President Obama signed the bipartisan spending deal negotiated in Congress earlier this month while on his vacation in Hawaii. Obama also signed the latest NDAA, complaining about the restrictions on Guantanamo detainees it included and that Congress isn't doing more about the prison.

  • The 9th Circuit Court ruled that it was unconstitutional for Los Angeles authorities to demand hotels and motels release guest information to them without a warrant.
  • Glenn Greenwald defended his defense of Edward Snowden while on MSNBC yesterday by pointing out that that network shills for Barack Obama 24 hours a day.
  • The United Nation wants the US and Yemen to confirm their roles in two drone strikes this month that both hit wedding processions in Yemen. The UN also wants to know what targeting standards are used and whether there are any plans to compensate victims' families.
  • The US sent 75 Hellfire missiles to Iraq earlier this month and will send more as that country battles Al-Qaeda insurgents in the desert. The Iraqi government has also asked for drones, which the US plans on sending it.
  • John Kerry is "concerned" about Egypt's crack down on the Muslim Brotherhood, which it recently listed as a terrorist organization.
  • The federal government is reportedly working on new regulations for face and hand transplants.

      Sorry, I am already married.

      1. Ted S.   11 years ago

It shouldn't be illegal for you to marry mutliple people, regardless of gender.

        1. DJF   11 years ago

It isn't, you just can't get a government issued marrage licence for that.

          1. sarcasmic   11 years ago

How can a marriage (or anything for that matter) exist without government recognition?

            1. UnCivilServant   11 years ago

The same way everything else does sarc, by just being.

              1. sarcasmic   11 years ago

Without force of government behind them, empty assertions are empty.

          2. Fist of Etiquette   11 years ago

This one I think actually is illegal in places.

            1. robc   11 years ago

              Yup.

              People get jailed for bigamy.

          3. Austrian Anarchy   11 years ago

Actually you can get those licenses, but just one spouse at a time and the government does not care (as long as previous licensed marriages went through their de-marriage system). Unless you are a traditional Mormon, then if you get married, divorced, and re-married the polygamy police get all in your business, even if you keep your ex's in Texas and your house is in Texas.

They have, uh, friends who stay there from time to time and their, uh, friend's wives don't need to find out about it.

They needed to ask a judge if it was okay to violate the fourth amendment?

It was worth a shot. The NSA is allowed to ignore it.

  3. Fist of Etiquette   11 years ago

The federal government is reportedly working on new regulations for face and hand transplants.

Register your new face! Because otherwise the NSA would have to completely reconfigure its facial recognition software.

    1. Francisco d Anconia   11 years ago

If you like your old face, you can keep it.

      1. seguin   11 years ago

I'm surprised they're going to the trouble of making facial recognition software instead of just forcing people to get barcodes stamped on their foreheads.

🙂 I can't be asked to do grossly out of title work - like dealing with the public. After all, you can't have the IT guy being paid Grade 23 rates for Grade 6 work. (And that rule predated the unions, believe it or not)

          1. Dweebston   11 years ago

IT is bad enough dealing with coworkers, let alone the milling milieu massing menacingly outdoors.

CNN Poll: GOP has edge in early midterm indicator

Democrats have lost their advantage and Republicans now have a slight edge in the battle for control of Congress, according to a new national poll.

A CNN/ORC International survey released Thursday also indicates that President Barack Obama may be dragging down Democratic congressional candidates, and that the 2014 midterm elections are shaping up to be a low-turnout event, with only three in 10 registered voters extremely or very enthusiastic about voting next year.

never underestimate the Repubs' ability to snatch defeat when victory is very possible. And talking about the social shit is the fastest route to that.

              Or bizarre comments about rape.

              1. Brett L   11 years ago

Seriously, get everyone in a room after the primaries and practice.

If you hear the word "rape" in a question, start off by saying, "Rape is horrible and there is never any justification for a woman to undergo such an experience." Then shut up.

Oh, hai, NRSC, I am available to consult for a mere $200/hr for your candidates.

                1. Francisco d Anconia   11 years ago

But don't women's bodies reject pregnancies from rape?

behold! The power of the penis.

It takes 15 Oregon cops and a Taser to subdue alleged masturbating meth-head

The man, later identified as 37-year-old Andrew Frey, had moved into the bathroom by the time Marion County deputy arrived on scene, but he was still masturbating.

When the deputy tried to arrest him, Frey resisted and he was zapped with a Taser multiple times. The two began fighting and a dispatcher, who had been unable to reach the deputy on his police radio, called for backup.

Approximately 15 more police officers responded to the call and Frey was eventually taken into custody.

    5. Ted S.   11 years ago

They need to move "alleged" to between "masturbating" and "meth-head". They knew he was masturbating; they didn't know whether he was on any drugs. Of course, they can always make up some drug for him to have been "on".

      1. Brett L   11 years ago

Well, just because he was stroking his erect penis, doesn't mean he was masturbating. I'm not sure that's been established beyond doubt, you know?

The United Nation wants the US and Yemen to confirm their roles in two drone strikes this month that both hit wedding processions in Yemen. The UN also wants to know what targeting standards are used and whether there are any plans to compensate victims' families.

Obama will send over a drone with that info right away. Just gather in one place and sit still.

    1. Swiss Servator, Pikes Forward!   11 years ago

I don't know what the fuss is all about - I mean, wasn't it just an Amazon prototype delivery drone bringing wedding presents and it happened to crash?

      1. Doctor Whom   11 years ago

John Fluevog is a Canadian shoe designer. His shoes are noted for their progressive, art deco inspired styles. His shoes often include messages?for instance, "Resists alkali, water, acid, fatigue and Satan" -- engraved into the soles.

    2. Ted S.   11 years ago

      "Progressive, art-deco inspired styles"?

How is going back to the 1930s progressive? And what the hell is a progressive shoe style anyway?

And why do women obsess about shoes?

      1. Kaptious Kristen   11 years ago

They mention bacon right there on their home page! Duh!

        1. Ted S.   11 years ago

    Nice defense, Kristen.

That defense admits up front that there are at least some people at MSNBC who do, in fact, shill for Obama 24 hours a day.

    1. Andrew S.   11 years ago

It's true that MSNBC does not shill for Obama 24/7.

  17. Lord Humungus   11 years ago

I know we can't get enough of this story:

    A&E's Duck Dynasty Dilemma
The network shouldn't expect the Robertson clan to back down.

When big, powerful TV executives ask a star to apologize for what they deem inappropriate comments or behavior, the star simply complies. A team of publicists is assembled, the star does the obligatory apology tour for the press and promises never to do or say what he did or said again. Ever.

But the TV gods never met a man like Phil Robertson. Or his family. When they decided to place the patriarch of the Duck Dynasty clan on a non-suspension suspension for his comments to a GQ magazine writer about homosexuality, the executives at A&E created a problem.

Because this family believes in a bigger God. The same God that roughly 70 percent of Americans believe in. The Robertsons take their faith seriously, and one of the more important elements of that faith involves putting no god before theirs. Not even the suits at the big network.

    1. wareagle   11 years ago

this is what happens when you don't need the money or care much for the fame, etc. Part of me thinks Phil has had enough and wants to return to his old life. The man is not stupid; no way he did not know his comments might stir the pot.

      1. MP   11 years ago

Problem is, NR is trying to make an argument based on Faith, but ultimately you can't separate their Faith from their Fame/Wealth. Only if they were poor as dirt and had A&E as their only source of income could you legitimately argue a Faith based argument.

Otherwise, one suspects they're saying FU because they are already wealthy and famous and they don't really give a shit about being PC.

Phil turned down the NFL because it interfered with Duck hunting season.

He wasnt rich when he made that decision.

I think he has a back history that suggests that having money isnt what allows him to do this.

          1. Smilin' Joe Fission   11 years ago

            I agree.

          2. MP   11 years ago

I don't know how old he is, nor do I care enough to look, but back in the day, the NFL didn't pay shit.

Anyhow, that also shows how you can't simply default to a Faith motivation.

            1. Kaptious Kristen   11 years ago

He played college ball with Terry Bradshaw. There was a decent amount of money to be made as a QB in the NFL back then.

              1. robc   11 years ago

To be clear, Terry was his backup.

                  No shit?

I will admit to not giving one fuck about this story, but that tidbit makes it mildly interesting.

Robertson was recruited by bigger schools but went to La Tech to stay close to home.

Bradshaw was a year younger and his backup. Robertson quit football (but not school) after his junior year because practice interfered with duck hunting.

Even after taking his senior year off, the Redskins contacted him about playing for them, they wanted to sign him anyway.

Bradshaw, meanwhile, got to play 2 seasons instead of 1 and became Terry Bradshaw.

IIRC, that is close to accurate.

There was a decent amount of money to be made as a QB in the NFL back then.

Average salary was about $200K inflation-adjusted. Pretty good even back then.

I think there needs to be a hearty balance between the individual and the collective. Either extreme is hell.

I just want to know what is "hell" about a government being constrained to its most important and ONLY legitimate function, protecting the rights of the individual.

      1. robc   11 years ago

To me, that is the "balance" she is talking about.

I mean, its not extreme like anarchy would be.

Guys, just when you thought the fake interpreter was going to be the craziest thing to come out of Nelson Mandela's funeral, I give you this tasty bit of conspiracy theory.

A very interesting rumor from a reputable source, is that the Mandela Funeral was used as a cover-story to assemble the world's Top Leaders to pay homage to an ancient Nephilim alien ET leader called Marduk and who has allegedly returned after hundreds of years absence to be crowned as the new King of Africa, perhaps later to be elevated to "Ruler of The NWO" or the "New Caesar of the Ages"as the final Third Force Plan for the Globalist NWO is revealed and actuated in full.

If true, the Mandela funeral has perhaps provided great cover to assemble the world's top leaders to pay homage to Marduk as the new "Crowned King of Africa". And as the Mandela Funeral became a major world event covered in detail on every major news network around the world, there were several strange anomalies during or surrounding the funeral that have became apparent and which can be interpreted in ways which support this rumor.

Consumers beware: Not all health plans cover doc visits before deductible is met

"This could be the next shoe to drop, as people don't realize that if they're buying a bronze plan, they may have to pay $5,000 out of pocket before it contributes a penny," said Carl McDonald, senior analyst with Citi Investment Research, speaking at a Washington, D.C., conference last month.

Experts worry that some enrollees will be discouraged from seeing doctors if they have to pay the full charge, rather than simply a copayment.

You can go without your morning Starbucks when money's tight, but not your healthcare. Ergo, healthcare is an extra-market good.

Never mind that Starbucks is a highly successful international franchise, a boutique retailer with an easily substitutable product line, and in any event the paradigm of competitive efficiency that should serve as a model for healthcare delivery.

      1. UnCivilServant   11 years ago

PS, who does your cover art?

        1. Lord Humungus   11 years ago

I do my own cover art - pay for the image on Dreamstime and then add the title using an online photo editor.

I understand your short vs. long work, but - based on what I see out there - there are plenty of authors selling 15-30K long works for $1.99 to $3.99. Or even 3k-5K works for 99c. As a reader, I think those are extremely bad deals. I tend to price everything at 99c or free.

          1. UnCivilServant   11 years ago

Darn, I'm trying to find a cover artist, because I can't find applicable existing art, and my own talents in the visual arena are - lacking.

                  1. UnCivilServant   11 years ago

I haven't worked that out yet, I can probably swing triple digit range, or low four digits if the quality of work justifies it (and depending on what rights the artist wants to keep versus is willing to part with as a work for sale agreement)

What sort of actual artistic expectations do you have? i.e. Do you expect electronic brush and paint illustrations? I've had a regular designer put together a hot hardback book book cover in the $150 range including stock photography license costs that cover print reproductions.

It really depends what your expectations are.

                    3. Pompey   11 years ago

I would add that the assumption is if you commission the job The IP becomes yours. A simple contact with 2 lines can easily secure the artist's surrender of the IP

It appears, shopping a local wine store last weekend, that the clearing price for a bottle of red wine that I consider not special but definitely better than what I think of as table wine is under $10 now. I know this because I bought a bottle for $10 at Whole Foods the week before and this guy was selling it for $6.99. (So I bought a case.)

    1. robc   11 years ago

The weird thing is, I was surprised these plans still exist, I thought high deductible plans were banned by the ACA.

When I was offered one of these as a replacement for my current plan, I was stunned. That is was worse than my current HD plan just made me laugh.

      1. Red Rocks Rockin   11 years ago

I think they defined "high-deductible" as anything $10,000 or above for an individual.

If you look at some of these current HD plans, it's typically about $5-7.5K for an individual, and about $10-12K for a family. Which, unsurprisngly, fucks middle-income families with stay-at-home parents.

        1. NoVAHockey   11 years ago

they changed the name. what used to be a "high deductible" plan are called "Catastrophic" ... and those are restricted to those 30 or younger. "high decutible" in ACA-speak are are plans with a minimum deductible of $1250 per year for individual coverage and $2500 for family coverage

that doesn't mean you won't have high deductibles for an HMO or whatever. but that's a different classification.

and yes. it's a cluster fuck.

          1. Juice   11 years ago

So basically ALL silver plans and bronze plans are "high deductible."

Beneficent government Medicaid expansion puts more people at risk of the government seizing their estate when they die

    1. Count Negroni   11 years ago

If you're 55 or over, Medicaid can come back after you're dead and bill your estate for ordinary health-care expenses.

Plot point for an upcoming dystopian novel? Team of Medicaid actuaries goes out and starts killing people so their estates can be billed to keep Medicaid/the state solvent?

      1. Jordan   11 years ago

Plot point for an upcoming dystopian novel? Team of Medicaid actuaries goes out and starts killing people so their estates can be billed to keep Medicaid/the state solvent?

Henry VIII dissolved the estates of the Catholic parishes to acquire funding for his extravagent spending and wars. It's not out of the realm of possiblity that a President would set things up so that they could use Medicaid as a lever to absorb and liquidate private assets, even if they're relatively low in value.

    2. Fluffy   11 years ago

I also believe that the next step here will be to allow the state to pursue heirs' personal assets when the amount owed exceeds the value of the estate.

Once that happens, serfdom will have returned. Which is the goal here.

      Don't believe me?

      Student loans - nondischargeable
      Tax debt - nondischargeable
      Child support - nondischargeable
Medical debt - about to be nondischargeable

New ObamaCare fees coming in 2014

Most insurers aren't advertising the ObamaCare taxes that are added on to premiums, opting instead to discretely pass them on to customers while quietly lobbying lawmakers for a break.

But one insurance company, Blue Cross Blue Shield of Alabama, laid bare the taxes on its bills with a separate line item for "Affordable Care Act Fees and Taxes."

The new taxes on one customer's bill added up to $23.14 a month

My "favorite" is the 3.5 percent user fee to sell medical plans on the HealthCare.gov Web site. Bastards.

    1. PM   11 years ago

3.5 percent user fee to sell medical plans on the HealthCare.gov Web site.

    3. Agammamon   11 years ago

      Oh! Oh, never mind.

  35. The Late P Brooks   11 years ago

The way Prins saw it, that meant health insurance via Medicaid is hardly "free" for Washington residents 55 or older. It's a loan, one whose payback requirements aren't well advertised. And it penalizes people who, despite having a low income, have managed to keep a home or some savings they hope to pass to heirs, Prins said.

With an estimated 223,000 adults seeking health insurance headed toward Washington's expanded Medicaid program over the next three years, the state's estate-recovery rules, which allow collection of nearly all medical expenses, have come under fire.

Call me heartless bastard, if you wish, but why should anybody expect to shield their assets from being used to satisfy medical expenses?

I have heard it repeatedly: "OMG, it's so horrible, Mr X had cancer (or old age), and the hospital provided hundreds of thousands of dollars worth of medical treatments, and now they want their money! They think he should sell his house and give them the money! Ohh, what a cruel world!"

Sorry. If you want the kids to end up with the house, don't rack up a million dollar hospital bill on your way out the gate.

    1. UnCivilServant   11 years ago

Or sell the house to the kids to pay the medical bill.

No, the way to avoid govt taking your stuff when you die is to set up a revocable trust. This is my daughter's area of law.

Ironically, my daughter is a prog whose career is now involved with avoiding the long arm of the tax collector.

You must dissonate your cognate, my son.

    2. Fluffy   11 years ago

That's all obviously true, but if I was walking around telling people I was giving them free health care, but buried in the fine print was language allowing me to seize their estate when they died, they'd lock me away.

The disclaimers on this aspect of the Medicaid expansion should be AT LEAST as prominent as those required to be made by reverse mortgage salespeople.

      1. MP   11 years ago

Well, this isn't new to the ACA. It's always been part of Medicaid. It's just that the ACA is sweeping more people under the Medicaid umbrella.

But yes, there's some "fine print" involved with Medicaid that should be a bit more prominent on the OCare website. I suspect all the website says is FREE SHIT HERE.

        1. Fluffy   11 years ago

Right, but the ACA changed the target population and as a result the covered services.

Before, in general you didn't end up on Medicaid until you were getting nursing home care and had exhausted all other assets (and generally you were over 65 at that point).

Now, the relaxed qualification rules for Medicaid, combined with the deliberate destruction of the individual insurance market, can mean that you end up on Medicaid in your 50's after your existing private plan is cancelled. So that moves the whole Medicaid estate recovery problem into people's working lives, instead of being something that applies to end-of-life care for the very elderly only.

          1. PM   11 years ago

So that moves the whole Medicaid estate recovery problem into people's working lives, instead of being something that applies to end-of-life care for the very elderly only.

This. A lot of people who were never intended to be, and never planned to be, Medicaid recipients are going to get pushed into the program only for their heirs to find out they signed away whatever modest estate they may have had when the ACA website merrily told them "Congratulations! You qualify for Medicaid in your state!"

      2. Juice   11 years ago

The disclaimers on this aspect of the Medicaid expansion should be AT LEAST as prominent as those required to be made by reverse mortgage salespeople.

Lizzie Warren is on the case!

    3. Brett L   11 years ago

Can we expand the right to check out with assistance? My father's mother went through that. Burned through maybe $350k in assets to care for her senilie dementia. Was the most frugal woman on earth. If someone would have sat her down on her last truly lucid day and told her, "okay, you're going to spend $350k and leave your kids nothing", she'd have stood in front of the LIRR train.

      1. Brett L   11 years ago

To be clear, her family would rather she had the care than they had the money, but she almost assuredly would not have felt the same.

        1. Clich? Bandit   11 years ago

And it was HER money (not to mention her life). Sometimes these people fucking make me sick. I don't plan on getting an inheretance but I do plan on leaving one...multiple, off shore, numbered accounts as well as the Auagpb bank.

          1. BigT   11 years ago

In OH, at least, one can establish a revocable trust for all your assets. The state can't touch that, so it is left for your heirs. Otherwise you have to spend your assets down to $1500 before you can get the state to pay for nursing home care.

      2. mr simple   11 years ago

Can we expand the right to check out with assistance?

        You mean teh death panelz?

But, yeah, that can be a rough situation for any family. My Parents have both told me to "take them hunting Cheney style" if they ever lose their minds and to have them cremated to cut down on funeral expenses.

    4. MP   11 years ago

don't rack up a million dollar hospital bill on your way out the gate

The real sticky wicket here is how much choice the patient has in the first place about the care they receive. And furthermore, how well informed they are that their care will have strings/costs attached to it.

Again and again, this all comes down to people who are generally unwilling to make hard choices and thus expect everyone else to cover the costs of their indecision.

    5. PM   11 years ago

If you want the kids to end up with the house, don't rack up a million dollar hospital bill on your way out the gate.

Or divvy up your estate beforehand so you die with the $1,000 for which you "sold" your kids the house.

Anyway, your treatment may or may not be in your control at that point ("We're sorry Mr. Brooks, you didn't have a DNR order on file, so that final defibrillator and emergency open-heart surgery that failed to restart your heart is going to cost your heirs your entire estate. Guess you shouldn't have a racked up a million dollar medical bill. Better luck next time.")

Also, the hospital in this particular case gets paid either way - the estate is going to the government to reimburse the payments made by Medicaid to the hospital, not to the hospital in exchange for the medical care. Two points here: I doubt many of the people who are going to get shoved into the expanded Medicaid system under the ACA really planned on becoming participants, and even fewer will probably be aware of the recovery provision until it comes due on their death. Of course you always have the option of going without insurance and letting the IRS slowly confiscate your estate on an annual basis via ACA penalties, but either way you're paying the government for the privilege of dying with medical coverage they forced you to have.

      1. Brett L   11 years ago

There's a five year look-back for Medicaid, so do it now.

        1. PM   11 years ago

I mean the smartest thing would be to have it in a trust, but the people who are going to end up on Medicaid probably don't have a large enough estate to make it worthwhile to hire an estate planner/attorney and make that happen.

Quitclaiming the house to your kids on your 65th birthday and giving them cash on the sly for the tax payments might work though (saying you own it outright).

      2. Cdr Lytton   11 years ago

Or divvy up your estate beforehand so you die with the $1,000 for which you "sold" your kids the house.

        Already ahead of you.

Transfers of Assets for Less Than Fair Market Value: This practice is prohibited for purposes of establishing Medicaid eligibility. Applies when assets are transferred, sold, or gifted for less than they are worth by individuals in long-term care facilities or receiving home and community-based waiver services, by their spouses, or by someone else acting on their behalf.

        1. Clich? Bandit   11 years ago

yup, not to mention medicaid aside the simple value difference, if over the gift tax limit, can be calculated as direct income for the receiveing party.

        2. PM   11 years ago

The 9th Circuit Court ruled that it was unconstitutional for Los Angeles authorities to demand hotels and motels release guest information to them without a warrant.

They needed a ruling for that? The hotel and motel managers are a bunch of pussies. Any of them could've perfectly say to authorities "Fuck You!" and there would have been NOTHING they could do about it because if the LA authorities had taken those records by force without a warrant, it would have rendered those records USELESS in ANY case against ANY defendant.

    1. Agammamon   11 years ago

      Third party doctrine.
