D.C. Asks for Stay of Gun Ruling

Federal judge struck down ban on carrying guns outside home.

Lawyers for the District of Columbia have asked a federal judge to stay his ruling that strikes down the city's ban on carrying handguns outside the home.

Attorney General Irvin Nathan filed the request for a stay on Monday. In a ruling made public Saturday, U.S. District Judge Frederick J. Scullin concluded that the Second Amendment gives people the right to carry a handgun outside the home for self-defense.

Following the ruling, D.C. Police Chief Cathy Lanier instructed officers not to arrest District residents carrying registered firearms or visitors who have permission to carry guns in their home states.

You forgot to mention that Alan Gura agreed to an immediate stay of 90 days to give the District time to write a new law. Given that Alan Gura and his client the SAF oppose Open Carry one can expect a repeat of the Illinois fiasco. After the decisions, no permit was required to carry a handgun in public regardless of whether or not it was carried openly or concealed. The NRA and the SAF lobbied to ban Open Carry and lobbied to require that only the concealed carry of a handgun would be allowed and only then with a highly restrictive government issued permission slip.
