SWAT Team Raids Home of Libertarian Activist Adam Kokesh, Arrests Him on Drug and Gun Charges

A local SWAT team working with the U.S. Park Police raided the Herndon, Va. home of libertarian activist Adam Kokesh shortly before 8 p.m. last night. Kokesh was arrested and "charged with possession of schedule I or II drugs while in possession of a firearm," according to the Washington Post (The drug: psilocybin mushrooms.)

The raid--which a Kokesh roommate says involved a SWAT team knocking in Kokesh's front door then tossing a flashbang into the foyer--likely resulted from a video that shows Kokesh loading a shotgun in Freedom Square in D.C. on July 4th, in violation of D.C. law (I say "likely" because the U.S. Park Police has yet to confirm the video's role in Kokesh's arrest).

Kokesh had originally promised to lead a group of armed gun-owners across the Memorial Bridge from Virginia into D.C. When the Metropolitan Police Department promised to meet him on the D.C. side and arrest anyone violating D.C.'s gun laws, Kokesh backed down. Hence the early morning shotgun-loading video he filmed in Freedom Square. The video, titled, "Open Carry March on DC a Success," concludes with Kokesh saying, "We are the final American Revolution. See you next Independence Day." 

A statement posted on Kokesh's website, Adam Vs The Man, describes the raid thusly:

On the evening of Tuesday, 09JUL13, at approximately 7:45 PM, a combination of US Parks Police (an arm of the DHS) raided Adam Kokesh's residence. Local Herndon police assisted in the armed invasion. The officers used a battering ram to knock in the door after two knocks, and did not announce that they had a warrant. Immediately after breaking down the door, a flash bang grenade was deployed in the foyer.

Numerous police vehicles, including a light armored vehicle and two low-flying helicopters barricaded Adam's street. More than 20 armored SWAT team members surrounded the house, as well as a number of detectives, and plainclothes officers. Assault rifles were aimed on all members of the team as they were handcuffed without being told why they were detained. Masked and armored police in full "Storm Trooper" gear flooded in and ransacked the residence. The team was cordoned in a front room, while Adam was pulled aside for questioning.

Over the course of the next five hours, the police searched every corner of the house with canine units and blueprints to the house obtained prior to the search. All officers refused to speak to the crew while they we being detained. They confiscated cell phones and personal items with force. Throughout the ordeal, the police repeatedly showed a volatile desire to initiate aggressive, forceful conduct with detainees. At one point, Adam politely requested to use the restroom and was kicked by the officer forcing him to sit handcuffed on the floor. After hours of determined attempts, the safe was forced open and all items inside were confiscated. Adam was arrested and his crew were told he was being brought to the Herndon Police department overnight. Well after midnight, police officers cleared the house.

"Kokesh refused to be fingerprinted or arraigned, or to speak with court officials on Wednesday morning," the Post reports. He'll be arraigned tomorrow morning.

        You completely defeat an enemy by denying him all of his objectives. You achieve a total victory by doing so while achieving all of yours.

        The jihadists hate our freedom, hate our way of life, and they want to make us just like them.

        We could have completely defeated them simply by continuing to be ourselves. Instead, we chose to defeat ourselves and give them a total victory.

        So Osama bin Laden got killed? So what? He won and we lost. He was willing to die to win, killing him was not a defeat for him if he accomplished his objectives in the process. He won. We lost.

        And so long as our freedoms get thrown into a garbage pile in the name of making us more like them, he continues to win and we continue to lose.

          That's actually a good idea, if you had any reason to suspect that you might be the target of a no-knock, as Adam certainly should have. Not even fifty, if you had five medium-to-large-sized dogs and the wide-eyed, panicky play-soldiers killed all of them I would think that might get some serious attention.

    It would be great if a longer version of that video would be released showing Kokesh stepping out from in front of a green screen at the end of the it.

    For someone who apparently sees the effectiveness of video, it's disappointing he didn't have surveillance cameras at his place to capture the inevitable state agent roidfest that rained down upon him.

      The disappointing part to me is the Virginia and local cooperation in this shit. The idealistic part of me would hope that a state would protect its citizens from an overreaching federal government - not kick down his door with relish.

      They could have at least low-keyed the whole thing. Arrest him on the street and have uniformed cops do the search. Instead of proving his point so dramatically.

      I'd say low - 20% or so. Their response was so over-the-top, this is obviously personal to them. If they were going to plant, I'd say they'd be much more likely to plant something that would put him away for a lot longer than shrooms. A few bottles of oxycodone or a few teenths of meth, perhaps.

      OTOH, maybe shrooms was all they could find at the station, and they were in a hurry to beat someone's ass.

The active ingredient in shrooms, psilocybin, is not going to show up in a urine drug test. It is likely for that reason the mushrooms were planted. He has no way to prove he wasnt a user.

I don't think that having some marijuana plants in my house should be a crime-- nor should having processed coca leaves, but my living in Washington State not withstanding, if I have ten kilos of marijuana and/or coke in my garage, I'm going to go to jail for a very long time. He forgot that he's working to restore rights that have been taken from us, not prevent them from being taken in the first place. Yeah, you should be able to eat a pound of shrooms while cleaning a bazooka as three hookers use your dick as a snorkel and still be taken seriously when you advocate legitimate political views. But it doesn't work that way, and it never has. It especially doesn't work that way when you're trying to convince non-libertarians that there's nothing threatening about open carry. Previously, he was a veteran who was a firm believer in individual liberty, a political activist who venerated the Constitution. Now he's a 20-something unbalanced drug addict who probably suffers from PTSD. That's the story the media's running with, and that's the one that the people we need to convince are gonna buy.     OT: I posted this on another thread, but this actually seems germane to a post about miscarriages of justice. Justice Department paid to organize marches and rallies against George Zimmerman.

    Separately, in response to a Florida Sunshine Law request to the City of Sanford, Judicial Watch also obtained an audio recording of a "community meeting" held at Second Shiloh Missionary Baptist Church in Sanford on April 19, 2012. The meeting, which led to the ouster of Sanford's Police Chief Bill Lee, was scheduled after a group of college students calling themselves the "Dream Defenders" barricaded the entrance to the police department demanding Lee be fired. According to the Orlando Sentinel, DOJ employees with the CRS had arranged a 40-mile police escort for the students from Daytona Beach to Sanford.

        I'm about to turn 35, and, if I've learned one thing in the past year, it's that I've got better shit to do than argue with morons. As soon as I see someone use a "witty" misspelling or blatant straw man, I wish them the best of luck in their future endeavors and get the check. You can work with differing opinions, or lack of information. You can have productive discourse that results in both people coming away with deeper understandings of the subject, or at least a better idea of what opposing viewpoints are based on. You can't do anything with stupid, and stupid always, ALWAYS wins.

      ...but it seems to me that quietly ignoring the law is the better option.

      Or at least not making a big deal out of rights you do have. The recent outlawing of open carry of firearms in California being an example.

      Some gun owners demonstrated their right to open carry [unloaded] handguns by meeting at restaurants and such wearing their guns. This made the news some others nervous. So, after the Newton shootings that was right out in the open for the state legislature to attack and they outlawed open carry of even unloaded handguns.

      So what did those same gun owners do after that? They said, "We'll show them. We'll just open carry our rifles and shotguns instead". You guessed it. The legislature jumped on that in a minute and outlawed open carry of long guns, too.

      Hard to say if they might not have outlawed it, anyway, due to the Newton and Aurora hysteria, but shining a spotlight on themselves and the fact they were legally able to carry unloaded guns didn't help.

        I will say this about Kokesh. If he really had drugs in his house he is monstrously stupid. Good for him for engaging in civil disobedience. I wish I had the balls to do that. But if you are going to do that, you better be totally clean in every other aspect of your life. If he really did have drugs in his house, he just gave his enemies a way to change the subject and justify his arrest.

        There is a reason why the NAACP picked a nice little old lady secretary to get arrested for refusing to ride in the back of the bus and not a 20 year old prostitute.

          I think it's interesting that psilocybin was found. Hallucinogens. It is probably a show that libertarians 'see' things that the normal population doesn't. While that is a true statement, I think most of us see the fucked up shit even when we are stone cold sober.

            He knew he was going to do this. Why would he not clear all of the drugs out of his house in advance?

            The fact that it was psilocybin makes me think it was actually there. That doesn't seem to be the kind of drug cops would plant. They would plant coke or pot or meth or something more common.

              Unless, of course, that's what they want you to think.

              I'm not willing to discount the possibility of it being a plant just because it wasn't something common. Not necessarily saying it's a plant (I'd put the odds at less than 50/50), but I wouldn't dismiss it just because of what was "found".

      The disconnect between HuffPo's scary lead article (Over militarization of police, which quotes Reason btw) and the comments of people praising the military raid is mind boggling.

      I try to stay away from HuffPo--even went so far as to block them from Google News--but I had to see what they thought about this raid. Bad idea.

    That'll show all these negative-nancys who complain about a tyrannical police-state that their concerns are unfounded. people sitting at home alone should rest easy knowing there are such professional SWAT members in the parks department. With helicopters, no less! also, that people should remember to pee BEFORE they kick in the door. Pee on your own time, criminals!

    I suspect there may have been some Tuttle/Buttle mixup involved here anyway. "Alright Mr Koresh, your days of crazy talk are finally over..." "ITS KOKESH!!"...."ahh, close enough. Hippies with guns. Same diff."

    Those who are victims of government agents, have the right to seek personal consequences against the perpetrators. The moral right, not the legal right. Two different things. Adam Kokesh is perfectly aware, as is anyone who has had their right to Life, Liberty, Property, or the Pursuit of Happiness violated or infringed by government agents, that if someone violates your natural rights, then they forfeit their own. So, if a cop has broken down your door, or a judge has ordered them to do it, then both of those people are fair targets for retribution.

    Karma is a bitch. And the agents of the state should be at least smart enough to understand that it should be preferable to conduct themselves in a non-aggressive fashion, than constantly looking over their shoulder for the inevitable retribution.

    Strictly in a practical sense, his actions were foolish. There are more prudent and effective ways to modify the law than grandstanding.
