City officials in Encinitas, California, have fined Peabody's Bar and Grill $3,000 after catching people dancing to live music performed there. Owner Brie Cardosa says she was surprised. She says she doesn't run a dance club but sometimes the natural reaction to music is to move around.

"The [Alcohol Beverage Control] interprets their rules that if you sway to the music, you could be in violation of the rules. That is not what city council is interested in having happen."
It beggars description why the city council made the rule in the first place if they thought it would only be used sensibly, narrowly, and in a manner which didn't inconvenience constituents. Have they ever met code enforcement? Did they think they lived in Rights Of Man Land?

Let's examine the benefits of something we want to do without considering the down side - and occasionally without recognizing that there might BE a down side. Especially when the benefits come to us, and the down sides on someone about whom we currently don't care. This is how we make the world an interesting place to live.

I would presume that dance halls have their own regulatory regime (including higher fees to the govt.).

So getting a permit as a restaurant, not paying for a dance hall permit and going through all the regulatory hurdles associated with such a permit, then allowing dancing, is like stealing from the government.
