NSA's actions in concealing that info - and sentencing her to prison is exactly an indication that 'conceal' is what they intend - undermine election administration esp since the last year is exactly when counties make their security fixes and purchase decisions and such in preparation for upcoming 2018 elections.

That is precisely why it should never have been 'classified' to begin with. There is no reveal of sources/methods. No even remote 'national security interest'. There is enough info there to know that that was a preparatory hack - collect the county contact info (and their computers) for a particular company's election system (and there's only 4 main suppliers out there). Next step - with two years to do it - is to hijack maintenance/upgrade downloads. It is very easy to rig the vote counts with all of that blackbox software.
But hey - obviously there is no fucking public interest at all in knowing WHO is trying to hack that. Because obviously the Russian govt is not as cybercapable as a programmer in Memphis.

Voting machines produce a local vote total that is sent to state voter offices.
It can hacked and is not as secure as manual ballots but its also fast for vote totals and can be decentralized during the voting process so tampering is less likely.
It can only be decentralized to the degree that it uses entirely separate voting/election technologies. The 'fraction magic' video I linked to shows how any of those tabulating/reporting systems can be hacked/rigged - centrally and invisibly - across every single precinct that uses that system - for any particular election that it is tabulating - and successfully enough to survive most audits from the precinct level up to the general election level.
And, once embedded, the hacking/rigging can occur far faster than election results are reported.
At core - the hacker can decide who/what is going to win the particular election - decide what % of the final vote they will win - and the actual individual votes will be weighted to ensure that that is the outcome. And every major voting system incorporates that 'fractional vote' mechanism that allows for the hack.

Actually, it does; She can make that argument to the President, who is empowered to pardon her.
The problem for her is that the law doesn't make exceptions for her thinking it's in the national interest, because she hasn't been assigned the job of making that decision.
There are certainly conceivable circumstances under which somebody at her level should, morally, make that call. But I don't see any way to build those into the law. Basically you have to take your chances on the big guy agreeing with you.

The government doesn't have to show any actual harm to prosecute. This allows them to over classify to protect information that may be embarrassing but not relevant to national security and punish people for embarrassing the government.
Like FISA warrants then.

This is what disturbs me. Trump has done some really bad stuff and he's done some really good stuff. Overall he's pretty ordinary but much better than average from a libertarian perspective. But there's no sense of proportion in the media coverage. Including Reason. I've been hating presidents for 45 years and I could find plenty to hate about Trump. But the irrational hatred for him amongst the elite and their followers borders on the bizarre. I'm left to believe that even the "libertarians" at Reason see Trump as a threat not to liberty, not to the economy, not to world peace but to the status quo that they secretly find comfort in. Trump is a political revolution for better or for worse. But Reason would rather have Clinton so they can spend the next 8 years establishing their bona fides by tilting at windmills while the nation continues down the road to serfdom.

A pardon? No, that won't call the dogs off, and where does this go? But I wonder... could Mueller have any case at all against the Russian hackers but for her leak? I'm guessing no. Things are so firewalled/compartmentalized at the federal level, I don't think his team would have discovered any of this, because Trumps name is nowhere near it. And, since Sessions seems content with the special prosecutors trajectory of late [a narrative being crafted about a "circle of corruption" to smudge the president with by creating process crimes or plea deals], a pardon for Reality does not add or subtract to that effort. Nothing's going to happen, especially when her treatment spotlights the bias within the DOJ to continue down their road of obstructing and aiding/abetting the hildebeast for her crimes against national security. Is she a hero? No. Did she perform a public service [given the permanent 'stand down' order 44 seemed to have in place during his second term]? Perhaps. Does the 2012 Whistleblower Protection Enhancement Act need to be revisited? Maybe, but first note that agencies stall people following 'process' at least several years, and often past any sitting presidents term.

What to do?
One of the Deep State bunch saw an out. They all understood that Russian interference in the 2016 was real but it was a nothing burger and Obama had been so briefed. They all knew That Trump "collusion" with Russians was also nothing but business as usual in both parties and that investigating that would ultimately go nowhere.

Given that the heavily Democrat Mainstream Media stood eagerly waiting to lend massive support to any Witch Hunt effort (even one which there was no real reason to initiate.) Mueller volunteered to step forward and be the brutal strong armer of TDS on an undefined quest.
Trump, however, will not get used and abused so easily. Bet on that one.
Winner will not be pardoned. She leaked Top Secret material. President Trump does call for equal justice for Winner, in that Hillary should be in jail too.
