It's done pursuant to the section 207 of the Immigration and Nationality Act (8 U.S.C. ? 1157): https://obamawhitehouse.archives.gov/ the-press-office/2016/09/28/ presidential-determination-refugee-admissions -fiscal-year-2017 (remove the spaces to make the link work).

Under that provision, plus the Refugee Act of 1980, annual refugee admissions are nominally capped at 50,000, but the cap can be exceed if the President requests it and Congress approves funding. I haven't read the briefing in the court case, but from what I can find on-line, the 2017 figure of 110,000 was already requested by the Obama administration and approved by Congress before Trump took office. I suspect that the Maryland argument is that Trump therefore can't reduce the number this year, only starting in 2018.

Five judges on the U.S. Court of Appeals for the 9th Circuit implicitly took President Trump to task for his disparaging comments on judges and the judiciary.

The response, the strongest-to-date from sitting judges, came in a dissenting opinion Wednesday in which the five actually agreed with Trump on the legal issues surrounding his executive order on travel to the United States.

The opinion decried "the personal attacks" by parties to the case on judges who blocked the president's first executive order, including U.S. District Court Judge James L. Robart in Seattle and the three appellate judges who upheld Robart.

Judge Jay Bybee, joined by four members of the court, did not mention Trump by name.

Radio host Savage says he was attacked outside Tiburon restaurant

Savage had just finished dining at Servino Ristorante on Main Street in Tiburon when a man, whom he did not know, approached him in the parking lot around 8 p.m. Tuesday, said Savage's attorney, Daniel Horowitz.

The man, believed to be about 50 years old and over 6 feet tall, began yelling at Savage, calling him "weenie" and "Weiner," an apparent reference to Savage's legal last name, Weiner, Horowitz said.

Savage, holding onto his toy poodle, Teddy, and a to-go bag, told the man to "get lost," Horowitz said.

The man then pushed Savage to the ground, and when a bystander tried to intervene, the man punched him in the face, Horowitz said.
