Schedule 5 allows an awful lot of freedom. It just says the product has to be dispensed by a pharmacist to an adult for (what the pharmacist believes to be) a medical purpose, and that the recipient sign for it and not exceed some monthly limit if one is established. Like the way it is now with ephedrine & pseudoephedrine, by statutes that were written to parallel (but not be part of) schedule 5. That's less restrictive in at least some ways than state medical or even recreational marijuana laws. Given the current state of affairs, nobody's going to de-license a pharmacist for dispensing marijuana for recreational purposes, because everybody will understand that's what the law is about in everything but name.

And actually the att'y gen'l could deschedule marijuana just by ignoring treaty provisions, or interpreting them as nonapplicable.

Not only that, but even in recognition of the treaties, the att'y gen'l could exempt certain licensed preps (or varieties) of marijuana from the schedules by declaring them to not have enough potential for abuse to merit continued controls, even as marijuana generically is still controlled.
