Cops Arrest, Attack Mom Who Let 11-Year-Old Son Drive Golf Cart
Charged with child abuse


A North Carolina mom who let her 11-year-old son drive a golf cart on a vacation island for about 30 seconds was arrested, wrestled to the ground, handcuffed, and frog-marched onto a ferry to the police station, where she was jailed in leg irons and charged with child abuse.
The mom, Julie Mall, was on vacation with her husband, son, 9-year-old daughter, 22-year-old niece, and their golden retriever, staying at a $1000/night cottage on Bald Head Island. On the evening in question, last July 26, they were riding on a paved path at dusk when the cart was pulled over by an officer.
According to Mark Washburn in The Charlotte Observer, "Mall says there is no question she was wrong." No one is allowed to drive a golf cart without a drivers' license. But what happened next is in dispute.
The police department report says that after Officer James Hunter pulled over the cart, he identified himself to the Malls and "immediately observed them both to be intoxicated"—a fact the Malls dispute. The police did not conduct any intoxication tests.
The report added that Julie Mall was "agitated and loud" and "interfering with street and pedestrian traffic." The officer said that when he ordered Mall to move off the path, she refused. And then:
"In attempting to secure the custody of the female, same dropped to the ground and began screaming and flailing around, refusing to surrender her hands or obey officer commands," Hunter wrote.
"Same was physically assaultive and required me to initiate ground control to secure her custody."
Julie Mall recalls the incident differently. After Officer Hunt pulled them over:
"Immediately he started berating us," she says. "He was saying 'How old is this kid?' 'Are you guys drunk?' 'I could write you up for child abuse.' "
Mall says she had no more than a single glass of wine with dinner hours earlier, and no one was intoxicated.
As the officer's tirade continued, she says, her son burst into tears. She asked her niece to take the children back to the cottage.
Until now, it should be noted, Mall's only encounter with the police was a 2007 traffic ticket:
Mall says after the sobbing children left, she told the officer she was angry that he had upset them unnecessarily. "I said, 'You ought to be ashamed of yourself,' and I stuck my finger in his face."
She says the officer didn't have a citation book with him, so he radioed for someone to bring him one. A second police vehicle arrived, and later a third.
Four or five officers were conferring there when she asked her husband to drive their golf cart back to the cottage to get mosquito repellent, leaving her alone in the dark with the police.
Four or five officers? What if elsewhere on the island some desperado was picking flowers from a public park? The story continues:
Mall says she was standing on the median of the path tapping away on her cell phone when the officer came over and told her she was blocking traffic and she needed to return to her golf cart – which no longer was there.
Mall says she was standing off the roadway at the time and the police vehicles had the road blocked.
"He said, 'You need to go back to your golf cart or I'm going to cuff you,' " she says. "He lunged across at me, twisting my arm behind my back. I'm hysterical. I've never been that scared of anything in my life."
Scott Mall returned and managed to videotape what came next: His hysterical wife sobbing and screaming on the ground, with the officer's knee in her back. She was then driven to the local station house (where a gaggle of officers were watching Naked and Afraid). From there:
Hunter and another officer took her to the ferry, where about 30 passengers were waiting for the next boat.
When it arrived, she says she was led aboard barefoot – she lost her flip-flops in the struggle – for the trip to Southport. Waiting passengers were told they would have to wait for the next boat because a prisoner was being transported.
Like she's Son of Sam.
On the mainland she was driven to the police office in Bolivia, NC. There she was charged with resisting a public officer, intoxicated and disruptive behavior, and misdemeanor child abuse.
When her handcuffs were removed so she could be fingerprinted, her ankles were shackled instead, and she was put into a jail cell. Bond was set at $1,000. Her husband arrived, paid the bond and she was released.
She returned for her trial on Aug. 20, but Officer Hunter did not appear. The trial was rescheduled for Oct. 2, and again Hunter did not appear. "Without a witness, the state dismissed the case," according to the Observer.
If I were that officer, I'd be AWOL, too.
Elsewhere in the article, the reporter noted that "Bald Head Village has about 25 officers in its Public Safety Department. With a year-round population of 168, the municipality has the enviable ratio of one officer for every seven residents."
Just how enviable it is to have one cop for every seven residents is up for debate.

There's a difference between year round residents and peak residents, and the number of officers may be tied to the latter rather than the former. It's not uncommon for beach areas to hire extra officers for the summer months, so your stats may be apples to oranges.
Having said that, her treatment - as described - does seem wrong.

It's isolated by a ferry too. There's literally no riff-raff on the island for these cops to harass. Can you imagine how much pent-up tension they're dealing with? They must have something going on under the radar, like monthly field trips to Wilmington to shoot dogs and beat up the homeless.

What would be nice in these cases where the behavior necessary to constitute a crime is utterly subjective is to require the police to obtain video evidence of the behavior prior to making the arrest.
Instead of body cams maybe they could be issued club-cams? LEO's would call them their Rodney K Club-Cams.
She was also "flailing". That's a word that comes up alot in police reports; suspects are always "flailing " their arms.

Marge gets arrested after Bart goes to the playground on his own, and some nosy mom at the park calls the cops after finding out that he's there unsupervised.
All that was missing was a guest appearance by Lenore Skenazy!
One good bit was Marge telling the judge something many of us have commented -- how when she was young, all the kids played unsupervised all day, and her mother would just tell her to be home before dark. Then they show Marge's elderly mother being handcuffed for allowing this forty years ago.

Hassling tourists over BS like this is not a smart thing if you have a local economy based on tourism. They're going to find that out real quickly when people start cancelling their reservations, not making them, etc.
I doubt it. People assume that it was a bad-apple cop, and/or that they won't do anything wrong so they don't have anything to worry about. They don't understand that more cops are bad-apples than not, and you don't have to be doing anything wrong to get their attention.
Maybe, but I disagree. I love Bald Head Island and been there several times in the last decade. I honestly didn't know they had a police force at all - why would they need one, was the first question that came to mind.
Then the comments from the city on this matter have all been, "he followed procedure... blah blah blah" that tells me that its a systemic problem (even before I google searched Bald Head Island Police and discovered they have regular controversies). There are plenty of other islands to go with that don't encourage this sort of behavior. Jekyll Island is a great alternative. I've been there more often than Bald Head Island, and the only police I've ever seen was a trooper who lived on the island and has since moved away.
My two thoughts:
1). They will lose money off their jack assery in an Google friendly world.
2). After reading comments about Officer Nero being wrongly found innocent because police only abuse their power with minorities ... Why did they show a picture of a white chick?
I'm considering reserving there then cancelling on the last day to do so penalty free and telling them the incident is the reason.
But I agree with you about the majority. People never believe it until it happens to them. And even then some people manage to go full cognitive dissonance and choose to believe that they really deserved it.
Here in New Hampshire, officer Steven Coco committed hit and run, and was initially charged with a misdemeanor. One of the mothers of a boy that Coco ran over said this "gives the appearance" of a double standard. Reality was smacking her in the face and she still couldn't flat out say it IS a double standard.
The euphemisms of state power have penetrated her very soul. Me personally, I wouldn't be able to be quoted by the newspaper in the first place because after redacting all the expletives, death threats and incitements to revolt there'd be nothing left to print.
These cops are entrepreneurs and business owners? Sorry, but they get paid with taxes. Those taxes and the formal as well as informal immunities they enjoy insulate them from the occasional mood swings of a peasantry that by and large never seems to learn their lessons about government power.

In all truthfulness, when I see an article like this, I am almost always skeptical of the police. Unfortunately, this is not one of those instances. I saw the $1,000/night cottage, and my thoughts instantly went to "affluent teen" and Johnny Manziel. No one should be vilified based on how much money they have (whether earned or inherited), but it is becoming much more common, IMHO, that people of wealth truly feel that they are above the law.

I spend a week each summer on Bald Head Island (such is the price for familial bliss). It's a wealthy place where golf carts are the only motorized method of transportation allowed. I think Bill Cowher has a place on the island.
Predictably, I'm sure the cops are bored as hell. And, per Steve Sturm's comment, there are quite a few more than 168 people on the island during peak tourist season. There's a lot of stupid in this article, including this:

Those ferries are huge, and have both a covered, below-deck area and an above-deck area, covered and uncovered. That's just inconvenience for the sake of stupidity. I'm sure rules were followed, though.

This is, perhaps, the most annoying part to me. What would have happened to her if she had just not appeared on these dates? The process is the punishment of course.
This is one thing that really needs to be addressed in any criminal justice reform package. A trial date should be set in stone. If the court doesn't have resources to meet that date then the case should be dismissed and the accused should be informed of dismissal at least a week in advance. If the officer doesn't show up on court date then the officer should be found in contempt and should get his own court date to worry about.

I'll just add that nothing gives away the cozy relationship between judges and cops than the fact that cops routinely skip court and judge's rarely seem to get upset over it.

Even more odd is that you don't need a driver license to ride a moped in NC - which is gas powered, goes faster, has two wheels, and more dangerous than a golf cart in nearly every way.
The NC golf cart law is probably similar to the SC law - you only have to have a DL to drive it on the roadway. On private property you don't have to have a DL to drive a car. A lot of BHI roads are mostly dirt paths that probably don't qualify as roadways, so he may have been off on his b.s. legal pretense too.

It's stories like these that demonstrate that our beloved country is running quickly toward a nanny police state and everyone is guilty until proven innocent.

It's a toxic combination of zero tolerance for non-compliance and zero tolerance for anything that might possibly be perceived as something that could jeopardize officer safety. Put those two together and it's the perfect mix for authoritarian assholes to initiate violence for any or no reason. All they have to do is say that the subject was non-compliant and/or that they felt that their safety was in peril, and anything goes.

1) The only part of the officer's story I believe is that she was a little inebriated. But so the fuck what? Which leads me to...
2) An 11 year old can drive a golf cart just fine. She did the right thing by having him drive her, if she thought she couldn't. Again, so the fuck what?
3) I agree with "some guy" above. They should have one shot at a trial, and if the cop doesn't show up for something he initiated he should at the very least be fined.
4) I get the feeling, like with most of these things, the cop was just bored. I have a cop friend (I know, I know, that's a sin around here) who tells me all the time how utterly boring his job is, and he lives in a major city with plenty of real crimes. Places like in this story ought to have a sheriff and a deputy and that's it. They don't need a whole squad of people.
The boredom is a real thing. I've got cop friends, and they mostly just tool around looking for stuff to poke their noses into. Shit, half the time they just give drunks rides home, pull people over (typically for good reasons, but sometimes just for driving "weird" or dickish), and hang out in the "what kind of doughnuts did you get" formation. That's the one where two squad cars are stopped with the driver sides facing each other.

The lack of anything other than anecdotal evidence allows them to assert the perps were drunk. The subjects also appeared to have stolen items on their person, however police did not attempt to match belongings to any reported robberies.

OK, maybe by the strict letter of the law, which apparently requires a DL to operate a golf cart in NC (which I've never heard of anywhere else), but an 11 year old should absolutely be able to handle driving a golf cart. When I was 11 I drove my grandfathers Ford F150 pickup truck and a lot of different farm machinery, and dirt bikes, all of which were slightly more dangerous than a golf cart. No one cared, including the cops.
That jumped out at me as well, but it occurred to me that perhaps it is the policy of the owners of the carts.

One of my first jobs (12) was working at a golf club, and part of the gig ("bag-room boy") was sweeping the area for carts at the end of the day and driving them all back to the garage and setting them up to get charged overnight.
Usually after the rounds were done, we'd stealborrow one and go toodling all over the neighborhood. We'd drive it down to the corner store and back. we'd try and do donuts on oil-spots in the parking lots. No one suggested there was a problem until *after* we wrecked one.

How many of those accidents occurred with a licensed driver vs an unlicensed one? If licensed drivers don't wreck their carts at a lower rate than unlicensed, what does it prove to have a license? (other than one has passed a test to drive a CAR)

I'll bet that it is indeed a thing that is defined in statute to give the police reasonable suspicion to attempt to ruin someone's day. Not only that, but it is likely defined with specific phrases that end up in police reports routinely simply because the words appear in statute, though their relationship to reality is likely questionable. For example every single DUI police report will include the words "eyes were red and bloody," "slurred speech" and the like, regardless of if the words describe the person in question. Because those words are in statute and help to ensure a conviction.
As recently as a couple of years ago when I'd re-post this kind of stuff on my (since defunct) FB page people thought I was a conspiracy theorist.
Since then it has become somewhat more mainstream to see MS stories about cops pounding the shit out of people. Not unusual to see such stories in the Globe and Mail.

But seriously, we have really gotten so horrible so quickly in this country on stupid shit like this. In the early 90's I drove around range carts for work on a nearby golf course from age 13 to 15. An 11 year old should not be a big issue driving one.

This is all part of NC's attempt to abuse more whites by the police. I would think the golf cart was being operated on private property,not public roadways,and thus no need for a drivers license to operate it. But the mom was wrong to resist arrest,and to point her finger in the officer's face. That's just asking for trouble.
the officer was probably worried that if he took time off to go to court, the island would not have enough police protection.
I grew up in a suburban borough of 2800 with one full-time officer (the chief) and four or five part-timers.
My last traffic citation, maybe five years ago, was for an expired inspection sticker that they discovered at a sobriety check point (where they immediately discovered I was sober). I scheduled a hearing with the district magistrate to fight it, as I believed a check point was not an excuse for a fishing expedition. The first time the officer failed to show, it was dismissed.
