Hillary Clinton's Parade of Disappearing Blackberries Is Your Holiday Weekend News Dump
Here's why calling Donald Trump 'reckless' doesn't pack that much of a punch.


Today, right before Labor Day weekend, the FBI dumped some heavily redacted summary files of its interview and investigation of the private email and communication systems set up by Hillary Clinton when she was secretary of state.
Hey, at least they released the information early enough so that journalists can search through it before dumping their findings onto a populace that is currently stuck in traffic.
Here's a very quick summary from the Washington Post:
The documents, which total 58 pages, do not seem to provide any major revelations about Clinton's actions — though they paint her and her staff as either unaware of or unconcerned with State Department policies on email use. The materials also show that the FBI was unable to track down all of Clinton's devices, including phones, it sought, and that made it impossible for agents to definitively answer every question they had, including whether Clinton's emails were hacked.
"The FBI's investigation and forensic analysis did not find evidence confirming that Clinton's e-mail accounts or mobile devices were compromised by cyber means," the author of the report wrote. "However, investigative limitations, including the FBI's inability to obtain all mobile devices and various computer components associated with Clinton's personal e-mail systems, prevented the FBI from conclusively determining whether the classified information transmitted and stored on Clinton's personal server systems was compromised via cyber intrusion or other means."
When they say "all her devices," they're talking about 13 different mobile devices and 5 tablets, most of which were never found or turned over to the FBI for inspection. That information has been raising a lot of eyebrows, given how Clinton's defense of her secretive and private email and communication methods was because she wanted to handle it all from one device for ease. Maybe she meant only one device at a time? (Update: Also, a laptop used to archive Clinton's emails is missing.)
The other big eyebrow-raiser is that it appears, at least based on what the FBI was told, that Clinton had very little grasp of what classified markings on documents even were or what they meant. She did not know that a "C" marking meant that she was dealing with "confidential" information and told investigators she speculated "it referenced paragraphs marked in alphabetical order."
Clinton sent a memo warning staff not to conduct Department of State emails from personal accounts but then later told the FBI she didn't recall sending that memo. And the State Department sent out warnings frequently to staff about the security dangers of not using mobile devices not "configured to State security guidelines."
Oh, and the FBI has recovered more than 17,000 emails that she didn't turn over to the FBI, like she says she did. They're a mix of both work-related and personal emails.
Chris Cillizza over at the Washington Post has a great look through the components of the investigation that hadn't really been made clear already from FBI Director James Comey's previous public statement. A deep look paints a picture of a secretary who was at least completely disengaged in appropriate security protocols, even though she herself was at one point concerned she had been hacked.
At its worst, we're looking at somebody who is deliberately playing dumb about the handling of classified materials in order to avoid accountability, and that person is now asking to us to vote for her as president. Even without proper labeling, somebody with the duties of secretary of state should know what sort of information they're dealing with. Comey said exactly that in July. Remember, part of Clinton's campaign is essentially calling Donald Trump dangerously uninformed and reckless.

Which is exactly why we know she is the least qualified candidate in history. It has really gotten that easy, generally, namely that if the Obama and his cheerleaders say one thing, then the opposite it highly likely to be true. In some cases, the "thing" they are talking about doesn't even exist.
What's more believable, that a woman who had been a Senator and received classified briefings for 8 years, followed by another 4 years as Secretary of State, had no idea that a "C" portion marking meant "Confidential," or that she knew but didn't give a shit about information security measures?

So far I haven't seen any outlets bring it up. But, at one point in the document dump it says. "In Fall 2008, Clinton's longtime aide, Huma Abedin, proposed hiring former Clinton campaign staffer Bryan Pagliano to the system." Then on page 10 it says that none of her aids, including Abedin was aware of the system until it became public knowledge. Now, I'm no FBI agent. But, that seems deceptive to me.
The notion that she or her aides didn't lie to the FBI within this testimony and it couldn't be proven is absurd. You could add to your paragraph that Huma is on record in those damn emails asking Hillary if maybe they shouldn't switch over to a .gov email because of issues they were having. To which Hillary basically replied nah, I don't want to be subject to FOI requests.
Yea, I know. But, I haven't seen them reference that in the document dump yet(I've only read about half). I'm just floored that the actually included conflicting statements in the summation they released.
Not to mention Huma and Hillary denying that she brought her Blackberrys and iPads into her restricted SCIFs, but other staffers said it was routine. She actually stored them in the drawer at her desk. Putin had a 24/7 microphone on her.

2. Even if there were a requirement to establish intent, it would be well and thoroughly established by now. People have been sent to jail for life on crimes with stringent mens rea standards with less evidence of intent.
Comey's specific argument was that the parts of the Espionage Act that are strict liability and call for punishment of negligent handling of classified material have never been used except for cases involving actual espionage. That's the 'nuanced' line of bullshit he adopted. Only issue is, it's completely false.
When Comey was #2 at the DOJ under Bush, they prosecuted an NSA analyst under 18 U.S.C. ? 793(e) only despite the FBI publicly stating they had no evidence of ill intent or espionage.

Not only is it false that they've never used it before, they would absolutely use it again in a heartbeat for anyone other than Clinton.
It should also be added that the Obama administration has routinely lowered the bar for Espionage Act prosecutions. They have used it more than all other administrations combined since its passage. They have defined Espionage as leaking to the media. The argument that Comey made was prosecuting Hillary would be unfair regardless of whether it would be constitutional/right by the letter of the law. Beyond this being flat-out false - others have been charged and prosecuted for far less under these statutes without intent or malice, but it's a contradiction of what Comey's FBI has done the last 8 years going after leakers for Obama.

And again, the focus on what is or wasn't classified continues to skirt the point that she explicitly wanted a private server so she could conduct her foundation business and State business together and keep them out of the public eye. I, for one, find it comical that the DOJ kept this investigation as narrow as possible. A field agent investigating a report of cyber harassment through email led to the take down of the head of the CIA. But here the FBI was basically told that you can only investigate and charge her for violating the Espionage Act. Other laws related to the handling and maintaining of public records were just ignored completely. I mean, so was the Espionage Act for that matter, but since when does the FBI refuse to look into or consider obvious other laws broken right before their eyes?

I'm of low-to-middling importance in my company and I get a steady stream of emails 24x7, and I have no assistant. I literally can't check them all. HRC is going to have a battery of assistants checking, sorting, flagging emails for Hillary to read and /or send out.
Because it was a personal server, we don't have any record of who had access to Hillary's email. It has nothing to do with hackers.

Unfortunately, unless the FBI knows something we don't, there is no evidence her server was compromised. This doesn't mean I don't believe it wasn't compromised, but that there is simply no evidence it was.
We've been treated to speculative stories for months, including one Russian hacker (currently in jail) claiming he was all like, totally in there and stuff-- but unfortunately, listening to some bros talk about their conquests isn't very convincing. Give me a stack of emails that can be reasonably vetted as coming from the HRC server-- that haven't already been publicly released and then we'll talk. Otherwise, it's just SportsCenter speculation about the upcoming season.

In organizations that are at all concerned with info security, a missing device sets off klaxons and flashing red lights. You have to report those immediately, as a missing device doesn't just compromise what's actually on it, it (potentially) compromises any system you ever used it to connect to.
Merely losing a device, or even misplacing it for any length of time, is a serious security breach all on its own. Not reporting it compounds the breach.
But, we all know this already headed for the memory hole. I look forward to furrowed-brow chin-stroking articles in a year or two about why nobody noticed during the campaign that Hillary's health and mental condition weren't up to the job. Why were there no red flags, etc.

Did they recover those from her devices, or did they recover those from the folks at State and elsewhere that she corresponded with? It's not clear to me, but I can envision a scenario where, during the course of her tenure at State, she read emails and deleted stuff on a day-to-day basis (particularly stuff she would not want a record of) and then when the investigators came calling, she turned over all the stuff she had 'left' (minus the materials that her lawyers deleted), and then the investigators found the day-to-day deleted emails in the records of other people's emails.
Just curious if anyone knows the source(s) of those 17k emails.

However, there's an explanation that makes far more sense than either of those. That she willfully and repeatedly violated laws governing national security, record keeping, and government transparency. Laws that have been enforced against less politically connected people and that have severe penalties for violating them.
