Mandatory Transparent Backpacks Violate Students' Privacy Rights
"My school is starting to feel like a prison."


Students returned to Marjory Stoneman Douglas High School this morning sporting new, mandatory transparent backpacks.
This so-called safety measure, like so many others proposed in the wake of the horrific mass shooting—installing metal detectors, hiring more school resource officers, raising the minimum age to purchase an AR-15—is security theater.
One can understand why survivors of the Parkland shooting might want an extra level of comfort as they resume classes this week. But many students seem to understand that the transparent backpack mandate is a violation of their privacy rights. "My school is starting to feel like a prison," student Sarah Chadwick said, according to Buzzfeed News.
Another student, Delaney Tarr, posted a picture of her new backpack on Twitter with the caption, "Starting off the last quarter of senior year right, with a good ol' violation of privacy!" She also complained about walking through a fenced line with a checked bag.
Tarr is right. These are perfectly reasonable objections to a policy that probably isn't going to make Stoneman Douglas any safer from a rampage. In any case, teenagers should be allowed to express their individuality by choosing their own backpacks and keeping their stuff hidden from private view. Many students might be carrying items than they would rather not display to the entire student body: medicine, toiletries, etc.
The same goes for other "security" measures, such as metal detectors, wands, and school resource officers. There are good reasons to doubt that these policies actually promote safety. They do, however, make schools more prison-like. In the case of school resource officers, the attempted trade-off between safety and liberty seems especially unwise. This is something students of color tend to understand a bit better than their white peers: At a press conference last week, black Stoneman Douglas students told reporters that more cops would actually make them feel less safe. Police violence often disproportionately affects minority communities, so such concerns seem well-founded.
Policies aimed making it harder for people to own firearms aren't fundamentally different from the above security measures, even if some students feel otherwise. Take Carly Novell, who wrote on Twitter: "We want to be safe, not uncomfortable. The only thing that can really have an impact on our safety is gun control."
But "gun control" is another dubious trade-off, like transparent backpacks and cops in schools. It's just that with this piece of security theater, the people who suffer the infringements on their liberties are gun owners rather than (or as well as) students. Gun owners of color, of course, have good reason to think a governmental anti-gun policy would disproportionately target them. That's one reason Killer Mike, the left-leaning rapper and activist, is suspicious of gun control (though he apparently resents being used by the NRA).
It may not matter to Novell or the Parkland activists whether other people are allowed to exercise their Second Amendment rights. But the principle is the same as it is with transparent backpacks: No one's liberties should be infringed just because agents of the state arbitrarily decide that a new policy might somehow make somebody feel safer.

The same logic behind clear backpacks is the same one used to justify not allowing students to carry backpacks to class. Children in schools do not enjoy the full benefits of individual rights.

I totally agree. However, many of the students there do not. They want gun laws that do just that, Infringe on liberties in the name of feeling safer.

Student's only have limited rights, including privacy rights. There is no way a school could operate if students were allowed to have normal adult rights.
Its why there is a massive "rights" line at the age of majority.

Um nobody asked for my permission. Here in my state we have a thing euphemistically called "compulsory education". It's not a particularly apt description of what actually takes place, but like all things compelled by government it comes with a threat of violence. Around here if you don't submit, sooner or later the sheriff will show up on your doorstep. If you fail to respect his autoritah, he will shoot you, your dog, and your kid if he gets in the way. Maybe it's different where you live.
Another thing is that this isn't a new thing. I taught from 1992-2000. Schools were adopting clear backpacks then, although the reasoning was drugs. Since I taught at semi-inner city schools, nobody seemed to object. At that time, the students were given the option of mesh or clear backpacks. The clear backpacks are horrible. They tear easily, and will last probaly the rest of the school year for the Parklands students. The mesh backpacks weren't bad. They were fairly durable, and I even bought one for myself--it was a great beach backpack. Shake it a few times, and you got rid of any sand that got in.

Many years ago my wife worked for a major department store. Employees that wished to bring purses in to work were required to use clear bags/purses. As I recall, it was to reduce shrinkage (stealing by employees on the job). Didn't seem like a big deal back then to my wife. I don't think she felt like her privacy rights were violated.

I have several friends who are corrections officers. At one jail, they are not even allowed to bring their own lunch in, they have to eat what the prisoners eat, because of the security risk.

Schools aren't a place for freedom of expression. They are a place to learn. I agree they aren't private schools where you have have a dress code but there is still a code to private schools, you can express yourself in anyways.
A lot of public schools limit sneaker choices, clothing, jewelry, etc for the safety of the students (Aka they were stolen/robbed). Why is this different?

Why reason could there be for a teacher criticizing a student for wearing a Marine sweatshirt unless it violates a school dress code in some way in which case it would be a school infraction? I could see it triggering a discussion on the role of the military, US defense policy etc. but not negative comments just for wearing the shirt.
Any adult that curses at a kid who wears a Marine emblem sweatshirt is a time bomb waiting to happen, and should be fired, and not allowed to work with kids. Interestingly, that's what they did. They fired the teacher.
I believe in one case it wasn't actually the EGA, the Marine emblem, but some other image that -shock horror-showed Marines with rifles and other assorted weapons that triggered a teacher.
In fact, too many protest (more than perhaps one or two every decade) just make those few that are really necessary something people pay attention to. No they are a dime a dozen and some of them every bit as big as yours.
Please learn a basic rule of life you can do nothing about. Just because something happens, however, "dramatic it might be" and hopefully you never have to go to war and watch thousands of your fellow friends and soldiers die a horrible death on some beach like Normandy that died so you would not have to feel like you were in a prison.... it's call person freedom (for which there are personal responsibilities also you can not avoid.)

This is the solution to all of this. Small self-organized neighborhood schools need to be the norm. Let the parents fund them, perhaps with state taxpayer supplied grants to the parents.
Parents are motivated to get their kids an education that makes the kids employable, because the alternative is to support the kids for the rest of their lives. If you do it really right, your kid may support you.

I understand they went through a traumatic experience, but if being required to have a clear backpack in the environment of hysteria they and their peers have milked is a bridge to far for them, I'm not going to waste any sympathy for them. You wanted rights taken away in the name of greater safety, this is just the next logical step in doing so. I hope every school institutes this type of policy where the walkouts took place.

The complaints about security in the prison+ camps for children are absurd. This is one case where the government is actually doing something that it should be doing - providing security for the animals they cage. It is particularly absurd in the context of the Parkland Massacre.

When I was a kid nobody had backpacks, all your shit was on display for everyone to see every day.
When I was in high school, we had such a problem with drugs that they closed up or removed all the lockers. Everyone stumbled around with backpacks loaded up for 7 classes every day.
Somehow everyone in high school still did drugs. Weird.
When I was a kid we had lockers big enough to hold an average teenager. We could put our own locks on them, and some of us did. Some students had guns in their cars and occasionally a rifle racked in the back window of a pickup.
I walked a couple miles to school so I carried a real backpacking backpack with a big knife and a Crossman CO2 pistol in it and a change of clothing. No books. If I had homework, I hung out at school and finished it with my friends. The school was mostly open for anyone to roam in or out of till at least 8pm.
I don't remember anything more violent than fist fights.
I think the safe world we have created is far more damaging than what it replaced.
But all that stuff makes people feel threatened. Nevermind what actually happens, it's all about feelings of safety.
Nobody is going to violate your privacy, we just need you to use clear backpacks. It's common sense!

Sorry but I think it is very ironic that these kids are all whining about "their rights" yet they have no problem advocating for stripping me of mine. They have swallowed the entire anti gun narrative they have a "right to feel safe" and the only way for that to be possible is confiscate my guns. Bags are checked at airports, concerts, sporting events. You are restricted to entering through specific entrances at all these locations and many business and government agencies require all employees wear badges. Everything these kids are whining about is a clear demonstration that they want to feel safe so long as they are not required to do anything to help make that happen. They do not seem to understand that Cruz broke a number of laws, Federal and state by just bringing the gun on campus. How would they have defended themselves if he had opted to use a Katana or broad sword? A lot of people would still be dead. The students say they want to feel safe, fine this is what it takes, so suck it up buttercup.
Maybe we should consider sending all 13-23 year olds out to live in the woods. Those that survive could be welcomed back into adult society.

Like a prison? No, not really. More like an airport or a government building or a pro sports venue or maybe a live concert. The clear plastic backpack more or less obviates the need for x-ray machines saving the school money.

Many inner city schools have metal detectors, electronic wands, armed guards, security glass, locked and alarmed exterior doors, security cameras, etc. and guess what? You can't bring a weapon into these schools. The other irony is you almost never hear inner city students complaining about excessive security and a lack of privacy.
Yeah, and you didn't hear the media reporting on German Jews complaining about their neighbors disappearing in the night. The lack of attention does not mean that they are not upset. It's just that a few white kids involved in an easily politicized matter more to the media than hundreds of brown kids in a shitty school.
Besides, I think you just aren't paying enough attention to kids in inner city schools and are trying to pass it off as expertise. Many are unhappy about the security theater. Even if some aren't that doesn't really justify it.

As frustrating as this backpack policy is, the most annoying thing for me (as a parent) is having to replace these bags so frequently. They are just not durable enough for heavy school books. I managed to find a heavy duty backpack for my kids from https://www.bestbackpack.com/best-clear-backpacks/ which is great... but is this a long term solution for our kids? Secondary to this issue, is the fact that we are now adding to the already heavily burdened plastic waste issue. With so many plastic backpacks needing to be replaced so frequently... just think of how many are filling up landfills. We really need a better solution!
