Cop Breaks 17-Year-Old Girl's Jaw at Library, Lawsuit Alleges
The cop fell on the girl while trying to remove her from the library. He was suspended without pay for 40 hours.

A police officer working off-duty at an Ohio public library broke a 17-year-old girl's jaw while removing her from the premises, a lawsuit filed by the girl's mother this week alleges.
The incident occured last November. According to the lawsuit, Officer Kevin Jones first complained that the girl's headphones were too loud, then told her to "shut the fuck up" after her phone rang, and finally declared that she had to leave after he saw her put her feet up on a chair.
The teenager, referred to in the complaint as J.G., and her 11-year-old brother, referred to as D.J., settled first in the children's section of the library, according to the lawsuit, but moved to the adult section after Jones' complaints about the girl's headphones and phone because Jones' "constant vigilance made them uncomfortable, especially given the hostile manner in which he had treated them since they arrived."
The mother's attorney, Subodh Chandra, has released surveillance video and body camera footage. The surveillance video shows the officer pushing the girl across the library, placing her in a full nelson near the entrance, and falling on top of her just short of it. The lawsuit alleges the fall broke the teen's jaw.
A statement from the Lakewood Police Department confirms the actions in the surveillance video: It says Jones "took hold of the female by the arm and back of the neck and they fell to the ground," notes the "full nelson type hold," and acknowledges that the two fell to the ground and that "the female sustained an injury to her mouth as a result of the fall."
The NBC affiliate in Cleveland WKYC obtained Jones' performance reports, which apparently say that Jones needed "little to no supervision" but needed "to continue to exercise patience with members of the public."
The police department suspended Jones without pay for 40 hours, prohibited him from working at the library, and ordered him to undergo additional training to resolve his issues.
"When employees act outside of their training and responsibilities they are held accountable," the statement read. "The Lakewood Police Department trains their employees to de-escalate encounters and to only use force when reasonable and required."
The lawsuit also alleges that Jones—and other officers who responded to the scene later—did not promptly request medical assistance for the girl, who was left bleeding outside. Instead, body camera footage showed Jones "re-hashing his attack on J.G. and laughing with the other officers about clocking out early rather than calling an ambulance to attend to the crying teenager."
The case shows the benefits of zero tolerance policies for police officers—that is, of identifying problem officers as early as possible and removing them before their excessive use of force turns deadly. Permitting an officer who has been cautioned to exercise patience to work security in a place like a library, full of children, suggests a culture where performance problems aren't taken seriously. In such an environment, problems get worse.
The lawsuit accuses the city of failing to train employees on how to deal with a "forseeable population"—namely children—and of failing to train them on how to "properly respond to serious medical needs." In nearby Cleveland, it took a settlement with the Department of Justrice to make medical care a part of the city's supposedly "exacting" use of force policy.
The lawsuit also says the officers violated the girl's Fourth Amendment rights, and it accuses Jones of criminal acts of assault, menacing, abduction, unlawful restraint, disorderly conduct, and interfering with civil rights.
The Lakewood Public Library and the Lakewood Police Department did not respond to requests for comment.

No proof that the cop did not request her to leave. My guess is that he asked her several times. If the cop does not get compliance, what is he suppose to do? Granted it is just noise in a library but do you honestly think, given the fighting back that she displayed, that there was no sha-nae-nae going on in that conversation? If he had nicely brought in 5 cops to pick her up and remove her, folks would then be outraged as well.

If someone is say, disturbing the peace, what is the proper application of force if they will not comply with 2 or 3 requests to shut up or leave? Had he tazed her, there would be outrage, and rightfully so.
If she will never comply and is belligerent, what is the police officer supposed to do? Had he not fallen upon her and hurt her, would this be an excessive use of force?

Yes, I think that's obvious. His default mode for someone supposedly not complying with his order was to get violent - he escalated the situation, which is the exact opposite of what a police officer should be doing.

There are many different ways to approach this situation that do not involve violence, but an on-duty police officer could have written her a summons for disturbing the peace, or something along those lines. Wrestling her around the building is obscene.

I have no doubt the girl was being obnoxious. Teenagers are assholes. But as often as I would love to beat the crap out of my own when they act defiant, I don't actually do it. Yes it's a tough spot for the officer, but he picked the worst possible course of action. If she was really being disruptive, he should have just persisted in annoying the crap out of her until she left of her own volition.

Well, I think the other question here is what is the applicable law. If they are supposed to give out ticked under certain conditions, then yes, by all means.
I am not trying to be racist when I mention how they were both of darker skin, but it is important to keep in mind when you consider how his own police department suspended him and publicly acknowledges how he went outside of his training, which guarantees some cash in litigation.
That would be my question, just how outside his training was he? I feel that a lot of the abuse by law officers start right from the start with piss poor training and re-training programs.
Disturbing whose peace? Others around them? Hypothetical others? There wasn't a soul within thirty feet and headphones are required by physics to obey the inverse-square law. Something about the surface area of a sphere, any cop can explain it to you I'm certain.

You could get cop accountability real fast if all cop assaults were treated as ordinary crimes; Put every single incident under the jury microscope. No union protection, no suspension with pay. You punch somebody, a jury decides if it was justified in the line of duty, just as they would for any non-cop who punches somebody.

When I was a kid, there were no cops in libraries.
Maybe that's the problem. Cops are blunt instruments. Maybe things would not have escalated if this girl was first confronted by librarians, who have the same restrictions on use of force as any other citizen.
I was never disruptive in a library as a kid, but I think "if you don't settle down, you're banned from the library for a month" or, in extreme, "leave now or we're calling the police" would have more than sufficed to quell most kids.

The question about off-duty authority is this: A police officer in Ohio has the same authority off duty as he has on duty. It is like this in most states.
I am from the area this happened in, the Lakewood (the suburb of Cleveland this happened in) public library has constant problems with teens and young adults behaving inappropriately, as well as with men having sexual encounters in the bathroom. These problems were so pervasive that they had to hire Lakewood police officers to work secondary employment there.
The question about what the teen should have done is simply comply, then none of this would have happened. Yes, comply with the officer's authority. The police are where the buck stops when it comes to controlling illegal and/or disruptive behavior in society. They are legally authorized to give, as the citizens are legally required to obey, their lawful orders. To those that don't understand this, perhaps a citizenship class that they slept through should be re-attended. It's simply common sense.
So, non-compliance is dealt with swiftly, by breaking the jaw of the non-compliant? I understand what you are saying, but writing the girl a ticket would have been a much less violent way of resolving this matter. It's revenue to "the State", which your appeal to authority argument shows you clearly defer to. Instead, the taxpayers of Lakewood are going to have to shell out millions with this lawsuit.
Does your typical "disturbing the peace" public ordinance law state the penalty is immediately getting your jaw broken? They are two separate actions, being disruptive and the officer breaking the girls jaw, but one didn't end with one person's jaw being broken and a lawsuit being filed. A lawsuit many municipalities quickly settle and push the tab to the local tax base.
Now to the issue of the officer's behavior. I can tell you from knowing an officer that works there that teens are made to leave by officers quite frequently, and the bulk of the offenders of the library's code of conduct are African American. Not exclusively mind you, but mostly. The conducts prohibited include playing headphone with volume audible to other than the person listening to them (for the doubters, this is easy to do) and putting feet on the furniture. Violators who do not comply with the codes of conduct can be banned for periods of time. The officers, acting as agents for the library, are permitted to enforce this under Ohio's Criminal Trespassing law. Yes, I know some liberals may be butt-hurt about this, but these are the facts and the law, Clearly the young lady in question was struggling with the officer and they both tripped and fell, which caused the injury to her jaw. The officer was severely punished for this issue, 40 hours of suspension cost him over $1200.00, and his inability to work at the library will cost him much more. He will receive additional training i this area. He has been punished, as the city will be in the resultant lawsuit.
Hopefully she learned a lesson, too. Unfortunately that lesson learned is argue and struggle with the po,ice and you might get PAID to be a moron.

If I have to explain to you what the NAP is, you should research it yourself and then think about this story through the lens of the NAP
OK, maybe I'm dense, by why does a *library*, of all places, require a cop to be around? When I was growing up, we didn't have cops in Walmart, in the schools, in libraries, etc. The world is not more unsafe than it was 20 years ago, so I fail to see what the desperate need is.
Given the proclivity of police departments to hire thugs, this is a disastrous idea.
